Our office represents New Cingular Wireless PCS,LLC(AT&T)with respect to its Application to modify its existing
public utility wireless telecommunication facility at the subject premises. With respect to the Building Permit
Application,the following are enclosed in this submittal package;

Section 6409 of the Federal Middle Class Tax Relief and Job Creation Act("Section 6409") was adopted in 2012..
Under Section 6409, your city retains discretionary Zoning review over the construction of new towers, but simple
collocations and/or equipment upgrades at existing telecommunications facilities must be approved, no later than
August 1,2025. The new law provides that:
"A State or local government may not deny, and shall approve, any eligible facilities request for a
modification of an existing wireless tower or base station that does not substantially change the physical.
dimensions of such tower or base station."
The federal law defines an "eligible facilities request" as "(A) ,cols cation of tie ' tans Fission eg,ui a j.V (B)
removal of transmission equipment;or(C)replacement of transmission equipment."
Also,the Federal Communications Commission issued a Wireless Infrastructure Report and Order on.October
179 2014 ("FCC Order") which established regulations that clarify and streamline the municipal approval
process for eligible facilities requests under. Section 6409. A copy of the FCC Order is enclosed herewith.
The.FCC Order clarifies that municipal review of an.eligible facilities request is limited to determining whether the
request falls within Section+6409:
"a State or local govenunent may require the applicant to provide documentation or information
only to the extent reasonably related to determining whether the request meets the
requirements of this section [Section 6409]. A State or local government may not require an
applicant to submit any ether documentation, including but not limited to documentation

intended to illustrate the need for such wireless facilities or to justify the business decision to modify
such wireless facilities."47 C.F.R. 1.4000 l(c)(1)
The FCC Order also specifies that the term "base station" includes any structure that "supports or houses"
communications equipment. Since this structure already supports communications equipment,it is considered
a"base station"under Section 6409
AT&T's liention is an Ell, it Fad"litie s,11equest, under Section 6409,
AT&T's application qualifies as an eligible facilities request under Section 6409 because the proposed installation
involves"an existing wireless tower or base station that does not substantially change the physical dimensions of such
tower or base station."
As shown on the plans prepared by Westchester Services, dated 6/26/2025, AT&T's proposed installation consist
principally of the following elements:
Swap three(3) antennas and six(62) RRH units and remove three (3)RRH units inside the Church Steeple all inside
AT&T's leased premises.
Accordingly,AT&T's installation involves the"collocation of new transmission equipment"and that will not increase
the height of the tower nor the dimensions of the equipment compound. As a result, the installation "does not
substantially change the physical dimensions of such tower or base station." Therefore, these proposed equipment
upgrades constitute an"eligible facilities request"under Section 6409, and must be approved.

We would like to highlight an important timing requirement for processing this application. The FCC Order
determined that a municipality must act on an eligible facilities request within sixty (60) days of receiving the
application. 47 C.F.R. 1.4000 1(c)(2)(Emphasis added). (Note,the sixty(60)-day period is also known as the"Shot
Clock"). Thus,the city must approve this application within sixty(60)days of its receipt, no later than August 31,
2025. The FCC Order provides that upon a municipality's failure to act prior to expiration of the Shot Clock, the
"request shall be deemed granted" and AT&T will be legally entitled to proceed with construction. 47 C.F.R.
1.4000 1(c)(4).
Note that the FCC Order does allow the Shot Clock to be tolled if an application is incomplete. However,in order to
do so, a municipality must provide written notice that the application is incomplete within thirty (30) days of the
submittal. 47 C.F.R. 1.4000 1(c)(3)(i). The notice must"clearly and specifically"describe the missing documents or
information,47 C.F.R. 1.40001(c)(3)(i),and,as previously mentioned, such documentation must be necessary to the
determination of whether the application qualifies as an eligible facilities request. If the municipality requests
additional information after the first thirty (30) days have passed, we will still provide any "reasonably related"
information allowed under the FCC Order, but the Shot Clock will not be tolled.
In light of the foregoing, AT&T respectfully requests that its proposed equipment upgrades be approved. In the

monitored and this analysis cannot be considered to be a condition assessment of the
structure.

prescribed by the governing building codes and standards. Any higher loading conditions
required by the local jurisdiction or structure owner should be made known to WSLLC
immediately for analysis. No lesser conditions will be accommodated.

fully developed unless otherwise specified.
The information provided to WSLLC for analysis is assumed accurate and up to date as
supplied. No independent efforts were taken by WSLLC to verify the validity of the
information supplied. If any additional information is presented at any time that contradicts
what is referenced in the analysis,the analysis is invalid and must be performed again with
the new information.
Any reinforcement or modifications are assumed to be fully installed and functional.
All welds are assumed to have been performed to current welding standards and are assumed
to develop their fall capacity and to be in good condition. In addition, all bolts and bolt-like
anchors are assumed to be fully tightened, fastened, or bonded to the manufacturers'
specifications and are assumed to have full capacity.
Mount connections to towers are intentionally neglected from this analysis unless otherwise
noted. Full rigorous analysis of these connections is not possible with standard methods.
Typically, these connections are tested empirically by the mount manufacturer combined with
full FEA analysis. Good engineering practice would demand that these critical connections
are adequately designed. It reasonable to assume that a passing mount analysis can be taken
to indicate the mount to tower connection is passing as well.

