HomeMy WebLinkAboutTB-04/10/1979SOUTHOLD TOWN BOARD April 10, 1979 MORNING SESSION Mr. George Michos, P.E., Porject Manager, Greenman-P~dersen, Associates, P.C. appea~ed before the Town Board to discuss the uncompleted work in the Town Hall addition by Minnesota Constru- ction Corp~ Mr. George Penny I~[ of Penny Lu~ber Company also appeared; Penny Lumber is still owed s5393.60 by Minnesota. There are also two other liens against Minnestoa by Freeport Carpet Cleaners, Inc. for $1200. and Ruttura & Sons for $6338.41. Since Minnesota has been paid all but about $8100.00 on the contract, it was decided to declare the contractor in degault and instructed the Town Attorney to notify the bonding company to take the proper steps. This will be done formally at the Town Board meeting.--- The Board also discussed with Mr. Michos the responsibility of Greenman-Pedersen to correct thw water damage done to the Town Hall addition by the break in the sprinkler pipe. Mr. Michos stated he would send a letter to the Town Board outlining all work to be dOne to correct the situation. Chief Carl Cataldo appeared befrore the Town Board. Among other items discussed was conservation measures he has instituted for reducing the amount of gasoline being used by police cars; and the New York Telephone Horizon Communication System he has been studying. Chief Cataldo and Councilman Drum will visit the New York Telephone Office next week the inspect the equipment. A regular meeting of the Southold Town Board was held on Tuesday, April 10, 1979 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Justice Martin Suter Justice Francis T. Doyen Councilman Henry W. Drum Councilman William R. Pell III Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Terry Supervisor Martocchia informed those present that the official ground breaking ceremony took place at 2:00 P.M. this afternoon for the Southold Town Senior Citizen/Youth Center. Within three or four months the building should be completed. On motion Of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the minutes of the March 27, 1979 Southold Town Board meeting be and hereby are approved as suhmitted. Vote of the T~Wn~Board: Ayes: Councilman Pell, Councilman Drum, Justice Doyen, Justice Suter, Supervisor Martocchia. Absent: Councilman Homan. This resolution was declared duly adopted. Supervisor Martocchia stated that it has been suggested that night Town Board meetings be held. Beginning in May, the second meeting of the month will be night. This has been tried before with very little success, but the Board is willing to try it again. On motion of Justice Doyen, seconded by Justice Surer, it was RESOLVED that the following audited bills be and hereby are ordered paid: General Fund Whole Town bills in the amount of $25,936.39; General Fund Part Town bills in the amoun~ of $7,971.86; Highway Department bills in the amount of $11,572.03; and Fishers Island Ferry District bills in the amount of $47,070.09 Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Justice Doyen, Justice Suter, Supervisor Martocchia. Absent: Councilman Homan. This resolution was declared duly adopted. On motion of Justice Doyen, seconded by Justice Suter, it was RESOLVED that the following reports for the month of March 1979 be ~and hereby are accepted and ordered placed on file: Fishers Island Ferry District, Town Clerk, Building Department, Town Trustees, Dog Warden, Justice Sater, Justice Rich, Assessors, Supervisor and Bay Constable. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Justice Doyen, Justice Suter, Supervsior Martocchia. Absent: Councilman Homan. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Pell, it was RESOLVED that Greenman-Pedersen, Associates, P.C. submit to the Town Board a~ letter of guarantee, covering all the items reviewed today with Mr. MichoS of Greenman-Pedersen, stating that they will assume the responsibility and cost for repairing the damage done to ~he Town Hall addition by the break in the sprinkler system on January 20, 1979. On motion of Councilman Pell, seconded by Justice Suter, it was RESOLVED. that the general contractor for the Town Hall addition ~innesota Construction Corporation, be and~hereby is declared in default of their contract With the Town of Southold, and the Town Attorney be ahd he hereby is instructed to notify the bonding company. Supervisor Martocchia:. 1. There will be a meeting on Thursday, April 12 th of the East End Supervisors and ~ayors Association. Someone will represent the Town of Southold. 2. The North Fork Taxpayers Association, !nc. has requested the budget figure for the maintenance of the projecte~ recreation center. At this point in time Supervisor ~artocchia has talked to the architects as to how much they estimate the heat ~ill cost in the buildinc and this will have to be computed upon how many days it will be in use. ~e placed $5,000~in the 1979 budget for 6 months use~of the building. This should cover the heat, lights, telephone, maintenance (this will be 'handled by CETA workers}., and insruance. A final figure cannot be determined until the building is operational. The N.F.T.A. will be advised by mail of this. 3. Notice. from the Department of the Army, Corps of Engineers, upon application of Doris C. Idler for permission to build a-pier, ramp, and float at Dawn Lagoon, East ~arion. Comments must be received by May 4, 1979. 