MORNING SESSION
Charles Cuddy, Esq., representing William Schriever, Orient
appeared before'the Board to discuss the exbhange of property
between Mr. Schriever and the Town on Tabor Road, Orient. Mr.
Schirever would like to go ahead with the exchange and post
an additional amount in the subdivision bond to cover completion
of placing top soil on. the property to be exchanged with the ~own.
He would like to take the top soil from the subdivision area~but
he will no~ have final approval of his subdivision for a few
months. After considerable discussion if was decided Mr.
Schriever should place the necessary fill on the parcel he is
transferring to the Town, and when the transfer has been
completed he will push the fill onto the Town property. To
insure the work will be done it was decided Mr. Schriever
should post $.150.00 as a bond.
A regular meeting of the Southold Town Board was held on Tuesday,
March 27, 1979 at the Southold Town Hall, Main Road, Southold, New
York. Deputy Supervisor Homan opened the meeting at 3:00 P.M. with
the following present:

On motion of Justice Suter, seconded by Councilman Pell, it was
RESOLVED that the minutes of the March 13, 1979 meeting of the
Southold Town Board be and hereby are approved as submitted.

On motion of Councilman Drum, seconded by Justice Suter, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3:00 P.M., Tuesday, April 10, 1979 at the Southold
Town Hall, Main Road, Southold, NeW York.

Deputy Supervisor Homan stated he has the February report of the
Police Department to be placed on file.
Highway Superintendent Dean reported that he and Councilman Pell
and Justice Surer met with the DEC at Stony Brook along with all
of the east end towns. The concensus of opinion was that by 1985
all landfills will be closed through out the state. The object is
to go into resource recovery. The DEC doesn't know how this will
be accomplished. The town thought they were on the right track
with compacting or bailing, but what has happened now ~s by 1985
nothing whatsoever will go into the ground. Liners can't be used
abd bailers can't be used~ everything will have to be compacte~"
is ~empstead. Brookhaven is ±~ the process of do±~g a survey~ they
take in approximately 1100 tons of garbage a day. They are talking
about a site at Brookhaven Lab, as Brookhaven Lab is the biggest
purchaser of ~eCt~City from Long Island Light. The cost is going
to be astronomical, we are going to have to transport the compacted
harbage up there. In about two or three weeks there will be another
meeting wi~h the DEC here in Southold. What the DEC would like at
teh next meeting is for the Town Board to authorize %he Commissioner
of Public Works and one Board member to be on a resource recovery
committee. The Hempstead resource recovery site has been having a
lot of problems.and their plant cost $100,000,000.
Deputy.Supervisor Homan commented on a newspaper article that
appeared in one of the local papers last week where it might be
considered he said various things about CSEA negotiations.
There was information included in the article that did not come
from the Supervisor's Office becuase the Supervisor was not there,
Deputy Supervisor Homan was there and he does not have access to
the information. The reason he made onote of this is that it is
not good negotiating principals to have contract negotiation items
in the paper before the contract is signed. He did not give that
information to the paper, he does not know where they got it from.

