January 2, 1979 ORGAN'IZ~TIONAL' MEETING A regular meeting of the Southo'ld Town Board was 'heild on Tuesday:; January 2', 1979 at the Southo'ld' Town Hall, Main Road, South~ld, New York. Supervisor Martocch±a opened the m~e~ing at 3:00 P.M. with the fol'lowing present: Supervisor Albert M. Mar~0cchia Justice Martin Suter Councilman James Homan Councilman Henry W'. Drum CounCilman William R. Pell, III Town Attorney Robert W. Tasker Town Clerk Judith T. Terry Absent: JustiCe Francis T. Doyen Mrs. Anna Hataier, Cutchogu~, New York, was sworn in as a Southold Town Trustee by Town Clerk Judith T. Terry. Supervisor Martocchia outlined the directi.ons of the Southold TowN Board for the.year 197~: "1. 'Supervisor Martocchia flew to Connecticut %ast Saturday ~o Yiew a n~w Qompactor at Chester. The Board is going to proceed further with their studies for a compactor in Southold Town. 2. Supervisor Martocchia is prepared to ask the Town Board for a full indepth study.,on full .valDation for the Town of Southold. 3. When the~airport study is completed by Councilman Drum, the Board will review it to determine whether expanded facilities are called fo~ in this Town. 4. Th~ study on a Firg.Code for the Town will be concluded shortly and a determination will be made. 5. A meeting is scheduled for this Thursday for a review of some of the ordinances pT~sently in effect. 6. A hearinq bas been ~cheduled f~r'.Janu~ry 23, 1979 to repeal the local law on SEQR, and neact a new local law. 7. Supervisor Martocchia stated they presently have the following dredging projects under consideration: The prime one is in Matti'tuck Inlet. The Board has been contact with the Corps.of Ar~:~ineers both in Riverhead and New York. Councilman drum stated that he spoke with the Engineers because on Thrusday several commercial fishermen in the Mattituck Inlet tried to get out of the Inlet and due to the sho~l~nq condition that has taken place since June of this year they were unable to get out. Also, Northville Industries who have barges and equipment that they use to service the large tankers is in Mattituck Inlet and it must be able to get out. The corps of Engineers said they would get a survey team out here immecidately to take soundings of the Inlet to ascertain the actual depth. On motion of Councilman Drum, seconded by Councilman Pell, it was RESOLVED that the Town Board of the'Town of Southold write a letter ~ to the~ Cgros of Arm¥.~Dqineers outlining the dangerou~ condition of the Mattituck Inelt. ~ Vote of the Town Board: Ayes: Councilman -Pell, Councilman Drum, Councilman Homart, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. Supervisor Martocchia (continuing goals for 1979: 7. (continued) - The other town creeks require ~eneral. maintenance. Of the following creeks, one is a ma]or pro]ect and that is the Norman E-. Klipp Marine .P. ark, Greenport (Gull Pond~, where the whole length must be dredged, approximately 900 feet. The others scheduled for 1979 are: Brush.es Creek, J.a~es.C~eek, Deep Hole Creek, Halls Cree~, West CTeek, ~ew Suffolk, School House Creek, Wickham Creek, Mud Creek, 5ittle Creek, Corey Creek, Golssmith Inlet, Cedar Beach inlet, Goose Creek, To~m Creek, Budd Pond, Mill Creek and Sterlin9 Basin.--- If there are others that are shallow, the Supervisor asked that he be notified so they can be considered. 8. Bids have been received for the Senior Citizen and Youth Center, Peconic. It appears the bids are high based on the money on hand to work with but the architects are studying possible deletions or substitutions to get the cost down. 9. The Town will go further on the street light extension program. It is possible the Board may have to go to a bond issue this year to continue the program. Under the present program a considerable savings has been realized~ 10. Due to the high cost of insurance premiums, all insurance policies held by the Town will be reviewed. There will be a meeting this month with the County Executive to discuss a comprehensive insurance ~plan for the County and Towns. 11. The new addition to the Town Hall is about completed and there is money enough on hand to pay all the bills. 12. The Town is in agreement with the firm of Holzmacher, McLendon, and Murrell to study so~ and scavenger waste and the program should be moving along rapidly now. 13. There is a project going on at the present time for illumination fo the rear parking lot at the Town Hall. There has been some vandalism which m£ght not have occured if there had been proper lighting. 14. There are several drainage projects which are under way. One at Duck Pond Road, Cutchogue and another on Boisseau Avenue, Southold. 15. Supervisor Martocchia said there is a very conservative budget for 1979 and he insists that all department heads stay within their allocation. On motion of Councilman Homan, seconded by Justice Surer, it was RESOLVED that the minutes of the December 26, ~78 Southold Town Board meeting ~ and hereby are approved as submited. Vote of the Town Board: Ayes: CoUncilman Pell, Councilman Drum, Councilman Homan, Justice Surer, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Pell, it was RESOLVED that the next regular meeting of the Southold Town Board will be held on Tuesday, January 9, 1979 at the Southold Town Hall, Main Road, Southold, New York at 3:00 P.M. