TERMS AND CONDITIONS The Permittee Klein Family Trust, 2155 Laurel Way, Mattituck,New York as part of the consideration for the issuance of the Permit does understand-and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all, damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be'subject to the inspectipn and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of-the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. We understand that the Trustees require that any tree taken down within their jurisdiction is to be replaced at a minimum of 1:1,and we support the intent of maintaining vegetation cover and ecological function. Due to the site's specific ecological conditions and development goals,we respectfully propose a modified replanting strategy that includes tree replacement coupled with the introduction of a diverse native shrub layer. Organic matter plays a key role in nutrient cycling and,therefore,soil health, plant health, and ecosystem stability. The introduction of native shrubs will also promote natural forest regeneration on the property by creating favorable microhabitats for native tree seedlings at the ground layer. Therefore,the creation of a natural litter layer will assist in improving the ecological integrity of the site. In addition to the habitat value native shrubs provide,they also play a critical role in stabilizing soil and preventing erosion. Native woody shrubs have fibrous root systems that reduce sediment displacement during heavy rainfall or flooding events. The vast root systems will support infiltration by allowing water to absorb into the ground rather than flowing down the sloping property into Laurel Lake. Native shrubs are critical for capturing and breaking down excess nutrients like nitrogen and phosphorus before they enter surface and groundwater systems. The introduction of native shrubs would significantly improve the site's ability to protect and enhance local water quality. In short,the introduction of a shrub layer would contribute to ecological resilience and biodiversity of the subject parcel and, more widely,the Town of Southold. SCTM# 1000-121-4-20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the LWRP policies 5 and 6. 1. The pool in its current location will sit in the groundwater. The test hole was dug at a much higher elevation near Crescent Way. 2. The grading proposed on the property will impact drainage patterns and vegetation in this Critical Environmental Area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