Deputy Supervisor Homan:
1. There will be an EPA meeting on April 11, 1979 at the
Southold Town Hall, 7:30 P.M. Mr. William LaRow of the DEC
and Mr. Michael Bonchonsky of the EPA and James Monsell of the'
Village of Greenport, as well as Holzmacher, McLendon and Murrell.
It ~ill be an open meeting to the public. The Town Board will
hold an execUtiv~ meeting with these people in the afternoon.
2. Notice from the Department of the Army, Corps of Engineers
upon application of Petroleum Combustion International, Inc. for
maintenance dredging in ~attituck Inlet, Mattituck Creek. Object-
ions by April 13th.
3. Notice of application to the New York State D.E.C. by the
Mattituck Fire District for construction of two fire wells. Object-
ions by April 12, 1979.
4. Receipt of Negative Declaration, Notice of Determination
of No Significance from the N.Y.S.D.E.C. upon application of
Francis Roman who proposed to construct two timber decks, walkways
adn timber retaining wall and back fill at 280 Beebe Drive, Cutchogue;
and application of Glenn Heidtmann who proposes to construct a one
family dwellina on Lot 148, Map of Cedar Beach Park, Southold. Another
one upon application of Steve Mitacchione who pretenses to construct
a one family dwelling on the north side Eugene~Road, Cutchogue.
5. Receipt of a Suffolk County Legislature resolution amend-
ing the Agricultural DiStrict in ~outhold Town to include the Lappe
property.
6. Notice from the Department of the Army, Corps of Engineers
upon application of Orient Wharf Co. for permission to construct
pier arrangement and mooring piles at Orient Harbor, Gardiners Bay.
7. The Town has received the New York State Coastal Management
Program, Draft Report with Draft Environmental ImpaCt Statement which
is on file in the Town Clerk's Office~
8. A recent Board of Appeals decision was taken to court
in the matter of the Mattituck Inlet Watch Dogs vs. Town of southold
and the Supreme Court, State of New York, County of Suffolk upheld
the Board of Appeals decision.
9. Letter from J. Parker Wickham, Mattituck Airbase, Inc.
"Time has changed people and many factors affecting the operation
of a small airport, so it is with regret that we terminateca most
pleasant relationship with South~ld.Town. You have never failed
to maintain the runway. I hop~ we can do as well. Termination of
this lease does not mean the closing of the airport. We intend to
be here a long time. We wish to thank you, the board, and your
efficient highway department who through the years have helpte to
make Mattituck Airport one or. the safest, cleanest and respected
anywhere."
10. Copy of letter from Long Island Cablevision Corporation
of the New York State Commission on Cable Television notifying
them of the increase in rates as a result of a public hearing and
resolution by the Southold Town Board. Also, letter from New York
State Commission on Cablevision Television to Long Island Cablevision
Corporation asking for additional information before the rate increase
can be approved by them.
11. Receipt of a petition, containing 58 signatures, request-
ing night meetings of the Town Board.---Deputy Supervisor Homan
commented that in the past night meetings of the Town Board, except
for public interest hearings, have never been well attended. How-
ever, since there are over 50 people whO~say they woUld like'to
attend night meetings, and the Town Board has discussed it this
morning, they will shortly begin holding night meetings possibly
once a month in the next several months to see if they have any
more success in getting an audience.
12. Request for a street light on New Suffolk avenue by
Mrs. Kull. Highway Superintendent Dean will pass this informa.tion
on to the street lighting man. At the present time there are no
secondary wires in the area to which a light can be installed.
13. Letter from the Suffolk county Gray Panthers advising
that May is Senior Citizens' Month, On May 1st there will be a
one-dau conference at the State University, Stony Brook on
"Advocacy & Aging: Coming Together to Hake ThinGs Better".--Copies
of this news ~olease has been sent to the local-senior citizen clubs.
14. Receipt of a check from the Suffolk County Treasurer
in the amount of $4,577.32 representing 75% of the excess dog fees
in Southold Town.
15. Letter from Richard J. Cron, attorney for Shorecrest
Subdivision at Southold, requesting bond release on this subdivision.
1~. Copy of a letter from County Legislator Denis Hurley to
Carl Eisenschmeid, Suffolk County Department of Public Works, stating
the Richmond Creek area, Nassau Point, will now be presented to,the
Special Projects Dredging Review Committee.
17. Letter from Barbara A. Zurl, Little Neck Road, Cutchogue,
questioning the -uality of transportation available to the people
of Southold Town with respect to railroad, railroad buses, local
buses.
18. Letter from the SUffolk Community Development Corporation
relative to low income housing loans. Brochures are posted on
the Town Clerk;s Bulletin Board and the Town Clerk's Office.
In Southold Town from October 16, 1978 through January 31, 1979
there were loans in the amount of $5,600.00
19. Letter from Cheryl Ann Beebe, Cutchogue applying for
summer employment.
20. Letter from Margaret J. Lightfoot, Greenport asking what
is being done towards installing nets at the swimming areas to
dter jellyfish.---This matter was looked into last year and prices
were obtained. At that time the cost appeared to be extensive.
However, the possibilities will ~e investigated.
21. Receipt of a petition, containing 118 signatures, request-
ing that Jerry Kin~ be allowed to remain in his present employment
at the Southold Town Nutrition Center.---~r. King has been through
two CETA extensions and his appointment will be up as of May lat.
The Town Board is exploring avenues where possibly an arrangement
can be made to keep ~r. King at the Nutrition Center. Thoy are
fully aware of his value to the program.
22. Letter from Nelson Axien, Peconic, concerning the jetty
at Goldsmith Inlet. ~r. Axien presents the view that the jetty
is not entirely the cause of erosion to the shorefront of that
area.
Moved by Justice Surer, seconded by Councilman Drum,
WHEREAS, an Introductory ResolUtion No. 2094-78 introduced by
legislators representing constituents of the five western towns
of Suffolk County and which would mainly benefit only those towns
which voted to be served by a county police department, and
WHEREAS, the Town of Southold taxpayers voted against being a part
of a county police force and decided they preferred paying directly
for their own town police department with the back-of the Suffolk
County Sheriff's deputies for which all county residents mus~ pay
and with the facilities of the New York State Bureau of Criminal
Investigation available to the town and for which all residents
must pay, and
WHEREAS, the Town of Southold taxpayers already contribute substantial
sums, the town estimates $150,000, for certain services provided by
the 7th Squad Detective~Division of the Suffolk County Police Depart-
ment and which fairly covers any cost for such services, and
WHEREAS, the intent of County Resolution No. 2094-78 is at this
late date to add an additional tax burden on the residents of
Southold Town for services not asked for and not used by the tax-
payers of Southold Town and is a direct attempt to make the cost
of the entire Detective Bureau of the Suffolk County Police District
a general charge to the east end towns for non-representative
expenses beyond their means and for a service ~hlch they still have
to provide themselves if they want tocal control o£ th~.~r detectives
work in their communities, .... ~
NOW, THEREFORE, BE IT RESOLVED, thatthe Town Board of the Town of
Southold opposes with whatever control is has the adoption of County
Introductory Resolution No. 2094-78 by the Suffolk County Legislature
for the reasons stated and because-it feels that only those services
asked for and provided should be paid for by its taxpayers, and
County Resolution Introductory No. 2094-7.8 would tax Southold Town
in an unfair and unrepresentative manner and our County ExecUtive
and out County Legislators should be adivsed of the position of
the Southold Town Board in this important tax matter affecting our
Town of Southold.

