I received a call from Supervisor Horton on July 11, 2003, which he stated the Planner (the town hired) Mr. Bob Grover would be getting in touch with the communi~ and me. He also lalked about the I-rlstorian Alison Monisera, as to whether I had spoken to her. Supervisor Horton was telling me of his wedding plans in Mitchell Park, and hope that Bob and I would be able to attend. He then asked me about the Molar landscaping business east of our property. I stated I had no problem with the building. Thle was my personal opinion not the Church Lane Hamlet. At NO time did Supervisor Horton inform me that an exemption was an issue. After all there is a.4-month moratorium in place, so if building ia that ~area would b.e after that .time. Mohr and Robert T. Mokr, located at 22155 County Road 48, Cutchogxte, and identified by SCTM # 1000-96-01-20.1. The Planning Board has responded to the application and it be,qns m reference to the site plan-the Planning Board is referring to the site plan application that Mr. Mohr has made for this property. In reference to the site plan apphcation and the request for recommendation and findings. "This is to inform you that the Planrfing Board has rev/ewed this application at its work session on July 7. ARer review of the file, the following itemizes what has occurred with this application so far." And there are a listing of about ½ a dozen items. "The site was cleared in violation of Town Code-section ..... ; it received three copies of a preliminary site plan for a pre-submission; the application received a completed site plan application and payment of $452 in fees; it received a common driveway agreement; it received one revised site plan for the work session. The Planning Board resolved and determined that this project is a Type 11 action and not subject to the SEQRA review. Earlier this year, 2 it received 8 copies of a revised final site plan for review and scheduled an ARC review (that is the Architectural Review Committee), in April k received a signed detail for review; in May sent a request to the Cutchogne Fire Department for approval; requested building inspector for certification; sent a site plan and request to the Town Engineer for approval; in May received the Fire Departanent's approval and that no well is required; in June notified the applicant that in effect the application is on hold due to the moratorium and later in May received one set of construction plans for the Architectural Review Committee's final review. The concern of the Planning Board is the ske plan does not satisfy the landscaping required per Town Code. The applicant's representative was informed that the site plan xvill need to be fine-tuned and additional screening will be required. At this time, we still need the following for a final approval of the site plan: 1) revised site plans with landscaping; 2) Building Department certification; 3) Town Engineering approval; 4) Suffolk County Health Department approval; 5) Department of Public Works approval for use of existing driveway with agreement and 6) the moratorium must expire or a waiver must be gotten. It is not known if the proposed use of structures meet with the code. It is stron~y recommended that the Building Department be consulted as to whether there are other outstanding issues. We hope that this information helps in the review of the waiver request." Those are the only xwitten responses that we have to the Mohr's request for a waiver on the moratorium in the Church Lane area. SUPERVISOR HORTON: We open the floor to the public on this public hearing. Yes, Mrs. Egan. JOAN EGAN: I may be wrong but I thought that either at the last meeting of the one before that you were going to have a new survey done in that area_ Are you going to spend another $10,000 or $12,000 as far as the Church Lane thing? Is that so? Has that survey been completed? SUPERVISOR HORTON: That is actually in progress as we speak. MS. EGAN: What do you mean by that? SUPERVISOR HORTON: That it is actively being worked on. MS. EGAN: So how can you vote on sometl4ng if the survey has not been completed? SUPERVISOR HORTON: This is a public heating for a request for a waiver fi:om that moratorium that effects that parcel. MS. EGAN: So what does that mean? I don't quite understand. SUPERVISOR HORTON: This is a legal .... MS. EGAN: You are having a survey done, so why did you even bother doing this until the survey was completed? SUPERVISOR HORTON: We have a legal obligation under the moratorium law to have a public hearing if a grant request does come forward. 3 MS. EGAN: So if you granted, then what happens if the survey says that it shouldn't be done? I mean, aren't you ~oing to be contradicting yourself and getting yourself into worse trouble than you are akeady in? SUPERVISOR HORTON: [fin fact that was the case. COUNCILI~LAN RO~MNELLI: Actually, all we are ..... MS. EGAN: Uh, uh, uh, uh, uh, uh. SUPERVISOR HORTON: Feel free. MS. EGAN: You can tell Mr. Horton. SUPERVISOR HORTON: No, Ivlrs. Egan, I will allow him to answer the question. MS. EGAN: Alright. COUNCILMAN ROMANELLI: Actually, all we are doing here is, if it is passed, that we are granting a waiver for this parcel to get out of the moratorium and move for~vard in the process_ We are not granting permission for this structure to be built, we are just saying that if xve waive it, they can continue through the process. In the end, it still may not get final approval from the Planning Board, Building Department, Health Department and all agencies that Tom listed_ All we are saying is, we will grant the relief, if we pass it, to be ~ee from the moratorium structure and continue on through thc process_ MS. EGAN: So what you are saying is that they can go ahead and do things? Is that what it is? COUNCILMAN ROMANELLI: They still have ways to go. We are not granting final approval on their plan_ We are granting them the continuation of going through the process of site plan. MS_ EGAN: I think that after all of the meetings that we have had up here, the press, the Newsday and all of that, that you are going ahead with this, I think that this is one, as far as I have been coming to meetings the last couple_. ~ .I think that this is absolutely disgraceful. I thil~k that you have one beck of a nerve to go against these people like tlfis... SUPERVISOR HORTON: IV[rs. Egan. MS. EGAN: Now, let me tell you, god will get you for it. I will be back. SUPERVISOR HORTON: Are there other connnants from the floor? Yes, Ms. Toll_ KATHY TOLL: I am still Kathy Toll and I ~m still from Greenport. I would urge the Board not to grant waivers at this time, if it is granted for this parcel there is no reason that every other parcel and every other application wouldn't go forward_ There is a limited number of parcels over there. There is a limit of time that things have to wait and I would be rather surprised if that short period of ;v0it xvould have a profound effect on the Mohr's business. I would urge you to vote no. June 22, 2003 Joshua Horton, Town Supervisor Southold Town Hall Main Road - Route 25 Southold, New York 11971 Re: Mohr Property Route 48 Cutchogue, NY Dear Mr. Horton: I hereby request a Waiver of Local Law 11 - 2003 in reference to Church Lane. My property's location does no__~t impact the Church Lane issue which is presently under Moratorium. On the west side, a 100 ft. Morton Building operates as an auto repair shop. On the east side is Cox Lane Industrial Center (Micari). Between is my vacated property which borders the to~m land fill. Without a waiver, extreme hardship ensues. We have lumber delivered and.more importantly the labor commitment, which took a year to obtain. Everything is time contingent. Without a waiver, the above mentioned facts are lost 7without a time plot available. Our perm/t process alone has taken 13 months to accomplish_ At the recommendation of Supervisor Horton, we respectfully ask for our request to be put on the Town Planning Board Meeting on July 8, 2003 for approval. The buildings proposed by Chris Mohr are within the Moratorium of Church Lane and will require a waiver as described in local law# 11 of 2003. The site plan application will reqpire a variety of approvals before the Planning Board can give Final Approval. The most important approval needed is from the Building Inspector. To date the building inspector did not certify the site plan and it may require an appeal to the Zoning Board for a variance. We sent a letter 6/11/03 to notify Grarret Strang the applicants agent about the moratorium. The letter included a copy of the Church Lane Moratorium LL 11/2003. If I can give you any more information, please give me a call.
