1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary.HARDSHIP because the property in question contains a total of 41,817.20 square
feet and is presently zoned "B-l" General Business District. Located on this pro-
perty are three~ two-family residences and one~ single family residence. The
buildings were built in approximately 1920 for the United States Army long before
the institution of a Zoning ordinance in the Tcwn of Southold. Without destroying
the houses or converting them into a business use, it is impossible to confo~ to
the present zoning requirements regarding use and ar~a requirements. ~ inspection
of the premises reveals that this particular street is primarily one of a residential
character and the only reasonable way Co divide this property is as the Petitioner
proposes. All of the houses have been recently occupied during the spring and
summer months. Petitioner no longer wants tha responsibility of maintaining these
houses and is presently under contract to sell these structures to four purchasers.
it is proposed that: lot one will contain 14,810.40 square feet and a two-family

If th~ Board grants the Petitioner's application to subdigide t2le property as p~-
posed the Petitioner then intends to remove the existing aboveground electric poles
and install underground electrical service to each of the houses. In addition Petitioner

2. The hardship created is UNIQUE and is not shared by oil properties alike in the immediate
vicinity of this property and in this use district because the property sought to be subdivided
into separate lots was originally officers quarters for the United Stases A~y on
Fort H. G- Wright.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the enfire area where th_ese ~houses are situated
was originally used by the United States A~m_v for housing. Tke architecture of
the existing buildings is compatible with the neighborhood and will not cha~ge
the existing use or character of this distr~ct in spite of the present sonin~.
Vehicular traffic will not be increased as the houses have always bea~ use~ as
residences. It is noted on March 1, 1979, Sout~hold Town Zoning Beard of Appeals
granted a variance to one Roger Barmache to enable him to reinstate a two-family
use to the fifth house on this block which is located i~mediately to the north of
proposed lot ~1. The neigkborhood should be improved by having individua~ owners
who will be responsible for the maintenance and upkeep of these properties.

DeHaan application to the Board of Appeals. The Board of Appeals'
has v~itten the Planning Board indicating that it does not wish to
be lead agency in this matter. The Planning Board will write the
Board of Appeals saying that since there is no filed subdivision with
.regard to this property but probably in the future it shou~.d be such
because it is considerably overthe 40,000 square foot minlmum~for a
building lot in the township. Consequently, at this point, ~here the
town agency does not wish to be lead agency under the State Environ-
mentalQuality Review Act requirements, it is suggested that probably
the next closest agency should be the New York State Department of
Environmental Conservation.

and Mr. 0rlowski Will study same and return to the Board with a
report.
