The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may nqt be technically expert in environmental analysis, in addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full (~^F is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. DETERMINATION OF SIGNIFICANCE--Type I and Unlisted Actions Identify the Portions of EAF completed for this project: [] Part I [] Part 2 [3Part 3 Upon review of the information recorded on this EAF (Parts 1 and 2 and 3 if appropriate), and any other supporting information, and considering both the magnitude and importance of each impact, it is reasonably determined by the lead agency that: [] A. The project will not result in any large and important impact(s) and, therefore, is one which will not have a significant impact on the environment, therefore a negative declaration will be prepared. [3 B. Although the project could have a significant effect on the environment, there will not be a significant effect for this Unlisted Action because the mitigation measures described in PART 3 have been required, therefore a CONDITIONED negative declaration will be prepared.* I-I C. The project may result in one or more large and important impacts that may have a significant impact on the environment, therefore a positive declaration will be prepared. * A Conditioned Negative Declaration is only valid for Unlisted Actions .b'"ou/h'O PHnt o~ ~¥pe ~ame of £esponsi~e Officer ~n ~ead Agency Signature of Responsible Officer in Lead Asency Signature of Preparer (I f different from responsible officer) - Date 1 PART I~PROJECT INFORMAT~ .~1 Prepared by Project Sponsor NOTICE: This document is designed to assist in determining whether the action proposed may have a significant e~fect on the environment. Please complete the entire form, Parts A through E. Answers to these questions will be considered as part of the application for approval and may be subject to further verification and public review, Provide any additional information you believe will be needed to complete Parts 2 and 3. it is expected that completion of the full EAF will be dependent on information currently available and will not involve new studies, research or investigation, if information requiring such additional work is unavailable, so indicate and specify each instance. The reviewer is not expected to be an expert en¥i[onmental analyst. · The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. · The impacts of each proiect, on each site, in each locality, will vary. Therefore, the e×amples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. · The number of examples per question does not indicate the importance of each question. · In identifying impacts, cqnsider long term, short term and cumlative effects Instructions (Read carefully) a. Answer each of the 20 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. c, If answering Yes to a question then check the appropriate box (column 1 or 2) to indicate the potential size of the Impact. If Impact threshold equals or exceeds any example provided, check column 2. If Impact will occur but threshold Is lower than example, check column 1. d. Idenilfylng that an Impact will be potentially large (column 2) does not mean that it Is also necessarily significant. Any large Impact must be evaluated in PART 3 to determine significance. Identifying an impact In column 2 simply asks that It be looked at further. e. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3. f. If a potentially large impact checked In column 2 can be mitigated by change(s) In the project to a small to moderate Impact, also check the Yes box In column 3. May 27, 2003 Architectural Review Board Town of Southold Main Road Southold, NY 11971 RE: RIVERHEAD BUILDING SUPPL Y- GREENPORT YARD Dear Sir or Madam: At the time of approval from your Board on the above project, it was mentioned that the Board desired that no mechanicsi ,:quipment be mounted on the roof, as they were concerned about its visibility from the road. We have attached a drawing which shows the profile of the building to scale, the street and two eye level views from across the street to the north, (approximately 160' from the building) and the sidewalk on the property, (approximately 110' from the building.) As you can see from the sight lines we feel that the equipment mounted on the roof would not be visible from either side of the street. We respectfully request of the Board that out proposal to install two HVAC units on the roof, as indicated by the drawings dated 05/26/03 be approved. While we feel screening around the equipment is not necessary, we would agree to such screening if later requested by the Board, fne type, m,Xhod an¢ matehals as approved by thc Board. I realize that the owner is only required to notify adjacent property owners, but the only thing between my property and the construction site is the Long Island Railroad tracks. Since the properties on the other side of the Main Road were notified, I feel that someone in my situation should be included in the process. I am a business person in this community and would not have objected to Riverhead Building Supply expanding. However, if given the opportunity, I would have addressed the Board to ask for an appropriate buffer area to be maintained. I was notified when the original application was submitted and a 25 foot buffer of "existing trees and vegetation" along the southern property line was included. As I was not notified about the hearing of change in the site plan, I was under the impression that when construction started, it would adhere to the original plan. You can imagine my shock when the property was clear-cut to the Long Island Railroad tracks! I realize that a nature preserve/resort and a commercial lumber yard are not complimentary uses, but I would hope that a little consideration and environmental protection would be in order. [ appreciate the fact that the lighting problem has been addressed. I hope that my guests and visitors will once again feel like they're at the beach and not at an industrial site. I leave it in your hands for now. No. 5114 - RIVERHEAD BUILDING SUPPLY Property Location: 74500 Main Road, Greenport; Date of Public Hearing: May 16, 2002 46.