APPEAL PROCEDURES a. The To~xm Board shall have the authority to vary or waive the application of any provision of this Local Law, in its le~slative discretion, upon its determination, that such variance or waiver is requh'ed to alleviate an extraordinary hardship affecting a parcel of property. To grant such request, the To~xm Board must find that a variance or waiver will not adversely effect the purpose of this local law, the health, safety or welfare of the Town of Sonthold or any comprehensive planning being undertaken in the Town. Re: Addendum to Memo Dated October 2002 Request or Waiver from Local Law Temporary Moratorium on the Processing, Review of, and making Decisions on the applications for Major and Minor Subdivisions, and Special Use Permits and Site Plans containing dwelling Unit(s) in the Town of Southold for the major subdivision of Perino/Nastasi SCTM# 1000-122-7-9 Date: January 6, 2002 This memo serves as a addendum to the memo issued on the subject on October 15, 2002. In this memo, the Planning Board will further address the request in the context of land use planning and Chapter ^106 as defined by the Town of Southold Town Code; the consideration of and any comment upon any other reasons as stated, are beyond the scope of this review. The proposed action involves the subdivision of a 20.8211 acre parcel into 7 lots with the following lot sizes: Lot 1:1.003 acres, Lot 2:1.46 acres, Lot 3: 1.92, Lot 4:1.78 acres, Lot 5:1.58 acres, Lot 6 1.34 acres and Lot 7 11.37 acres. Lots 1 through 6 are intended for single family residential development. Lot 7 is a mix of residential and agricultural use. All lots are served by a 52.02 foot wide right-of way off of Main Road. The proposed project will utilize private sanitary and well systems within individual lots. The Planning Board has reviewed and stated the progression of the application in the preceding memo (attached) and based upon such, had made a recommendation that the Town Board grant the request of waiver for the application. This decision is based upon the following facts: Land Use - The project site is located in an area that contains a mix of residential, commercial and agricultural uses. The dominant land use in the immediate vicinity is residential, with agricultural land located farther to the west and commercial uses located to the noah along Main Road (Rte 25). The proposed application is generally consistent with the surrounding uses. The site is currently vacant land, with the proposed development resulting in 7 residential lots. Transportation Infrastructure - The proposed action is expected to increase traffic generation on S.R 25. However, traffic Impacts have been assessed through the State Environmental Review Act process and no si,qnificant impacts were identified. Natural Resources - This parcel is wooded in the noah and in early successional growth in the southern portion of the parcel where the parcel has been cleared to accommodate an agricultural use. The applicant has accommodated all recommendations that the Planning Board has requested for the Covenant and Restrictions including the integration of a USDA prepared Conservation Plan outlining Best Management Practices for the Agricultural Easement Area further protecting the natural resources, including groundwater. Water Supply - Sanitary disposal within the proposed subdivision will be managed by on-site underground sewage leaching systems. The proposed application would conform with Article VI of the Suffolk County Sanitary Code and would not be expected to adversely affect groundwater quality provided properly functioning systems are designed and installed. The applicant has received Suffolk County Department of Health approval, updated July 26, 2002 on the maps dated April 14, 1997. The applicant proposes water supply through private wells. Water use was reviewed through the SEQR process. No significant impacts to the water supply were identified. Rural Character- No reduction in home density, perpetual preservation of open space, limits of clearing or landscaping plan has been proposed, therefore, the application does not fully support the preservation of rural character. The Planning Board has mandated a natural buffer "screen" along S.R. 25 and the residential properties to the east to mitigate the visual impacts of development of the parcel. No known archeological items have been identified or are known to occur on site. Agricultural Lands - The project would result in the creation of an 11.37 acre Agricultural Easement Area, and therefore will result in a gain of agricultural use within the general area. The residual land area (9.45 acres) will be developed and result in a permanent loss of agriculture use. Open and Recreation Space - The site is comprised of woodland and open space (where the trees were removed). All lots are to be held in private ownership, therefore, no potential for public/community recreation use exists on the property. The applicant has submitted a Park and Playground Fee. It is the Planning Board's finding that the proposed project although not fully supporting the planning objectives of the Town of Southold which include the preservation of open space and recreational space; the preservation of the rural, cultural and historical character of the hamlets and surrounding areas and the preservation of the natural environment; has undergone the planning process as mandated and deftned by Chapter A106 within the Town of Southold Town Code and has met with satisfaction all requests and decisions rendered by the Planning Board over the past six years. The changes were made, however, the moratorium was soon enacted and therefore, the application could not proceed. As stated above the Planning Board recommends the Town Board grant the request of waiver for the application. If granted, the Planning Board would: 1. Close the public hearing 2. Issue conditional final approval upon the completion of the following conditions: a. Proof of posting a bond for all work to be completed in the State right-of- way. The approval of the Bond Estimate dated July 30, 2002 as determined by the Town Engineer in the amount of $108,550.00 and the administrative fee of $6,513.00 by both the Planning Board and Tow2~ Board. Just to give you alittle background, our request to sub-divide this property began early in 1997. It has been proceeding with the Town Planning Board since our original request. Approydmately four months ago, my wife and I attended a Planning Board meeting, with our prior attorney, Charles K Cuddy. The Plaxu~g Board adx4sed us, at this meeting, that everything they needed was submitted and we should get our approval in the next six to eight weeks. They advised us of a few mi~or items needed, which were given to them by Mr. Cuddy. A Public Planning Board Hearing was scheduled for August 12, 2002 at 6:00 p.m- A copy of letter of notification of this hearing is attached. Unfortunately, I was out of town on business on that date, but my wife attended the hearing with our then attorney, Charles R~ Cuddy. It was at this meeting that my wife heard (and later I learned) for the first time that Charles R. Cuddy had been requested bythe Planning Board, to make some minor changes to the map. 3/Ir. Cuddy agreed to the changes, but he did not have anew map prepared ~br the meeting. Apparently, because this wasn't done, our subdivision could not be approved that evening. The Planning Board agreed to accept a new map and leave our sub-division hearing open until the map was presented to them. To date, we have not heard from the Planrdng Board regarding our conditional approval.. While the comments that were made at this meeting were directed to Mr. Cuddy, it is our family that is being penalized for another's inaction. Charles C'uddy asked Young and Young to prepare another map to reflect the requested changes and I hand delivered the new map to Carol at the Planning Board on August 16, 2002 at 11:20 am. ThereaRer, a momtorinm was adopted and my family is again, waiting for tbeir right to sub-divide the property and build our house, as we have wanted for so long. My- youngest daughter has recemly come to Iive with us and it was our hope to have had our homo consU'ucted by now since we have been enduring the expense of rearing until we eau build our home. It is our understanding the Planning Board has all that is needed to approve tiffs sub- division at this time. We respectfully request that a waiver l~om the moratorium be granted to us and the Town Planning Board approve the sub-division that we have so long been lookin~ forward to. Presently we are in the process of moving to 2260 Wunueweta Road, Cutchogue, N.Y. 11935, and ask that any and all correspondence he sent to this address.
