SOUTHOLD TOWN BOARD SPECIAL MEETING September 19, 1978 WAIVER OF NOTICE OF. TOWN BOARD MEETING mE, the undersigned, being members of the Town Board of the Town of Southold, Suffolk County, New York~ do hereby severally waive notice of the time, place and purpose of the meeting of the Town Board to be held at Southold, in the Town of Southold, on Tuesday, September 19, 1978 at 10:00 A.M. and do hereby consent that the same be held on said date for the transaction of any business which may properly come_.~ before said meeting. Drum /s/ James Homan /s/ Martin suter A special meeting of the Southold Town Board was held on Tuesday, September 19, 1978 at the_Southold Town Hall, Main Road, Southold, New York. Supervisor Martocchia opened the meeting at 10:00 A.M. with the following present: Supervls_or Albert M. Martocchia Justice Martin Suter ~Councilman James Homan Councilman Henry W. Neville A~sen~: .Justice~Francis T~ ~oyen Superintendent.of Hiqhways,-Raymond ~Dean, informed the Boa~rd that in regard to ~landfitl opsrations, he has been.trying to find out exactly what the state would approve onan incinerator or compactor-and exactly what-funds.are available, Federal Revenue Sharing or State, to us for this undertaking. ~Lr. Dean said that he asked~Ro~ert E~, ,.Acie~n~ of wal~er ~ndustries. Inc,. to check on this matter as he is up in the Albany are,a. ~e asked him to check on it if we go to a com~a.c~or whether or not the state ~i~l accept it? Are %here .any grants from the state to help us do this-work? Fir. A¢ierno went to the State at Albany and also to-the, DEC at Stonybrook. He had several meetings ~ith them during which he explained exactly what our situation · s out here; what our population is; and~what water problems we have here. Mr. Aclerno stated that the State indicated to him that they would like to see a regional_situation take ~place, at ~i~erhad. ,-But they do. not know when this could take-place, sometime in the unforeseen future. ~ Mr. Acne,no pointed-out to~he state, that a bailin~ ,,type of operation would ~work. very well because of the number of small communi- ties in this area. They agreed that this type of operation would be very beneficial in this area. The state regional office brought up the possibility of Southold Town taking in the refuse from Shelter Island Town. In doing this, Southold~could~become a regional fa.ci.lit~. In certain ~nstances, regional facilities are allowed 50% funding. They suggested that the Town write them an informal letter and that they would then respond back in an informal manner advising the Town what technical aids would be available, what funds would be available and whether in fact a regional facility at Southold would be possible. They recognize that they have a problem with Shelter Island because they really can't put any type of facility over there, they are burying their refuse. The small'amount' of revenues that they generate over there really cannot produce the capital outlay to put in required landfill operations. So they recognize Shelter Island as a problem and they would like to see the refuse come off of Shelter Island. Mr. Aciern0 said that he felt that the Town of Southold could benefit from this situation. If we calculate the amount of refuse that Shelter Island generates~it is a very small amount compared to what South~Id could gain.- Mr. Dean~said that he thought that the State is looking for a leader in this'area, the Town of Southold could be it~ Mr. Acierno said that we are in for more stringent landfill operations in the future. Mr. Dean asked by what date? Mr. Aclerno said he did not know exactly. Mr. Acierno stated that it is his opinion that Southold will never be in a better position to have so much cooperation from the state. He read a rough draft of a letter theft the Town could send to the State. Mr. Acierno stated that this letter in an informal manner would bring more information to us then we would otherwise have available. Mr. Acierno welcomed questions from the Board members. Supervisor Martocch~a said that this is really just a way of reaching out to see what ~s available to us. Mr.. Acierno said that if the Town can get a 50% funding by taking in Shelter Island at this point, they should do it. If someone else does it, the Town will never hav~, this opportunity again. Supervisor Martocchia asked