Moved ~y Justice Demarest, seconded by-Councilman Homan, WHEREAS Terri Etak has requested a one ~ear leave of absence from her posi~i~o~n the Building Department, NOW,~ THEREFORE, BE IT RESOLVED that Terri Elak be and hereby is granted a maternity leave of absR~ce not~ to ~exceed one ~1) year, beginning September 28~ 1973, without pay. Such employee, upon the expiration of such period of leave of absence, shall be restored to the same or comparable position of employment if the same is available. Moved by Councilman Rich, seconded by Justice Demarest, it was RESOLVED that the road improvement bond for Longview Lane, Rambler Road, Pleasan~ Place and Watersedge. Way in-the amount of $10,500.00 be and hereby ~s renewed with the Security ~ational Bank. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, J~stice Surer, Justic~ D~marest, Justice 40.2 Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED that the law suit against Mr.' Frias, relative to fence height violation, be discontinued as the Zoning Ordinance has been amended and Mr. Frias is no longer in v~olation. Moved by Justice Suter, seconded by Justice Doyen, it was RESOLVED that Bond No. 73-S~12374 BCA issued by the Aetna Casualty and Surety Company in t~e name of Alfred R. Grebe, Jr., Town Constable, Town of Southold, in the sum of $4,000.00 be and the same is hereby approved as to form, manner of execution and sufficiency of sureties therein. Moved by Justice Demarest, seconded by Councilman Homan, it was RESOLVED that a $37,000 grant for the Southold Town Narcotic Council from the Suffolk County Narcotic Addiction Control Commission be accepted by the Town Board. Moved by Councilman Rich, seconded by Councilman Homan, WPiEREAS, proposed Local Law No. 1 - 1973 was introduced at a meeting of this board held on the 19th day of June, 1973, and WHEREAS, a public hearing was held thereon by this board on the 17th day of July, 1973 at which time all interested persons were given an opportunity to be heard thereon, NOW, THEREFORE, BE IT RESOLVED that Local Law No. 1 1973 be enacted as follows, to wit: LOCAL LAW NO. 1 - 1973 A LOCAL LAW TO AMEND THE PENALTY PROVISIONS OF CERTAIN EXISTING ORDINANCES AND LOCAL LAWS OF THE TOWN OF SOUTHOLD Be it enacted by the Town Board of the Town of Southold as follows: Section 1. A. The penalty sections of certain existing ordinances_of the Town of Southold, as enumerated below, are hereby amended to read as provided in Subsection B below. (1) Section 7 of the Bicycle and Motorcycle Ordinance adopted 10-2-15. Q (2) Section 5 of an ordinance adopted 5-21-57 regulating the burning of rubbish. (3) Section VIII of an ordinance adopted 4-7-70 Regul~ating the Use of Parking Areas at Southold Town Beaches. (4) Section 2 of the Good Order Ordinance adopted 9-21-65. (5) Section 3 of the Peddling and Soliciting OrdiNance adopted 4-7-70. B. The sections enumerated in Subsection A above are hereby amended to read as follows: "Any person committing an offense against any provision of this ordinance shall, upon conviction thereof, be guilty of a violation punishable by a fine not exceeding two hundred fifty dollars (~250.) or by imprisonment for a term not exceeding fifteen (15) days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this, ordinance, shall constitute, for each day the offense is continued, a separate and d~stinct offense h~e~nder." Section 2. A. The penalty sections of certain existing ordinances of the Town of Southold, as enumerated below, are hereby amended to read as provided in Subsection B below. (1) Section 4 of-an Ordinance Regulating the Placing ~ Obstructures in and on Town Waters and Public Lands and the Removal of Sand and Gravel from Lands Under Town Waters, adopted 5-18-59. (2)Next to last paragraph (unnumbered) of the Public Docks Ordinance adopted 6-28-53. (3)Sectio~ 11 ©f the Boat Ordinance adopted lI~4-60. (4)Sectio~ 4 of an Ordinance Regulating the Raising and Keeping of Ducks adopted 5-24-49. (5) Section XIII of the Excavation Ordinance adopted 2-16-65. (6) Section 18 of an Ordinance Providing for the Regulation of Tourist Camps, House Trailer Camps, House Trailers or Similar Establishments (as renumbered 9-24-58 from Section 22) adopted 6-30-53. B. The sections enumerated in Subsection A above are hereby amended to read as follows: ~A. Any person committing an offense against any provision of this ordinance shall, upon conviction thereof, be guilty of a violation punishable by a fine not exceeding two hundred fifty dollars ($250.) or by imprisonment for a term not exceeding fifteen (15) days, or by such fine and ~mprisonment. The continuation of an offense a~ai~st the provlslonsof this ordinance .shall constitute, for each day the offense is continued, a separate and distinct offense hereunder. "B. In addition to the above-provided penalties, the Tow~ Board may also maintain an action or proceeding in the name of %he town in.a court or competent jurisdition to compel compliance~with,or restrain by ~njunction the violation of_this, ordinance."