Aclerno, Vice-President and General Manager of walter Industries,., Incorporated made,a presenta- tion on a _compactor,and baling fac-ility to the Town DiSposal Area. This is a facility custom-tailored~for Southold Town, designed to serve the Town for 20 to 25 years. 1:00 P.M. -.Mrs. James Delehanty and a delegation of 20 .residents from Mattituck known as the Ad-Hoc AsSociation of Mattituck Inlet Watch Dogs, Browers Woods Association, et al, and their representa- tive Mr'. James Bitses, Southold, spoke to the Board relative to the Matt--A-Mar Marina. Mr. Bitses asked the Town Board to pursuade the:Board of Appeals to rehear a previous granted appeal to Matt-A-Mar Marina upon the introduction of new evidence. The Town Attorney and Supervisor advised Mr. Bitses ,that the Board of Appeals is an independent body and they would not interfere. Fir. Bitses was advised, the group has 30 days to appeal to the Board of Appeals for a rehearing and if the answer is no, they may then go to'the Supreme Court. A,regular meeting of the Southotd Town Board was held'.on Tuesday, June 20, 1978 at the'~Southold Town Hall, Main Road, Southotd, New York. District establi:shed in said Town and known as ,"East-West Green~ort Fire ~Protec~ion District, Town of Southold, N. Y." upon the following general terms, to wit: (a) The contract shall be for a term of five years. A representative of~ the Town Board will at~end this meeting when a~final date is set. 3. A request for a repr~esentative of the Town Board to be present at a meeting of the Steering commltte9 on June 2tst, 2:00 P.M. at Hauppauge, with relation to the afore~said~Suffo-lk Runaway Forum.---Justice Suter will attend if he can fit it into his schedule, he has civil work in court on the 21st. 4. Letter from~atholic ,Charities, community Life Center stating they are establishing an Advisor~ Board to facilitate communication between~the age~y and the community. They would like a representative of Southold Town to serve on this board~ Their initial meeting will be held on September 12, 1978, at 10:00 A~M. at their Laurel office. 5. Letter from Susan L. Rosenstreich,, Fecon~c Soccer Leaque, req~eSting~fund~ for their summer program for 9-12 year olds,---All recreation~ funds have been spoken for. for 1978, but 'they will be sent a letter stating they will be con'sidered for 1979. On motion of Councilman Homan, seconded by Justice surer, it was RESOLVED that $385.00 ~e paid to Boatmen'~rbor Marina_as a reim- bursement for ~ne-half of the cost of their dredging project in Cutchogue. Notice .from the N.Y.S. Department of EnvirOnmental Conser- vation upon application of ,Henry p. Smith, Robinson Lane, Peconic, for permissio~n. _ to sub-divide a parcel .of ,land into two lots and construct a one family dwelling and construct a timber dock with floating section on the west side Hobart Road, Southold. Mrs. Marie Johnson said it appears the~ Town 'BOa~d'draws ~the't~ne on opposing only'Federal 'legislation, but don't mind opposing State bills.---Councilman Homan said that if the decision she asked of this Board is going to make a drastic change in what the federal government did then helthin~s the Board would be very very much remiss if they did not consider and debate it, but since this Board is not going to change the position of the federal government one bit, he thinks Mrs. Johnson is doing a disservice to the Town~ Board to ask them to comment on it. That is Mr. Homan's Qpinion and his only. Justice suter stated that these are bills affecting the TOWn' of Southold because the Town is bargaining Under the Taylor Law. Those changes in the Taylor Law is weakening it and the Board is opposing those changes, so it does affect the Town and he thinks they are involved and have a right to ob3ect.--~-Justice Suter ~ said the federal .rules affect navigation, not the Town of Southold, the Town h~s their own rules under the Town Trubtees. if they were trying to take r~ghts of the Town Trustees away, they'.would oppose it. Island Sound at Arshamomaque for 'the months of June, July, August and September of the year 1978, terminating on the 30th:day ~f September, 1978, at a rental of $500.00,' $250.00 of which is payable on the first day of July, 1978 and $250.00 payable on the first day of AuguSt, 1978. SupervisO Marto¢chia - r: :- - : "13~ The'~Board has received, from the New York State'Commission On Cable Television a Preparation and-Evaluation of,Rate~IDcrease Applications, The, Supervisor had a~telephone call from the Chief, Accountant' of C~btevision, Les Dryden, Albany, who will send him the guidelines of the changes taking place,---He also learned that Long Island Cablevision did not get permission from the N.Y.S. Cable Television Commission to put homebox on Channel 2~ a matter they neglected to do with the Town either.---Mr. David Driscoll asked what the position of the Board is on the change back to channel 12?---supervisor Martocchia stated that Mr. Jones indicated to the Board that the reason they took 2 away and put 2 on 12 .was that 12 was not strong enough to use for home box office, bu~ ~hey must get permission' to ~o that. There was a very heated'discussion at the last meeting and both Mr. Jones and the Board walked away annoyed. The figures Mr. Jones gave the Board for the increase is 80¢ plus the cost, pro~ated out :to everyone;,-~of any new section they develop. Mr. Jones said the line extension policy is not working, the people do not want to pay the cost as it' is running too high. They will have to get back together again on this matter.