Dear Ms . Wickham:
The following action was taken by the Southold Town Planning Board,
Monday, June 25 , 1984 .
RESOLVED that whereas, a formal application for the approval of
a subdivision plat entitled "constantine P. Georgiopoulos" located
at Southold was submitted to the Planning Board on April 20, 19984
and filing fee was paid on February 2 , 1983
WHEREAS, a public hearing. was held on said subdivision application
and plat at the Town Hall, Southold, New York, on May 21, 1984 at
7 :30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have beenmet by said subdivision plat and
application,
NOW, therefore, be it RESOLVED that the application of "Constantine P.
Georgiopoulos" for approval of said subdivision plat prepared by
R. Van Tuyl and dated March 8, 1984 be approved and the chairman
be authorized to endorse approval on said subdivision plat
subject to the following condition:
1 . A cash payment made to the Town Board as a park
and playground fee in the approved amount of _$10,000.
Upon receipt of notice from the Town Board that this has been
done the chairman will endorse the maps .

Dear Mr. Murphy:
The Planning Board has waived the requirement for a reservation
of land for a park and playground in the above mentioned
subdivision, with the condition that in lieu of this a
fee be deposited with the Town Board. The applicant's attorney
Ms . Gail Wickham, has indicated that this will be acceptable
to the applicant.
We are requesting that the Town Board determine the amount
of this fee pursuant to Article III , Section A106-38 E (3)
of the Southold Town Ordinance.

of the park and playground fee for this subdivision. When
this matter was discussed before the Planning Board in the
latter part of 1982, the Board advised me that the fee would
be $10 , 000 .00 and asked that I confirm in writing that Mr.
Georgiopoulos would accept that fee in lieu of establishment
of a park and playground area. I enclose a copy of my
letter to the Planning Board dated January 10 , 1983 with
that confirmation.
I also enclose a copy of my letter to the Planning
Board dated October 8, 1982 enclosing contracts for several
surrounding properties to help ascertain market value. If
you would like the contracts themselves , I would be glad to
furnish them.
We therefore request that the fee be set at $10 , 000 . 00
in line with the statement of the Planning Board.

of the apornval dated December 30, 1982, indicating that despite this
condition, subsurface sewage di_suosal syste-r.93 (cesspools) will be
pernutted on ea^h of the lots.
I also enclose letter dated DecerL�er 22, 1982 fra-n the Department
of Health, i'?dicat;nn ths t the project confers with the Suffolk County
Sa tary Code. I understand that the last sentence in the enclosed
letter refers to the fact that the individual systcros or. each lot rill
be appro.•ed at the titre of construction, but that individual s•✓steTs are
permissible to the Suffolk County Sanitary Code. I believe this
suffices for purposes of your letter regarding Article VI approLal.
Please schedule this matter for a public hearing. Enclosed, ares sig:
prints of a revised preliminary map showing building envelopes on lots
and 8. Also enclosed is the subdivision filing fee in the araDunt of

Gentlemen:
Since I will be unable to attend the public hearing on this
preliminary subdivision map, I would like to submit this letter on
behalf of the applicant, Constantine P. Georgiopoulos.
This subdivision was applied for or April 8, 1982 and received
sketch plan approval on July 22, 1982. Thereafter, revised maps
containing a park area were considered, but it was ultimately decided
that the original sketch plan would remain and that the applicant would
pay the sum of $10,000.00 as a contribution to the park and recreation
fund in lieu of providing a park area, based upon the small number of
lots and the proximity to existing recreational facilities. Building
envelopes have been provided on lots 2 and 8, so no construction will
require a variance. The subdivision plan is for eight lots exceeding
40,000 square feet in an area where most of the surrounding properties
have been developed on one-half acre or less.
The Suffolk County Department of Health reviewed this subdivision
and issued its approval on December 30, 1982 following a variance
proceeding in which a 5 pool shallow leaching system was approved. The
water test was found to be satisfactory by the Department. The approval
is, of course, subject to individual application at the time of
construction on each lot.
on January 10, 1983, v-- submitted the preliminary maps to the
Planning Board, and on February 17, 1983, the maps were referred to the
Suffolk County Planning Commission.
The Southold Town Conservation Advisory Committee reviewed this
subdivision proposal, and we were advised by the Planning Board that
they found no objection. On March 28, 1983, the Planning Board issued a
Negative Declaration pursuant to SEQRA stating that the project will not
have a significant effect on the environment.
The Superintendent of Highways has approved the plan. No road or
drainage improvements are required.

The applicant has expended considerable tine and expense pursuing
this subdivision application. In addition to the usual costs for
surveys, water and engineering studies, filing fees and legal fees, he
has incurred considerable expense in the payment of interest and time
extension fees to the contract vendors. This Board has also invested
considerable time in reviewing this project, and every aspect has been
given careful consideration. I believe the plan is well laid out and
that all environmental and planning concerns have been addressed. By
providing lots twice as big as most in the neighborhood, this
developmexxt will be an asset to the community.