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilamn Homan, it was RESOLVED that the following December 1978 reports be and hereby are ordered filed: Supervisor, Highway Departments Assessors, Town Clerk. Vote of the Town Board:. Councilman Pell, Councilman Drum, Councilman Homan, Justice Surer, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. On motion of Justice.Suter, seconded by Councilman Drum, it was RESOLVED that the application of George McCarthy dated December 28, 1978 for a trailer renewal permit on private road off the south side Main Road, Laurel, New York, be and hereby is granted for a period of six months. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Surer, Supervisor Martocchia. Absent: Justice Doyen. This resolution~-was declared duly adopted. Supervisor Martocchia: 1. Reciept of a notice of complete application from the New York State Department of Environmental Conservation by Mr. & Mrs. Thomas Occhiogrosso for a permit to construct a one-family dwelling and associated spetic tank on property located at lot 28, map of Corey Creek Estates, Corey Creek Lane, Bayview, Southold. Comments by January 17, 1979. On motion of Councilman Drum, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board set 4:00 P.M. o'clock, Tuesday, 192 January 23, 1979~ Southold Town Hall, Main Road, Southold, New Aork as time and place for hearing upon the application of John and Olivia Fellinger~I~ar for a permlt'~und~n tbs prov~on~ 'of~ Chapter 81 of the Code of the Town of Southold, S011 Removal, for permission to remove sand, gravel, stone or other materials form premises located at Duck Pond Road, Cutchouge, New.York, generally bounded north and east by Nick and Patricia Aliano,. south by Antone Harris and John Walters, and west by John Krupski. Any person desiring to be heard on the above matter should appear at the time and place above specified. Humsjo, attorney for Freeport Floors, the firm that installed the carpets in the TOwn Hall Addition, notifying the Town that they have not been paid their balance dUe of $3,200.00 by the general contractor Minnesota Construction Corp. 3. Letter from the United State Department of Interior stating that lot 28/108/2 south-of the municipal pier, New London, Connecticut has been nominated for listing in the National Register OF Historic Places. The Town Board objects to this designation and will ebter a protest to the Department- of Interior. 4. Receipt of a Suffolk County Department of Labor CETA agree- ment for one of the CETA employees working for the Town of Southold. On motion of Councilman Homan, seconded by Councilman Pell, it was RESOLVED that 7:30 o'clock P.M., February 6, 1979, Southold Town Hall, Main Road, S~outhold, New York, be and hereby is set as time and place for a public hearing by the Southold Town Board in the matter of the application of Long Island Cablevision Corporation (LICC) to consider the following proposals to amend the~cable franchise granted to it by the Town of Southold, to wit: PROPOSAL NU. 1 -- To increase ~ates as follows: P'r'es'ent Pr'o'posed Installation Charge ~30.00 $40.00 Reconnection Charge 9.95 15.00 Rellocation Charge 9.95 15.00 Additional Outlet Charge 9.95 15.00 Monthly Service Charge Residential - First Outlet 7.25 Residential - Additional Outlet2.00 Motel- Each Unit 2.00 8.05 2.50 3.00 PRO'PUSAL NO'. 2 - To authorize LICC to delete carriage of WPRI-TV, Rhode Island ~hannel 121; carry CBS on Channel 12; carry Home Box Office on Channel 2, in consideration for which LICC shall commit itself any one of the following options: .~ Ia) Reduce LICC's requested monthly service charge zncrease from $8.05 to $8.00 per month, or -(b) Construct CATV facilities in the Little Neek/Beebe Lane, New Suffolk Avenue and Depot Lane areas of the Town, and increase present monthly servzce charges to $8.05, or Cc) L/CC will commit itself to a three year construction program whereby it will construct more than szxty miles of CATV facilities to be available to 2,200 additional homes at a total construction cost in excess of $400,000.00, and to increase the present monthly service charge to $8.70. The areas to be embraced within the construction program are set forth on a construction program plan on file in the Town Clerk's Office. It is further, RESOLVE.D~ that the franchise amendments, if approved by the Southold town Board~ may not take 'effect without the prior approval of the New York State Commission on Cable Television and that interested parties may file comments or objections with the Commission, and it is further RESOLVED that the application of Long Island Cablevision Corporation for an amendment to the cable franchise granted tO it is on file in the Town Clerk;s Office, Main Road, Southold, New York, and is available for public inspection during regular business hours; and it is further RESOLVED that a repressRtative of Long Island Cablevzszon Corporation will be present at such hearing and all interested, persons will be given an opportunity to participate in said hearin~ and to ask 1979 questions of the representative of Long Island Cablevision Corporation. Supervisor Martocchia: 5. Resumes have been received from individuals interested in serving on various boards where terms of present members expire in January and February. Resumes will be received until Tuesday, January 9, 1979. There are vacancies on the Board of Assessment Review, Planning Board, Board of Housing Appeals. 