Absen~t: Justice Doyen. This resolution was declared adopted. Supervisor Martocchia: 1. The Board has received the Audit Report for the Fishers Island FerrM-;District for the Mear eneed December 31, ~ from Doherty and Company, P.C., Certified Public Account- ants, New London, Connecticut. The Supervisor has requested the accountants to supply further details to the report. 2. The Board has received an ~ssessment and evaluabi~ on the audio-v~sual equipment purchased during the Bi-Centennial' This assessment was prepared by Donald G. Fisher of Sound Productions, Southold.---It is the feeling of the Board that all units of Town government should be notified of the existing equipment, to determine if there ~s a need for them, before disposing of the equipment. 3. Letter from Children's Bible Fellowship for per- mission to use town beaches for bible study.---They have been notified that there are beach parking permits available for parking at the town beaches. 4. Item 8 on the agenda, "Appraisal of property on Boisseau Avenue, Southold", must be discussed further before ~ringing to the public. 5. Information Memorandum received from the ,SuffolkU~ Coun~_y Office for the Aging, stating Suffolk District Attorney Patrick Henry is urging the county's sen~or citizens to be- ware of the "stranger at the door". The elderly are the przme target for the "spring-time racketeer" as well, who offer cut-rate home repairs. The Distric~'Attorney suggests Do"s and don%s for their protection.---Copies of this memorandum will be sent to'the local senior citizen organizations and to the local newspapers.---Justice Suter stated that in the last couple of weeks he has'-had cases Where local people have been getting judgments against outside contractors, only to find they are bankrupt. People should see that the contractors have a local license and know wh~ they~are doing business with. ' ' 6. Copy of a letter from the Leaque of Women Voters of Riverhead/sou~hold to C01. Clar~ H. Benn, Department of the Army, N. Y. District, Cgrps of Engineers., concerning notice of ~Pplica- tions to the Corps of Engineers'with the statement "The work applied for has 'already been accomplished without prior au%hbrization and the Corps declines to initiate legal proceedings at ~hi's ~ime." The League objects to the grantinq of permits after the fact. They fe~l legal proceedi'n~s shoul~ be instituted and approPriate penalti~'considered~.~-2-2The Board Will await the comments of the Corps ~f Engineers. On motion o~ Justice suter, seconded by Councilman Homan, it was RESOLVED that the Town Board of the Town 'of SOutho'ld accepts the amountlof $35,000 bond estimate for improvements in the subdivision to be' ~nown as "Col. Ted Dowd" as recommended by ~t~ S0uthold Town Planning Board and Engineer Lawrence M. On motion of Councilman Pell, seconded by Justice Suter, it was RESOLVED that Supervisor Albert~M. Martocchia be and he hereby is auth0rized'to execute a .lease between 'the Town of Southold and pavid Rothman for a parking field in Southold. This lease is for a term'of-one year'commencing June 1~ 1978 with an automatic extension for five consecutive one year ter~s. Supervisor Martocchia~ 7. L~tter from Charlotte Gadomski, 455 Summer Lane, Southold, including a signed petition by nine residents of Bayside Terrade,'requesting that summit Drive and Summer Lane in Bayside Terrace be accepted as town roads.-~-Superviso~ Martocchia stated this matter'could be handl~d as a road ~mprovement district, whereby the roads-are' improved to town specifications and the cost of t~is improvement is assessed to the property owners along the roads in question and paid over an a~proximate-five year period. Highway Superintendent Dean will discuss the matter with Mrs. Gado~ski. 8~. Letter from the S10-Pi~tch'Le~q~e requesting fundinq to help cover some of their expenses for the 1~78 sea~on.---Some- time soon the Board will sit down with the manaqers of the various leagues and work out the disbursement ~f approximately $6,000 Which is available for this purpose. 9. Receipt of a letter from T.E.C.~..Corporation (Total Environmental Concepts and Capabilities) regarding solid waste manaqement. This company will be invited to make a presentation as h~s ~ee~done With three previous companies.---Another proposal Supervisor ~Martocchia heard 'about i~ by-th~ Grumman C6rporation for a~study covering Southold, ~iverhead a~'d Sohthampton. After T.E.C¥C, has made their presentation, ~up~rvfsor Martocchia will get in-t~ouch--wi~h Grumman and request a 'representative to meet wi't'h~-t~h~TM Boa-~d ~hd give a presentation of their proposal. 10.- A letter has been received from the Suffolk County ._ ,Department Of Environmental-Control stating they have received an opinion on open'burning, in Southold T0~...n f~om ~he New York.State Dep~rtment of Environmental C0nservatio~, which states.~h~h~'real" population of Southold Town is over 20,000,_ .even though the LILCO survey ~tates 19,805. S0ut~old Town is a r~esort area and the populatfon increases during the su~,~er months, and Towns with population over 20,000 are not p~rmitted open burning.--,The D.E.C. submitted an application which can. be used for applying for a burn- ing permit, even though it will undou~_ tedly be denied. 11. The annual Memorial Day parad? will be hosted by'the, GrisWold-Terry-Glover Post No. 80~ and t~ld on Monday, May 29~ 1978 at t0:00 A.M. All members of the Town Board have been invited to participate. On motion of Councilman Homan, seconded by Councilman Drum,~ i~ was RESOLVED ~that the .bid 'of Southold E~uit~es~ Inc. in th~ amo~of $8'~,117~,00 ~or the ~Id Sout~old Town Clerk's building, be accepted, and the Supervisor be and he hereby is authorized to execute all documents to affect the transfer of title from the Town of So~thold to South°ld Equities, Inc. Supervisor Ma~tocchia: , 12. On Thursday, June 1, 197S~at 10:00 A.M. in~H~uppauge,. County Executive Conference Room, there w~ll be a meeting to discuss the comprehensive ~outh plan and the relation of the state to the county and~the county to the towns. A representative of the New York State Division for YoUth will be present.