431 SOUTH©LD TOWN BOARD MINUTES Meeting of August 28, 1973 The Southold Town Board met at the cffice of Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York, at 3:00 P.M., Tuesday, August 28, 1973, with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Justice Martin Suter Justice Louis M. Demarest Justice Francis T. Doyen Town Attorney Robert W. Tasker Superintendent of Highways Raymond C. Dean Town Clerk Albert W. Richmond Absent: Councilman James Homan Moved by Justice Suter, seconded by Justice Demarest, it was RESOLVED that the minutes of August 16, 1973 be and they hereby are approved. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doy~en. Moved by JuStice Demarest, seconded by Justice Doyen, it was RESOLVED that the next meeting of the Southold TownBoard will be ~eld at 3:00 P.M., Tuesday, September 11, 1973 at the office of Supervisor Martocchia/~16 SouGh Street, ~G~eenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, JUstice Surer,. Justice Demarest, Justice Doyen. Moved by Councilman Rich, seconded by Justice Suter, it was RESOLVED ~that the Southold Town Board accept the report of the Southold Town Board of Assessment Review. V~te'of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. Moved by Councilman Rich, seconded by. Justice Doyen, WHEREAS Wendell Tabor.has resigned az Assessor and Chairman of the Board of Assessors, and WHEREAS Section 22B of~the Town D~w allows the Town Board of any Town having more than one assessor to establish the office of Chairman ~of the Town Assessors, Who in addition to his regular duties shall perform such services in connection with assessment and taxation of property for State, County and Town purposes as ~he B~ard shall direct, NOW, THEREFORE, BE IT RESOLVED that David Walker be and hereby · s desighated to held the office of Chairman of the Board of Assessors until the first day'of January sext succeeding such des~nation, all in accordance with Section 22B of the Town Daw, and be it further ~ RE~OLVEDthat the compensation for such appointment be fixed at $500.00 per year payable ~n regular semi~monthly~payments. Martocchia be authorized to notify the Security National Bank to release Escrow Acc~ont E.58007 to the free control of the Security National Bank as follows: $80Q0000 Hempstead UFSD ~ 11 Bond 3~50 due 6-1~78. Moved by Justice Suter, seconded by Councilman Rich, WHEREAS Zdzislaw Mikotajczyk.applied to the Town Board for a single trailer renewal permit dated August 10, 1973, NOW, THEREFORE, BE ]~RESOLVED that the application of Zdzislaw Mikolajczyk to locate a single trailer on his property at the south side of a private road (John'~s Road) off east side Main Road, Mattituck, New York, be and hereby is granted for a six (6) month period. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich,~ Justice Suter, Ju~ice Demarest, Justice Doyen. Moved by Councilman Rich, seconded by Justice Demarest, WHEREAS Isadore P. Krupski applied to the Town Board for a single trailer renewal permit dated August 15, 1973, NOW, THEREFORE, BE IT RESOLVED that the application of Isadore P. Krupski to locate a single trailer on his property at the north side of Main Road, approximately 1000 feet east of Skunk Lane (Bay Avenue), Peconic, New York be and hereby is granted for a period of slx (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Suter, seconded by Justice Doyen, WHEREAS W. Edgar Worthington applied to the Town Board for a single trailer renewal permit dated August 10, 1973, NOW, THEREFORE, BE IT RE~OLVED that the application of W. Edgar Worthington to locate a single trailer on his property at the south side of Sound Avenue, Mattituck, New York, be and hereby is granted for a period of six (6) months. Vote of the Town Board: Ayes: Supervisor Martocc~ia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Suter, seconded by Councilman Rich, it was RESOLVED that one member of the Building Department be and hereby is authorized to attend the New York State Building Inspector Conference on September 20 and 21, 1973 at Fallsburg, New York, and be it further RESOLVED that the actual and necessary expenses to travel, meals and lodging incurred while attendhg said conference be a legal charge against the Town of Southold. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Suter, seconded by Justice Demarest, it w~ RESOLVED that Justice Francis T. Doyen be and hereby is authorized to attend Advanced Training Courses for Justices the week of September 23, 1973 at the Concord, and be it further RESOLVED that the actual and necessary expenses to travel, meals and lodging incurred while attending said training course be a legal charge against the Town of Southold. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. R~peal of enactments not included in Code. Ail local laws and ordinances of a general and permanent nature of the Town of Southold, in force on the date-of the adoption of this local-law and not contained in such Code or recognized a~d continued in force by reference therein, are hereby repeal-ed from and after the e~ffective date of this lodal law. ~ 1-4. Enactments saved from repeal; matters not affected. The repeal of local laws and ordinances provided for in § 1-3 of this local law shall not affect the following Classes of local laws, 9rdinances, resolutions, rights and obligations, which are hereby expressly saved from repeal: A. Any right of liability established, accrued or incurred under any legislative provision of the Town of. Southold prior to the effective ~date of this local law or any action or proceeding brought for th~ enforcement of'such right or liability. B. An offense or act committed or done before the effective date of this local law in violation of any legislative provision of the Town of Southold or any penalty, punishment or forfeiture which may resu.lt therefrom. C._ Any prosecution, indictment, action, suit or other proceeding pending, or any judgment rendered prior to the effective date of this local taw brought pursuant to any legislative provision of the Town of Southold. D. Any franchise, license, right, easement or pr~vileg9 heretofore granted or conferred by the Town of Southold. E. Any local law, ordinance or resolution of the Town Of Southold providing for the laying out, opening, a~tering, widening, relocating, straightening, establishing grad~, changing name, improvement, acceptance or vacation of any right-of-way, easement, street, road~ highway, park or other public place within the Town of Southold, or any portion thereof. F. Any ordinance or resolution of the Town of Southold appropriating money or transferring funds, promising or guaranteeing the payment of money or authorizing the issuance and delivery of any bond of the Town of Sou~h01d, or other instruments er evidence of the town's indebtedness. G. Local laws, ordinances or resolutions authorizing the purchase, sale, lease or transfer of property, or any lawful contract or obligation. H.The levy or imposition~of special assessments or chargers. I.The dedication of prpperty. J.Any local laws, ordinances or :resolutions relating to salari~' K.Any ordinance or resolution amending the Zoning Map adopted by the Zoning Ordinance of 11-23571. L. The Police Department Rules and Regulations approved by resolution of the Town Board 8-1Q-65. M. The Highway Specifications approved by resolution of the Town Board 3-11-70. N. Any ordinance or local law adopted after 5-29-73. ~ 1-5. Affect on previously adopted legislation. In compiling and preparing the local laws, ordinances.and resolutions of the town for publication as the "Code of the Town of Southold" as d~stributed and designated in the table in ~ 1-2 hereof, no changes in the meaning or intent of such local laws, ordinances and regulations have been made. ~ 1-6. Severability. If any clause, sentence, paragraph, section, Article or part of this Article or of any local law or ordinance cited in the table · n ~ 1-2 hereof shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined i~ its operation no the clause, sentence, paragraph, section, Article or part thereof directly involved in the controversy in which such judgment shall ha~e been rendered. --~ ~ 1-7. Copy of Code on file. A copy of the Code in loose-leaf form, has been filed in the office of the Town Clerk of the Town of Southold and shall remain therefor the use and examination of the public until final action zs taken on this local law, and, if this local law shall be adopted, such copy shall be certified to by the Town Clerk of the Town of Southold by impressing thereon the seal of the Town of Southold, and such certified copy shall remain on file in the office of said Town Clerk to be made available to persons desiring to examine the same during all times while the said Code is in effect. § 1-8. Amendments to Code. Any. and all additions, deletions, amendmen2s or supplements to any of the local laws, ordinances and resolutions known collec[ively as the "Code of the Town of Southold," or any new local law, Ordinances i.,44,3 or resolutions, when enacted or adopted in such form as to indicate the .intention of the Town Board to be a part thereof, sha~l be deemed to be incorporated into such Code to be a part thereof, shall be understood and intended to include such additions, deletions, amendments or supplements. Whenever