(Appeal Procedure) of Local Law #3-2002 and Local Law #3-2003 and the section states: Section& APPEALPROCEDLrRES a. The Tox~m Board shall have the authority to vary or waive the application of an3' provision of this Local Law, in its legislative discretion, upon its determination, that such variance or waiver is required to alleviate an extraordinary hardslfip affecting a parcel ofproperVy. To grant such request, the Town Board must find that a variance or waiver will not adversely affect the purpose of this local law, the health, safety or welfare of the Town of Southold or any comprehensive planning being undertaken in the Tox~m. The Toxvn Board shall take into account the existing land use in the immediate vicinity of the property and the impact of the variance or waiver on the water supply, agricultural lands, open and recreational space, rural character, natural resources, and transportation infrastructure of the Towm. The application must comply with all other applicable provisions of the Southold Town Code. WHEREAS the Toxxm has hired a "moratorimm group" consisting of in-house and outside plmmers and attorneys who are working on a "Comprehensive Implementation Strategf' of the Comprehensix'e Plan of the Town of Southold and certain corfiprehensive planning currently being undertaken includes, but is not limited to a 80% preservation of open space throughout the To;xm ,and a 60% reduction in density and clear establistmtent of the Hamlet Centers and a possible Transfer of Development Rights component (a full description of the "action" is set forth in the SEQRA Resolution dated January 7, 2003 for the Southold Comprehensive Implementation Strategy which is incorporated by reference into this decision); and WHEREAS the To;xm Board finds that the application is not in contrast ~Sth the extensive planning initiatives being undertaken by the "moratorium group", or the Comprehensive Plan of the Toxw~ of Southold; and '~V[IEREAS the Town Board £mds that this application ~vill not adversely affect the purpose of the Local Law # 3 of 2002 and Local Law #3 0£2003; and VvltEREAS the Toxvn Board of the Town of Southold finds that the application will not adversely affect the health, safety, or welfare of the Town of Southold; and ggqtEREAS the Town Board of the Toxxm of Southold finds that the minor subdivision application is consistent with the existing land use in the sun'ounding area and has a minimal impact on water supply, rural character, natural resources and transportation infrastructure of the Town; and WHEREAS the Town Board of the Town of Southold finds that the application has no effect on agricultural lands and open and recreational space; and WftEREAS based on the application, all relevant documentation, the comments set forth at the pnblic hearing on tiffs matter, the comprehensive planning currently being undertaken by the Town, the above referenced facts, and the criteria set forth in Local Law No. 3 of 2002 and extended by Local Law No. 3 ot'2003, Section 6. The parcel is located on the south side of Route 25, etc. The Planning Board has reviewed the progression of this application and the request for waiver for the proposed minor subdivision of Diane Alec Smith, and it makes a reconmaendafion that the Town Board grant the requested waiver for the application. And tiffs decision is based upon the following facts: Land use, the dominant land use in the general vich~ity is agriculture, mLxed with low density residemial. To the norttk agricultural uses dominate. The Toxxm of Southold holds the development fights to the parcel directly to the north. Lots located to the east, west and north range from .6 acres to 3.8 acres, with numerous lots close to the two acre size. Agrianltural lands, the parcel is cm-rently located within the R-80 zoning district, a designation intended to permit residantiai development, open space and recreation. Due to the size, location and current use of the property, the potential to provide significant open space or recreational uses are low. Based upon the above, it is the Planning Board's f'mdings that although the proposed project does not fully support the platming objectives of the Tox~m of Sonthold, the Board does reconLmend that the Town Board does grant the requested waiver for the application.' RECEIVED APFI. 8 2003 To: Ms. Betty Neville Town Clerk From: Bennett Orlowski, Chairman Re: Request or Waiver from Local Law Temporary Moratorium on the Processing, Review of, and making Decisions on the applications for Major and Minor Subdivisions, and Special Use Permits and Site Plans containing dwelling Unit(s) in the Town of Southold for the Minor Subdivision of Diane Alec Smith SCTM# 1000-109-01-07 Date: April 1. 