_ Section 3. Section V of the Ordinance Prohibiting and Regulating the Disposal of Garbage and Rubbish adopted 3-23-48 and amended in its entirety 6-25-65 is hereb~ amended to read as follows: "A. Any person committing an offense against any provision of this ordinance shall, upon conviction thereof, be guilty of a violation punishable,by a fine not exceeding two hundred fifty dollars ($250.) or by imprisonment for a term not exceeding fifteen (15) days, or by such fine and imprison- ment. The continuation of an offense against the provisions of this ordinance shall constitute~ for each day the offense is continued, a separate and distinct offense hereunder. "B. Any person committing an offense against the provisions of this ordinance shall be subject to a civil penalty enforce- able and collectible by the town in the'amount of one hundred dollars ($100.) for each. such offense. Such ~enalty shall be collectible by and in the name of the town for each day that such violation shall continue. "C. In addition to the above-provided penalties, the Town Board may also maintain an action or p~o~eeding in the name of the town in a court of competent jurisdiction to compel compliance with or to restrain, by ln~unction the violation of, this ordinance." Section 4. Section 1100 of Local Law No. 1-1967, entitled "A Local Law Establishing a Housing Code for the Town of Southold," is hereby amended to~ read as follows: "A. Any person committing an offense against any provision of this local law, or any person who fails to comply with a notice or order within the time limit stated thereon, shall, upon conviction thereof, be g~ilty of a violation punishable by a fine not exceeding two hundred fifty dollars ($'250.) or by imprisonment for a term not exceeding fifteen (15) days, or by both such fine and imprisonment. The continua- tion of an offense against the provisions of this local law shall constitute, for each day the offense is continued, a separate and distinct offense hereunder. "B. In addition tb the above-provided'penalties, the Town Board 'may also maintain an action or'proceeding in the nam~ of the Town in a court of competent jurisdiction to compel compliance with or restrain by injunction the violation of this local law." Section 5. S Section VII of an Ordinance licensing and Regulating Secondhand Junk and Auto Parts Activities and Businesses adopted 8-10-65 is hereby amended to read as follows: "A. The owner or licensee of any such place of business who commits or permits the commission of any offense against any of the provisions of this ordinance shall be deemed ~ to have committed a violation and shall be liable for any such offense or the penalty therefor. Each day such offense shall continue or be permitted to exist shalll constitute a separate offense. "B. For every offense against any provision of this ordinance, the person committing the same shall, upon conviction thereof, be subject to'a fine of not more than two hundred fifty dollars ($250.) or imprisonment~not exceeding fifteen (15) days, or by both such fine and imprisonment. "C. Convi~tionffor any abo~e-mentioned offense shall constitute and effect an immediate forfeiture of the license. "D. Any person committing an offense against this ordinance shall, upon conviction thereof, be subject to a civil penalty enforceable and collectible by the town in the amount of one hundred dollars ($100.) for each such offense. Such penalty shall be collectible by and in the name of the town for each day that such offense shall continue. "E. In addition to the above-provided penalties and punishment, the Town Board may also maintain an action or proceeding in the name of the town in a court of competent jurisdiction to cogpel compliance with or to restrain by injunction the offense against such