(1175 wait whitman Road, Melville, 11746, Suite 200, 427-6400.) Representatives of LockWood, Kessler, Bartlett made a presentation on solid waste management. They will submit a written proposal. A regular meeting of the Southold Town Board was held at 3:00 P.M., Tuesday, June 6, 1978 at the Southold Town Hall, Main Road, Southo~d,! N~w York. Doyen On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the.minutes of the may 23, 1978 Southold Town Board meeting and May 31, 1978 special Southold TOwn Board meeting be and hereby are approved as submitted. This resolution was declared adopted~ Councilman Henry W. Dru~. made a report of th~ first meeting of the.Technical Advisory Group (TAG) held on June 1, 1978. The meeting was chaired by the Deputy Commissioner of Transportation, John Sheridan, with representatives from State, County, -Town, Community and business in attendance. The purpose of TAG is to provide technical input into development of the master plan for the County Airport. The airport study, commenced in February 1978 is 90% Federal funded, for a twelve month period. Included in the study will be the impact of the airport becoming an International Airport as approval of the "Free Trade Zone" application is antici- pated. The Zone is adjacent to the airport, not the airport itself. It is planned that the airport will provide services to both the south and north forks as well as Western Suffolk. Supervisor Martocchia: 1. The committee of Supervisor Martocchia, Councilman Petl, Councilman Drum has been formed to discuss with Frank Csajko an approach to handling the request of the North Fork Animal Lea,~ue for a lodation for their shelter. 2. Letter from the Suffolk Developmental Center, Alan R. Sutherland, Acting Director, relative to the program of the office. of Mental Retardation and Developmental Disabilities for C0mmunit¥ residenc~S~ .... When they were before the Board on March 21st they asked that a person or group,be designated to work with them as liaison in the selection of sites for this program so that the c0m~hunity, could have its input~ councilmanHoman and Councilman Pell have been designated to'work with this group .... 3. Letter from the Department of the Army, .~orps of · Engineers stating they will conduct the survey requested by the Town Board at Mattituck I~le~'~eginning on May 28th and furnish the Board with several copies of the survey results when they become available. 4. Letter from Shepard M. Scheinber~, attorney for the Fellinger-Ihars relative to an arrangement the Board is trying to arrive a~~ for a serious drainage problem on Duck Pond Road, Cutchogue. The owners of the.property are in controversy with the Planning Board relative to the performance bond.~ The Supervisor has been authorized to call a meeting between the property owners and their attorney to try to resolve the situation of the drainage parcel which was supposed to be turned over to the Town. 5. Letter from Minnesota Construction Corp., general contractor for the town hall addition, asking that the old town .hall be-mQ~e~ from i~s present location as it is~hindering the progress of their work. The sale papers with Southold Equities, Inc. will be signed today. The specifications state that within 15 days arrangements must be made to move the building and 60 days to complete. 6. Letter from .Schriever CoDstruction Company, Inc., william W. Schriever, President, giving notice to the Town under the "Notice of Highway Defects" wi.th respect to a large evergreen tree located on the west side of Tabor Road approximately 100 feet south of the Main Road in the hamlet of Orient. "The tree severely obstructs the view st ~the entrance to our shop property and has already resulted in several incidents in which accidents were narrowly avoided." Highway Superintendent Dean will look into the matter. 7. Notification to the Town upon application of Kathryn Robedee, Pine Tree Road, Cutchogue, to the New-york State Depart- ment of Environmental Conservation for permission to dredge in Little Creek~. Comments wil~ be received until June 15, 1978. On motion of Councilman Homan, seconded by Justice Suter0 it-was RESOLVED that $1Q85.77_be and hereby is transferred .from the Operation of the Ferry Account, Fishers Island Ferry District~to New York state Retirement Account. Supervisor Marto¢chia: 8. Notice from the Long Island Lighting Company stating they have filed ~ew rate applications wi~h--the Public Service Commission, The new rates would increase gas-revenues by 13.1% and electric revenues would increase by ,18.5%. They state May 1978'is their target date for the new rates.---Mr. James Bitses asked if they'would entertain diScusSiOn.from-the floor at this time.? Could,he make a suggestion ~y which the Town could take it into~their own hands and decide it themselves?---Supervisor Martocchia stated he knows Mr. Bitses feelings, having discussed the matter with~him, and feels at this time discussion on this matter would impede'the meeting. 9~ Supervisor Martocchia announced, for the benefit of the Cutchogue-Mattituck and Greenport-southold Senior Citizen groups, that the transportation van has arrived. He would like to meet- with the officials of both groups so a program may be set up for the use of the van. He will write to the individual groups re- questing, such .a meeting. 