I wish to voice my opposition to the proposed subdivision
known as" Constantine Georgiopoulos at Southold,
I live on Lake Drive at Lake Court. The property in question
is a ,fragile area containing much standing water and wetland
veget'a`tion. I believe much of thss property is, or should be,
protected wetlands. The area serves as a nesting place for many
species of birds. In addition, the construction of houses and a
road through this property would certainly create more problems
of flooding and brackish drinking water in the area.

Gentlemen:
Your letter of July 1, 1983 indicates that there has been no
compliance with Article 6. On January 10, 1983, I forwarded you a
letter enclosing the approval of the Suffolk County DepartTeit of
Health,Board of Review, and the letter from the Suffolk County Depart-
ment of Health Services confirming that the proposed sewage and water
systems conformed to the Sanitary Code, subject, of course, to formal
application at time of construction. I was advised by your office
that this was sufficient to allow the map to go to preliminary hearing.
P7e feel that it is extremely unfair ro ths- applicant that he
now be denied by virtue of legislation enacted four months after the
Health Department approval, and would like to advise you that Mr.
Georgiopoulos does intend to pursue the proposed subdivision as set
out imder the one-acre zoning requirements. Uh realize that your
Board is unable at this point to accommodate that request, but fol-
lowing the suggestion in your letter, we could appreciate an appoint-
ment with the Board to discuss the matter.

The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time .
from the New York State Department of Environmental
Conservation it is assumed that there is- no objection-
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its agreement with lead agency designation.
Based upon the application subditted to the Department
a review of records indicate that conditions are adequate
for installation of individual water supply and sewage
disposal systems .
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

of the approval dated December 30, 1982, indicating that despite this
condition, subsurface sewage disposal systems (cesspools) will be
permitted on each of the lots.
I also enclose letter dated December 22, 1982 £ram the Department
of Health, indicating that the project conforms with the Suffolk County
Sanitary Code. I understand that the last sentence in the enclosed
letter refers to the fact that the individual systes; on each lot will
be approved at the time of construction, but that individual systems are
permissible to the Suffolk County Sanitary Code. I believe this
suffices for purposes of your letter regarding Article VI approval.
Please schedule this matter for a public hearing. Enclosed are six
prints of a revised preliminary map showing building envelopes on lots 2
and 8. Also enclosed is the subdivision filing fee in the amount of
$93.00.
This is also to confirm Mr. Georgiopoulos' acceptance of the park
fee of $10,000.00 in lieu of establishment of a park and playground
g area. I understand that this fee is payable at the tine the final map
is signed and filed.

Angel Shores - Mr. Richard Cron, Esq. inquired as to whether the
board was in receipt of correspondence from Lawrence Tuthill, Town
Engineer, regarding the drainage area within this subdivision. Mr.
Cron was informed that Mr. Tuthill ' s letter would be submitted to the
office prior to November 19, 1982 for discussion at the November 29,
1982 Planning Board meeting.
Richard J. Cron - Mr. Richard Cron, attorney and applicant submitted
to the Board correspondence from Mr. James Monsell, Greenport Utility,
stating this minor subdivision would be supplied by Greenport water.
Constantine Georgiopoulos - Ms . Abigail Wickham, Esq. confirmed that
the sketch map to be considered is the one previously given approval
by the Planning Board; this proposal has no park and playground area.
The Board requested that $10, 000 be QI� Ay�+-he town in lieu of the
park an playgroun area. It was noted that the Board had alrea y
ec are lead agency with regard to the State Environmental Quality
Review Act. Also noted was the filing fee for this proposal has not
been received. Ms . Wickham stated with regard to Article 6 , Mr.
Royal Reynolds stated he didn' t think water was a problem, but it
would have to go before the Board of Review. The board asked that
the proposed maps show a building envelope on lots two and eight. A
letter regarding money in lieu of park and playground will be forth-
coming from the attorney.
North Fork Bank & Trust Co. at Mattituck - Ms . Abigail Wickham, Esq.
discussed this proposal with the Board. Because of the question in
alternate areas to be deleted as retail sales areas , the Chairman
instructed the building department to stop certification. Mr. Raynor
asked Ms . Wickham to supply the board with a profile of the building
plans and information regarding the curb cut from the State . Ms .
Wickham presented both items to the Board. The Board was in agree-
ment that this application did not have to go before the Suffolk
County Planning Commission.
On motion made by Mr. Mullin, seconded by Mr. Latham, it was
RESOLVED that the site plan of North Fork Bank & Trust Co. to be lo-
cated at Mattituck, be referrET-to the Building Inspector for certi£ica-z