4. Application for summer employment from Suzanne Michel. 5. Notice from the N.Y.S. Office of ~ental Retardation and Development Disabilities stating the 519 First Street, Greenport site for a community residence is no longer under consideration. 6. Letter from the Suffolk County Departn~_ent aof Land Manage- ment advising that three additional parcels have been added to the Suffolk County Farmland Acquisition Development Rights Program: property of Donald P. Robinson, Dorothy R. Bins, and Marion W. Mears. 7. Notice from the New York State Retirement System stating~ the retirement d~te of John Wickham, Chairman of the Planning Board · s April ~0, 1979. Supervisor ~artocchia stated the Board would like to receive resumes for the fol!~ing positions: Dog Warden, member, Board of Appeals, two members,?~lanning Board and member, Board of Assessment Review, member Conservation~Advisory Council. 19792'55 8. Notice from the Long Island Lighting Company stating that the. S-t~e~ .l~gh~ing ~ervi~ce billing beginning April 1, 1979 will be adjusted to reflect adjustments as shown through the tabulations based on the difference between the tax portion of the rental rate for the current year and that of the original year of the contract which was 1976. 9'. Letter from the Office of County Exectuive Klein transmitting a Bill which New York State Senator Present is considering introducing to the State Senate. It is an amendment to the general municipal law, in relation to the establishment of reserve funds to pay judgements and claims arising out of acts or ommissionsof officers and employees. 10. Letter from the Suffolk County Department of Transportation advising that County Executive Klein has designated the week of April 15-21, 1979 as Bicycle Safety Week in Suffolk county. 11. Letter from Holzmacher, Mc Lendon and ~urrell, PC advising that three copies of EPA Form 5700-32, Greenport/SouthOld 201 Study, Scavenger Waste Study, and Amendment No. 1 to the Agreement have been forwarded to the United States Environmental Protection Agency and the New York State Depart~_ent of Environmental Conservation. On motion of Justice Suterf seconded by Councilman Drum, it was RESOLVED that Deborah Scott, Greenport, New York, be and hereby is appointed by the Southold Town Board to represent the Town of Southold on the CAST Inc. Board of Directors. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Justice Doyen, Justice Surer, Supervisor Martocchia. Absent: Councilman Homart. Letter from the Economic Opportunity/.Council of Suffolk, Inc. requesting that the Town of Southold appoint a representative to serve~~ on the EOC's Board of Directors. The Board members will submit names for consideration at the next Board meeting. 13. Notification from Francis J. Yakaboski, representing the Town of Southold in the matter of the Ad Hoc Association of Mattituck Inlet Watch Do~s vs. To~ of Southold~ that th~ petitioners have filed a notice of appeal and ~r. Yakaboski will continue his representation of the Board of Appeals in connection with this matter. On motion of Justice Surer, seconded by Councilman Drum, it was RESOLVED that Francis J. Yakoboski, Esq~ be and he hereby is appointed to represent the Town of Southold in the matter of the appeal of the Ad Hoc Association of Mattituck Inlet Watch Dogs v. Southold Town Board of Appeals. Receipt o~ additional applications for the Suffolk County Home Improvement Program and a Guidelines Handbook on the program. On motion of Councilman Drum, seconded by Justice Suter, it was RESOLVED that the United Fire Company No. 1, Cutchegue Fire Department be and hereby ~s granted permission.to use Town roads to cOnduct their 12th Annual Parade and Drill at 6:00 P.M., J~ly 21, 1979; rain date 2:00 P.~., July 22, 1979. This permission ls granted provided the Cutchogue Fire Department obtains insurance to hold the Town of Southold harmless. Letter from the Cutchogue-New Suffolk Chamber of Commerce thanking the Town Board for any consideration they might give to the renovation of Griffen Street, Cutchogue. The Chmaber submitted a plan for the renovation On March 14th to Supervisor Martocchia, Councilman Pell and Highway Superin- tendent Dean. They ~isplayed the plan at the Cutchogue Post Office and the public seems to approve the idea. On motion of Justice Suter, seconded by Councilman Pell, it was RESOLVED that the Southold Town Board and tke Superintendent of Highways will support the Cutchogue-New SUffolk Cha~er of Commerce in their beautification program for Griffen Street, Cutchogue. Pluschau for a wetland permit at 3:30 P.M., and (2) Application of W.S. Gardner for a wetland permit at 3:40 P.M. On motion of Justice Surer, seconded by Councilman Drum, it was RESOLVED that the Suoervisor be and he hereby is directed to execute a lease agreement between the Town of Southold and Agnes Reinhart for the lease of a 40 ft. by 40 ft. concrete block building, 1000 east of Peconic Lane, on Route 25, Peconic, New York for a one year period commencing on December 1, 1978 and ending November 30, 1979 for an annual rent of $2,400.00 Vote of the Town Board: Ayes: Councilamn Pell, Councilman Drum, Justice Doyen, Justice Suter, Supervisor Martocchia. Councilman Pell explained that this item, purchase of a new car for the Deputy Highway Superintendent, was in the 1979 Highway budget and the budget was approved last November. On motionof Councilman Pe!l, sec cnded by Justice Suter, it was RESOLVED that the Town Board of the Town of Southold join in the motion of the County of Suffolk for dismissal of the LILCO Jamesport facility application and agree that the County should review the the pertinent parts of the record , especially emergency evacuation problems, low level radiation and health effects, waste management and economics of the proposal, and recommend that the Siting Board deny the application. