passed by the Southold Town Planning Board at their regular
meeting held on February 7, 1972:
"IT WAS RESOLVED that the Southold Town Planning Board
grant final approval to the proposed minor subdivision of
Michael Zukas, property located at N/S Bayview Road, Southold,
New York (as shown on survey dated March 10, 1969 by Otto
Van Tuyl), subject to presentation of the following:
1. Three (3) copies of final map.
2. Two (2) copies of formal application.
3. Application fee of $50.
As all of the above mentioned items have been received
by the Planning Board, the maps were signed by the Chairman
at a meeting of the Planning Board held on March 7, 1972.

This is a re-division of lots found on a map prepared for Michael Zukas and
approved by the Southold Town Planning Board Feb 7, 1972 liber 8355 page
181.
Dear Ms. Scopaz:
I have spoken with Robert Kassner on several occasions recently, and prior to
that I spoke to Craig Turner who is no longer with you. Last week Robert said I
should send you this letter explaining what we want to accomplish with this
property.
My wife and I purchased the property in question this past August. Your
department should have this on file as the Michael Zukas sub-division noted
abpve.
That Southold approved sub-division calls out 5 building lots, 2 waterfront arid
three inland. We cannot leave it that way, as the SC Health Department requires
a minimum 40000 sq. ft per lot in this area, So, we are proposing that we reduce
the site to 4 lots from 5. I have enclosed a copy of the most recent survey that
details the existing (dotted) and proposed (solid) lot lines. Also shown are the
surrounding properties and wellheads. To me it appears clear that two proposed
inland lots are not a problem, nor is the waterfront tot number "Four". My main
question involves the lot number "Three" water front parcel, most northerly on the
survey. I also request your insights on all of the other lots in anticipation of my
submitting a formal request for approval of tot line changes and whatever other
approvals you might require - please advise.
The zoning requires certain setbacks and side yards. As you see this proposed
lot "Three" is an odd shaped lot. It is the largest of the group at 48,477 sq, ft.
This is required to maintain safe distances between the placement of our septic
system and surrounding wells. (Note that we have been approved by the SCVVA
for a water main extension for these 4 lots).

In order that I can maintain the minimum 25 ft width of the access road I have a
property line which separates lot "Two" and "Three" of 170.15'. ~ am requesting
that that line be understood as the front yard property line. This is very much a
flag lot situation and as such I hope there is flexibility in the front line selection. If
this can be accomplished I will be able to situate a house facing SW and easily
maintain the combined 35' minimum side yard, and front and rear yard
separations. I will also maintain the proper property width (1501). If I must
consider the frontage on the access road the front yard I cannot maintain !he
175' depth requirement, if only by less than 4', nor can I have the 150' ft. width.
The placement of a home in the desired location wil~ enhance the view of lhe
water and maintain a nice separation of the homes. Also, please note, I would
like to maintain the rear of the house above the 10' contour line on lot "Three",
this will assist us in obtaining a letter of non-jurisdiction from the DEC as they are
not concerned with construction on property having a rise of more than 10' above
the water in these situations..
Finally, on proposed lot "One" which borders Main Bayview, I would like to situate
the house facing the access road and not Main Bayview is there any problem
w~th doing that?
I have enclosed a copy of the survey and penciled in my idea for situating the
house and the septic system. I hope this makes things more clear. Should you
have any questions feel free to contact me at the above numbers or address.
Also, your opinion on the whole layout of the Platt would be appreciated. Upon
receiving your review I Will make the applications you require. Please advise. I