'Presently these i's a van for the Nutri- tion Program which works out of St~ Agnes ~Hatl. There is another one belonging to the RSVP which is brand new, unused, sitting at the Highway Department. Initially the Supervisor did not want to go along with the program as there were buses which were unused, but he was criticized highly for not going into the program immediately2 For the first year this. van will cost the Town noth~ing~ however in the'following years the situation will Change drastically. The program is only funded fo~ one year. The following years drivers, ~if necessary; must be'paid for, ~nsurance, maintenance, etc. Supervisor Martocchia, personally, feels this is a waste, that the need is not there for an additional va~ in Town, however, the people spoke and, the van has arrlved~ .... A letter has been received'from the Greek Orthodox Church, Matti- tuck, giving their reasons for feeling this new van is~ vital, 'and outlining their proposed uses for it. 10. Several weeks ag~ the Town Board took a stand on the funds appropriated to the various school districts for summer, pro~rams,. $12,000 a year' is divided among several scho~i~ districts. A pr~b.tem ar,os~ ~ith th,e Greenport school, they are-in:.the midst~ of an alteration~pro~r~mand cannot p~t t~e~program .on this summer. They asked if the' money could be used for a fall or winter pro~ram, and the Board decided against this reclue'st. However, Greenport appealed and cited many conditions they are being faced with. The~ontract~r for the~alteration project-doe~s not,want anyone in or ~round~ the building du~ring the~-s~mmer, months; there cout~ ~e a problem with insurance. The Board discussed -the~matter at length this morning and is inclined to approve the appropri.ation~o~f the ~oney-'fo,r a fall ~r.wi~ter program, due to-the ~a~ticutar circums,ta,nces. The most there have been at any time has been two carpenters, one electrician, two. plumbers. . ~- 15. Letter.from ~esidents of Leeton Drive; Southold~ rela- tive to speed problems they h~ve been having. The Chief'of Police met with the Board today and discussed .those problems and feels there is nothing legally the Town can do about the problems out- lined by the residents of Leeton Drive except more enforcement.--- F~r~ T~.omas Quinn a resident of Leeton Drive addressed'the Boar'd. She has called the police many times, but'cannot get the license plate number to report it as they goin~ too fast. Mrs. Quinn suggested 'that speed ~umps be instaTled.---Town Attorney Tasker sta~ed that if they inst~Ied speed bu~Ps they would have more accidents for ~hich the Town W~Ould he sued. They have a difficult enough fi~e now get~ing insura~nce coverage, if they create hazards o~ a pUbiic'h~g~way they a~e just opening'%hemselves to'prOblems.----Mrs. Quinn S~id that Leeton Drive is not a public highway, it is'a secondary road.-'--Firsl Quinn was advised 'it is still a public town highWay. This resolution was declared adopted. 30 Meeting-reconvened at 3:55 P.M. Supervisor Ma'rto~chi~% ~16. There has''been some~ discussion relative to 'the Mattituck. Airport not providing enough service. There is less than a year to go on the Mattituck Airport lease, and 91though a renewal is pretty welI assured, Supervisor Martocchia appointed Councilman Drum, and he to appoint his own committee, to make a study among the Southold Town residents, to determine the cost to lease or purchase land. If a,purchase is involved, the loss of income frQm taxes, the cost to the town, cost of a building and staffing and equipping an airp0~t t~ make it ope~ationa. 1. Councilman Drum was appointed because of his 30 years in' the Navy, many of which were in a~ administrative position, retiring as a Captain, and Supervisor'Martocchia felt he would be the most qualified to gather these Statistics. There are many items which may come into the picture, SUch as state or federal aid. This report will be sub- mitted three months prior to the expiration of the .Mattituck' Airport lease in March of 1979. 17.. Another request has been received for extension of CATV into the Indian Neck area in Peconic. The BOard is-meeting with representatives of CATV at 4:30 this afternoon. The Board was quoted increased figures and given four suggested areas for the extension of CATV, namely Nassau Point, Captain Kidd area in Mattituck, Bayview, Sou~ho.ld and Orient. Supervisor Martocchia has sin~e added Beebe Drive, Cutchogue~.a~d Laughing Water~, Southo'ld' It was his thoughts on the rate increaS~ that possibly a 25¢ or 50¢ increase W~uld be acceptable ~if the new areas were included. However.~ CATV is looking for an increase from $7.25 to $8.05 which is an 80¢ increase, plus the cost of the new areas for service. He a'ssur~d the public that the Board will fight all the Way to try to get the best deal they can.----Mrs. Gladys ~'~ Csajko asked the Board to keep in the back of their minds that a lot of people are tied into contracts on this.----Supervisor Martocchia stated that further increases CATV is looking for is an · ncrease from $30.00 to $40.00 for installation and a second connection from $1.50 to $2.50.---Mr. David Driscoll asked if there will be a hearing on the rate increase?