The subject parcel is a non-conforming 11,353 SF lot in the R-40 zoning district located on the corner of Rochelle Place and Bay Avenue in Mattituck. The lot is only 60' wide and therefore non- conforming in width and the house sits off center on the parcel such that a portion of its footprint lies just .3 feet from the side property line. The project contemplates an 837 SF second story addition with a small upper-level balcony at the back end of the house and open porch additions on the lower level. The proposed footprint would maintain the pre-existing non- conforming side yard setback of .3 feet where a 10-foot side yard setback is required under Town Code Section 280-124 on lots measuring up to 20,000 square feet in total size. This nonconformity makes compliance with the sky plane regulation impossible, thereby necessitating relief from the requirements of Section 280-208. The proposed construction is otherwise conforming to the front, rear and combined side yard setback requirements in Section 280-124. Although the proposed construction is conforming to the required lot coverage, the proposed second floor addition will add 837 SF bringing GFA to 2,605 SF which is 335 SF above the allowable GFA of 2,269 SF. The surrounding neighborhood consists of one- and two-story homes varying in size on differently sized lots. Rochelle Place is the gateway to a community of larger waterfront homes and many of the homes on the east side of Bay Ave in the vicinity of the subject premises have been significantly enlarged and renovated. In contrast, the west side of Bay Avenue is characterized mainly by smaller dated homes, which, similarly to the Applicant's home, require renovation. It is noteworthy that while the west side homes are currently smaller than the Applicant's proposed home, the average of the allowable maximum GFA for those homes is 3,056 SF. The average of the existing GFAs for the homes on the east side of Bay Avenue is 2,812 SF (207 SF more than the proposed) and the average of the allowable GFAs for the homes on the east side of Bay Avenue is 4,998 SF. For the following reasons, the Applicant submits that variances from Section 280-124 are warranted. Received 1. The existing dwelling on this property is an eyesore in desperate need of renovation. The Applicant submits that the granting of the requested side yard, sky plane and GFA variance relief to permit an aesthetically pleasing second floor addition to this home within its pre-existing, non-conforming footprint will not result in any undesirable change in the neighborhood and the renovated home will be entirely in character with many of the surrounding homes along Bay Avenue and Rochelle Place. It is noteworthy that the Applicant also owns the adjacent parcel to the south and therefore the side yard relief will be of no detriment to that property. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The Applicant is seeking the benefit of expanded and upgraded living space to meet the needs of 21st-century living. While they are proposing to renovate the residence substantially within the existing non-conforming footprint, the advent of GFA regulations and the pre-existing non-conforming side yard setback trigger the need for variance relief. There is no way to construct a second-floor addition to this home within the sky plane with a .3' side yard setback. 3. The amount of relief requested is not substantial because: The Applicant submits that while the magnitude of relief sought for side yard relief may be mathematically substantial, it is not practically substantial since the construction is confined to the existing footprint. The sky plane relief is mitigated by the Applicant's ownership of the adjacent parcel and location of the structures thereon significantly south of the common boundary line. As for GFA, the Applicant submits that the 14.8% relief requested is not substantial since the proposed GFA is well within the average of the existing and allowable CFAs on homes on the east side of Bay Avenue and the proposed construction is in character with the surrounding neighborhood where lot widths, areas and the mass of neighboring homes vary substantially. The granting of variance relief will not have an adverse impact on the physical conditions in the neighborhood and will permit the construction of a two story home that is entirely consistent with the size and character of neighboring homes. In addition, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. S.