2003 In this memo, the Planning Board will only address this request in the context of land use planning; the consideration of and any comment upon any other reasons as stated, are beyond the scope of this review. The proposed action involves the subdividing of a 3.915 acre Parcel (SCTM# 1000-109-01-07) into two lots where Lot 1 equals 85,265 sq. ft. and Lot 2 equals 85,265 sq. ft. Lot 1 is improved with a single family dwelling and several agriculture support buildings. Lot 2 is unimproved. The action would create one new residential building lot. The parcel is located on the south side of State Road 25; 242.68 feet west of Elijah's Lane in Cutchogue (Exhibit 1). The property is located in the R-80 (Low to Medium Density Residential) zoning district. On November 05, 2001 the Planning Board granted sketch plan approval on the map dated September 27, 2001. The Planning Board has reviewed the progression of the application and the request for waiver for the proposed Minor Subdivision of Diane Alec Smith and makes a recommendation that the Town Board grant the request of waiver for the application. This decision is based upon the following facts: Land Use - The dominant land use in the general vicinity is agriculture mixed with Iow density residential. To the north, agriculture uses dominate. The ToWn of Southold holds the development rights to the parcel directly north. The residential development in the area is consistent with the "homestead"' development pattern, where a residence anchors a large tract of farmland. An older residence and numerous supporting agricultural outbuildings currently . occupy Lot 1. The area proposed as Lot 2 is in lawn with a few interspersed trees. Historic aerial photos (2001) show that, although small, the Lot 2 area was in active agriculture. The Peconic Land Trust owns the property directly south of the parcel.' The winery and vineyard of Pelligrini Vineyards borders the western boundary of the parcel with larger agriculture operations farther west. To the east, the dominant use is residential. Due to the size of lot 2 (85,265 sq. ft.) the potential Of the area to provide collective open space and/or open space easements is Iow. Following the improvement of Lot 2, the view shed will be interrupted. During the application process, the visual impacts were evaluated during the SEQR review and no "significant" adverse impacts were identified. Note, however, that S.R. 25 is a Scenic Byway, and the view from S.R. 25 northwest across the property has scenic value and all efforts to minimize the interruption of the view shed should be taken. The subject parcel is zoned R-80, which requires a minimum size of 80,000 square feet per lot. The R-80 zoning district is also located to the north, south and east of the parcel. The property to the west is zoned A-C (Agricultural Conservation). The Zoning Board of Appeals granted an area variance (Appl. No. 4812) for the both Lots 1 and 2 on May 10, 2000 for a different lot configuration. The variance was based upon the finding that although the total parcel area is 3.915 acres, the wetland area (12,138 sq. ft.)was to be excluded from the yield of the parcel. Currently the lot configuration has been amended where Lot 1, excluding the wetland, is 73,120 sq. ft. and Lot 2 meets the dimensional requirement within the R-80 zoning district. Lots located to the east, west and north range from .66 acres to 3.8 acres; with numerous lots close to 2 acres in size. Based upon such, the proposed action would not significantly deviate from the general area land use and the parcel sizes adjacent to S.R. 25. Transportation Infrastructure -The applicant has applied for and received a curb-cut permit from the State of New York Department of Transportation. On January 15, 2002 the Planning Board issued a Negative Declaration pursuant to the State Environmental Quality Review Act Section Article 8, Part 617 indicating that no significant traffic impacts are expected to occur if the project is implemented as planned. Natural Resources - The parcel is in residential use. The eastern section of the parcel is comprised of a portion of a wetland (large pond). The remainder of the property is in lawn with a few interspersed trees. The building envelope of Lot 2 meets the 100' wetland setback. Correspondingly, the Town of Southold Trustees issued a letter of non-jurisdiction on November 26, 2001. On January 15, 2002 the Planning Board issued a Negative Declaration pursuant · to the State Environmental Quality Review Act stating that no significant environmental impacts are expected to occur if the project is implemented as planned. The action does fall within the jurisdiction of the Suffolk County Planning Commission. Comments from the Suffolk County Planning Commission have been received and considered by the Planning Board. Water Supply - The applicant has stated that water supply to the Lot 2 will be accomplished via a private well. Sanitary disposal within the proposed subdivision will be managed by on-site underground sewage leaching systems The applicant has stated that they have received Suffolk County Department of Health (SCDH) approval in November, 2002 (check). The Planning Board has no record of SCDH approval and the statement is currently unverified. Rural Character - The proposed action would result in the increase of one residential structure on Lot 2. Due to the location of the new structure, the view shed will be disrupted. As mentioned above, S.R. 25 is a scenic byway and placement of the residence should be evaluated to minimize any adverse impacts to the scenic quality of the area. The building envelope for Lot 2 is proposed with a 60-foot setback from the southern property line adjacent to S.R. 25. Agricultural Lands - The parcel is currently located within the R-80 zoning district; a designation intended to permit residential development. In 2001, approximately one third (1.3 acres) of the parcel was in active agriculture. Currently the area is in lawn; therefore, no active agricultural loss will occur. However, agricultural soils will be lost.