---Town Attorney Tasker stated there must be a public hearing. Councilman Pell ma~e a report on a study.he has made on the Mattituck Inlet. Sometime ago a group Of Mattituck residents took ~im on a tour of the Mattituck~Creek and submitted to him a.iist of eight recommendations which they would like the Board to consider. This list was ~eceived today and is as follows: The residents feel: (1) The Mattituck Cree~ is our largest commercial and' residential creek in ~outhold Town, (2) It has over 150 tourist ~oats using the area each weekend, (3) they are very much concer~ed wi~h the dumping" o~ human waste overboard, (4) The Ma~tituck Park District that once provided some control now has backed 0ut~ and there is no permanent patrol.---(8) The last suggestion they made is that the Town Board .employ someone over the summer and have t~em based out of the Mattituck Creek and cou'ld be called elsewhere when needed.----This report was turned into the Town'Board today and Councilman Pell hopes by two weeks from not when the Board meets again there will have been further time to Study and evaluate the request.---supervisor Martocchia made some observations on the list from the residents .... they claim it is the largest residential and commercial creek in Sou'thold Town---he.questions that. They indicate 150 tourist boats, he qu-estions that unless they are talking about the weekend of the Strawberry Festival. The~ falk about pollution .... there is a report on that.----Justice Suter stated that a couple of years ago this same question was raised, and at that time Paul Murphy and a group of residents from Brewers Woods questioned, the pollution.in the creek and the Board asked the DEC to make a study of it, which they did,~and their report showed that the'pollution is not affected on the weekends whe~ the b~ats are in, in July and August, particularly, but is affected very strong~!y by the run off of sewage and rainwater after a storm from the .roads 'and.,properties.---chief ~ata~do Was brought into 'this'~d~scussion earlier in the day and it was pointed out that where the residents indicate the Mattituck Park Distr'ict .PrOvided the patrols, they were wrong, it was the Town of Sou~hold %hat provided the patrols. In the Chie£'s opinion the ~patrols were not warr~n~e~, except occasionally. The TOwn works along the lines of hav~n~ the residents call the police 9nd they will respond. However, as far as patrols in the summer, tha~ is no problem, they do-hire seasonai ba~ c6nstables for that p~rpose.~-There will be a full report for Mr. Pell to take back to the Mattituck res'~den~s by the next Board meeting. ~ On motion, of Councilman Homan, seconded bY Councilman P~ll, it was R~SOLVED that the Town Board of the Town of Southold set July !1~ 1978, 3~30 o'clock P.M., Town Hall, Main Road, Southold,New York a~..t~me and place for a public hearing for the purpose of con.~ sidering ~ pr. opgsed contract .with the Village of Greenp0rt, Suffolk County, New York, for the fur~ishing of water for fire protection purpos.es, by, said Village to the Fire Protectio'n District established in said Town and k~Qwn as "East-west GreenDort Fire Protection District, Town of S~uthold, N.Y.? upon the following teneral terms, to wit: (a) The contract shall be for a term of five years. (b) For such service the Town of Southold shall pay the village of Greenport the annual sum of $70.00 for each fire hydrant'. ' .(c) Such other incidental terms as may be necessary or proper in connection with such contract. All persons interested in this matter should appear at the time and place above stated. Supervisor Martocchia explained ~hat the prior r~solution is ~ecessary to obtain data from the Sheriff's Off~ce or state Police. There is no cost. It is something that has always been available, however, now the federal and New York State rules have changed which now require that there be a written contract with them before they ~ill.gi~e out the information they have always given them. Supervisor Martocchia: 18. This is the last day for receiving ~esumes for the Board of Appeals' vacancy. Hopefully .there will be an appointment at the next-Board meeting. ~ M_rs. Csajko asked what Agenda Item 8 (e.) .Northville InduStries Corp. re: Mat~ituck Inlet referred to?---Supervisor MartocChia - stated that tied in with the'study being made at Mattituck Creek. Northville Industries had Iodged a complaint,that ~hi~gs looked pretty bad there and what was the disposition of ~he study. 'The SupervisOr has noel dispo~ition,~ it ~s in study and they are Staking out areas not. As soon as the information is available, Nor-thyille will receive ~ copy, df it. Firs. Huntley, R.L.A. proposalr~-S~pervisor Martocdhia s~ated that is a consulting firm offering their services for a fee ko aid in subdivisions, planning, etc. The Town is presently tied in with several local c~nsulting firms aG _the present time. Csajko. asked about Item 8 (g) Judy and walter Mengeweit re: Cablevision Channel 12---Supervisor Martocchia stated that is a letter relative to moving channel 2 to 12 and putting homebox on channel 2. Mr. David Driscoll asked how much is in the budget for the services of the 7th S_quad?