On October 21, 2003, we fded an application requesting an exemption from the Toxxa's
Subdivision lVIoratorium for the property re£erenced above That request is now not needed, as the
Southold Plam~ing Board resolved to treat the proposed action as a set-off during their work
session of December 15, 2003. A set-off of property is specifically exempted from the Town's
Subdix4ston Moratorium. Therefore, kindly accept this correspondence withdrawing the October
21-~ request tbr exemption from the To~x n's SnbdivSsion Moratorium.

Dear Members of the Board,
This Firm represents Amelia Mendoza, who owns the 27-acm parcel referenced
above. Mrs. Mendoza proposes to set-offa 7.044 acre waterfront parcel fi:om the 27-acre
parcel. Application is hereby made pursuant to Section 6 of Local Law 13, "A Local
Law in Relation to a Ninety-day Extension of the Temporary Moratorium on the
Processing and Review of, and making Decisions on applications for Major Subdivisions,
Minor Subdivisions and Special Exception Use Permits and Site Plans containing
Dxvelling Unit(s) in the Town of Southold" ("Subdivision Moratoriun~")_

Application for set-off of a 7.044-acre parcel fi:om a 27-acre parcel was made to
the Planning Board on September 18, 2003. The application was made subsequent to a
meeting with the Planning Board during which the Planning Board determined that such
set-offwas exempt from the Town's Subdivision Moratorium. Subsequently, the
Planning Board determined that the proposed set-off was not exempt from the
Subdivision Moratorium because a 3A acre parcel described as SCTM # 1000-15-2-16
was once part of the parcel but separated by deed sometime in the late 1960's or early
1970's. Thus, the Planning Board determined that our request to set-off 7.044 acres
constituted a set-off fi:om a previous a set-off that is not authorized in the Subdivision
Moratorium_
Subdivision Moratorium - Appeal
Appeal is hereby requested for the proposed 7_044-acre set-off on the basis that
the previous creation of'A-acre parcel described as SCTM # 1000-15-2-16 has caused
extraordinary hm'dship to the applicant and that the granting of the variance or waiver
would not adversely effect the purpose of the local law, the health, safety or welfare of
the Town of Southold or any comprehensive planning being undertaken in the To~_
Specifically, the creation of the %-acre lot occurred decades prior to the adoption of the
Subdivision Moratorium thereby causing extraordinary hardship to the applicant. In
addition, the applicant has offered to covenant the 7.044-acre parcel set-off fi:om the 27-
acre pamel existing today against further subdivision. That is, because the 7.044 acre
parcel could not be further subdivided, no adverse effect to the health, safety and welfare
of the Town or its comprehensive planning being undertaken would occur as a result of
this Board granting a variance or waiver fi:om the Subdivision Moratorium.
Application Contents
Consistent with the requirements of the Subdivision Moratorium, I attached the
following:
(1)
Copy of correspondence fi:om Bennett Orlowsky, Jr., Chairman of
the Southold Planning Board dated October 15, 2003 to Brace
Anderson rejecting the filed set-off application_
(2)
Seven copies of the survey prepared by Joseph A. Ingegno last
dated September 6, 2003 that shows the overall parcel and the
7.044-acre parcel to be set-off. The 7_044 acre parcel is designated
Lot 1 on the survey. Lot 1 could not be further subdivided as per
covenant.
(3)
Tax Map showing the overall property and the ~A acre parcel
(highlighted) that caused the hardship experienced by the
applicant_
(4)
Check made payable to the Town of Southold in the amount of
$250.00 covering the application fee for variance or waiver.
By way of this correspondence, I request that the processing of this
request for variance/waiver commence immediately trod as per the processing
requirements of Section 6 of the Subdivision Moratorium Law. Please do not
hesitate to contact this office should your require additional materials ur have any
questions regarding this request.
