Dear Joseph Sbarra,
Based on the information you submitted, the Department of Environmental
Conservation has determined that the portion of the property landward of the
topographic crest of a bluff in excess of 10 feet in elevation s shown on the survey
prepared by Steven F. Barylski, darted October 19, 20,19, is beyond Tidal Wetlands Act
(Article 2 )jurisdiction.Therefore, in accordance with the current Tidal Wetlands Land
Use Regulations 1(5 NYCRR fart 661), no Tidal Wetlands permit is required to conduct
regulated activities landward of the 30-foot elevation contour (topographic crest).
In addition, DEC has determined that the demolition of the slab and portion of the
existing residence within Tidal Wetlands Act jurisdiction is greater than 75 feet from the
tidal wetlands boundary and is listed in the Tidal Wetlands Land Use Regulations (6
NYCRR Part 661.5) as an activity that is not regulated.'Therefore, no permit is required
under the Tidal Wetlands Act.
Be advised, any additional work or modification to the project:as described, may require'
DEC authorization. it is your responsibility to ensure that all precautions are taken to
prevent any sedimentation or disturbance within Article 25 jurisdiction which may result
from your project, Such precautions may include maintaining adequate work area
between the jurisdictional boundary and your project(i.e. a 15'wide construction area)
or erecting a temporary fence, barrier, or hay bale berm.

in-ground pool with a 400sq.ft.patio surround,pool enclosure fencing,pool equipment area;
and to install an 11A OWTS sanitary system;with the condition to establish and perpetually
maintain a non-disturbance area running from the 30' contour line or the seaward end of the
neighbor's fence,towards the water; and a non-turf area running from the 30' contour line or
the seaward end of the neighbor's fence,landward to the pool fence; a revegetation plan to 1
address the clear cutting of the lot; and as depicted on the revised landscape plan prepared by,
Dragonfly Landscape Design,LTD.,received on January 26,2024 and stamped approved on
March 21,2024,and on the survey prepared by Steven Barylski,last revised January 11,2024
and stamped approved on March 21,2024.