---Superv~sor Martocchia stated the T~wn pays about $225,000 to the County for the Town of Southold ~hare. Need- less to say that town does not make use of all the services tha~ are availabl~ to ~hem. There is a ~ultitude of services. This- includes'the office of the Medical.Examiner, the service of any number of back-up men for the Town Police~should there be an emergency incident... Many legal services are available. ~o~ever, the Town-prefers to maintain their oWn Police Department an~ in effect that means the Town is paying for a duplication of servl.ces, many of which are not used. The County. Charter mandates ~h~t the various towns pay their share for County Police protection and services and there is no wa~ of, getting out of it. Mrs. Csajko asked who owns the RSVP~bus?'---Supervisor Martocchia stated it is a County bus, RSVP is s County proje~t~,,Mrs. Csajko asked, With r'eference to the senior citizen Van, wha~.was the . mention about transportation at the Greek Orthodox Church?--- Supe~sor Martocchia stated that there are senior citizens in that area who know the bus will be available and asked for trans- portation to the business community. .MrS~._C,sajko asked if there is a size in mind for an ~--- supervisor Mar~occhia said not at the present time. The matter of the airport study has come about because the lease will be coming due and Mr. Parker Wickham would prefer not to negotiate a lease if the Town wanted him to expand in various ways. At the present time, other than resurfacin~ the runways approximately everY five years and snow removal and sweeping, ~here is'not.~uch more cost to having the lease at the airport.---Mr. James Bitses and Mrs. Csajko asked several questions of Councilman Drum relative to what he would be looking fo~ in the way of land and facilities for a town aSrport.---Councilman Drum indicated that is what the study, is all about and he can make no determination at the present time, without such'a study. Mr. Bitses said he understands the Town Board has an inDere~ in the use of ~.b_gg~ to, generate electricitY and stea~ ~Would the Town Board ~xpand'discussionto include preliminary study and ana-lysis of the possibility of the Town taking over or purchasing LIL~0 electric distribution in this Town and ~reating a south01d~'Power District in oon3uncti6n with the Southo'ld Sanitary District which will probably have to be established? Each'would produce revenue for the other and lower taxes by paying a higher percentage of taxes than is presently being paid by either LILCO or the Town Dump facility itself.--- Supervisor Martocchia stated that today they had two more presentations, one from TECC Cor~. and the oLher from Kessler, Lockwood and. Bar~le~. They will both present a program of their services. Prior there have been presentations by three or four other firms along' those same lines. The Town is preparing for the future in looking into what plans are available. There is one more presentation to come, with the Grumman'~Corporation, involving the Southampton Town Board, Southold Town B~ard and Riverhead Town Board.---Mr. Biases asked what about the Southold Power District?---Supervisor Martocchia feels that Town may be rather' small for that, Greenport Village is having a pr'oblem surviving with their light and power plant. At 4:30 P.MJ the Board met with Peter L. Jones, Vice-President of Lonq Island Cablevision and Tom Robbins, chief engineer for CATV. Fir. Jones stated the reason for the .re.quested increase in rates is that the investors are not earning a reasonable rate of return on their investments.----Town Attorney Tasker and Justice Suter, after examining the financial statement submitted by Mr. Jones, insisted that it does not show a breakdown for Southold Town. Mr. Jones said such data did not exist, showing Southold Town alone. After much discussion Mr. Jones said he could prepare an allocated financial statement for Southold. The Board said they would look forward to seeing this, as sucha request has been before CAT~ since 1965 and has never been received.---The matter of putting channel 2 on channel 12 and using channel 2 for home box office was discussed at length. CATV made this switch without approval of the Town Board, a stipulation which is in their con- tract. Mr. Robbins said they sent out 800 questionnaires to cus- tomers asking their opinion on the proposed change, but received little response. Mr. Jones agreed they were in error in making the switch and asked how he could resolve this matter. The response was, put channel 2 back where it was. Mr. Jones said this would be virtually impossible at this point, without removing home box office entirely.----Supervisor Martocchia stated there will certainly be a lot more discussion on the matter of the proposed rate increase, and more meetings with Mr. Jones before this matter will reach the point of a public hearing. At the present time, he is unwilling to support such an increase. Meeting reconvened at 6:00 P.M. On motion of Councilman Pell, seconded by Councilman Homan, it was RESOLVED that the Town Board of the Town of Southold opposes the adc~on of Assembly Bill A-11929 and Senate Bill 8987, with reference to changing New York State Law to m~ke possession of any striped bass less than 26" in length illegal in the State of New York.