-1-2.1 and 1 BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated February 20, 2002, denying a permit to (a) construct and locate a new building (No.1) with more than 60 linear feet of frontage on one street, (b) construct and locate a new building (No.2) with more than 60 linear feet of frontage on one street, ref. Section 100-133C, and (c) to construct and locate off street parking at less than the required 50 foot minimum to the street and lot lines pursuant to Section 100-131C (9). AREA VARIANCE REQUESTED:. Applicant is requesting the board to reverse the building inspector's determination that a variance is required for the proposed 115-foot width of building No. 1 because under prior Appeal No. 4547, dated June 23, 1998, the board granted a variance to construct a 115-foot wide building in almost the identical location. Applicant is requesting the board to reverse the building inspector's determination that a vadance is required for the proposed 91-foot width of building No. 2 because the building does not have frontage on a street, and is located behind building No. 1 more than 300 feet from the Main Road. Applicant is also requesting the board the lift the condition imposed under prior Appeal No 4527, dated June 23, 1998 with respect to off street parking and loading, or the reverse the building inspector's determination. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 16, 2002 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1. (PROPERTY FACTS) The subject property consists of a total of 5.9 acres and is located on the south side of Main Road in Greenport. The property is zoned LIO (Light industrial Office) and is located in a neighborhood that is commercially developed. The site plan, prepared by Donald Alan Denis, Architect, dated August 21, 2001, last amended December 18, 2001, shows plans to demolish the existing building and construct a 14,100 sq. ft. retail/office warehouse with a width of 115 feet facing the Main Road. This building, No. I would be set back 110 feet from the Main Road, with customer parking in front of the building and a 25-foot buffer zone between the parking area and the Main Road. Building No. 2 is proposed for the drive-through operation of the lumber yard. It is 23,660 sq. ft. with a proposed width of 91 feet. Building No. 2 is located 70 feet behind building No 1 and more than 300 feet from the Main Road. The site plan also shows a 5,000 sq. ft. warehouse building. Page 2 - May 16, 2002 ZB Appl. No. 5114- Riverhead Building Supply 46.-1-1, 2.1 at Greenport 2. in reviewing the revised plan, the board finds that it is not substantially different than the plan which was reviewed by the board and granted variances under Appeal No. 4547. Instead of one large building of 53,425 sq. ft., the applicant has reduced the size of the principal building to 14,100 sq. ft., and created a separate 23,660 sq. ft. building in the rear of the principal building for the drive-through operation of the business, and a 5,000 sq. ft. warehouse building. 3. The 115-foot proposed width of building No.1 is identical to the width variance granted by the board under Appeal No. 4547. The board notes that the prior vadance was granted on condition that the applicant maintain a minimum 110 foot set back from Main Road in order to provide additional landscape buffer, which the applicant's have complied with. Since neither the 115 foot width of the building nor the minimum 110 foot conditioned set back to the Main Road have changed, no further variance is required for building No. 1. 4. With respect to building No.2, the building inspector states that the proposed construction is not permitted pursuant to Article XIII, Section 100-133C on the grounds that the building has "linear frontage of 91 feet." The code provision specifically states that, "a project shall be divided into separate structures so that no sinqle structure shall more than sixty (60) linear feet of frontage on one (1) street." The building (No. 2) in question does not have frontage on one street. It is to be located 70 feet behind building No. I and more than 300 feet from the Main Road. The board believes a clear reading of the provision indicates that it was intended to prevent the strip mall effect of one or many excessively wide structures facing the street. In this instance, the code provision is not applicable because the building does not have linear frontage on a street. 5 With respect to off-street parking and loading requirements pursuant to Article Xlll, Section 100-131, C (9). The board notes that the location of the parking and loading areas were worked out with the Planning Board during its site plan review of the project after the Board of Appeals granted its approval under Appeal No. 4547, which included a condition #3, that off-street parking areas comply with 100-131. In reviewing the amended site plan, the board finds that compliance with this condition is neither practical, nor would it in any way improve the layout or design of the plan, or serve any useful purpose. BOARD RESOLUTION: For the reasons stated above and, on the basis of testimony presented, materials submitted, the board makes the following determinations: Now, on motion by Member Tortora, seconded by Chairman Goehringer, it was RESOLVED, to REVERSE the Building Inspector's February 20, 2002 determination that Building No. I requires a