September 5, 1978
A regular meeting of the Southold Town Board was held on Tuesday,
September 5, 1978 at the Southold Town Hall, Main Road, Southold,
New York. supervisor Martocchia opened the meeting at 3:00 P.M.
with the following present:

appeared before the Board and presented a 5 ft by 10 ft. American
Flag to the Town on behalf of the $outhotd Chapter, Daughters of .
the 'American Revolution. This flag is to be flown at the site of
this new town hall, and they "hope it will wave for a long time."
Supervisor Martocchia expressed the sincere appreciation of the
Town Board and the people of the Town of Southold.

RESOLVED that the next regular meeting, of the Southold Town Board

Southold Town Hall, Main Road, Southold, New York.

On motion of Justice suter, seconded by Councilman Drum, it was
RESOLVED that the following a~ited bill~, be approved for PaYment.:
General Fund Whole Town bills in the amount of $21,440.94; General
Fund Part Town bills in the amount of $5,835.12; Highway-Department
bills in the amoUnt of $14,8~8~16; Fishers ts-land Ferry District
bills in the amount of $34,854~.47;'~nd Federal Revenue sharing-bills
in the amount of $960.65.

On motion of Councilman Homan, seconded by Councilman Pell, it was
RESOLVE~D that the August 1978 reports of the Supervisor, Town Clerk,
Assessors, Building Dep~rtment, Justice Suter, Justice Rich, be and
hereby are accepted and ordered placed on file.

1. Notification has been received from the county of suffolk
that the Year III .Commu~nity Development.funds in the amount of ~93,.000..
have been released to the Town of Southold. These funds will be used
for the construction of the Senl~or Citizen/Youth Center
On motion of Councilman Drum, seconded by Justice Suter, it wa~s
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to sign an agreement with the Count~; of. Suffolk for the
,completion of a senior Citizen/¥outhCenter using Year III Community
Development funds in the amount of $93,000.00. --

On motion of Justice Suter, seconded by Councilman Drum, it was
RESOLVED that Supervisor Albert M. Martocchi~ be and he hereby is
authorized to.contact the firm of Sacco, Ahlers, Brown, ~rchitects.
and E~qineers for the Senior citizen/Youth Center project on pec0nic
Lane, Peconlc, and advise them to proceed with preparation of the
bidding specifications for this project, in compliance ~with the'~rules
and regulations of the HUD contract.

RESOLVED that ~ani~t Lathamr Orient, New York, be and hereby is
recommended by the Town of Southold to serve as a member.of the
Suffolk County Select Committee on the Acquisition of Development
Riqhts,pf Farmland., the position recently vacated by Henry F. Moisa.

RESOLVED that the Town Board of the Town of Southold ~¢'~ a bond..
in the amount of $]00~000.00 for the roads and improvements in the
subdivision known ,as "~n~ry ~lub Estates," and recommended by Town
Engineer Law~c~ M. Tuthill.

2. Correspondence has been received from Ron zie%, President
of the.St~a~ Locomotive 39 Fund Committee, Inc. askin~ the suppor~
of the Town Board on a resolution before the Suffolk County Legisla-
ture which calls for the County to supply $50,000. to get engine~ No. 39
into operation to promote tourism in Suffolk County.---The Board~ has
discussed this proposal and feel they do not wish to support such a~
resolution.
3. Letter from ~h.~tic?¢hari~ies. asking that a representative
of the Town of Southold be present on September 12, 1978 at an~
Board meetinq. This board is being established to 'facilitat~~communi-
cation between their Community Life Centers and the community as ~well

as to take advantage of the c~nsel and guidance of local citizens.
---Councilman Drum will be present at this meeting.
4. Elaine F. Kaldor, Certified Public Accountant, has sub-
mltted estimates for performing a.fin~l audit in connection with the
.t~o ~ederal Droj'ects presently under way in the Town. Main Bayview
Road, Southold approximately $560.00 and Town~Ha~l Addition approx-
imatel~%1020~00. This is all in accordance with Section IV I of the
Department of commerce's "Audit Instruction for Local Public Works
Gra~ts Under Title I of the Public Works Employment Acts of 1976 and
19.77."
On. m0tion of Justice Suter, seconded by Councilma~ Homan, it was
RESOLVED that the amount of $27,000. be and hereby is approved for a
propOsed, lbond for the roads and ~improvements in the subdivision known
as "Sou%hold Gardens" located ~at Southold, New York, all in accordance
with the!. reCommendation of the Town Engineer Lawrence M. Tuthill.

