The new law provides that: "A State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical. dimensions of such tower or base station." Since this structure already supports communications equipment,it is considered a"base station"under Section 6409 AT&T's liention is an Ell, it Fad"litie s,11equest, under Section 6409, AT&T's application qualifies as an eligible facilities request under Section 6409 because the proposed installation involves"an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." As shown on the plans prepared by Westchester Services, dated 6/26/2025, AT&T's proposed installation consist principally of the following elements: Swap three(3) antennas and six(62) RRH units and remove three (3)RRH units inside the Church Steeple all inside AT&T's leased premises. Accordingly,AT&T's installation involves the"collocation of new transmission equipment"and that will not increase the height of the tower nor the dimensions of the equipment compound. As a result, the installation "does not substantially change the physical dimensions of such tower or base station." Therefore, these proposed equipment upgrades constitute an"eligible facilities request"under Section 6409, and must be approved. The FCC Order determined that a municipality must act on an eligible facilities request within sixty (60) days of receiving the application. 47 C.F.R. 1.4000 1(c)(2)(Emphasis added). (Note,the sixty(60)-day period is also known as the"Shot Clock"). Thus,the city must approve this application within sixty(60)days of its receipt, no later than August 31, 2025. The FCC Order provides that upon a municipality's failure to act prior to expiration of the Shot Clock, the "request shall be deemed granted" and AT&T will be legally entitled to proceed with construction. 47 C.F.R. 1.4000 1(c)(4). Note that the FCC Order does allow the Shot Clock to be tolled if an application is incomplete. However,in order to do so, a municipality must provide written notice that the application is incomplete within thirty (30) days of the submittal. 47 C.F.R. 1.4000 1(c)(3)(i). The notice must"clearly and specifically"describe the missing documents or information,47 C.F.R. 1.40001(c)(3)(i),and,as previously mentioned, such documentation must be necessary to the determination of whether the application qualifies as an eligible facilities request. Using this data, predictive modeling using IXUS electromagnetic energy(EIVIE) calculation software was performed for all transmitting antennas located at the site.The site was modeled using upper-limit parameters to determine the maximum potential RF energy density in all publicly accessible areas. Centerline believes this to be a very conservative analysis based on the best available data. Based on this analysis,the maximum calculated exposure from the upgraded AT&T facility at ground level is 20.97%of the General Population MPE limit,and the maximum calculated composite exposure at ground level from the upgraded AT&T facility plus all other existing antennas on site is 20.97%of the General Population MPE limit. For steeple/rooftop areas,AT&T will implement all required mitigation to ensure the facility remains compliant with FCC regulations in all occupational areas.The upgraded facility will be fully compliant with FCC rules and regulations. Keep in mind that the FCC did not arbitrarily establish their own standards but rather adopted the recommendations of national and international organizations such as the National Council on Radiation Protection and Measurements(NCRP),the American National Standards Institute(ANSI)and the Institute of Electrical and Electronics Engineers(IEEE).These recommendations were developed by expert scientists and engineers following extensive evaluation of the potential biological effects from RF exposure.The FCC MPE limits are based on thresholds for known adverse effects,and they were designed to provide a substantial margin of safety.There is a safety factor of 50 built into the General Public MPE limits. In cases where such compliance exists,the subject of electromagnetic field safety is preempted by the Telecommunications Act of 1996,which states: "No state or local government or instrumentality thereof may regulate the placement, construction,and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the (Federal Communication) Commission's regulations concerning such emissions." 750 West Center Street * Suite 301 9 West Bridgewater 9 MA e 02379 AdMEMMMIN 11INNOMMI q C EE NTE LINE Appendix A: FCC Rules & Regulations All information used in this report was analyzed as a percentage of the MPE limits as detailed in 47 CFR § 1.1310.The calculated power density at each sample point divided by the limit at each calculated frequency provides a result in%MPE.Summing the calculated % MPE from all contributors provides a cumulative%MPE at a particular sample point.Wireless carriers use different frequency bands with varying MPE limits;therefore, it is useful to report results in terms of%MPE as opposed to power density. All results were compared to the FCC radio frequency exposure rules as detailed in 47 CFR§ 1.1307(b)to determine compliance with the MPE limits for General Population/Uncontrolled environments as defined below. General popy!IationLuncontrolled exposure limits apply to situations in which the general public may be exposed or in which persons who are exposed as a consequence of their employment may not be made fully aware of the potential for exposure or cannot exercise control over their exposure. Members of the general public are always considered part of this category when exposure is not employment related (e.g. antennas located on a tower adjacent to a residential neighborhood). Occu patioqa 1,Zcontrol led ex,posur,e limits apply to situations in which persons are exposed as a consequence of their employment and in which those persons who are exposed have been made fully aware of the potential for exposure and can exercise control over their exposure. Occupational/ controlled exposure limits also apply where exposure is of a transient nature as a result of incidental passage through a location where exposure levels may be above general population/uncontrolled limits, as long as the exposed person has been made fully aware of the potential for exposure and can exercise control over his or her exposure by leaving the area or by some other appropriate means.
