Duryea Jr. State Office Building, 250 Veterans Memorial Highway, Room 4A9A, Hauppauge, New York, 11788, on Thursday, May 15, 2025, and upon all other papers in this matter,the Board makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT This petition pertains to an existing, detached, one-story, one-family dwelling of wood frame construction, located at 515 Gin Lane,Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 19 NYCRR, Part 1220, Ref. 2020 Residential Code of New York State, Section R310.1 which requires that, Basements, habitable attics and every sleeping room shall have not less than one operable emergency escape and rescue opening. Where basements contain one or more sleeping rooms, an emergency escape and rescue opening shall be required in each sleeping room. Emergency escape and rescue openings shall open directly into a public way, or to a yard or court that opens to a public way. (The petitioner wishes that a side hinged door in the garage be allowed to serve as the emergency escape and rescue opening for a basement recreation room at the garage level and is appealing the code official's determination in this matter) FINDINGS OF FACT 1. The dwelling that is the subject of this application has a basement with a two-car garage. NEWYORK Department STATE OF OPPORTUNITY_ Of State Petition No 2024-0545 Page 2 2. The basement with a habitable recreation room and non-habitable spaces is located adjacent to and intercommunicates with the two-car garage at the basement level via a doorway.The basement intercommunicates with the main living floor above via an interior stairway. 3. The basement does not have a bedroom. 4. A side-hinged door located on the outside wall of the basement garage allows walkout access to grade. 5. The Code Official with jurisdiction believes that the noted side-hinged door located in and providing immediate access from the garage cannot serve as an emergency escape and rescue opening (known as an EERO)for the habitable basement. He is supported in this by an opinion letter from the Department of State dated June 5, 2024. 6. Section R310.1 of the 2020 Residential Code of New York State states,"Where basements contain one or more sleeping rooms, an emergency escape and rescue opening shall be required in each sleeping room." It only indicates here that an EERO needs to be located in each sleeping room. It is not uncommon for a basement EERO for a recreation room to be located in an adjacent basement room. 7. Section R310.1 of the 2020 Residential Code of New York State also requires that, "Emergency escape and rescue openings shall open directly into a public way, or to a yard or court that opens to a public way." It doesn't require that the EERO be located directly from habitable basement rooms aside from bedrooms. 8. 19 NYCRR Section 1205.4(c)states that in cases before a regional board of review on appeal, the board may fashion suitable remedies so as to do justice among the parties, including but not limited to: (1)where an order or determination has been made; sustaining, reversing, or modifying, in whole or in part, such order or determination. 9. The board considers the layout as described to be code compliant with respect to R310.1 of the 2020 Residential Code of New York State if there is no bedroom in the basement. 10. The board has concerns that an egress path through a garage could be hazardous and recommends that that emergency lighting be installed in the garage with a striped, dedicated, Petition No 2024-0545 Page 3 unobstructed path to the existing side-hinged EERO door in this matter. Alternatively, an EERO could be installed directly from the habitable room in the basement. CONCLUSIC) _�2EIAW In view of the above findings, the Board sustains the appeal in favor of the Petitioner and therefore reverses the determination of the Code Enforcement Official. The granting of this appeal will not substantially adversely affect the Uniform Code's provisions for health, safety and security. DETERMINATION WHEREFORE IT IS DETERMINED that this application appealing the determination of a code enforcement official with respect to 19 NYCRR Part 1220, Section R310.1, is hereby GRANTED in favor of the petitioner.