such additions, deletions, amendments or supplements to the Code shall be enacted or adopted, ~hey shall thereafter be printed and, as provided hereunder, inserted in the loose-leaf book containing the said Code, as amend- ments and supplements thereto. Nothing contained in this local law shall affect the status of any local law, ordinance or resolution ~o.ntained herein and may be amended, deleted or changed from time to time,as the Town Board deems desirable. Legislation originally adopted by resolution may_ be amended by local law, ordinance or resolution. Legislation originally adopted by ordinance may be amended by local law or ordinance. Legislation originally adopted by local law maybe amended only by another local law. § 1-9. Code book to be kept up-to-date. It shall be the duty of the Town Clerk to keep up-to-date the certified copy of the book containing the "Code of the Town of Southold" required to be filed in the office of the Town Clerk for the use of the public. Ail changes in said Code and all local laws, ordinances and resolutions adopted by the ~own Board subsequent to the enactment of this Article in such form as to indicate the intention Of said Town Board to be a part of said Code shall, when finally enacted or adopted, be included therein by temporary attach- ment of copies of such changes or local laws, ordinances or resolutions until such change or local lawsj ordinances or resolutions are pri~ed as supplements to said Code book, at which time such supplements shall be ins~mted therein. ~ 1-10. Sale of Code book; supplementation. Copies of the Code may.be purchased from the Town Clerk of the Town of Southold upon the payment of a~ fee to be set by resolution of the Town Board, which may also arrange by resolution for procedures for the periodic supplementation' thereof. § 1-11. Penalties for offenses. Any. person~who, without authorization from the Town Clerk, changes, or amends, by additions or deletions, ~any part or portion of the?'Co~e of the Town of Sou~hold," or who alters or tampers with such Do~e in any' manner whatsoever which will.cause the legislation of the Town of Sou~thold to be m~srepresented thereby, or who violates an~ other provision of this local law shall be guilty of an offense and shall, upon conviction thereof, be subject to a fine of not more than two hundred fifty dollars ($250.) or ~mprisonment for a term of not more than fifteen (15) days, or both. ~ 1-12. Incorporation of provisions into Code. The provisions of this local law are hereby made Chapter 1 of ~the '"Code of the Town of Southold," to be ent'itled "Genera'~ Provisions, Article-I, Adoption of Code," and the sections of' this local law' shall be numbered ~ 1-~ ~o 1-13 inclusive. § 1L13~ When effective. This local law shall take effect immediately upon filing with ~the~Secretary of State of-the State of New York. WHEREAS, this board desires to hold a public hearing with respect -to said local law, NOW, T~EREFORE, BE IT RESOLVED--that a public hearing be held by this board with respect to the adoption of the aforesaid local law at the Supervisor's Offic~ 16 South Street, Greenport, New' York, at 3:30 o'clock P.M. on the llth day of September 1973, and it is further - RESOLVED that the Town Clerk be and he hereby ~s authorized and directed t~ cause public notice of said hearing to be given as ~pr0vided by law. -Vote of the Town Board: Ayes: Supervisor Martocchia', Councilman Rich, Justice Suter, Justice Demarest, Justice Doyen. Zaleski has mad~ application to the Town Board to dedicate certain roads in Mattituck, New York, to be known as "T~IERESA DRIVE", "RICHARD STREET", and "DONNA DRIVE" as shown on subdivision map entitled "Map of Deephole Creek Estates" filed in the Suffolk County Clerk's Office on January 28, 1965, as Map No. 4256, together with release executed by the owner thereof, and WHEREAS the Southold Town Highway Superintendent has inspected the said highways and has advised the Town Board that said proposed highways comply in all respects with the specifications for the dedication of highways in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED that in accordance with Section 171 of the Highway Law of the State of New York, consent be and the same is given to the Superintendent of Highways to make an order laying out the aforesaid highways, to consist of lands described in said application as shown on certain maps attached to said application, and BE IT FURTHER RESOLVED that the Town Clerk be and he hereby is authorized and directed to forthwith ~ause the dedication, release and deed to be recorded in the offiee of the C~rk of the County of Suffolk, New York.
