SOUTHOLD TOWN BOARD January 30, 1979 A regular meeting of the Southold Town Board was held on Tuesday, January 30, 1979 at the Southold Town Hall, Main Road, Southold , New York. Supervisor Martocchia opened the meeting at 3:30 P.M. with the following present: Supervisor Albert M. Martocchia Justice Martin Suter Councilman James Homan Councilman Henry W. Drum Councilman William R. Pell III Town Attorney~Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk JuditbT. Terry Absent: Justice Francis T. Doyen Moved by Councilman Homan, seconded by Justice Surer, WHEREAS, the Town of Southold is eligible to receive HUD funds fr6m the U~S. Department of Housing and Urban Development (HUD~ under the Community Development Small Cities~ Program, and WHEREAS, the Town of Southold has previously received HUD Community Development funding through Suffolk County, under the Urban County Program, which is no longer being funded thereby excludin9 the Town from this source of funding, and WHEREAS, there are sever&l dligible physical dev~opment projects of interest to and needed~' by %he Town that may be funded by this program, now, therefore, be it R~SOLVED, that the Town Board of the Town of Southold hereby authorizes the preparation of an application for HUD Community Development funds, according to the HUD regulations, and be it further RESOLVED that th~ Southold Town Board hereby authorizes the Town Supervisor qo execute and fild said application, and in the event of approval by HUD, to execute th~ required grant agreement with the funding agency. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. Supervisor Martocchia advised that Item 2 on the agenda relative to the allocation of funds for construction of the recreation center has an amendment which is being worked out with the Village of Greenport at the-present time. ~The Boar~ will go into recess shortly and further review the resolution. Mrs. Jean Tiedke presented draft letter and petition for rehearing on the Jamesport LILCO plant which the Board has not had time to study. They will do this during %he recess. Moved by Justice Suter, seconded by Councilman Drum, WHEREAS, a serious drainage problem exists on Boisseau Avenue at or near its intersection with the Long Island Railroad right of way, and WHEREAS, PETER J. MEYER,'JR. and others are the owners of property on the east side of Boisseau Avenue and will sell a 40,000 square foot parcel thereof to the Town of southold for the sum of $7,500.00, and WHEREAS, this Board deems it in the public's interest that the Town of southold acquire said 40,000 square foot parcel of land for the 0 !97 219 purpose of constructing a recharge basin thereon to alleviate flooding conditions in the area. NOW, THEREFORE, BE IT RES©L~ED-;~tha~ '%he ToWn of Southold acquire the parcel Of land herein described from Peter J. Meyer, Jr., for sum of $7,500. and that the Supervisor be and he hereby is author- ized and directed to execute a contract for such purchase on behalf of the Town of Southold, said con~ract to be in such form as is approved by the Town Attorney. Said real property being described as follows, to wit: ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, Situate, lying and' being at Southold in the Town of southold, County of Suffolk and State of New York bounded and described as follows: BEGINNING at a point on the easterly line of Boisseau Avenue, 1395.96 feet northerly along said easterly line from the Main Road; said point of beginning being the southewsterly corner,s'Of land of Barzac; from said point of beginning running along said land of Barzac, 2 courses as follows: (1) south 87 degrees 29 minutes 50 seconds east 200.0 feet, thence (2) north 2 degrees 30 minutes 10 seconds east 112.51 feet to land of Knutson Marine Center, Inc. being also the southerly line of a 25-foot right of way; thence along said land of Knutson Marine Center, Inc, being along said southerly line of said 25 foot right of way, south 81 degrees 55 minutes 50 seconds east 96.70 feet; thence along t&nd of the party of the first part, 2 courses, as follows: (1) south 2 degrees 30 minutes 10 seconds west 203.13 feet; thence (2) north 87 degrees 29 minutes 50 seconds west 296.24 feet to said easterly line of Boisseau Avenue; thence along said easterly line, north 2 depress 30 minutes 10 seconds east 100 feet to the point of beginning. This resolution was declared duly adopted. On motion of Councilman Drum, seconded by Justice Suter, it was RESOLVED that application of John C. Tuthill dated January 29, 1979 for a renewal of his trailer permit on th~ east side Elijah's Lane Mattituck, New York be and hereby is granted for a six month period. Vote of the Town Board: Ayes: Councilman Pel~, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Mart0cchia. Absnet: Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that a recess be called at 3:50 P.M., meeting to reconvene in one hour. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. During the recess Councilman Drum made an airport committee report; the Board discussed the HUD small cities program with Kerron Barnes; Jean Tiedke spoke about the reopening of the Jamesport LILCO hearings; and Councilman Pell said he is going to look into the unauthorized dredging by Goldsmith's Boatyard. Meeting reconvened at 5:15 P.M. On motion of Councilman Pell, seconded by Justice Suter, it was RESOLVED that the Town of Southold retain the services of Kerron Barnes for the purpose of preparing the Preapplication for federal assistance under the Community Development, Sm~ll Cities program, Comprehensive Grant. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Surer, Supervisor Martocchia. This resolution was declared duly adopted. Vote of the Town Board: Ayes: Councilman Pell, Councilman Dr~um, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly ~dopted. Moved by Councilman Drum, second, ed by Justice Suter, WHEREAS~ the. V~llage of Greenport has funds remaining an its yeas II Community. Development PTogram in excess of $40,000; and WHEREAS, the Town of~S~uthold is in need of $40,000 in order to implement its year III Community Development Project, NO. ? '1,000- 2.19-521-02, Senior Citizen and Youth Recreational Center, be it therefore RESOLVED that the Syervisor of the Town of Southold is bereby authorize~ to amend the Town of Southold's Community Development contract with the Count of Suffolk, which will enable the County ot reduce the Village of Greenport's year II allocation by$40,000 so that in a subsequent contract amendment between the County of Suffolk and the Town of southold, he $40,000 can be added to the aforementioned ~r~ Southold Community Development Project. Vote of the Town.Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, ~pervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. Moved by Councilman Drum, seconded by Councilman Pell, WHEREAS, this Board heretofore adopted a resolution authorizing the amendment or the Community and Development contract between the Town and the County of Suffolk to allocate $40,000 of Community Development funds of the Village of Greenport to the Town of Southold to be added to the Town of Southodl Community Development Program for the construction efa Senior itizen and Youth Recreation Center, and WHEREAS, teh Village of Greenport, as a condition to its consent to such allocation, requires assurances in the form of an agreement with the Town of Southold, that the Town will, in the future, reallocate funds or render services to the Village in said amount, and WHEREAS, the Town Attorney and teh Village Attorney have prepared a proposed agreement to effectuate such reallocation to the Village which has been reviewed by' this Board. NOW, THEREFORE, IT IS RESOLVED that this Board does hereby approve said agreement, and it is f~ther RESOLVED that the Supervisor be and he is hereby authorized and directed to execute said agreement on behalf of the Town of Southold. On motion of Councilman Pell, seconded by Councilman Homan, it was RESOLVED that Supervisor AlbertM. Martocchia be and he hereby as authorized to sign a contract with the New York State Department of Labor for eight positions under the CETA IV program to work as data coll-ctors for the Board of Assessors: 1 clerical~ 6 hour day, at $6,567.00; six data collectors, 7 hour day, at $9,718.00; one supervasor, 7 hour day, at $9,955.00; with benefits amounting to $1,320.75, totalling $76,150.75. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Ma~tocchia. AbSent; Justice Doyen. This resolution was declared, duly adopted. Moved by Councilman Pell, seconded by Justice Surer, ~EREAS the Southold Town Board by resolution dated September 2~, 1978 advertised for sealed bids for the general construction of a Senior Citizen and Youth Center, and WHEREAS on December 22, 1978 at 11:00 A.M. four se&led bids were received and opened the form of Strathmore Construction Corp., 3680 Route 112, Coram, New York was determined to be the lowest responsible bidder, now, therefore, b~ it RESOLVED that Strathmore Construction ~orp., 3680 Route 112, Coram, New York be and hereby is awarded the contract for the general construction of the Senmor Citizen and Youth Center at the net bid price of $122,926.00, and be it further RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to enter into a contract with Strathmore Construction Corp. for the general construction of the Senior Citizen and Youth Center, Peconic Lane, Peconic, New York.
