Dear Mr. Eller:
The Southold Town Planning Board, at a meeting held on Monday, May 12, 2008,
adopted the following resolution:
WHEREAS, on August 30, 1982, the Planning Board approved the Minor Subdivision of
Mary Harris/Robert Ernest Bidwell to subdivide a 15.87 acre parcel into two lots where
Lot 1 equals 14.952 acres and Lot 2 equals .9183 acres in the A-C Zoning District; and
WHEREAS, the approved plat was not filed with the Office of the Suffolk County Clerk;
and
WHEREAS, Rose's Vineyard, LLC acquired the parcel from Robert Ernest Bidwell and,
upon attempt to file the plat with the Office of the Suffolk County Clerk, the plat did not
reflect the current owner and, therefore, could not be filed; and
WHEREAS, the current owner has amended the plat to accurately reflect current
ownership of the parcel; and
WHEREAS, the Suffolk County Department of Health re-approved the action on March
7, 2008; and
WHEREAS, all conditions have been met; be it therefore

RESOLVED, that the Southold Town Planning Board hereby re-issues final approval
upon the plat prepared by John Metzger, dated August 18, 2004 and last revised March
30, 2007, and authorizes the Chairperson to endorse the maps.
Upon endorsement by the Chairperson, the mylars and paper prints must be picked up
at this office and filed in the Office of the Suffolk County Clerk. Any plat not so filed or
recorded within sixty-two (62) days of the date of endorsement shall become null and
void.

I am writing to follow-up mp 2!26/07 appesranx hefo:e the Boxed om behalf of
Vineyard 48, and I thsak the Board for its statement of appauval of the subdivision map
presarted to it at that time.
As you may recall, I indicated then that before I actually sabmitted the map to the
Planning Bvaxd for sigaeture, I first had to.arxange for two changes to the map m update
the names on it (eg.; because the sale of Bidwell Vineyards to Vineyard 48 had closcd in
the interval between initial preparation of the map in the 1980's and its approval by the
county on 3n7/06).
However, after speaking again with Mr. Craig Kncppa (at the Suffollc County
Department of Health Services) it now appears that cotmty approval by the deadline of
3/16/07 is tmlfitely.
Therefore, per Mr. 1Cnepper's direction, Vnaeyatd 48 will arrange far fire
ptepmation of a new map and then ro-file it with Health Services, along with s cover
letter explaining the changes. ha addifierm m the name c]tsmiges on the map, Vineyard 48
will also up-date the changes xequued by the Planning Based in S/06 sad which V~aaeyard
48 later made (eg.; haodicap padding area, concrete walkway from handicap paddng axes

Dear Mr. Terry:
As we discussed briefly yesterday, I am writing to reacquaint you with a sub-
division matter that was last before the Phumiatg Board in 2007, when it was apprcrved,
but which was "tabled" then to allow Vineyard 48 an opporhmity to make some minor
name corrections on the sub-division map. By way of background, T have enclosed a
copy of my 3/12/07 letter to the Planning Board, Hon. Jerilyn B. Woodhouse,
Chairperson.
Although the signature and government review processes took much longer than
anticipated, they have been completed. Thus, Vineyard 48 now has a corrected sub-
division map. In addition, this new map notes the changes required by the Planning Boatel
in 5/06.
Vineyard 48 now seeks to have this sub-division matter placed on the Planning
Board's calendar for re-review and re-approval. Should that occur, V48 would
respectfiilly request that the appropriate person from, or on behalf of, the Planning Board
sign the map so that V48 can file it with the Suffolk County Clerk.
There is no emergency need here regarding timing. However, the sooner the
planning Board moves forward on this matter, the sooner the current owners of Vineyard
48 can finally complete a process fast started by the late-Mr. Robert Bidwell many years
prior to the time o£ their ownership.

Vineyard 48, and I thank the Boazd far iu statement of approval of the subdivision map
presentdd to it at that time.
As you may recall, I indicated then that before I actually submitted the map to the
Platutittg Board fox signature. I first had to arrange for two changes to the map to up-date
th<~ names on it (e.g.; because the sale of Bidwell Vineyards tp Vineyard 48 had closed in
t'~e interval between initial preparation of the map in the 1980's and its approval by the
county on 3/17.~0~.
However, after speaking rain with Mr. Craig ICnepper (at the Suffolk County
Dapamzurit of Health '~ervie-s) it nave appears that county approval by the doadlino of

617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Robert Ernest Bidwell is a two lot
subdivision located at Cutchogue.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur shculd the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
stated no objection with the lead agency designation.
A precursory review indicates conditions are suitable
for individual sewage disposal systems; however, prob-
lems may be encountered with obtaining potable water
due to the effects of agriculture on the groundwater
supply.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.