ordinance.' Section 6. Section XI of An Ordinance Regulating the Taking and the Manner of Taking Shellfish in the Town of Southold adopted 6-23-66 is hereby amended to read as follows: "A. Any person convicted of an offense against any provision of this ordinance sh~llbe deemed to have committed a violation against snch ordinance, and also shall be liable for any such offense or penalty therefor. "B. For every offense against any provision of this ordinance, the person committing the same shall be subject to a fine of not mome than two hundred fifty dollars -($250.) or imprisonment not exceeding fifteen (15) days, or by ~o~h such fine and imprisonment. "C. A second conviction' for ~n offense against any of the provisions of this ordinance within a period of one (1) year shall constitute and effect an immediate forfeiture of a permit issued to such person. No new permit shall q be issued to such person.for at least one (1) year after such forfeiture. "D. Any person committing an offense against this ordinance shall be subject to a civil penalty enforceable and collectible by and ih the name of the town. "E. In addition to the above provided penalties and punishment, the Town Board may also maintain an action or proceeding in the name of the to~n in a court of compete~nt jurisdiction to compel compliance withl or to restrain by injunction, the offense against this ordinance." _Section 7. Section 3~0 0f An Ordinance Regulating Dredging, Filling and Construction Operations on Wetlands in the Town of Southold adopted 6-29-71 is hereby amended to read as follows: "A. Any person committin~ an offense against any provision of this ordinance, or failing to comply with a notice of viola, tion issued by the Building Inspector, shall, upon conviction thereof, be ghilty of a violation punishable by a fine not exceeding two hundred fifty dollars ($250.) or by imprisonment for a term not exceeding fifteen (15) days, or by both such fine and imprisonment. The continua- tion of an offense against th~ prediCtoRs of this ordinance shall cohstitute, for each day the o~fense is continued, a separate and dls~ihct offense hereunderl "B. In addition to the above-provided penalties, the Town Board may also maintain an action or proceeding in the name of the town in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this ordinance." ~ ' ~ Section 8. Moved by Councilman Rich, seconded by Councilman Homan, WHEREAS proposed Local Law No. 2 -1973-was introduced at a meeting of this board held on the 19th day of June~ 1973, and WHEREAS, a public hearing was held thereon by this board on the 17th day of July, 1973 at which time all interested persons were given an opportunity to be heard thereoh, NOW, THEREFORE, BE IT RESOLveD that L~cal Law ~o. 2 - 1973 be enacted as follows, to wit: LOCAL LAW NO~ 2 - 1973 A LOCAL LAW ~OPROVIDE FOR THE CONTROL OF LITTER IN THE TOWN OF SOUTHOLD Be it enacted by the Town Board of the Town Of Southold: §57-1. Definitions. _ For the purposes of this ~ocal ~aw, the following words, phrases and terms and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future; words used in the plural number include the singular; words used in the singular number include the plural; and words in the masculine include the feminins and' the neuter. The wor~ "shall" is always mandatory and not merely directory. AUTHORIZED PRIVATE RECEPTACLE -- A litter storage and collection receptacle of steel, aluminum or plastic, of ten (10) to thirty (30) gallsns capacity, with tight cover, or larger steel container with closed lid. GARBAGE -- Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consdmption of food. HANDBILL -- Any printed or written mat%er, any sample or device, dodger, circular, lea~t, paper, booklet or any other printed or otherwise reproduced original or copies of any matter of literature'. LITTER -- Garbage, refuse and rubbish, as defined herein, ~nd all other waste material which, if thrown or deposited as herein prohibited, tends to create ~ danger to-pdbli~ health, safety and welfare or tends to create blight. NEWSPAPER -- A printed ~ublication issued at regular intervals, including any periodical or current magazine regularly published with not less than four (4) issues per ~ear and sold to the public, commonly containing news, comment, features and advertise- ments, including any "newspaper" duly entered with the Post Office Department of the United Sta~es ~ acc0rd~nce