Deputy Supervisor Homan opened the meeting at 3:00 P.M. with the following present: Absent: Deputy Supervisor James Homart Justide Martin Surer Justice Francis T. Doyen Councilman Henry W. Drum Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Terry Supervisor Albert M. Martocchia Councilman William R. Pell III On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the minutes of the February 6, 1979 Town Board meeting be and hereby are approved as submitted. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen, Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared duly adopted. On motion of Councilman Drum, seconded by Justice Doyen, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, March 13, 1979 at the Southold Town Hall, Main Road, Southold, New York. Vote of the'TOwn Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen, Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared duly adopted. Deputy Supervisor Homan reported that the reason for this Thursday meeting in that most of the Town Board members attended the Associa- tion of Towns meetings in New York City Monday through Wednesday. The meetings were very enlightening and every board member and other officials of the town who went to the con~ention profited greatly, despite the inconvenience caused by the snow and the mix up of some of the speakers and their saheduled appearances. Justice Surer stated that the D.E.C. should go to New York City and examine the city streets as they do our landfill operation because seeing garbage piled four and six feet high in the streets, it seems the D.E.C. has a lot of work to do in cleaning up the area. Deputy Supervisor Homan reported on~a shellfish meeting that was held here in the Town Hall about two weeks ago and the Town has reached agreement with the D.E.C. on a Clam Transplant Program, and the Town does once again expect to go into that type of program. Deputy Supervisor Homan stated that he met with Supervisor Martocchia and the Assessors and the--firm of Finnegan and Associates relative to 100% Assessment. He also asked the assessors to attend a meeting in Shelter Island last 'Tuesday on that same subject. Councilman Drum reported that in the matter of the dredging of the Mattituck Inlet, the Town has received a sounding survey and lo~king at it, the Board went back to the Corps of Army Engineersand requested that they conduct emergency dredging at least at the entrance to the Mattituck Inlet. There are funds budgeted by the Army Engineers for fiscal year 1980 for dredging the entire inlet, however the Board requested emergency funding and received a telephone call saying 22,9 they are taking the request and forwarding it to Washington to cQns~der emergency funding. They did request that the Town provide them w~th. tha amount ~ Cra~t~F~P. lea~u~e, and in particular tha commerical fishing and barges and tugs that use 'the Matt~tuck ~nlet~ There are a grea- many commerical fisherman who use' the Inlet, but also this si where Northville keeps their emergency equipment ~n ca~e there is an oil spill. This information is be.~ng furnished to th.e. Corps of Army Engineers in hopes it will justify at least emergency dredging by early spring. Town Attorney Tasker indicated that he expects t~ be clos~ng ne~t w~e~. on the Meyer property, ~oisseau Avenue, Southold, ~ch '~s bei'nq purchased for drainage problems. Deputy Supervisor Homan: 1. Notice of rate increase for Fishers ~sland Electric. 2. Notice from~-~he~Department of the Army¥ Corps of Enginee~s~ upon application fo Shelter Island ~?Oyster t~Company for maintenance dredging and pile replacement at Sterling Creek, Greenpo~t. 3. NOtification from the Department of the Army, Corps of Engineers upon application of Frank Guarriello, for permission to bulkhead, fill, pier and float arrangement at Dawn Lagoon, East Marion. 4. Notification from the Department of the Army, Corps of Engineers upon application of Albert J. Moyse, for permission to construct timber groin and pier at Orient Harbor~ Gardiners Bay, East Marion. ' 5. Notification from the Department of the Army, Corps of Engineers u~pon application of Henry J. Smith, for permission to construct a groin field, Ho~ Neck Bay, Little Peconic ~ay, Southold. 6. Letter from the New York state of Environmental Conservation stating a workshop will be held on March 1, 1979 at 2:00 P.M. at Stony Brook to inform representatives of local ~overn-- ment, industry, and the public of proposed changes in the State Implementation Plan for air quality.---Deputy Supervisor Homan does not know affect this will have on Southold Town and he will look into it.---Justice Surer stated there migh~ be a question on the burning ordinance. 