5. Letter from Kerron Barnes, Community Development Director,
asking for Southold Town's participation in the Home I~provem.ent
~roqram. This program will provide Home Improvement Loan~ to eligible
South61~ Residents at an annual interest rate of only 3%. The County has
allocated $20,000. to the Town for this purpose.
On motion of Councilman Homan, seconded by Councilman Pell, it was
RESOLVED that the Town of Southold is interested in participating in
the Home Improvement Proqram. sponsored by the County of S~ffolk.
It is understood that participation requires no financial or adminis-
trative commitment on the part of the Town of Southold. Permission
i's hereby granted for the County~to serve the residents who have applied
for HOme ImproVement Loan~

6. Letter from County Leqislator Denis R. Hurley advising
of a meeting of the Aqricultural Districtinq Advisory Committee this
evening, Tuesday, September 5, 1978 at 8:00 P.M. at the Agricultural
Extension Building on Griffing AvenUe, Riverhead. This will b~ open
discussion on the Farm Pro~ram and how the Town of Southold feels about
it. The Town Board at the present time ~s not prepared to take a posi-
tion on this matter, they are not sufficiently informed as to the rami-
fications. If it is going to affect the tax base too much by too much
property going into exempt they will have to take a hard look at it, be-
cause everything that goes into exempt comes back to those who pay to
make up the difference.
7. Notification from the suffolk County Department of Public
works that on or abou~ 8/28/78 dredqinq operations will commence at
~Cedar ~each Harbor Inlet, wickham Creek.~, and Halls Creek.
8. A Certi.fication of Incorporatio~ of.T~e seniors Club of
Southold-Peconi~c, Inc., a new group, ~as been received. ' This is
merely a notification to the Town Board.
9. Letter from The Amerigan National Red. Cros~ Suffolk
County Chapter, requesting that the Town of Southold sign an agree-
ment permitting the Red Cross to .use the Nutri.~ion Center, St. Agnes
Church, Greenport', as a facility in the e.vent of disaster. Supervisor
Martocchia talked to Father Rocco this morning and verbally he agreed
to such an agreement. Once he has agreed in writing it will be trans-
mitted to the Red Cross.

10. There wiil'be'a meetin~ on Thursday, September 7th at
9:30 A.M. at the.Brookhaven National Laboratory in Upton, hosted.by
the Town of Brookhaven on the protection and preservation of the..under-
ground water supply ~n the Nassau-Suffolk rggion.---There will probably
be a Southold Town represen/ca.tive there.
1-1. Letter from Holzmacher~ McLendon and.Murrellr P.C..~
Consulting engineers, environmental scientists and planners, stating
they have considerable experience with scavenqer waste .applications.
and permits governing the discharge of wastewater, and asking if .they
can be of assistance in helping the town reapply for their SPDES permi~ ·
or in providing laboratory/engineering services.---The Town has no need
for their services at the present time. - ~
12-. Letter from General Appraisal Compgny acknowledging
permission to proceed~.wit~ a detailed property record installation
for the Town of Southold. This work should begin within 45 days.
13. Letter from Jody Ada_~-, Peconic, New York relative to
.~ablevision.
14. The Southold Town-Greenport Village contract for~do~.
control will be renewed automatically unless either side disagrees.
On motion of Councilman Homan, seconded by Councilman Drum, it was
RESOLVED that S15,400.00 in Anti~ecessio~ Funds, Public Works, Title
II be allocated as follows: $1,650.00 to he. placed in. A1680.4, Central
Data Processing for Fixed Asset Accounting: $6,000.00 be placed ~n
A8160-1, Disposal Area, personal services; and $7,750.00 be placed'~n
B3120.1, Police, personal services.

RESOLVED that $3,377.58 be and hereby is transferred from Contingent
A1990.4 to (1) Disposal Area A8160.4 - $1,877.58, and (2). Shellfish
A7530..4 - $1,500.00.

15. A problem relative to drainaqe at Indian Neck Lane,:
Peconic has been resolved. Supervisor and Highway Superintendent
Dean met with the~owners of the property invol,ved and have-arrived
at the sum of $7,000. for the purchase of two pieces of property,

will be taken by the Board.
On motion of Councilman ~oman, seconded,by Councilman Pell, it was
RESOLVED that the following ~und,s ..be and hereby are transferred:
Fishers Island Ferry District from Operation of Ferry to Insurance -
$5,500.00, and Operation of Ferry to Repairs to Docks and Buildings -
$3,000.00.

On motion of Justice Suter, seconded by CoUncilman Drum, it was
RESOLVED that the Southold senior Citize~ns be and hereby are granted
permission to contract for three (and possibly four) buses, to~ take
them to Bear Mountain On October 18, 1978; estimate for three buses
is $1,052.00; provided there is enough money in their budget for
this expenditure.