This resolution was declared duly adopted.
On motion of Councilman Pell, seconded by Justice Surer, it was
RESOLVED that Deputy Supervisor Homan be and he hereby is authorized
to execute an agreement between the New York State Department of'
Environmental Conservation and the Town of Southold for the 1979
Shellfish Transplant Project, said project provides for 50% reimburse-
ment.

On motion of Councilman Drum, seconded by Justice Surer, it was
RESOLVED that the Supervisor be and he hereby is authorized to
hire Jean Schneider as a part-time bookkeeper in his office at
an hourly wage of $5.08

~=- On motion of Justice Surer, seconded by Councilman Drum, it was
RESOLVED that the Southold Town Board sets 3:40 P.M., April 10,
~_~ 1979, Southold Town Hall, Main Road, Southotd, New York as time
and place for hearing upon the application of W.S. Gardner, Vanston
Road, Cutchogue, New York, for a permit under the provisions of the
Wetland Ordinance of the Town of Southold for permission to construct
104 ft. fo bulkheading and dredge approximately 200 cu. yds and
place behind proposed bulkhead and proposed retaining wall on his
property on Vanston Road, Cutchogue, New York. All persons interest-
ed in said matter shall appear at the time and place above specified
and will be given an opportunity to be heard.

On motion of. Justice Suter, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the Town of Southold approves
the action of the Board of Commissioners of the Fishers Island
Ferry District in entering into an agreement with Richard Grebe
for the operation of the Fishers Island Airport from April t, 1979
through March 31, 1984 at an annual rent of $2,900.00

On motion of Councilman Drum, seconded by Justice Suter, it was
RESOLVED that application of Martin Sidor dated March 15, 1979 for
renewal of a trailer permit on the south side Oregon Road,Mattituck,
for housing of trainees under the National 4-H Agricultural Program
be and hereby is renewed for a six month period.