---Someone from the Town Board will be present at this meeting. 13. ~r. Peter Jones and a representative of the home office of L.I. Cablevision Corp. met with SuPervisor Martocchia to discussx several areas of~ line ~xtension in Southoid Town, namely Nassau Point, Bayview, Southold, Orient, Capt. Kidd area, Mattitu~k. He also indicated ~hat if any individuals had areas they wish extend~d-~ those areas would be incorporated in the study. One area mentioned today was Laughing Waters. Mr.~Jones will be invited to the next Town Board meeting ~o discuss these extensions.---Mr. David Driscoll asked if it wasn't correct that when the franchise was renewed channel~2 was to rever% to channel.2 rather than remain on i2.--- Councilman Homart stated it was not a point of discuss at the re- newal of ~the contract.---Town Attorney Tasker stated that when the contract was 'renewed channel 2 was~on channel 2. After the con- tract was signed, and without Board approval, they switched 2 to 121---Supervi~r Martocchia stated that is one of the points~0~ discussion with CATV at the present ~ime. 14. Receipt of letter from Nassau Point Property Owners Association relative to CATV.---This is one of the areas marked out for consideration. 15. ~The matter of "lead a~ency." under the State Environmental Quality. Review Ac~ was'discussed.----Town~ Attorney Tasker-state~~ ~ ~ that under the law, when an application is received ~it is then decided who will be the lead agency; whether it be federal, state, county or town, .dep~ndin~ ~p~n 'which one will be mos~ vitally involved with the process of 'the application. That is when a determinatiOn is made as to who the lead aggncy is, in ea6h case. ---supervisor ~artocc~ia stated they have received a letter from Ecological Analysts, Inc., Middleto~ New York indicating they have developed a ~staff of experts ready to assist the town in fulf~li~ its responsibilities under SEQR in a prompt and cost-effective manner, and to aid in selecting criteraa that are most appropriate~ to local environmental conditions. They can also assist the Town in making the "initial determination" of whether an action would ha~ec significant effects on the local environment. Southold Town Bayme~'s Association suggested these~two sites and feel these,creeks should be closed for 30 days. Gladys Csajko asked i~ a referendum is required to m~ke this change from $100,000 to $200,'0007---Town Attorney Tasker stated what they are talking' about is a proviSion' in the Highwav Law which says'in towns ,of-cer-ta~in~sizes you cannot spend more · n a~y'one ~ear for. highway machinery than $100,000 unless you submit a proposition to the people and they approve of it. What was submitted to the Board was a bill in the State Legi'slature to change-that stat'e law. tO raise~'~it from $100,000 to $200,000. This bi~t ~id not Only affect Southold, there were several Other eastern towns involved in the bill. Such a~ law, because it applies to less~than"~a~I~the towns~ requires a local home rule message. oUr co~Stitutio~ says ~if yo~~ ch~nge'~a law which applies t~-'some municipalities and notoall, it is a'~pecial'-law'and the legislature can't pass it without the consent of those municipalities affected by itl ~Apparent~y~af~er all this was'done, they looked at the bill' they had and found there w~re some technical errors, probably references to wrong chapter numbers-or'section nui~bers in the laW~ That,-meant they had to amend it, and'when they amend it, it is in effect a new law and they must'start all over again, resubmit-it back to the municipalities. That was what the special meeting would~-have'beeh-for had the~ submitted ~O-us the amended-~iI1.--- Mrs. Csajk~ th06~ht that'the first'time around they were actin~ on something"the~legislature'had already done. Councilman-Homah stated, to clarify this further, many peo~l~ think that if this law i~ passed ~he'~Board:will have"the automatic approVal to go out and~spend this money. They budgetted $88,000 this year and that is how much they can spend, they can only spend what?~he~' budget, what this bill does is faire'the amount that can'be put in the budget. For the $88,000 this year, they are not going to buy any new major equipment. If a payloader at the disposal area breaks~-~Wh'~ou are talking about-'S75,000, or a smaller piece of equipment~at $35,000~ -The thing is, is the Town better off going for a bond issue for five or six-years or trying to jockey the budge~ around and getting the one piece of equipment and buying it outright'and not paying interest. They would then have-the latitude to buy one large piece of equipment by budgetting~the money. This would allow them to raise the amount and maintain their equipment without having to go to bond issue which he thinks is a ~uch better way of running a town, than'going to bond issue and putting' th~ town in debt. On motion of Councilman Homan, seconded by Justice Suter, WHEREAS, this Board has learned with'deep sorrow of the death of James Maimone, member of th~Zonin~ Boar~ of Appeals° Southold Town, and WI{EREAS, in his service to the people of the Town of Southold as a~-,member of the Zoning Board of Appeals Mr. Maimone has been a dedicated and conscientious public servant, NOW, THEREFORE, BE IT RESQ~VED that the Town Board of the Town Of' Southold hereby gives formal exPressio~ of its loss in the death Of James Maimone, and be it further RESOLVED that when the Town Board adjourns this da~, it do so out of respect to the memory of James Maimone, and that a copy of this resolution be transmitted to the family of James Maimone that we may extend to them our sincere sYmpathy.