7. ~Notification that Suffolk members of the N.Y. State Assembly Minority will hold a Legislative Forum, on major issues which are ~urrsntly before the state assembly. This is entitled a "Budget Listen In" and will be held on March 2, 1979 in the Legislative Hearing Room, Hauppauge and on March 9, 1979 at the County Center, Riverhead, Both hearings will be between the hours of 10 a.m. and 2 p.m. 8. Notice from the Department of the Army, Corps of Engineers relative to Ocean Dumping. The Board will w~ite for the local guidance package from the U.S. Army Engineer District, New York. 9. Receipt of an application for a wetland permit from Raymond Pluschau, Orient. It has been forwarded to the Trustees and Conservation AdVisory Council. 10. Letter from Assemblyman John L. Behan informing the Town of shi new address in Albany: Room 523 of the Legislative Office Building, Albany 12248 (518-472-8020), and in Montauk P.O. Box 1005 (668-5656). 11. Letter from the New York State Planning and Development Clearinghouse acknowledging receipt of the Letter of Intent submitted by the Town of Southold under the Community-Development, Small Cities grant. 12. Letter from the Times Mirror Communications stating Long Island Cablevision Corporation has reviewed the construction plan proposed to the Town and amends their proposal of a three year construction plan to a two year construction plan. 13. Notice of cecrease ~n insurance premiums for the Fishers Island Ferry District. 14. Letter from John S. Lockman relative tO erosion on the Sound. Mr. Lockman asks for results of a public hearing and when held regarding the~removal of the jetty at Goldsmiths Inlet.---Such hearings were not held. Former legislative Joyce Burland said she would hold hearings is reauested. T~ the Board's knowledge she did not hold hearings and Mr. Lockman will be so advised. 15. Letter from~Holzmacher, McLendon and Murrell directed to the United States Environmental Protection Agency relai~tive to a scavenger waste'-study for Shelter Island town. The U.S. E.P.S. has not replied to the letter. 16. Letter from the Cutchogue-New Suffolk Historical Council thanking the Town Board for the $500.00 for maintenance of historic edifices on the Village Green, Cutchogue. 17. There has been a request from County Legislator Denis Hurley to amend the proposed agricultural district by the addition of three parcels in Southold Town. There is a letter from John Wickham, Planning Board Chairman, approving this action. On motion of Councilman Drum, seconded by' Justice Suter, it was RESOLVED ~hat the Town Board of the town of Southold recommends the inclusion of the following three parcels of a'lnd in the original petition to create an Agricultural Dsistrict in Southold Town: A 28½ acre parcel owned by Frederick Lappe, 2290 South Harbor Road, Southold. a 47+ parcel owned by John C. Diller and Frank J. Diller at Peconic. An 81.757 acre parcel owned by six individuals.and is known as the Simon parcel at Peconic, New York. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homart, Justice Doyen, Justice Surer, Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared duly adopted. On motion of Justice Suter, Seconded by Justice Doyen, it was RESOLVED that the resol~t±on adopted February 6~ 1979 awarding the plumbing contract for the Senior Citizen and Youth Center to Metro Plumbing East, be and hereby is amended to read as follows: "RESOLVED that Metro Plumbing East, P.O. Box 347, Aquebogue, New York be ahe hereby is awarded the contract the the plumbinq construction of the Senior Citizen and Youth Center at the net bid-price of S10,340.00 Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homart, Justice Doyen, Justice Surer. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared dulY adopted. On motion of justice Surer, seconded by Councilman Drum, it was RESOLVED that the resolution adopted February 6, 1979 awarding the heating and air conditioning contract for the Senior Citizen and Youth Center to Thermal Comfort, Inc., be and hereby is amended to read as follows: "RESOLVED that Thermal Comfort, Inc., 25A Carlough Road, Bohemia, New Yokr be and hereby is awarded the contract for the hearint and air condtioning construction of the Senior Citizen and Youth Center at the net bid price of $20,361.00" Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homart, Justice Doyen ~ Justice Surer, Absent; Superviso~ Martoechia Councilman Pell. This resolution was declared duly adopted. On motion of Justice Doyen, seconded by Councilman Drum, it was RESOLVED that the resoltuion adopted February 6, 1979 awardinq the electrical contract for the ~nior Citizen and Youth Center to Cavaliere Et~ctric Contracting Lt~., be~and hereby is amended to read as follows: "RESOLVED that C~valiere Electric Contracting, Ltd., 28 Kejaor Court, Centereach, New ~ork be and hereby is awarded the contract for the electrical Construction for the Senior Citizen and Youth Center at the net bid price of $15,176.00" Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen, Justice Suter. Absent: Supervisor MArtocch±a Councilman Pei1. This resolution was delcared duly adopted. On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that Deputy Supervisor Homan be and he hereby is authorized to enter into a contract, on behalf of the