SOUTHOLD ,TOWN BOARD MINUTES
Meeting of January 23, 1973
The Southold Town Board met at the.office of Supervisor .Albert M.
Martocchia, 16 South Street, 'G~eenport, New York, at 3:00 P.M.,
Tuesday, January 23, 1973, with the following present:

Moved by Councilman Hogan, seconded by Councilman Rich, it was
RESOLVED that the minutes of January 2, 1973 be and they hereby
are approved.

RESOLVED that the next meeting of the Southold Town Board will be
held at 3:00 P.~, Tuesday, February-13,~ 1973 at.the office of
Supervisor Martocchia, 16 South Street, Greenport~ New York.

Supervisor Martocchia asked all to stand for a minute of silence
in memory'of former President Lyndon B. Johnson.
The following resolution was offeredby Justice Suter, who moved
its adoption, seconded by Councilman Rich, to wit:
BOND RESOLUTION DATED January 23, 1973.
A RESOLUTION AUTHORIZING THE ISSUANCE OF $24,000
SERIAL BONDS OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY,
~ NEW YORK,~ TO PAY ~HE COST OF THE AQ~ISITION OF
CERTAIN REAL PROPERTY IN AND FOR THE MATTITUCK PARK
DISTRICT IN SAID TOWN.
WHEREAS, the, Board of Park Commissioners of the Mattituck Park
District. in the Town of Southold, Suffolk County, New York, duly
adopted a resolution on the 13th. day of~ Dscember.~ 19~2, .authorizing
the acquisition of certain real property,~as_therein described, in
and for said Park District, at, a maximum estimated cost, including
incidental expenses, of $24,000, which resolution requests this
Town Board to authorize the issuances.of $2~,000 serial bonds~of
said Town to pay said maximum~ e.stimated cost; NOW~ THEREFORE BE IT
RESOLVED, by the'TOwn Board of the ~own of Southold., Suffolk
County, New York, as follows: .
Section 1. For the specific object.or purpose of paying the
cost of the acquisition of the real property referred to in the
preambles hereof in~and for the~Mattitu~k .Park ~istrict in the Town
of Southold, Suffolk County, New York, there'_are ~ereby authQrized
to be ~issued $24~000 serial bonds of said Town pursuant to-the
Local ~inance Law.: ...... - ·

Section 2. The maximum estimated cost of such specific object
or purpose, including incidental expenses, of $24,000, and the plan
for the financing of such maximum estimated cost is by the issuance
and sale of $24,000 serial bonds of said Town herein authorized.
Section 3. It is hereby determined that the period of probable
usefulness of such object or purpose, pursuant to subdivision 21 of
paragraph a of Section 11.00 of the Local Finance Law, is thirty years,
and that the maximum maturity of the bonds herein authorized will
exceed five years.
Section 4. The faith and credit of the Town of Southold,
Suffolk County, New York, are hereby irrevocably pledged for tke
payment of said bonds and the interest thereon. To pay said bonds
and the in~rest thereon, there shall annually be levied and assessed
against the taxable real property of said Park Distr±ct, and collected
in the same manner, at the same time, and by the same officers as
the taxes of said Town are levied, assessed and collected, an amount
sufficient to pay such principal and interest as the same respectively
become due and payable, but if not paid from such source, all the
taxable real property within the Town will be subject to the levy
of ad valorem taxes to pay said bonds and interest the~'eon without
limitation as to rate or amount. ~
Section 5. Subject to the provisions of the Legal Finance
Law, the power to authorize the iss~uance of and to sell bond
anticipation notes in anticipation of the issuance and sale of
the serial bonds herein authorized, including renewals of such
notes, is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents,
and shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Fiance Law.
Section 6. The validity of such bonds and bond anticipation
notes may be conteated only if:
1) Such obligations are authorized for an object or purpose
for which said Town of Southold is not authorized to
expend money, or
2) The provisions of law which should be complied with at
the date of publication of this resolution are not
substantially complied with,
and an action, suit or proceeding contesting such validity is com-
menced within twenty days after the date of such publication, or
3) Such obligations are authorized in violation of the
provisions of the Constitution.
Section 7. This resolution, which takes effect immediately,
shall be published in full in the Long Island Trav~er-M~ttituck
Watchman, a newspaper published at Southold, Town of Southold, New
York, and in the Suffolk Times, published at Greenport, Town of
Southo~d, New York, both papers having a general circulation within
the Town of Southold, together with a notice of th~ Town Clerk in
substantially the form provided in Section 81.00 of the Local
Finance Law. .........
The question of the adoption of the foregoing resolution~was
duly put to a vote on roll call, which resulted as follows:
Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan,
Justice Suter, Justice Demarest.
The resolution was thereupon declared duly adopted.
Moved by Justice Demarest, seconded by Councilman Rich,

decking on the Mystic Isle, approximately 400 square feet:
Thames Shipyard & Repair Co. - Total Price $6348.00
Price per pound installed $1.15
Newport Shipyard - Total Price $8500.00
Price per Dound installed $1.54
NOW, THEREFOKE, BE IT RESOLVED that the Southold Town Board
approves the action of the Fishers Island Ferry District in
accepting the hod for the specified work on the Mystic Isle

from the Thames Shipyard & Repair Co., the lowest bidder at $6348.00.
Ail work to be done according to the specifications.

Moved by Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the Southold Town Board authorizes the Fishers Island
Ferry District to advertise for bids for two engines for the M/V
Mystic Isle. The acceptance of any bids by the Commissioners of
the Fishers Island Ferry District shall be subject to the approval
of the Town Board of the Town of Southold, Suffolk County, New York.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Board approves the action of the
Fishers Island Ferry District in hiring the firm of Doherty &
Company of New London, Connecticut to do the necessary auditing
and financial reports for the Fishers Island Ferry District.