variance pursuant to Article XIII, Section 100-133C because such variance was granted under prior Appeal No 4527, dated June 23, 1998. BE IT FURTHER RESOLVED to REVERSE the Building Inspector's February 20, 2002 determination that Building No 2 requires a variance pursuant to Article Xlll, Section 100-133C because such building does not have frontage on a street and the provision is not applicable to this structure. Page 3- May 16, 2002 ZB Appl. NO. 454~ Dear Chairman and Board members: JAN z 2002 Southold Town P anning Board Riverhead Building is before the Planning Board for approval of the amended site plan. The public hearing was opened on January 14, 2002 and left open pending your communication. Enclosed is a print of the proposed site plan which shows the Planning Board reviewed and recommended improvements. The Building Inspector raised two issues prior to certification of the site plan: First: Appeal No 4g47 granted relief for the width of the building to 115, provided that the building was set back an additional lO' {110 total). In appeal No 4547 the front building (along Route 25) was connected to the rear building. Due to fire code issues the new amended site plan provides for a detached building (building 2). Pursuant to Section 100-133 (C) "A project shall be divided into separate structures so that no single structure shall have more than 60 linear feet of frontaqe on one street. The setbacks of multiple structures on a parcel may vary, provided that the average setback of the structures meets the setback required above and all buildings are at least 75 feet from the right-of-way." Please note that only Building 1 has frontaqe on the road. The rear building is in the ~rear yard", behind the front building, more than 300~ back from Route 25. It was my belief, as well as the former building inspector's, that the variance ran with the land, the relief requested was the same (applicable to Building 1) therefore Riverhead Building Supply could proceed to obtain amended site plan without another variance from 100 133. Issue 2: Parking setback has been questioned by Mike Verity. RBS has complied with 100-132 Bulk, area, and parking regulations of 100-191 and 100-192, incorporated by reference. Mike Verity saw your reference to 100-131 in your decision. We believed you intended to refer us tc our obligation to comply with whatever provisions of 100-131 were applicable. We and the Planning Board believed that we had complied with all parking requirements, and 100-131 (9) is not applicable. Moreover, the relocation of parking in order to conform to a 50 setback would result in insufficient parking at the retail building, and placement of parking in areas that the Planning board wishes to keep open for vehicle arid truck access. The Planning board needs to determine the most suitable placement of parking. Site plan issues are correctly before the Planning board, 100-131 (9) if applied as Mike Verity suggests will interfere with good site plan review. The Planning Board and staff did not apply this ssction of the code with either the present or the previously approved site plan. To my knowledge, 100-131 has not been applied to the parking for a "principle use", in this case a wholesale business, warehouse and building material storage and sale (i.e. lu~nberyard) . Section 100-131 (C) is intended to apply to accessory Moreover, Riverhead Building Supply is a preexisting nonconforming building storage etc.) and a site plan is more parking, landscaping muoh more conforming have certainly code. I do not believe he wishes to send us to your board for variances, he asks that your board clarify the decision granting the variance, and respond to him accordingly. If your communication is favorable, Mike Verity will be comfortable with this, the Planning board is ready to approve the site plan. This August 10, 1998, approved plan was never built. A new application has replaced the previously approved plan. The new retail building is 115' wide, as was the original building, however, it has a different footprint. The original storage building was connected to the retail building and was also 115' wide. Prior to issuing a New York State Highway Work Permit, the following items must be addressed: Please revise the Traffic control Plans to include a lane shift in addition to the shoulder closure as per the attached detail. All on site drainage must be contained on-site. Runoff onto the State R.O.W will not be permitted. Provide for the clean out of existing drainage structures along the NYSDOT R.O.W. after completion of construction. The existing ferry signs are not shown in the plan set. Please show all existing signs including text, poles, and the adjacent properties' driveways. All on site drainage must be contained on-site. Runoff onto the State ROW will not be permitted. In recent years, many states have employed access management as a major technique to address conflicts between through traffic and that generated by developments. The goals of access management are to limit the number of access points, separate conflict points and remove turning traffic from through movements. New York State is utilizing this technique to minimize impacts to State highways. We recommend, therefore, that cross access to this site be obtained from adjacent property. If this is not presently possible, it should be shown on the plans for implementation as part of future redevelopment. :48 IRIS 2001 IRIS 2001 ?)L|⊈‰ÂÄ¡ÁJá§p%rqŽˆH‰Jœ1,Cƒ‰+â?QQº#žõÄE\Ä#nâ#â‡ÓˆˆˆˆˆY3]ÄE|â7qhDDD$¶Ò…ñ”"r%Á±q¥pñ‰‚‡ˆ+ˆøGDD>"""Î}г€Ç1µPœBGzKôAP3DxÄE\«…ÐGDGÄ”ˆ¸ˆÇhâýeq*DD$TB¤‰Ogâoºˆ‹¸/†’ˈ9J"ú±™øÄÅž7q$ºØÊ|¦<"ˆrƒ„tƒ*ñ‰q±§‹-âb‹ø'ââ)&ŽcU)›áRâAÏ•)2’˜=[ÄE#â‚ ¤O\Ä•˜½@ µá—âgÁªPC!D$.˜rªÅ?"""""Î<%‰%-6…ÄBÄENt‡?"""ÎLÄ)bbÎõ.3SÓˆ“D%¾ˆOW ’A¢+Ô’Œ–††(§N¦Èˆd 8ÂÄ)âÿÿ“UTU @ qÎ Ž qÎ II* þ