with federal statute or regulation. PARK -- A park, reservation,' playground, beach, recreation center or any other public area in the ~gwq, owned or operated by the town and devoted to ackive or passive recreation. PERSON -- Any_person, firm, partnership, association, corporation, company or~ o~gahization o~ any kindl PRIVATE PREMISES -- Any house, building or other structure not owned or operated by the town, whether inh~b~ted or temporarily or cas~inu~usly unihhabited or vacant, including any yard, ground, .parking lot, Walk, driveway, p~rch Steps., vestibu~& or mailbox belonging or appurtenant to such house, building or other structure. PUBLIC PLACE -- Any and all streets, sidewalks, bpulevards, alleys or other public ways, and' any and all public parks, beaches, squares, spaces, grounds and buildings. RE~USE -- As def'ined in the Town of South01d ordinance regulating t~e disposal of garbage and rubbish. RUBBISH -- Nonputresc~ble sol'id wastes Consisting of both, combustible and noncombustible wastes, such as, but not limited to, paper wrappings, cardb~ard, tin cans, Wood, glass, bedding, crodkery. TOWN -- The Town of Southold. VEHICLE -- Every device in, upon or by which any person or property is or may be transported or drawn upon a highway or public street. ~57-2. Litter in public places. A. No person shall throw or deposit litter in or upon any street, ~dewalk or other public place within the town except in public receptacles or in authorized private receptacles for collection, or as provided in the ordinance regulating the disposa! of ~arbage and rubbish. B. Persons placing l'itter in public receptacles or-in authorized private receptacles sh'all do so in such a manner as to prevent it from being carried or deposited by the q the elements upon any street, sidewal~ o~ Other Public place or upon private property. C. No person shall s~eep into or deposit in any gutter, street or other public place within the town th~ accumulation of litter from any building or lot or from any public or private sidewalk or drive~ay. D. Persons owning or occupying property shall keep the sidewalk in front of their premises free of litter. ~57-3. Litter f~O~ v~hicles~- A. No perB~on shall throw or- deposit~ litter from any vehicle upon a~y street or other public placewithin the"town or upon private property. B. No person shall 'drive or. move any vehicle or truck~ within the town,- the wheels 'or ~ires of~ Which carry 0nt6 or deposit in any street, alley or other public place sticky substances or foreign matter Of such kind as adheres to the road surface. ~57-4. Litter in parks, beaches and bodies of' water% A. No person shall throw or deposit litter in any park or beach ~ithin the town except in public receptacles and in such a manner that the' litter w~ll be prevented ~rom being carried~ or deposited by the' elements upon any part of the park ~o~ b~ach or upon any street or other public or private place. Where public receptacles are not provided, all such litter shall be carried away from the park or beach by the person responsible for its presence and properly disposed of ~lsewhere, as provided'herein. B. No person shall throw or deposit l~itter in any pOnd, river, stream 'or 'other body of water within the town. ~57-5. Litter on private property. A. No person shall throw or deposit litter on any private proper property within the ~town, whether owned by such person or not and whether occupied or vacant, except that the owner or person in control of private property may maintain authorized private receptacles for collection in such a manner that litter will be prevented from being carried or dep deposited by the elements upon any street, sidewalk or other ~57 -6. A. public place or upon private property. B. The owner or person in c~ntrol of ~r~ate property or any portion thereof shall at all times maintain the premises or that portion controlled by him free of litter, except when stored properly-in authorized private receptacles for collection, when such person shall have actual notice thereof or when said litter shall have been present a sufficient length of time to constitute constructe~e notice. Handbills. In public places. No person shall throw or deposit any handbill in or upon any sidewalk, street or other public place within the town. No person shall hand out or distribute any handbill in any public place except to persons willing to accept it. B. On