The dwelling is located at 2740 Deep Hole Dr., Town of Southold, County of Suffolk, State of New York. Relief is requested from: 19 NYCRR Part 1220,The 2020 Residential Code of New York State,Section R326.4.2.1, Compliance, provided as follows: The top of the barrier shall be no less than 48 inches(1219mm)above grade measured on the side of the barrier that faces away from the swimming pool. The vertical clearance between grade and the bottom of the barrier shall be not greater than 2 inches(51 mm) measured on the side of the barrier that faces away from the swimming pool. Where the top of the pool structure is above grade, the barrier may be at ground level, or mounted on top of the pool structure. Where the barrier is mounted on top of the pool structure, the barrier shall comply with Sections R326.4.2.2 and R326.4.2.3 [The petitioner requests having a pool barrier with heights less than allowed.] FINDINGS OF FACT 1. Top of the glass pool barrier is 42 inches from patio where 48 inches is required. 2. Bottom of the barrier is 3 inches from patio where 2 inches is required. 3. The glass barrier is 48-72 inches from the final grade and walkway. 4. Glass railing hardware set back is 4 inches from the edge of the patio, necessary for the strength of the glass rail barrier and the hardware. 5. Code official supports the granting of a routine variance by the Department of State in this matter. INEDepartment W YORK STATE AT E lof State Petition No. 2024-0574 Page 2 CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety, and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties, economic hardship, or would otherwise be unwarranted because such would be unnecessary in light of alternatives which,without a loss in the level of safety,achieve the intended purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, The 2020 Residential Code of New York State, Section R326.4.2.1, Compliance, be and is hereby proposed to be GRANTED with the following conditions: 1. That pool alarms be installed to deter unauthorized entry into the pool area and sound both inside and outside the dwelling. 2. That periodic inspection of the pool barrier is conducted for any damage or potential issues. 3. That in all other respects the applicable requirements of the Uniform Code shall be satisfied. This DECISION is issued under 19 NYCRR 1205.5 unless objected to by the petitioner in a writina received by the department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