how the Village of Greenport ~buld fit in. They are now using our disposal area, cOU~d they become part of the regional package. Mr. Acierno said "yeR", "absolutely", it would be a question to the state as to whether it would mean extra funding. Councilman Homan stated that both the Town of.Shelter Island and Village of Greenport should be contacted prior to sending this letter to the state. Mr. Homan asked what the price of th~ facility would be without the funding. Mr. Acierno stated about a half a million'd~llars. Mr. Homan asked that if we are fortunate enough to receive the 50% funding from the state, does Mr. Acierno know of any other ~unding that is available, Federal or otherwise? Mr. Acierno said that he didn't. They would have to check around. Mr. Homan asked what the operational costs of such a facility are. Mr. Acierno, stated that he did not have operational costS becase they haven't gotten to'that point yet. Mr. Homan stated that they had to have an idea of how much manpower, how much machinery, etc. would be necessary.~ In relation to our present system~ what would be operational difference? Mr. Dean stated that all it would require would'be a smal~ f~rk-~ift to lift the bail, a small front~end loader to push the material that · s dumped into the hopper. Mr. Acierno sa~d that if we are operating with 3 people now, it would not require additional manpower. Mr. Pell asked how placing all the cement blocks under the earth will affect water filtration. Mr. Acierno stated ~%hat it will naturally~be~less. But with a regular lan~ill operation, you will be required to line the entire area, whereas with thin, bailing operation, you will only have to line the container. Mr. Homan asked' how long he could operate as w~ presently are before the state will require us to go to the compactor~- Mr. Dean said he thought about 5,6, or 7 years. If we go compactor, it would be extended to apProximately 25 years. Mr. Dean stated ~that we mine our own sand, it is the most economical way of getting it; we don't have to buy it. It also gives us a continuous 25 ft. hole, which is very unique. Mr. Dean has asked Mr. Acierno to inquire if we to compactor whether we would have to use theliner because he does not want to put out thousands of dolors to install and maintain it. Mr. Pell stated that if we initiate this, we will be doing two things: [1} a stop gap by going to the compactor; (2) if they do go to in- cinerators, we will already be a reqional cQmpa~ting station. Town Attorney Tasker aske~ if the state goes to inc~nerators,.would they accept, this type of, bail. Mr. Acierno said that they would have to break the bail down. Mr. Tasker asked that if they were accepting the bales and it were costing them money to break them down wouldn't the Town,,have to pay for them. Mr. Acierno stated that it takes a great deal of equiPment to put the bale together, but it doesn't take,that much to break themapart. Fir. Pell stated that if we have to tmans~port it, this would be the most economical way to transport it. Mr. Acierno said that they recognize this fact that it could switch into a trans~grtatiqn' system. Supervisor Martocchia asked what type of system Riye~head and Southampton is ~o__~ly~.working on. M~.~ A¢~erno~,stated that they have no solid proposals at this time. Supervisor Martocchia said that this letter to the state would be an exploration letter to find out what would be available to us. _Mr. ,Pei1 asked about HUD funds. Supervisor Martocchia stated that difference monies are available, we will have to explore all possibili- ties. The Board discussed cost with available funding and thought that the least amount it could cost the Town would be $ 100,000. Mr. Homan asked where there is a facility such as this already constructed. Mr. ACierno stated t~a~,smithtgwn has such a facility. Supervisor Mar~occhia asked if th~ were satisfied with their facility. Mr. Acierno said yes, they did have some unique problems with their landfill area, but he understands that has been resolved with the state. Supervisor Martocchia asked if anyone would have~y ob- jections to a lette~ of inquiry going out tothe State. M~. Pell stated that the Mayor of the ~illaqe of Greenport and the S~pervisor of,She~er Island, should be contacted prior to it b~g sent out~ supervisor Martocchia said that they would be sent a copy of the rough draft 1et%er and an.