Moved by Justice Surer, seconded by Councilman Homan,
WHEREAS, certain events, including the introduction of County
Resolution No. 2094-78 have shown that reasoning of west end
legislators Of the Suffolk County Legislature leans towards taxing
east end towns for non-county provided services, and
WHEREAS, the concept of a new county.composed of east end rural
towns has been denied becuase of so-called population?figures,and
WHEREAS, the Town Board of the Town of Southold believes that serious
study should be made at this time for the creation of a new county
for the east end of Long Island in order to provide a more local
oriented operation of our government and in which our people have
a fair voice in their own taxation,
NOW, THEREFORE, BE IT RESOLVED, that the Supervisor of the Town of
Sou~hoid be, and he hereby is authorized to appoint citizens of
the east end towns and villages and that the necessary expenses of
such citizens of our town be paid for by the Town Board upon proper
authorization of the town Board and upon their audit by the Town
Board of the Town ~f Southold.

Wickham for providing the town of Southcld with the use of the
Mattituck Airport for the past fifteen years.

WHEREAS, Detective Fletcher A. Baldwin of the Suffolk County Police
~eD~ra~t~ei~i~e~i~dg from law enforcement after twenty years of
honorable service, ~d
WHEREAS, during the past twelve years while assigned to the Seventh
Squad Detectives he has been working within the Town of Southold
jointly with the Southold Town Police, and
WHEREAS~ during that period he has proven to be a dedicated police
officer and has shown concern and interest for the citizens of the
Town of Sou%ho!d, and
WHEREAS, during that period he has also earned the respect and

friendship of the members of the Sputho%d.~Town Police Department
as well as many of our citizens, N~9~he.~efo~e, be' ~%
RESOLVED that the Town Board of the Town of Southold does hereby
thank Detective Fletcher A. Baldwin for his service to the people
of this community and wish him years of health and enjoyment in
his retirement.

On motion of Councilman Pell, seconded by Justice Surer, it was
RESOLVED that the Town Clerk be and she hereby is authorized to
advertise for bids for the necessary replacement parts to restore
the D-6 Catipillar bulldozer at the Disposal Area; Highway Department
to prepare specifications.

On motion of Councilman Drum, seconded by Councilman Homan, it was
RESOLVED that the Supervisor be and he hereby is authorized and
directed to enter into a drainage easement agreement with Richard
J. Babcock and Frederick F. Rimler d/b/a Southold Gardens,said
drainage area to have an area of 125 ft~ by 150 ftc, to be located
on the north side of Hill Road W~st at Southold, New York.

On motion of Councilman Drum, seconded by Justice Suter, it was
RESOLVED that the DeClaration of Covenants and Restrict$ons~ dated
February 26, 1979, of Southold Gardens, heretofore approved by the
Town Attorney be and the same hereby is approved. Said declarations
covering the premises comprising 12.060 acres located east of Wells
Avenue at Southold, New York.

On motion of Councilman Pei1, seConded by Councilman Homan, it w~s
RESOLVED that Deputy Supervisor Homan be and he hereby is authorized
and directed to execute a lease agreement between the Board of
Commissioners of the Cutchogue Fire District and the Town of Southold
for ~ ~.~ parcel of land on the west side of New Suffolk Avenue to be
used as a public parking field; and (1~ a parcel of land on the east
side of New Suffolk Avenue, Cutchogue, to be used as a public parking
field, beginning April 15, 1979 and automatically extended for
successive one year terms at $1f00 per year.

On mO~ion of Councilman Pell, seconded by Justice Suter, it was
RESOLVED that Deputy Supervisor Homan be and he hereby is authorized
and directed to execute a lease agreement between th~ Board of
Commissioners of the Fishers Island Ferry District and the Town of
Southold for rental of justice chambers at the Fishsrs Island Fire-
House at $500.00 per year, beginning April i, 1979 and automatically
extended for successive one year terms.