vehicles. No person shall throw or deposit any handbill in or upon any vehicle; except it shall not be unlawful in any public place for a person to hand out or distribute a handbill to any occupant of a vehicle who is willing to accept it. C. On private property. No person Shall throw or deposit any handbill in or upon any private premises which are: (1) Temporarily or continuously uninhabited or vacant. (2) Posted with a sign placed in a conspicuous position near the entrance thereof, bearing the wor~s "No Peddlers or Agents," "No Advertisements"oDr words ~f similar import indicating the desire of the occupants not to have such handbills left upon such premises, or where an occupant expressly directs the person not to throw, deposit or distribute the handbill on the premises. (3) Inhabited, but not posted or subject to an express warning,by an occupant, except by handing or transmitting any such handbill directly to an occupant, unless he places or deposits any such handbill so as to secure or prevent it from being blown or drifted about the premises or sidewalks, streets or other public ways. D. The provisions of this section shall not apply to the distribution of mail by the United States Postal Service nor to newspapers (as defined, herein), except that newspapers shall be placed on private property in such a manner~as to prevent their being carried or deposited by the elements upon any street, sidewalk or other public place or upon private property. §57~7. Penalties for offenses. Any person committing an offense against any of the provisions of this local law shall be punished, upon conviction, by a-fine not exceedigg two hundred fifty dollars ($250.) or by imprisonment not exceeding fifteen (15) days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this local law shall constitute, for each day the offense is continued, a separate and distinct offense hereunder. §57-8. When. effective. This local law shall become effective immediately as provided by law. §57-9. Severability. If any clause, sentence, paragraph, section or part of this local law shall be adjudged by any court of competent jurisdicti,on to be invalid, such judgment shall not effect, or impair or invalidate any other clause, sentence, paragraph, section or part of this local law. Moved by Councilman Rich, seconded by Justice Demarest, WHEREAS, proposed Local Law No. 3 - 1973 was introduced at a meeting of th~s board held on the 19th day of June, 1973, and W~IE~EAS, a public hearing was held thereon by this board on the 17th day of July, 1973 at which time all interested persons were given 4O8 an opportunity to be heard thereon, NOW, THEREFORE, BE IT RESOLVED that Local Law No. 3 1973 be enacted as follows, to wit: LOCAL LAW NO. 3 - 1973 A LOCAL LAW TO PROVIDE FOR'THE LICENSING AND REGULATION OF PEDDLERS AND SOLICITORS WITHIN THE TOWN OF'SOUTHOLD Be it enacted by the Town Board of the Town of Southold: ARTICLE I §69-100. Legislative intent. This local law is enacted for the purpose of regulating itinerant merchandising in order 1that the peace, health, safety, welfare and goodorder of the town and of the inhabitants thereof, shall not be endangered or unduly d±st~rbed .... §69-101. Definitions. For the purpose of this local law, the terms 'used herein are defined as follows: ESTABLISHED PLACE OF BUSINESS -- Any building, store or depository in whic~ or where the person transacts business and deals in the goods, wares and merchandise he hawks, peddles or solicits. HAWKER and PEDDLER -- Except as herein expressly provided, any person, principal or agent who, in any public street or highway or publiC place, or by going from houSe to'house or place of business to place ofbusiness, on foot or on or from any vehicle standing in a street or highway, sells or barters, offers for sale or barter or carries or ~xposes for sale or barter any goods, wares or merchandise, except as hereinafter exempted. MERCHANDISING -- Refers to the'selling, bartering or trading, or offering to sell, barter or trade, Of any goods, wares, commodities or services. PERSON -- Any individual~ firm, partnership, corporation, unincorporated association and~all other estit&es of any kind, or any principal or agent thereof. SOLICITOR -- Any person who goes from place to place or house to house, or Stands in any street or public place, ta~ing! or offering to take orders for goods, wares or merchandise, except as herehafter