Moved by Justice Suter, seconded by Councilman Rich, it was
RESOLVED thatthe following bonds issued by The Aetna Casualty
and Surety Company be approved as to their form, manner of execution
and sufficiency of sureties therein:
Bond No. 73 S-7377 BCA - W. Gordon Ahman - $1,000.00
Bond No. 73 S-12140 BCA - Francis T. Doyen - $4,000.00
Bond No. 73 S-688 BCA - Raymond Doyen - $1,000.00
Bond No. 73 S-689 BCA - Elizabeth McCloskey - $20,000.00

Moved by Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Board approves the action of the
Fishers Island Garbage and Refuse District whereby they increased
the fee for the Commissioners meetings from $10.00 to $15,00 per
meeting.

Moved by Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that a letter be forwarded to Hon. Perry B. Dureya,
Speaker of the Assembly, The Capitol, Albany, New York, urging
him to use his influence on the State Legislature for the passage
of the two Bills to amend Article 3 and Article 9 of the New York
State Constitution, thereby enabling the erection of Peconic County.

Moved by Councilman Rich, seconded by Justice Suter, it was
RESOLVED that a letter be forwarded to Hon. Leon E. Guiffreda,
Senator, The Capitol, Albany, New York, urging him to use his
influence on the State Legislature for the passage of two Bills
to amend Article 3 and Article 9 of the New York State Constitution,
thereby enabling the erection of Peconic County.

Moved by Councilman Rich, seconded by Councilman Homan,
WHEREAS the Southold Fire Department is holding their Third Annual
Parade and Tournament on July 7th, 1973 at 6 P.M. and ask permission
to use part of Bayview Road, Lower Road, Acklery Pond Lane, HoCkey
Creek Drive to form; Main Road to parade to the Fire,House and part
of Boisseau Avenue near the railroad tracks to disband the parade,
(rain date July 8th, 4:00 P.M.), now, therefore, be it

RESOLVED that the Southold Fire Department be granted their afore-
said request on the Town roads specified. A request must be made
to the State of New York for the use of Main State Road.

Moved by Councilman Rich, seconded by Councilman Homan,
WHEREAS a petition was received from William B. Conway on behalf
of William B. Conway and Wilfred Jerome Conway, Southold, New York,
requesting a change of zone on certain property situated at Southold,
said petition for a change from "A" Residential and Agricultural
District to "B-l" General Business District,
NOW, THEREFORE, BE IT RESOLVED that the Town Clerk of the Town of
Southold be and he hereby is directed to transmit this application
to the Southold Town Planning Board in accordance with Article XVI,
Section 1600 of the Building Zone Ordinance of the Town of Southold.

NOW, THEREFORE, BE IT RESOLVED that the Southold Town Board accept
the bod of 2.90% by the Valley Bank of New York on the $30,000.00
Grand Avenue Bridge Construction Bond Anticipation Note.

Moved by Councilman Rich, seconded by Justice Demarest, it was
RESOLVED that the Southold Town Board would consider the offe~?~'
made by the Village of Greenport of land on which a new Southold
Town Hall could be constructed.

Moved by Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that Southold Town provide guaranteed ordinary death
benefits upon the death of its employees as covered under Section 60-b
of the Retirement and Social Security section of New York State Law.

RESOLVED that Sherley Katz be and she hereby is reappointed to
represent the Town of Southold in the CAST program for 1973.

Moved by Justice De~arest, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Board accept the resignation of
William McGonegal, Police Patrolman, a position to which he was
appointed on March 1, 1971. Resignation effective as of January
29, 1973.

Moved by Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Board accepts the bond of $100,000.00
for roads and improvements in the subdivision known as "Lands End"
located at Orient Point, New York, owned and developed by Lands End
Realty, 108 Allen Boulevard, Farmingdale, New York.

RESOLVED that the Superintendent of Highways of the Town of Southold
be authorized to advertise for bids and to purchase from the lowest
responsible bidder, the following, more or less, as may be needed:
(a) 2500 tons of 3/8" Blue Stone, to be delivered
by truck to the Highway Department Yard, at
Peconi~, .N.Y., and each truck must have a
weight slip.
(b~ - Price loaded on Town trucks, .from Barge, at
Mattituck, New York.

Moved by Councilman Homan, seconded by Justice Suter~ it was
RESOLVED that the Town Clerk be and he hereby is directed to
request the Long Island Lighting Company to install:
1 - 100 CP light on Pole ~49, end of PeqDash Ave., Cutchogue.
2 - 175 MV lights on LILCO Poles ~203 and ~206, in front of
the East Cutchogue School, Route 25, Cutchogue.

RESOLVED that Supervisor Albert M. Martocchia be and he ~eby is
authorized to advertise for a new 1973 pick-up truck for the Dog
Warden.

Moved by Justice Demarest, seconded by Supervisor Martocchia, it was
RESOLVED that Frederick E. Gordon, Greenport, New York, be appointed
to the position of Trustee on the Board of Southold Town Trustees
effective February 1, 1973, and to serve in that capacity until the
next general election in November 1973.

Moved by Councilman Rich, seconded by Justice Demarest,
WHEREAS bids were received for tax computer service from: Parity Systems Corp. $10,700.00
Belmil Computer Service, Inc. - $9,200.90
NOW, THEREFORE, BE IT RESOLVED that the bid of B&lmil Computer
Service, Inc. at $9,200.00 be accepted for the tax bill and
assessment book service for the Town of Southold.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Delegations were present to discuss, pro and con, the renaming of
Skunk Lane back to Bay Avenue at Cutchogue, New York. No decision
was reached.