Mr. Franklin Bear, Southold stated the meeting witk Mr. LaRow will
be a joint meeting sponsored by the Town Board and the League of
Women VOters, North Fork Environmental Council and North Fork
Audubon Society. The meeting fits in with what Highway Superintendent
Dean was talking about at the beginning of this meeting. It Will be
pertaihing to handling of different kinds of waste, engineering
aspects, hwo funding can be integrated. There are funds available

between this year and next for towns who have already started the
study and made some progress toward trying.to find a solution to
these problems. Of course, the Town of Southold already has two
studies under way, one on waste water and another on the disposal
area, so that is in our favor. The meetin~ will be 7:30 P.M.,
here at the Town Hall, Wednesday, April ll~h.
Mr. Samuel Markel, Southold, stated that the problem on the sound
shore is becoming extremely dangeroust especially for people who
own property to the east of Goldsmith Inlet. Also, the boat ramp
at Kenneys Beach is in a vary precarious position at this moment.
The end of the ramp is completely gone, and.there is nothing at all
under the concrete. He is aware ~hat Mr. Lockman is sueing the Town
and this is unfortunate because if he wins it will be a precedent
for thrity or forty addition&l homeowners which includes Mr. Markel..
Of all of the inveStigations that.they have made into this matter they
have firmly proved that the jetty~has caused the problem. It has
created a tremendous beach on the west side of the jetty which is
now right out to the tip. He can remember fifteen years ago water
heing all the way out on both sides of the jetty. He said the
original intent of the jetty was to keep the Inlet open at all
times, but it is now not good enough to a get a boat through. Mr.
Markel stated he has lost over 150 ft. of beach in front of his
house. The water is directly up to his porch. He feels the proble~
should be weighed carefully and examined because in. the long run if
the Town loses the suit and loses tourists and loses business it
will be a great expenditure which could.have been avoided by a little
expenditure which would be the removal of the jetty or reducing the
jetty to an ~xtent where it will &llow the sand to flow again.
Mr. Charles Hickey asked if the $~500 dog moneys from the County
could be used toward a leaf picker?
Mr. William Overton asked when a deicision will be made rel&%ive
to Jerry king at the Nutrition Center.~,-~Deputy Supervisor Homan
stated Mr. King has been employed at the Nutrition Center under
a CETA program, and under CETA 2 the people cannot be extended
once their terms, runs out, and Mr. King's term ends May 1st. The
Nutrition budget which is received from the county' provides no
funds for a cook or any of the kitchsn help. Mrs:. Tuthill does
have access to other CETA people who may be cooks, but everyone
thinks highly of Jerry King, so the Town Board, today, made a
request to the County Executive for reconsideration of the budget
with perhaps necessary funds to retain the services of.Jerry K~ng.
The Town is ~ery sympathetic to the. problem and would re~ret .~ i~
we coul~ not come up with something. H~wever~ the Town. is very
limited as to how thsy can deal.with this matter. T~i's does not
mean the end of the Nutrition Program, it will continue on.

RESOLVED tha~ there being no further business :to come before this
Town Board meeting adjournment be called at 3:50 P.M.

The Board met at 4:00 P.M. wi~ representatives of the' local
libraries tO discuss future funding by the Town. Present w~re:
Deputy Supervisor Homart, Justice Suterr~'Councilman D~um~ Councilman
Pell, Town Attorney Tasker, Highway Superintehdent Dean~ Town C~erk
Terry, Douglas Love, L.~. Traveler, Richard Curtis, S~ffelk Times,
Library, W. Perry Hukill, Greenport Library, W.S. Gardner, Cutchogue
Library and Rensselaer Terry, Southold Library.
The library representatives stated they are all very concerned
about taxes but would like to continue receiving the usual funding
from the Town. Deputy Supervisor Homan stated that he has discussed
this ~atter with Supervisor Martocchia and they would like to see
the libraries go to the public for the funds through_ th.e annual
school budget vote. The people of Southold Town do no% have a vote
on the town budget and they are being denied th~ democratic process
by not having a vote on the library budget. All of the libraries
said they have considerable concern about 'this proposal and feel
they could be voted down if the voters were unhappy with the s~hool
budget and voted it down. ~They~e~l~if the town withdraws their
funding it would indicate to the public that the libraries do not'
have town support. At the conclusion of the meeting-a% 6:00 P.M.
it was left in the hands of the libraries to consider going to the
public for funds they are raising for their districts.