--- Mr. ~Driscotl asked if the first step wouldn't be to demand they respect the franchise which was granted to them and they should put 2 back on 2.---Supervisor Martocchia stated that Mr. Jones told the Board they failed' to get the permit from the Board, what is the penalty for not doing it? Supervisor Martocchia said he felt the fair pena]'~y .w~uld be to do th~ new areas without any cost t~-the subscribers, which, of-course, he'~dn'-t'buy.---Mrs. Gladys Csa~ko'stAted"that in' the originai'fra~chise it stated the franchise could 'not'he transferred or assigned without-Town approval, and she never found anything to indicate that the Town gave approval when it was changed over to the Times-Mirror.-r-Justice Suter stated that Mr. Jones' answer '~.0 the BOard on thg~t was that. The annual· report shows·~hat ~the Town only received $4., 000..O0,.~-~- Supervisor Martocchia stated that~this year~.they~received a~¢heck! for $10,000.---Town Attorney Tasker stated that they are entitled to deduct from this franchise fee. they pay~the Town the real property franchise.taxes they pay to Southold Town, the state taw requires this, it requires that CATV be:<given~he credit for- 'thereal~Proper~y taxe's~aga~nst the franchise tax they pay.and the fr'anchise tax which they%pay, the upper'limihs fixed.by,the State which they-take:l%~ off the top, so the Town-really doesn't have much flexibility: in what'~they.-get~paid. ·.The:~Town is cbar~ing th~m~the maximum-and-~hey. are entitled under~the~ law to deduct the-real'property tax.~' ~14. Section 88-~1. _ 'Site requireraents Each recreational vehicle site and campsite shall be well- defined-and permanently marked and' shall meet the fOllowin~ require- Rents: A. Section 88-24. Compliaffce Wi'th other' law~ The establishment, maintenance and operation of a Recreational Vehicle Park shall comply with and be suboect to all of the Provi-sions of Sections 88-1 ~nd g8-19, inclu'siv&,~O~"fhis CHaPter; 'not"i~conL -sis~e~t with-~this Article II. Letter from the Town Trustees authorizing the'~of Mill Creek (Arshamomaque Pond) and Hallock's Bay (Pete's Neck) for a period of thirty days for the purpose'of, tran~plantinq 600 bushels of polluted clams. 18. Letter from the Town Trustees supporting the movement for a part-time summer patrolman in Mattitudk'Creek. as they consider it the.largest creek in Southold Town and has a large transient popu- lation.---There were some problems on Sunday~, there is a ba~ge Parked at one of the corners belonging to Howard Petersen, where Mr. Petersen was denied p~rmission for the placement of pilings. Supervisor_Martocchia stated there are two salary adjustments that must be..mDde; George Fisher, Senior Building Inspector and Edward Hindermann, Building Inspector. They are both in different categories than when their salaries were set in January 1978'. Mr. Hinder,mann was a Housiag Inspector at the ~ime-and Mr. Fisher was a Building Inspector. Both have qualified under civil service for the promotions which were made-a short time ago, a:nd have not been compensated for new positions. It is recommended Mr. F.isher's salary be raised to $.14,700.00 and Mr. Hindermann's salary-to $13,681.00.---Mr~."Pell said this is the first he has heard of this and asked that the Supervisor wait on these-salary increases until the next meeting and make it retroactive-to July lst.---Town Attorney Tasker stated they c~nnot make them retroactive.---Supervisor Mar- tocchia stated he had discussed the matter at length with Mr. Fisher and Mr. ~indermann .and they stated they would be willing to stay until mid-year at the salaries set in January. The Board members come in more than he ever expected them to.---Councilman Homan stated that the request for the salary increases is not news to the Town Board, it was discussed at the first off,he year when Mr. Fisher. was appointed Acting B~ilding Inspector. It was discussed again when Mr. Fisher was appointed senior Building Inspector and Mr. Hindermann was appointed Building Inspector. It was also discussed again when Mr. Horton was appointed a replacement Building Inspector. The only thing new about it was it was not on the agenda and no one here knew it was going to be on the agenda.----Mrs. Barbara Schriev~r said she does not think it is in the best interest of the Board to have it seem as though it w~s to be a ru]~ber stamp, she does not think it is/n the best expected interest of the Supervisor, and she realizes that things can come up at the last minute, but with a little consideration and forethought something like this could be-avoided.----Supervisor'Martocchia stated that he believes the Supervisor is closer to things in the Town Hall than anyone ~else, and he has been evaluating this for at least three months and he did indicate to the-two building inspectors that he would try to effect the change for them on July tat, and then it occurr.ed to him around 2:45 that there will be no meeting before July let, and decided he should move on it today. He does not feel what he 'as-ked for is unfair to the taxpayer, the taxpayer is getting their money's worth from these two people and he has no shame in recommending that salary.