Town of Southold, with Holzmacher, McLendon and Murrel!, PoC. for a separate facility report incorporating Scavenger Wastes and Septic Tank Management as part of the Facility Plan (201 Waste Water Study) being developed for the Town of Southold/Village of Greenport in order to meet the requirements of its State Pollution Discharge Elimination System Permit, at a cost to the Town of Southold of $3,897.00 Vote of the Town Board: Ayes: Councilman Drum, DePuty Supervisor Homan, Justice Doyen, Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resoltuion was delcared duly adopted. On motion of Councilman Drum, seconded by Justice Doyen, it was RESOLVED that Deputy Supervisor James Homan be and he hereby is authorized to enter into a contract~ on behalf of the Town of Southold with Briarcliff Landscape, Inc. for the 1979 land and shrub program at Southold Town Police Headquarters; and the 1979 land and shrub program at the Southold Town Hall. On motion of Justice Doyen, seconded by Justice Surer, it was RESOLVED that the following items be included in the 1979 Fishers Island Ferry District Budget: Increae estimated revenues, New York sta~e Department of Transportation - $34,269.75; Increase appropriations, Repairs to Docks and Buildings (Dolphins) - $34,269.75. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homart, J~stice Doyen, Justice Suter. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared duly adopted. On motion of Councilman Drum, seconded by Deputy Supervisor Homan, WHEREAS, the Town Board concurs with the recommendation of the Chief of Police following a hearing held by the Chief of Police charging Sergeant Barney P. Harris with a violation of rule and regulation RR-4 Paragraph II, Subdivision c in regard to sick time and recommending upon the agreement of Sergeant Harris to waive a disciplinary hearing before the Town Board and agreement to accept the recommendation of the Chief of Police for a forfeiture of two days time off, such forfeiture to be arranged and scheduled by the Chief of Police, now, therefore, be it RESOLVED that Sergeant Barney Pi Harris be forgeited two days time off and that same be arranged and scheduled by the Chief of Police. Vote of the Town Board: Ayes: Councilman Drum, Deputy Supervisor Homan, Justice Doyen. Justice Surer. Absent: Supervisor Martocchia, Councilman Pell. This resolution was declared duly adopted. Mrs. Gladys Csajko, G~e~nport, asked about the increase in the amount of the contraCt?prices for the Senior Citizen and Youth Center.---Town Attorney Taske~ stated that what happened is that when the original bids were received the architect got together with all the bidders and some of them he told the Town indicated to him that they would reduce their bid, so at the previous meeting the Board passed resolutions accepting the reduced bid. When we got to signing the contracts all of the bidders said, no, we didnt~ really agree to that, we talked ~bout it, but we didn't agree to it, and said they stood by their original bid. It makes a difference of something like $2,500.00 to the total cost. There is sufficient funds on hand to build the building. Mr. Dave Abatelli asked when the construction will start?--Town Attorney Tasker said he thinks the general contractor said as soon as the frost is out of the ground and he can pour concrete. He w~ll need three weeks to get the building up. Mr. Charles Hickey, Southold asked the fugure for landscaping the police station and town hall---Deputy Supervisor Homan said he has figures. This does not include maintenance of the lawn or cutting the grass, this is for spraying of shrubs, lawn, fertilizing. For the Town Hall the figure is $453.00, and for the police station the figure is $299.00. Mrs. Marie Johnson, Southold asked about the financing the Senior Citizen and Youth Center, stating that there will only be about $6,000. left over after the contractors have been paid, how will that cover everything else that must be done in the building?--- Deputy Supervisor Homan stated that this a a turn-key operation and almost everything inside the building is covered, with the exception of tables, and chairs; movable pieces of furniture. The kitchen will be finished, the rugs will be there, the stage, and so forth.---Justice Suter stated that the Town has an application in for $60,000 more under the Small Cities grant, and if we get that we will be in good shape.---Mrs. Johnson said that it appears to her that we will not be facing a bond issue.---Deputy Supervisor Homan said he personally would not have agreed to a Senior Citizen Youth Center if there had been any thought of a bond issue.---Mr. William Weinheimer asked what the estimates for the annual maintenance cost for the building will be?---Deputy Supervisor Homan said those figures have not-be~n prepared. On motion, of Justice Surer, seconded by Councilman Drum, it was RESOLVED that there being no further business to come b~fore this Town Board meeting adjournment be called at 3:35 P.M.