~explana~i~n'and asked if they~ would concur with such a proposal. Mr.. Dea~stated that he felt that t~3earlier we go with this, the more benefits we will get from the.state. Councilman Drum and Councilman Pell will visit the Smithtown site. It seems that the S~ffelk Coun~y,Planni'nq Commissiog w~.~s to put in a 13,000 acre exemption in South01d=ToWn. We now have on an individ6al basis'an~exemption Of 2,6'50 a~res~?'~They have application forms from our local farmers for a-21900 acre' district-. Councilman Ho~a~--asked if the assessment c0u~d-'be r~is~d if we-go along with-~this. Town Attorney Tasker stated that='they~could=and~sh0uld raise the 9~sessment. The ~andowners already=have one ~a'x exemption from t~e Town AssessOrs, th~s new program ~wo~ld~-entitle-them. bo another one. Our assessme.nt on,agricnltural land is now-far below what is predicted by the,~arm B~reap~now. ~Flr. T~sk~r stated that~it~was-his'u~derstanding.'%hat~'the dis~rid~ could not be Created without~-the consent of the landowner and he has heard tha't~a':lot of our farmers do ~ot want ~t. If.they get a 50% exemption oh their taxes, then we'would have to make-up the 50% in our tow~ assessment~ Mr& Tasker 'stated th~ our assessors are supposed to properly ~sseSs the property--and'he: does not think that $250. per. acre plhs an agric%lturat distriat~on top of--it% to cut it in-hail i~ right. Mr.-Tasker stated-that the agricultural~land should be.assessed at around $1,000. - $1,500'. per"aCre and then give them half of that.- Fir'.' Pelt Stated that our farmers ~hould-realize'-that=.what they are being aSsessed at now is less than what they would pay ~n thi~ .. district. Supervisor Martocchia stated that Dennis Hgrley has-asked that the Board-make'-:a re6.ommendation t0~him~and-he witi honor their position and fight-for it. · - · On motibn of Henry-'D~um; seconded-by Councilman'Homan, it was RESOLVED tha~ the Southold Town~'Board recommend to' the. Suffolk County Leqislature a~ 2,900 acre exemption unde~ the Farm Preservaltion Proqram. Vote of th~ Town Board: Ayes: CounCilman Pell, Councilman Drum, Councilman Homan, JustiCe Suter, Supervisor Martocchia. Absent: Justice Doyen.- ........ Supervisor Martocchia reported that he and Superintendent Dean attended a meetin~ 'on the'HUD pro,ram funds at Ke~ron.'Barnes office at the' Labor Department. We have-receivsd=a let'ter 'that they $700,000. ~-~on h~nd because Of the towns that=did not apply and qualify by sehd~ng i~'.the amended Year ZII-resolution with al~ ~he condition's. However, the Town of Smithtown has began,titiqation~' against this.-' Their grant was 'sup-pos'ed-to be $500,000.-. S~, now with the 'bourt proceeding~ ~t~rting ag-ain-st-it by the Town of Smi'thtow~ you do 'not ha~e $~00,000. to divide Up.- The money-noW..-becomes c:ondition~l. YOU m~st s~gn ~ paper 'stating tha~t if you get your share of-the $700,000. and the court rules in favor of Smithtown, you must ~i~e back'your share. Nobody wanted to sign that. If the court reules in favor of _~~and sets precedent, Lindenhur'st' Will then come into the picture. They~did not. sure, but if there is a-precedent set, they will. The~, there would~?~tbe anything~ left of the'money-anyway. So they decided to' h01d it up by setting conditions on it. Some of the things you could apply for the money for are road improvement, road drainage, and expansion of your recreation-cen~er and str.eet lighting. The most the Town could~ g~t out of this~ i-s $20,000. under their formula~' The.' litigation by the Town of smit~tow~ could ho~d the f~nds up ~or several years or more,~ if 'they~ rule~ against them.and they appealed. Supervisor Martocchi'a .reported that Ke~ron Barnes is go~ng to develop something for us to consider on small cities monies. The Town of Southold would ~qualify as a small city, he understands there is quite a bit of money available under this. Supervisor Martocchia announced that he ~s having a meetin~ wi~h Peter ,Jones from CATV ~nd anyone who would like to attend is invited. Supervisor Martocchia announced that he would like to meek with the finance committee in regard to the budqet. On motion by Councilman Drum, seao~ded by Justice Suter, it was RESOLVED that there being no further business to come before this Town Board meeting adjournment be called at 11:45 A.M.