Dxempted, or-fOr services to be performed in the future, or for making, manufacturing or repairing any article or thing whatsoever for future delivery. §69=102. License required. It shall be unlawful for any person, within the limits of the Town Of Southold, to act as a hawker, peddler or solicitor, as herein defined, except in conformity with the provisions of this loca~ law, and without first having obtained and paid for hh~ing in force and effect a license, as provided herein. ~69-103. Applicatinn requirements. Every applicant for a license under this local law shall file with the Town Clerk a swbrn written application, in duplicate, on a form to be furnished by said Clerk, which shall gzve or be accompanied by the~following: A. Name and description of the applicant. B. Permanen~ home address and full local address of the. applicant. C. A brief statement of the nature of the business and a description of the merchandise or service to be sold.. D. If employed, the name and address of the employer, together with credentials establishing the exact relationshipl. E.The length of time 'for which the license is desired. If a vehicle iD to be used, a description of'such vehicle and its license number. G. The place where the goods Or property to be sold or offered for sale are manufactured or produced, where such goods or property are located at the time such application is filed and the proposed method of delivery. H. A ph6tograph of the applicant taken within sixty (601) days immediately prior to the date of the application, which photograph shall clearly show the head and shoulders of the applicant and shall measure two by two (2 x 2) inches. 409 I. Two (2) business r~ferences located in the County of Suffolk, State of New York, or, in lieu thereof, such other available evidence of the character and~business responsibility of the applicant as will enab, le an investigator to properly evalaate such character and responsibility. J. A statement as to whether the applicant has been convicted of any crime, misdemeanor or violation of any municipal ordinance, the nature of the offense and the punishment©~r penalty assessed therefor. K. The fingerprints of the applicant. §69-104~. Investigation and issuance of license. Upon receipt of such application, the original shall be referred to the Chief of. Police of the Town of Southold, who shall cause such investigation of the applicant's business and moral character to be made as he deems necessary for the protection of the public good. A. If as a result of such investigation the applicant's character or business responsibility is found to be unsatisfactory, the Chief of Police shall endorse on such application his disapproval and his reasons for same and return the said application to the Town Clerk, who shall notify the applicant that his application is disapproved and that no license will be issued. A hearing upon such disapproval shall be held, upon appeal, as provided in 69-11 . B. License feeS. ~ ~ - " .~ ' The fee for each license issued pursuant to ~this :local law shall be twenty-five dollars ($25.) per year or ten dollars ($10.) per-day or fractio~th'ereof. : § 69-106. -Li~ense~ cohditiOns. ~'' A. A license shall not be assignable. Any holder of such license who permits it to be:~Sed by a~y other person, and any person-who uses such license granted to any other person, shall be gUilty of any offense against this local law. B. Each Such license'issued shall automatically expire on December 31 following the date of issuance thereof, but sudh-license'may provide'for"an~:earl~er expiration date. C. No'applicant t~ whom a license has been refused or who has had a license which has been revoked shall make further application, until a period of at'~east twelve (12) months shall"have elapsed since the last'previous rejection or revocation, unless he can show that the reason for such ~ejection or revocation no longer exists. D. Every licenseee, while exercisting his license, shall carry the license whk~ and shall exhibit the sameupon demand to any police officer or citizen. ~69~107. Records. - . ~ It shall be the duty of the Town Clerk to keep. a.record of all applications and~of atl~ licenses..granted under-the provisions of this local law, giving the number and date of each license, the name and residence of the person licensed., the amount-~Qf the license fee paid and also the date of revocation-~of a~! licenses