Box 1179, 54375 Main Road Southold, New York 11971 Re: Zoning Change George Braun Oyster Co, Inc. 30840 Main Road, Cutchogue,New York 11935 SCTM No. 1000-103.00-01.00-001.000; 1000-103.00-01.00-002.000; 1000-103.00-01.00-003.000 Please be advised that we represent George Braun Oyster Co, Inc. in connection the re-zoning of the company's property from General Business to Corridor Business (CB). The company started over 100 years past as a wholesale/retail business buying aquatic good from local fishermen, then selling the product to residents and restaurants, which it continues to this day. There are three (3) separate retail operations at the site: Sale of seafood to residents, sale of prepared meals for consumption on site, and retail sale of non-seafood. Retail use should be a permitted use in the proposed Corridor Business Zone, or the Zone should remain General Business. The proposed zoning change to CB Section 280-22 Corridor Business states, "The purpose of the Corridor Business (CB) District is to provide non-retail commercial development outside hamlet centers . . ." Hence, the George Braun Oyster Co. and other businesses similarly situated in such a zone would become non-conforming uses. Presently, there are no commercial operations in the proposed CB zone in Cutchogue, except for Brauns, which engages in commercial and retail operation. 1 Limiting retail establishments to the Hamlet Centers is short sighted because of the lack of public sewage, code required parking requirements, and Health Department regulations prohibiting retail operations at the small parcels of land in our Hamlets. The idea works well in theory if you were to plan the layout of a new Town, but it does not work not in the historic Town of Southold. For example, where would a retail operation like King Kullen locate in the Hamlet of Cutchogue? With parking already a major issue in Cutchogue Hamlet, where would people park vehicles if all retail operations were only located in the Hamlet? Where is the sewage being treated for the proposed new retail operations in the Hamlet. As you know, Southold Town is primarily a farming and resort bedroom community, as opposed to our neighboring Town of Riverhead. I would hope that it is the goal of the Town Board and the residents of Southold Town not to promote exclusively commercial operations along the Main Road of Cutchogue. It would undermine the work and effort of our elected officials over the last 185 years to maintain our rural community by purchasing development rights, restricting development, cluster zoning,promoting farming and aquaculture, and all the other initiatives over the years. Further,the zone change would cause immeasurable financial harm to George Braun Oyster Co, Inc., and the people it employs. Please consider the above. Thank you for your time and consideration.
