Subject:accessory uses in accessory structures
Hi Mara,
As we discussed, here are some of the accessory uses in detached structures that are accessory to a principle
dwelling , (such as barns, detached garages, sheds etc.) that the ZBA would like to see explicitly listed as
permitted in the new town code. Currently the draft code lists accessory structures and uses in 280-41 B on
page 57and says that "accessory uses not listed herein may be permitted if the Building Inspector deems it to
be customarily incidental to a permitted principal use." This is not objective and depending on which Building
Inspector is doing the interpretation, could be subjective and arbitrary and leave the Town open to litigation.
The Board of Appeals thinks these should be clearly stated as permitted:
1. personal home artist studios (for homeowners use only, no gallery type viewing/exhibits or sale open to the
public).
2. personal home workshops ( auto mechanic, carpentry, crafts, with same restriction as above, i.e. for
personal use only without any sales from the premises)
3. Personal home gyms/fitness workout space (no classes for the public etc.)
4. personal home offices (again just for the home owner's use, and not the same as in RO where an
accountant could have an office inside their home where they could meet with clients as an
occupation/business use)