Numerous connection details of large-scale structures are unobtainable and are omitted from
the structural analysis. This includes,but is not limited to: bolts,welds, flanges, and small
gusset plates. These connections are considered adequate and are therefore neglected from
the analysis. In addition,in the absence of building plans,many wall, floor, and ceiling
constructions can only be determined from observable field data and are supplemented by best
judgment and experience.
Antennas, dishes, feedlines, and any other such appurtenances are assumed adequate through
manufacturer testing. No analysis is provided for the structural strength or stability of these
items unless otherwise specified.
Other carrier equipment that is unknown at the time of the analysis are conservatively
estimated visually(size and weight) as this information may not be available.
Antenna and other equipment small-scale mounting systems (equipment to mount pipe) are
assumed structurally sound unless specifically called for in the analysis.
• Soil conditions and foundations are not considered unless specified in the analysis and have
no deterioration or defects. For sites located on a building, only local effects of the equipment
is considered unless otherwise specified. The overall structure of the building and its
foundation are assumed to be unaffected by the telecom equipment.
Any differences between the scope of work and that found at the site at any time prior to
installation must be brought to the attention of WSLLCimmediately. Any changes or
substitutions to any part of the scope of work must be brought to WSLLC for explicit
approval. Any changes made without prior approval will render the analysis and its

Executive Summ
Centerline was contracted to analyze the proposed AT&T telecommunications facility modifications for
the purpose of determining whether the predictive exposure from the upgraded facility is in compliance
with Federal Communications Commission (FCC) rules and regulations regarding RF exposure as defined
in 47 CFR§ 1.1307(b) and 1.1310.This document and the conclusions herein are based on the
information provided by representatives of AT&T which is assumed to be true and correct.
AT&T is proposing to upgrade antennas and equipment at its existing facility on the building rooftop.All
information used in this report was analyzed to determine compliance in all areas of the subject building
rooftop as well as in publicly accessible areas, including the interior of the subject building, all adjacent
buildings and at ground level.The analysis evaluates the telecommunications facility with respect to the
General Population/Uncontrolled Maximum Permissible Exposure(MPE) limits.
Based on the analysis, Centerline has determined that:
AT&T is compliant with the FCC rules and regulations governing human exposure to RF
electromagnetic fields as described in 47 CFR§1.1307(b)and 1.1310 in all publicly accessible areas.
The proposed upgrades will be compliant in all steeple/rooftop areas upon implemetation of
recommended mitigation.

Centerline has included the upgraded AT&T antenna system as well as any existing antennas systems on
site at the subject location in the analysis,which are listed in the antenna table above.
Using this data, predictive modeling using IXUS electromagnetic energy(EIVIE) calculation software was
performed for all transmitting antennas located at the site.The site was modeled using upper-limit
parameters to determine the maximum potential RF energy density in all publicly accessible areas.
Centerline believes this to be a very conservative analysis based on the best available data.
Based on this analysis,the maximum calculated exposure from the upgraded AT&T facility at ground
level is 20.97%of the General Population MPE limit,and the maximum calculated composite exposure
at ground level from the upgraded AT&T facility plus all other existing antennas on site is 20.97%of
the General Population MPE limit. For steeple/rooftop areas,AT&T will implement all required
mitigation to ensure the facility remains compliant with FCC regulations in all occupational areas.The
upgraded facility will be fully compliant with FCC rules and regulations.
Keep in mind that the FCC did not arbitrarily establish their own standards but rather adopted the
recommendations of national and international organizations such as the National Council on Radiation
Protection and Measurements(NCRP),the American National Standards Institute(ANSI)and the
Institute of Electrical and Electronics Engineers(IEEE).These recommendations were developed by
expert scientists and engineers following extensive evaluation of the potential biological effects from RF
exposure.The FCC MPE limits are based on thresholds for known adverse effects,and they were
designed to provide a substantial margin of safety.There is a safety factor of 50 built into the General
Public MPE limits.
In cases where such compliance exists,the subject of electromagnetic field safety is preempted by the
Telecommunications Act of 1996,which states: "No state or local government or instrumentality thereof
may regulate the placement, construction,and modification of personal wireless service facilities on the
basis of the environmental effects of radio frequency emissions to the extent that such facilities comply
with the (Federal Communication) Commission's regulations concerning such emissions."

Appendix A: FCC Rules & Regulations
All information used in this report was analyzed as a percentage of the MPE limits as detailed in 47 CFR
§ 1.1310.The calculated power density at each sample point divided by the limit at each calculated
frequency provides a result in%MPE.Summing the calculated % MPE from all contributors provides a
cumulative%MPE at a particular sample point.Wireless carriers use different frequency bands with
varying MPE limits;therefore, it is useful to report results in terms of%MPE as opposed to power
density.
All results were compared to the FCC radio frequency exposure rules as detailed in 47 CFR§ 1.1307(b)to
determine compliance with the MPE limits for General Population/Uncontrolled environments as
defined below.
General popy!IationLuncontrolled exposure limits apply to situations in which the general public may be
exposed or in which persons who are exposed as a consequence of their employment may not be made
fully aware of the potential for exposure or cannot exercise control over their exposure. Members of the
general public are always considered part of this category when exposure is not employment related
(e.g. antennas located on a tower adjacent to a residential neighborhood).
Occu patioqa 1,Zcontrol led ex,posur,e limits apply to situations in which persons are exposed as a
consequence of their employment and in which those persons who are exposed have been made fully
aware of the potential for exposure and can exercise control over their exposure. Occupational/
controlled exposure limits also apply where exposure is of a transient nature as a result of incidental
passage through a location where exposure levels may be above general population/uncontrolled limits,
as long as the exposed person has been made fully aware of the potential for exposure and can exercise
control over his or her exposure by leaving the area or by some other appropriate means.
The MPE limits defined in 47 CFR§ 1.1310 and utilized in this analysis are outlined in the table and
diagram below:
