The Planning Department is conducting the Zoning Update for the Town, and any changes to the
Town Code will be adopted by the Town Board. I forwarded your email to them.

Zoning Board of Appeals Authority:
The Zoning Board of Appeals is a quasi-judicial body, consisting of five members appointed by the Southold
Town Board. The ZBA is authorized under New York Town Law to hear appeals of applications that have
been reviewed and issued a denial (Notice of Disapproval) by the Building Inspector under Chapter
280 (Zoning) of the Town Code. One of the basic powers given by law to a Zoning Board is the “variance
power”, whereby the Board may “vary” or modify the strict letter of a zoning ordinance or local law. The
Board cannot amend or create zoning regulations; that legislative power resides with the Southold Town
Board.
The ZBA also has original jurisdiction to consider uses specifically permitted under Chapter 280 (Zoning) by
Special Exception application, such as Accessory Bed and Breakfasts, Accessory Apartments in an
Accessory Structure, certain commercial uses, motels, inns, and other specifically referenced uses, when all
requirements referred to in the Town Code and New York Town Laws have been met.

I am the owner of 41155 CR 48 and my mother is the owner of 41095 CR 48.
Currently, these two properties are zoned as Limited Business.
The proposed zoning code would change them to the proposed RURAL BUSINESS II.
This new zone will have LESS uses than Limited Business.
As business owners in the Town of Southold since 1968, we are NOT in agreement with this change, as it may
directly impact our continued and future business operations.
We currently employ 13 local individuals and are a key supplier to numerous Long Island businesses. This
change in zone may not only impact our operations, but those of other Long Island businesses.
We ask that you not adopt the zoning code RURAL BUSINESS II in our area.