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Justice Doyen, Justice Surer, Supervisor Martocchia. Absent: Councilman Homan. This resolution was declared duly adopted. Justice Suter stated that he feels the last sentence in Mrs. Tiedke's report covers most of what some'of us feel: "Personally I believe that eventually nuclear power could be a great boon, but that they have a long way to go before that poiht is reached." Mrs. Tiedke has~.foltowed the meetings all the way through and the Board has a great deal of faith in her recommendation. He feels she has done an excellent job in covering the hearings for the Town. Supervisor Martocchia reported that all of the ToWn Board members have received a copy of the proposed CSEA contract prepared by Town Attorney Tasker. It will be studied for the next two weeks and acted on at the April 24th meeting if the Board is in agreement. On motion of Justice Suter, seconded by Justice. Doyen, it was RESOLVED that the Supervisor be and he hereby is authorized and directed to execute - Hemorandum of Agreement between the Suffolk County District Attorney and the Town of Southold for use of space, and alterations~hereof, in %he basement of the east wing of the Town Hall. Justice Surer stated that he recommended'this before as it will be a great help to the police departments, not only the Town of Southold, but a~so the Village of Greenport and Shelter Island to have a District Attorney located in our area. T~fs resolution w.~S~ dec'l~He~t dul~..adopted, Supervisor Martocchia reported that he has received a letter from residents of the Cedar Beach area who have been having problems with visitors to the beach over the last few years. The Town has entered into an agreement with the County of Suffolk for the Town to maintain the beach this summer. Supervisor Martocchia will meet with the residents in the near future to discuss their problems and what can be done to relieve them. On moiton of Justice S'uter, seconded by Councilman Drum, it was RESOLVED that the Town Board of the Town of Southold request the Suffolk County Executive and Suffolk County Department Of Public Worss to expedite dredging of James Creek and Deep Hole Creek, ~{attituck, one of which has been on the schedule for two years and badly needs dredging. Town Attorney Tasker announced that the bond for the Bayside Terrace Road I~mpr0vement District was sold for 5.3 % ~r. John Case, Cutchogue, thanked the Town Board, on behalf of the Cutchogue-New Suffolk Chamber of Commerce, for their suppor~ of the G~iffen Street beautification program. ~r. Paul Stoutenburgh presented a r~vised folder on Docks, Filling, Dredging, ~ooring, Bulkheads, Alteration of Wetlands, as prepared by the North Fork Environmental Council for the Town of southold. This informational folder was reviewed by the Town Trustees, .Conser- vation Advisory Council. There is a name on the front "Prepared for the Town of Southold by the North Fork Environmental Council" whiCh four of the Trustees voted to leave on and one said they didn't want it on. It is up to the Board to review the folder and dacide _~ how it should be prepared.---Supervisor ~artocchia said the folder will be reviewed for the April 24th meeting. Supervisor Ma~tocchia advised Thomas Jurzenia, who was in the audianca, that he has received a copy of a letter sent to Judith Hope by Austin Emory of the N.Y.S~ Dept. of Transportation relative to directional signs on the Expressway. The work will be done but it appears a small project has become a bi~ project and it is moving slower than anticipated.---~r. Jurzenia said that an ad appeared in the Sunday Daily News about fishing on Long Island. It~is sponsored by the Suffolk County Tourist Group and Nassau Tourist Group. He called the number advertised but no one couid give him any informa- tion ~r. Jurzenia said this is being sponsored by taxpayers dollars and wanted to know if the Town Board knew about it?---No one on the Board knave anything about it, although Councilman Pell said it is also being advertised on the radio. Supervisor ~artocchia stated Councilman Homan is out of the Country and is returning today but not in time for the meeting. Mr. A1 Fickeissen introduced a group of five men from Chile and their grou~ leader who are spendin~ a month in the United States. They spe~t this day touring the No~th Fork and will go on tour in Suffolk County. Next year five young men from the Suffolk County area will go to Chile.