6. Letter from Gary Flanner Olsen, attorney for Country Club Estates, Philip Babcock, owner, requesting the release of the~road performance bond. Reports must be secured from the Highway Committee, Highway Department, Town Engineer and Planning Board before action can be taken on this request. Moved by Councilman Homan, seconded by Councilman Pell, WHEREAS Section 22B of the Town Law allows the Town Board of any town having more than one assessor to establish the office of Chairman of the Town AsSessors, who in addition to his regular duties shall perform such services in connection with assessment and.taxation of property for State, County, and Town purposes as the Board shall direct, now, therefore, be it RESOLVED that Melville A. K~lsey, Jr. be and hereby is designated to hold the office of Chairman of the Board of Assessors until the first day of January next succeeding such designation, at the pleasure of the Town Board, ~nless otherwise provided for by law~ all in accordance with Section 22 B of the Town Law~ and be it further RESOLVED that the compensation for such appointment be fixed at $1,000.00 per year payable in regular semi-monthly payments. On motion of Councilman Homan, seconded BY Justice Suter, WHEREAS Section 123 of the Town Law provides that town officials and employees who receive and disburse monies of the Town shall account to the Town Board for all monies received and disbursed by them by the 20th day of January, and WHEREAS the Town Board deems it necessary to engage a public accountant to prepare the aforesaid annual account for all town officers and employees, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Southold engage the services of Elaine F. Kaldor, Certified Public Accountant, to make the annual audit of the books and records of officers and employees of the Town of Southold for the fiscal year 1978 at-!a contract fee of $2,000.00 Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum. Councilman Homan, JuStice Suter, Supervisor Martocchia. Absent: Justice Doyen. This resolution was declared duly adopted. Supervisor Martocchia: 7. Some of the names for vacancies are: Samuel Manarel, for the Board of Assessment Review, and William J. Erdmann for the Conservation Adivsory Council2 On motion of Councilman Pell, seconded by Councilman Drum, it was RESOLVED that the Town Clerk be and she hereby'is authorized to advertise for bids for No. 2 fuel oil for the Southold Town Hall, Main Road, Southold; Town Highway Department building, Peconic Lane, Peconic, and Justice Court building, Main Road, Cutchogue for the c&lendar year 1979. Specifications for such bids may be obtained at the Town Clerk's Office, Town Hall, Main Road, Southold, New York, and said bids will ~be opened and read aloud at 3:00 o'clock P.M. on the 24th day of January 1979. Notification has been received from Executive Insurance Company that a general liability insurance policy has been cancelled or not renewed for non-payment. Since the building has not been officially released to the Town of Southold the architects Greenman & Pederson Associates P.C. will be notified of this cancellation. On motion of Justice Surer, seconded by Councilman Homart, it was RESOLVED that Raymond E. Latham an employee Of the Disposal Area, Cutchogue for amny years, will retire effective January 14; 1979, and it is Ordered that he be paid monies accrued and due to him as per the CSEA ~contract. Ma~rtO!cchia:.~ 9. Follow-up on a letter from Orient Fire Commissioners relative to request for radio units. The police Department is going to a new system. However, many of the radios are leased, a few are owned. Orient would like to have access to the ones owned by the Town. This matter is still open. 10. Supervisor Martocchia announced that PBA and CSEA have no contracts as of this date., therefore there will be no salary ~ncreases other than increment steps due certain empt6yees. Moved by Justice Surer, seconded by Councilman Drum, WHEREAS it is required by Section 27, subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be apyable, now, therefore, be it RESOLVED that Robert W. Tasker bs and he hereby is appointed Town Attorney for the Town of Southold at a salary of $20,000.00, and he shall hold such appointed office at the pleasure of the Town Board unless otherwise provided for by law, ahd be it further RESOLVED that this salary be effected as of January 1, 1979, and the same shall be paid in regular semi-monthly payments~ and be it further RESOLVED that the Town Clerk be instructed to file such certificates with the proper parties as are required by Section 30, Subdivision 3 of the Town Law. On motion of Councilman Homan, seconded by Councilman Pell, it was RESOLVED that the area known as 67 steps at the north end of Sound Road, Greenport, New York be and hereby is closed from the public until further notice for the purpose of reconstruction.of the area. (Supervisor stated that the 67 steps area has been the site of a tremendous amount of Vandalism. The steps have been completely destroyed, the street lights, including the fixtures have been shot out (costing approximately $75~00 per fixture) three times in three months. Until spring a barrierrmust be posted keeping the public out.) On motion~of Councilman Homan, seconded by Supervisor Martocchia, it was RESOLVED t~hat John Wickham be and he hereby is appointed Chairman of the Southold Town Planning Board for the year 1979. Item XIII (ii) refers to a meeting with a representative of the L.I. Traveler to discuss legal advertising charges. Councilman Drum reported that he had a telephone call from the C6rps of Army Engineers during this meeting, and the Chief of the Navigation Branch stated the Army Engineers will dispatch a survey team to commence sounding surveys on the entrance of the Inlet, first th±ng Monday, January 8, 1979.
