HomeMy WebLinkAboutTB-02/06/1979222 SOUTHOLD TOWN BOARD February 6, 1979 MORNING SESSION Mr. David Spohn, Orient, and Mr. John Duell, East Marion, spoke to the Board relative to the airport study, Mr. Spohn is a member of the ~Airp0~t Committee. Councilman Drum said the committee will have a report by the first of March. A regular meeting of the Southold Town Board was held on Tuesday, February 6, 1979 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James Homart Justice Martin Surer Councilman Henry W. Drum Councilman William R. Pell III Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Terry Absent: Justice Francis T. Doyen On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the minutes of the January 23, 1979 and January 30, 1979 Southold Town Board meeting be and hereby are approved as submitted. Vote of the Town Board: Ayes: Councilman Pell, Councilman DmU~, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Drum, seconded by Councilman Homart, it was RESOLVED that the next regular meetin~ of the Southold Town Board will be held at 3:00 P.M., Thursday, February 22, 1979. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent': Justice Doyen. This resolution was declared duly adopted. The audit will be completed during the recess of this meeting. On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the January 1979 reports of the Supervisor, Town Clerk, Building Department, Assessors, Police Department, Dog Warden, Bay Constable, Highway Department, Fishers Island Ferry District and Justice Suter, be and hereby are accedpted and ordered placed on file~ Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Surer, Supervisor Martocchia. Absent: Justice Doyen. This resolation was declared duly adopted. Supervisor Martocchia: t. Receipt of a negative declaration and notice of ~mplete ~ application from the New York State Department of Environmental Conservation upon application of Marian B. Pell, Greenport, for permission to construct a timber dock and dredge in front of bulk- head at Atlantic Avenue, Sterling Basin, Greenport. Comments will be received until February 21, 1979. (.Councilman Pell stated that Marian B. Pell is his wife.) 2. Application to the Corps of Army Engineers by Richard Greene for permission to install a ramp and attached floating pier at Jockey Creek, Seln Road, Southold. Objections will be received until February 12, 1979. 3. Receipt of a resume from James C. Henderson, Nassau Point Road, Cutchogue for consideration on' the Board of Assessment Review. Letter from the Matti~uck Fire District asking that they be notified if and when the low band police car radios are disp6sed of.---The same request has been made by the Orient Fire District. 5. Letter from the Floyd Memorial Library, Sou~hold Free Library, Cutchogue Free Library and Mattituck Free Library asking when a meeting can be arranged between the libraries and the Town Board to discuss their 1980 budget.---A date will be set for March. 6. Letter from the U.S. Department of Housing and Urban Development inviting a Section 8 Existing Housing Program Application for Fiscal Year 1979. This program is to engage or assist in the development or operation of housing for low-income families.---The Board is not interested in submitting such an application. 7. Receipt of a letter from ~he New YORK State Department of Transportation to Dr. J.J. Callis, Director of the Plum Island Animal Disease Center relative to a study of the se~ wall between Orient and East Marion. They state they are developing a project to make major repairs to the entire length of the sea wall and are porposing to resurface Route 25 in that area, as w~tl as resurface the parking area between the road and the sea wall, and improve the drainage in the area and reconstruct the shoulders on Route 25. This project should be under way in approximately one year.---If there is any immediate emergency the Regional Office will make repairs. 8. Letter from the New York State Department of Transportation that the pavement marking contract has been completed, with the exception of the railroad warning signs-~which will be ~rected at a futute date Under a separate contract. 9. Letter from the New York State Department of Environmental Conservation relative to the shellfish management program.---There is a meeting scheduled for 11:30 A.M. tomorrow with Mr. Hendrickson of Shellfish Management, the Town Board and Baymen's Association. 10. Letter from William J. Kranz, Sr. King Street, Orient relative to his 'feelings on a proposed full-service airport at Orient Point. 11. Receipt of a letter from Mrs. Mable P. Lytle stating a serious sight problem precludes the practicability of her serving another regular term on the Board of Assessment Review. Mrs. Lytle's term does not end until February 22nd. 12. Receipt of a resume from Margaret L. Conway for a position on the Southold Town Conservation Advisory Council.---The Board interviewe~ Mrs. Conway during the morning session. On motion of Councilman Drum, seconded by Councilman Homan, it was RESOLVED that Margaret L. Conway be an~ she hereby is appointed to the Southold Town Conservation Advisory Council for a two year term beginning February 6, 1979 and expiring February 6, 1981, to fill the vacancy Created by the resignation of John Mulhall. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Surer, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Drum, seconded by councilman ~oman, it was RESOLVED that the resolution appointing Margaret L. ~Cbnw~y to the Conservation Advisory Council to fill the vacancy created by resignation of John Mulhall, be amended to read: to fill the vacancy as the seventh member on ths Southold TOwn Conservation Advisory Council. Letter fro~ Andre MoraillOn, Ackerly Pond Lane, Southold, stating that since last November his property has been~flooded not less than four times because of ftooding on L'ow~r Road.---A copy of this letter ~has been transmitted to Highway Superintendent Dena. ' There has been considerable flooding in many areas of the Town and the Town is in the process of purchasing property ~or drainage purposes in three areas, and will purchase others w~en funds are available. Drainage has been made a part of the Small Cities Grant P~ogram application. 224 On motion of ouncilman Homan, seconded by Councilman Pell, it was RESOLVED that the Town Clerk be and she is hereby authorized to advertise for bids for the sale of the "Blue Bell" Police Boah, when specifications have been prepared. On motion ~ Justice Suter, seconded by Councilman Drum, it was RESOLVED that the Town Clerk be and she hereby is'authorized to advertise for bids for the purchase of two new outboard motors, installed, with warranty and maintenance within the Town, for %he Bay Constable Mako boat, when the proper specifications have been prepared. On motion of Justice Surer, seconded by Councilman Homan, it was RESOLVED that the House Numbering System as developed by the Southold Town Building Department, and presently being used by the Building Department, be and hereby is adopted as the official Housing Number~ ing System for the Town of Southold. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, Seconded by Councilman Dru, it was RESOLVED that the southold Senior Citizens be and they hereby are granted permission to contract for one bus at $173.00 to take them to the Nassau Coliseum for the Flower Show on March 7, 1979, providing the funds are available in the Senior Citizen budget. Vote of the Town Board: Ayes: Councilman Pell, Councilman Dr~Lm, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the Board of Commissioners of the Fishers Island Ferry District be and hereby are authorized to advertise for bids for the repair of the Yale Fork Lift, Model G51P-040-CRS-G. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Su%er, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Councilman Drum, it was RESOLVED that the Town Board of the Town of Southold requests the enactment of Assembly bill No. 1288, entitled "An ACT in relation to authorizing the governing, body of the Town of Southold to make certain permanent appointments for the position of police officer," and the Town Clerk to ocomplete the necessary forms and submit them to the New York State Assembly. Vote of the Town Board: Ayes: Couniccilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Councilman Drum, it was RESOLVED that the Town Board of the Town of Southold requests the enactment of Senate bill NO. 1002, entitled "An ACT in relation to authorizing the governing body of the Town of Southold to make certain permanent appointments for the position of police officer," and th~,'Town Clerk to complete the necessary forms and submit them to the New York State Senate. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice D~yen. This resolution was declared duly adopted. On motion of Councilman Drum, seconded by Justice Suter, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to write to the Department of the Army, Corps of Engineers, requesting a time schedule for dredging the Mattituck Inlet. Justice S~ter stated that he also feels the Coast Guard .should be contacted pertaining to the red buoy in Mattituck Inlet.,~ whfch he believes to be in the wron~ position and very dangerous... The Coast Guard should check it out and verify its location. Supervisor Martocchia: 14. Receipt of a letter from Dr. Joseph J. Lizewski requesting funds for the Peconic Soccer League, North Fork Zone.---This will be taken into consideration along with the other youth activities. Moved by Justice Suter, seconded by Councilman Drum, WHEREAS the Southold Town Board by resolution dated September 26, 1978 advertised for sealed bids for the general construction of a Senior Citizen and Youth Center, and WHEREAS on December 22, 1978 at 11:00 A.M. two sealed bids were received and opened for the plumbing contract and the firm of Metro Plumbing East, P.O. Box 347, Aquebogue, New York was determined to be the lowest responsible bidder, now, therefore, be it RESOLVED that Metro Plumbing ~ast, P.O. Box 347, Aquebogue, New York be and hereby is awarded the contract for the plumbing construction of the Senior Citizen and Youth Center at the net bid price of $10,240.00 and be it further RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to enter into a contract with Metro Plumbing East for the plumbing construction of the Senior Citizen and Youth Center, Peconic Lane, Peconic, New York. Moved by