Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): --SEE ATTACHED ADDENDUM-- WETLANDS PERMIT APPLICATION ADDENDUM FOR 8100 INDIAN NECK LLC 8100 INDIAN NECK LANE PECONIC,NY SCTM#1000-86-7-9 STATEMENT OF EFFECT The subject property has been stabilized and protected from erosion by a concrete seawall and return since prior to 1963, but during the past two years, wave energy has severely eroded the adjacent Town road end, exposing drain pipes on the beach (see Figure 3), and eroded and undermined the naturally vegetated embankment landward of the existing seawall return on the subject property, resulting in the loss of soils, a tree, and other vegetation(see Figures 1 and 4). The application therefore proposes an approximately 10 if extension of the existing seawall return with a vinyl bulkhead return, which can be located just inside the applicant's east property line, to enable the restoration and revegetation of the naturally vegetated embankment and its protection against continued flooding and erosion. The proposed armor stone along the toe of the return, which would function to dissipate incoming wave energy, will be located partially on Town property at the adjacent road end, and it is anticipated the stone will ultimately tie into a stone revetment structure to be installed at the road end by the Town of Southold, whose permission is required for implementation of the project. Once the return is installed,the eroded embankment area behind it can be restored with clean sandy fill and planted with native vegetation. Given the site's exposure to the adjacent fetch of Hog Neck Bay and the severity of the potential erosion demonstrated by the existing site conditions, not just at the subject property but at the adjacent road end,it is clear that the erosive loss of upland is being caused by incoming wave energy, not by runoff or other mitigatable upland sources, and that a "soft" stabilization solution such as coir logs and/or sand replenishment alone would be insufficient and designed to fail. Therefore, without an extension of the return, the subject embankment would remain exposed to further flooding and erosion, thus creating increased risk not only to the subject upland but to the adjacent Town road end. And the project can be implemented without causing adverse impacts on the surrounding beach or adjacent property, and without interfering with public access along the beach, because 1) it will be located entirely landward of spring high water; 2)the proposed armor stone, a nature-based feature, would dissipate wave energy; 3) the project is designed to vegetatively restore and protect the naturally vegetated embankment; and 4) the project will ultimately become integrated with the Town's effort to restore and protect the adjacent road end, apart of the Town of Southold's infrastructure that provides public access to the adjacent beach. 11Page The project is therefore consistent with the general standards for permit issuance set forth in Section 275-12 and with the specific construction and operation standards set forth in Section 275- 11(B). See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. i ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR 8100 INDIAN NECK LLC 8100 INDIAN NECK LANE PECONIC,NY SCTM#1000-86-7-9 POLICIES 4, 6 & 9 The subject property has been stabilized and protected from erosion by a concrete seawall and return since prior to 1963, but during the past two years, wave energy has severely eroded the adjacent Town road end, exposing drain pipes on the beach (see Figure 3), and eroded and undermined the naturally vegetated embankment landward of the existing seawall return on the subject property, resulting in the loss of soils, a tree, and other vegetation(see Figures 1 and 4). The application therefore proposes an approximately 10 if extension of the existing seawall return with a vinyl bulkhead return, which can be located just inside the applicant's east property line,to enable the restoration and revegetation of the naturally vegetated embankment and its protection against continued flooding and erosion. The proposed armor stone along the toe of the return, which would function to dissipate incoming wave energy, will be located partially on Town property at the adjacent road end, and it is anticipated the stone will ultimately tie into a stone revetment structure to be installed at the road end by the Town of Southold, whose permission is required for implementation of the project. Once the return is installed,the eroded embankment area behind it can be restored with clean sandy fill and planted with native vegetation. Given the site's exposure to the adjacent fetch of Hog Neck Bay and the severity of the potential erosion demonstrated by the existing site conditions, not just at the subject property but at the adjacent road end,it is clear that the erosive loss of upland is being caused by incoming wave energy, not by runoff or other mitigatable upland sources, and that a "soft" stabilization solution such as coir logs and/or sand replenishment alone would be insufficient and designed to fail. Therefore, without an extension of the return, the subject embankment would remain exposed to further flooding and erosion, thus creating increased risk not only to the subject upland but to the adjacent Town road end. And the project can be implemented without causing adverse impacts on the surrounding beach or adjacent property, and without interfering with public access along the beach, because 1) it will be located entirely landward of spring high water; 2)the proposed armor stone, a nature-based feature, would dissipate wave energy; 3) the project is designed to vegetatively restore and protect the naturally vegetated embankment; and 4) the project will ultimately become integrated with the Town's effort to restore and protect the adjacent road end, a part of the Town of Southold's infrastructure that provides public access to the adjacent beach. 1 Page The project is therefore consistent with the general standards for permit issuance set forth in Section 275-12 and with the specific construction and operation standards set forth in Section 275- 11(B).