revoked. §69-108. Employees of licensee. Any licensee.using a motor vehicle may,employ not more than two (2) persons to assist in-selling and: delivering the wares, but such persons 'shall'also act only while accompanying a licensed peddler, hawker or solicitor. .410 ~69=109. Not stand or.permit the vehicle used by him to stand in one (1) place in any. public place or street for more than ten (10) minutes, or in front of any_premises for any ~ime if the owner or the lessee of the premises objects. Not create or maintain any booth or stand., or place any barrels, boxes, crates or other obstructions, upon any street or public place for the purpose of esell or exposing for sale any goods, wares or merchandise. Not sell confectionery or ice cream within five hundred (500) feet of any school between the hours of 8:00 a.m. and 4:00 p.m. on school days. Not sell or. peddle prepared foods or any kind, including ine cream, cenfeDtionery, beverages, p~epackaged snack foods, .hot. dogs, hambBrgers andoother sandwidhes, on any town beach npon which is located a concession stand operated under an agreement with the town, or ~n any parking area adjacent thereto. Revocations; h~arings._ ~ Causes. Licenses .~ssue~ under ~he .proy~sio~s of this local law may be revoked by the Town Boa~d of the Town of Southold after notice and hearing ~or any of the following causes: ........ (1) Fraud., misrepresentation or false sta~D_ment contained in in the application for a license. (2) Fraud, misrepresentation or false statement made in the course of carrying on his~business as a hawker, peddler or solicitor. (3)Any violation of this local.law. (4)Conviction of any crime or misdemeanor involving moral turpitude. (5) Conducting the bBsiness_o~_peddling, hawking or soliciting in an~:nnlawful manner or in such a manner as to constitute a. breach of the. peace_or to constitute a menace to the ~ealth, safety or general welfare of the public .... Notice of hearing for revocation or refusal of a license shallsbe given in writiDg, s~ting fo~t~hspecifically the grounds of complaint and the time and place of hearing. Such notice shall be mailed to the licensee at his last known address at least ~ive (5) days prior to the date .set for hearing. Exempgions. No part of this local law shall be enforced so as to conflict withArticle 4., Section 32, of the General Business Law of the State of-New'~York, providing for exemption for veterans'. The requirements of this local~ law shall not app~ty to the following, provided that. official~-uniforms, clothing or other suitable identification is displayed: (1) Any recognized nonprofit religious,-charitab%e, educational,- civic or political organization. (2) ~snsh organizations as the Boy Scou~s, Girl Scouts or local volunteer firemen~ C. Nothing in this local law shall be held to apply to: (1) Sales conducted pursuant to statute or by order of any court. (2) Persons selling person property~at.wh01esale to d.ealers in such articles. .(3) Merchants having an established place of business w~thin the town, or their employees. (4) The peddling of meats, fish, fruit and similar produce by farmers and persons who produce such commodities. (5) Dealers ~n milk, baked goods, heating 0il and daily newspapers. (~6~ Licensed real estate brokers. ~69-112. Signs. Appropriate signs, as the Town Board of the Town of Southold shall deem necessary, shall be erected by the Highway Department of the~Town of Southold at such places within the Town of Southold as the Town Board directs, advising of the existence of this local law. §69-113. Penalties for offenses. Any p~rson committing an offense against any provision of this local law shall, upon conviction thereof, be guilty of a violation punishable by a fine not excceding two hundred fifty dollars ($250.) or by imprisonment for a term not exceeding fifteen (15) days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this local law shall constitute, for each day the~offense ~s continued, a separate and distinct offense hereunder. §69-114~ W~hen effective. This local law shall become effective immediately as provided by law. §69-115. Severability. If any c~use, sentence, paragraph, section or part of this local law shall be adjudged by any .court of_competent jurisdiction to be invalid, such judgment shall not effect, impair or invalidate any other clause, sentence, paragraph, section or part Qf this local law. ~69-116.