Justice Suter, seconded by Councilman PeI1, WHEREAS the Southold Town Board by resolution dated September 26, 1978 advertised for sealed bids for the general construction of a Senior Citizen ~nd Youth Center, and ~HEREAS on December 22, 1978 at 11:00 A.M. two sealed bids were received and opened for the elect~ical construction, and the firm of Cavaliere Electric Contractin~ Ltd., 28 Kejaor Court~ Centereach, New-York was determined to be the low~st responsible bidder, now¥ therefore, b~hit RESOLVED that CavaliereE~ectric Contracting Ltd., 28 Kejaor Court, Centereach, New York b~ and hereby is awarded the contract for the electrical construction for the Senior Citizen and Youth Center at the net bid price of $14,976.00, and be it further RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to enter into a contract with Calaliere Electric Contracting Ltd. for the electrical construction of the Senior Citizen and Youth Center, Peconic Lane, Peconic, New York. Councilman Drum reported on his airport committee- comprised of David Spohn., Franklin Bear, Henry Raynor and Councilman'Drum, They have met with the FAA and they have indicated that funds might be available but not immediately. The Tri-State Planning Commission is conducting a study at the present time on airport needs in the three states of New Jersey, New York, and Connecticut. It is' anticipated that their study will be completed within one year to 18 months, and at that time the needs of the area will be identified. The airport Committee has proceeded to look into~ costs, cost of land and a facility, not only for a new airport but the possibility of leasing. At this time the approximate land cost to meet the need of a faaility that would meet the FAA requirements would be about $500,000. The complete airport committee report will be completed by the end of February~ Mr. Charles Hickey, Southold asked if the Supervisor has anything new to report on the problem at the new wing?---Supervisor Martocchia stated the architect has not determined who is responsible as yet. the joint that was broken has been sent to a laboratory to be tested. The specifications did not call for the pipes to be wrapped, although it has not been determined whether the pipe was forzen or a bad conn- ection. All the insurance companies for the trades and the town's insurance company has been notified. The Town's insurance company states that we are not covered for extended damage such as occured.-- Mr. Hickey asked if ~y of the contractors for the new wing are involved in the Senior Citizen and Youth Center.?---Supervisor Martocchia stated that one is, and that is Metro Plumbing East, and he was one of the best ones on the whole project, very efficient. He brought up the point of wrapping the pipes to the architects. Mr. David Driscoll, Southold said the house numbering is not new, why are they doing it now?--~Supervisor Martocchia said that it is not new, but it was never formally adopted by resolution.---Mr. Driscoll asked if it is mandatory for every homeowner to now display their house number?~--Supervisor Martocchia stated it is not.---Justice Suter stated that this will aid the post offices who have given out numbers to people due to the fact the Town did not have an official numbering system. This will now close that gap. There was consider- able discussion on this subject. ~--~ Mr. D~iscoll spoke about the CATV hearing which will be held at iL~i 7:30 P.M. tonight. He asked the Board members to individually define a "public hearing". Councilman Drum responded, then Super- visor Martocchia asked Mr. Driscoll what point he wanted to ~ake as he is aware of what a p~blic hea~ing is.---Mr. Driscoll objected to Supervisor Martocchia speaking for the Board, and after considerable discussion Supervisor Martocchia ruled Mr. Driscoll out of order. On motion of Justice Surer, seconded by Councilman Drum, it was RESOLVED that a recess be called at 3:55 P.M. for the purpose o'f auditing bills, meeting to reconvene following the audit. During ~he recess the Board spoke With Robert Holzmacher and Brij M. Shrivastva, Solid Waste Manager of Hotzmacher, MeLendon & Murrell, the firm the Town has engaged to do the engineering services for the "Application of Approval to Operate a Solid Waste Management Facility." Mr. Holzmacher explained the scope of the project, which will include preparation of regional plan or map, preparation of vicinity plan or map, preparation of site plan, operating plan, plans of proposed facilities, future site utilization plans, existing~ conditions, projected waste generation, alternative courses of actio~i site analysis of the solid wastes management facility, operation, economic anaiysis and final site recommendations.---The group discussed the pros and cons of compaction, bailer, liners, transporting to other areas. Meeting reconvened at 4:55 P.M. On motion of Councilman Pell, seconded by Councilman Homan, it was RESOLVED that the following audited bills be and hereby are ordered paid: General Fund Whole T~wn bills in the amount of $49,187.29; General Fund Part Town bills in the amount of $45,419.94; Fishers Island Ferry District bills in the amount of $22,703.43; and Highway Department bills in the amount of $11,58t.52.