16. As a result of a meeting of the Board of commissioners of
the Fishers Island Ferry District on September 1, 1978, Commissioner
~aymond DQyeq was unanimously elected as chai~a~of the Board of
commissioners.
17. Notification of a meeting of the Suff~l~ county solar
Energy Commission for Thursday, September 7, 1978 at 9:30 A..M.
at Suffolk County Federal savings, 2100 Middle County Road, Centereach.
Those attending the meeting will have the chance to review ~he pro-
visiQns o.f the County legislation and discuss the activities of their
solarlEnerg.y Commission and how it affects all townships in the County.
---Someone from the Town will attend.

RESOLVED ~that the application, of carl Frelix, Jr. da'ted July 26,
1978, for permission to maintain a single one'fa~ity trailer on his
property on a private road off the north side Main Road, Mattituck
be and hereby is granted for a period of six months.

RESOLVED that a recess be called at this time, 3:30 P.M. for the
purpose of holding a public bearing oh the Meskouris wetland, applica-
tion; meeting to reconvene following the public hearing.

Meeting reconvened at 3:35 P.M.
A member of the audience stated there has been mention made of
an application for incQrporati0n of senior citizen~. We already
have one. in Mattituck and one in Southold. Who is this group and
are they competing or what is their p~pose?---supervisor Martocchia
stated he received a Certification of Incorporation of The seniors
Club of Southold-Pec onic, Inc. under Section 402 of the Non-Profit
Corporation Law the undersigned, and so on---signed by Henry B.
Lytle.
Mr. Henry~Lytle stated that if anyone would like an eXplanation of
the reason for this it would be obvious if they attended a few of
the meetings of the Southold group which has taken in the whole
eastern end of the Island, including Greenport to the end, this past
winter particularly. They are meeting in a most unsatisfactory
place from the standpoint of location especially for the people who
come from the west end of the meeting area. They have had many re-
quests to have a localized meeting place that would be central to the
Southold-Peconic area and finally they took it upon themselves to
incorporate a club for the purpose of permitting any other seniors
that wish to loin with them. It is not a question of competing, it
is a question of additional offering because of groups that have
already grown too large. The Mattituck group broke away from the
Southold group quite a few years ago and they are already being
pressed both for space and wish that they could drop some of their'
members. He thinks they have taken the bull by the horns and started
this for the sole purpose of having another senior gT0uP .~n a township
which certainly could afford to have one.
Mr. Frank Pospisil stated that twelve years ago he appeared before
the Town Board and asked for permission to organize the_~
citizens. At that time, he was told that it was tried before, but
he had the Board's blessings, and to go ahead. Two years later,
their group grew so much they couldn't meet any longer in the
Southold Legion Hall because the capacity at that time was only 204.
So they asked some of the members if they would like another club
in Mattituck. He again appeared before the Board to ask permission
to organiZe another club in Mattituck. Permission was received, and
that group began meeting and have been there for ten years. He~fe~s
that it there is another club necessary it~is perfectly justified.
However, they don't think the Southold-Peconic name woul be very
favorable to them as they are registered in Albany and the County as
the SOuthold Seni0r Citizens. ~f there is a $outhold-Peconic senior
Citizens there will be a conflict with the name.
Mr. Lytle stated'the correct title of the club is The Senior Club
of.southold-Peconid Incorporated. There is no mention:of "citizens",
it is a seniors club and open to all seniors.
Mr. Pospisil said that there already-is a club fn~'go~thold, -s'o Mr.
Lytle is actually duplicating Something. If they want a Peconi~c '~
Club it would be' very nice, no p~ob~ems. The S~'~iOrS of Peconic.
But the moment they say Southold they are interfering with the
Southold group.
Supervisor Mar~occhia asked if a charter had ever been issued to ithe
Southold group?z---Mr. Pospisil ~tated'~hat at th~'~ime, Mr. Albe~ts0n
was Supervisor and asked %hem~to file ~heir by-lawS With him 'and~
after they did that the Town Board WaS"~vidently shpp0Bed'to have
looked it over and granted them permissiOh to start the ~lub. He
would like the'Board to take into consideration the' causing of a
conflict by their using the name Southold.----Supervisor Martocchia
stated they have nothing to do with the matter at all. Privab%-u,lubs
do not need the sanction of the Town Board.
On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED that there being no further business to come before this
Town Board meeting adjournment be called at 3:45 P.M.

Following this meeting, a% 3:45 P.M. a public hearing,was held in the
matter of the application of T~e North Fork Bank & Trust Company
for a franchise to run an aerial communications cable,between their
Love Lane office and data center on Sound Avenue, Mattituck.
At. 4:00 P.'M. a public hearinq wa~ held on a 'propos,ed Local Law
Entitled "A Local Law providing for the increas~n9 of do9 licens'er
f~es in the Town of Southold."
