EXECUTIVE SESSION 10:15 A.M. - The Board met with 'Charles GraVes concerning the CSEA and PBA negotiations. WORK SESSION 10:55 A.M. - Richard Storz, Lovisa, Leonard M. 'Grillo, Velzy Associates and Merlon Wiggin, appeared before the Board to make a presentation on a ~roposed refuse t'o en'ergy' cO'gen'ergtiO'n 'facility. (A complete copy of the proposal is on file with the. Town Clerk.) Mr. Storz and Mr. Grillo indicated that the only possible location for their proposed facility would be at Greenport, where they can forsee selling steam to the hospital, seafood processing plants and other industrial facilities. They hav~ looked into funding and find there is six million dollars in state bond issue,-energy recovery money for small communities. They propose that the Town seek this funding and turn the money over to them and at the end of ten years of operation the facility would be turned over to the Town. During the preceeding ten years payments based upon the profits of the operation would be paid to the Town annually in lieu of taxes. 12:40 P.M. recess for lunch. 2:05 P.M. work session reconvened and the Board resumed reviewing the agenda and off agenda items. 5:45 P.M. work session adjourned. A regular meeting of ~he Southold Town Board was held on Tuesday, September 8, 1981 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Petl opened the meeting at 7:30 P.M. Tasker SEPTEMBER 8, 1981 329 On motion of Councilman Drum, seconded by Councilman Murdock, it was RESOLVED that the following audited bills be and hereby are approved: General Fund Whole Town bills in the amount of $32,894,23; General Fund Part Town bills in the amount of $20,493.72; Highway Department bills in the amount of $105,528.26; Fishers Island Ferry District bills in the amount of $81,945.90; Federal Revenue Sharing bills in the amount of $350.00; and Delinquency Diversion and Prevention Project bills in the amount of $377.12. COUNCILMAN MURDOCK: This morning we had a presentazion to the Board by Lovisa Construction Company on a refuse to energy 6ogeneration facility. Their proposal for the Town 6f Southold is 70 odd pages which the To~ Board, of course, has not had time to read. It is another proposal similar to Energy Developmenz Corporation that puts the Town in the position to have two proposals to weigh in terms of burning municipal solid waste and hopefully solve some of the problems that we're ~nder. The other little items we did in terms of putting the--- Highway Superintendent is going to put a little longer, or actually a perpendicular piece of fencing at Bailey Beach Road to keep people from obtaining access to the dunes in Mattituck. That's about all for now Bill. COUNCILMAN DRUM: I have nothing. COUNCILMAN NICKLES: Nothing to report. COUNCILMAN MURPHY: Last Tuesday night we had an information meeting on seed clams here in the Town Hall. It was very well attended by a lot of baymen, a lot of people who were just interested in the program and a lot of people who wanted to find out what was going on with this. The program seemed to go over very well. The baymen accepted it, seemed to accept it very very much. They Would like to participate, in this and hopefully next Town Board meeting we'll have a resolution when we set up a final agreement with the man who's_Paul Flacke from East Hampton who's going to run the program. We'll have a resolution authorizing this %o establish it next year. It holds great promise for our creeks and it's something worthwhile trying out here. That's it Bill. SUPERVISOR PELL: Thank you. My Supervisor's report. I'd just like to report that I am working on the budget with the different depart- ment heads. Everybody from the White House right on down to the Town 330 SEPTEMBER 8, 1981 Board is conscious of the budget taxes and one way to win friends is to say "yes", but the other way is to keep the budget in line, say "no" and when I do present the budget to the Town Board for review ~he~e ~e goia~ to ~e a lot of red lines t,hrough requests. It is something I feel has to be done to maintain status quo on our tax rate. The county is going to lose a lot of money. If they lose it we lose it ali the way down. It will be felt down at our level. COUNCILMAN DRUM: There may be nothing left to cut. SUPERVISOR PELL: There might not be, Hank. On the railroad. There is a gentleman here and he can address the Board later on. We have contacted the governor's office to set up a meeting out here with representatives from the railroad. There was a meeting held ThUrs- day of this past week in New York at Twin Towers on budget. Operating budget of the railroad. They notified somebody out here who mentioned it the other day. We were advised to write a letter to the president of the railroad requesting that a meeting be held out here in Southold Town Hall and we were assured that it would be done. There were some people they wanted to send our who were on vacation, they took the Labor Day Weekend and. the rest of this week off and they said they would get back to us in the very near future and they were quite sure that meeting would be held out here. As soon as we get the date we will give it to all the people that were there that night as well as the Town Board~ II. PUBLIC NOTICES - COUNCILMAN NICKLE~: 1. The first notice that' you will see on your agenda regards the Department of Conservation. It is a notice of hearing on the application of Rudolph DeHaan to subdivide 74,800 sq. ft. into two lots. The hearing is to be held on September 17th here in the Town Hall at t0:00 A.M. This property is located at Cedar Beach Harbor, south si~e Dryads Basin. 2. Notice from the Long Island Regional Planning Board sponsoring a one day seminar dealing with design~ construction, and closure of sanitary landfills. The seminar is scheduled for September 21st and I believe Councilmen Murdock and Murphy will be attending. 3. Notice that there will be a meeting at the Suffolk County Center at the Legislative Me~ting Room on the utility rate making process. This is a state committee chaired by Assemblyman Behan and I believe Councilman Murdock will be attending that on behalf of the Town Board. (September 25, 1981 - I0 A.M. - 4 P.M.) 4. New York State Department of Conservation. Application by Robert E. Lawless for John Xikis vo construct a one family dwelling and septic ~ystem at Middle Road.. Arshamomaque. Comments by September 30th. 5. Also from the DEC, public notice on the hearing on application of Fred Melin to construct aluminum bulkhead and extend existing floating dock. Hearing will be held October 5th at 10:00 A.M. (Southold Town Hall.) Ail of these notices are filed with the Town Clerk if you wish to review them. III. COMMUNICATIONS - SUPERVISOR PELL: 1. Thank you note from Nassau Point Property Owners,thanking us for the use of the center on Peconic Lane where they held their meeting which was probably attended by a hundred plus people. 2. Request from the Mattituck Inlet Advisory Committee request- ing that the Town Board ask the Town Planning Board to'work on the idea of changing the zcne down around the waterfront property in Mattftuck Inlet. Up until what I am going to call the Petersen property from the Inlet into the Petersen property. They are' thinking of turning it into--recommending a passive recreat~o~ use. The Town Board is referring this for study to the Planning Board. 3. & 4. The Baymen's Association president was supposed to be with us today a~ 10:00 o'clock, It is a request from them to acquire a piece of land down in Hallock's Bay, Pete's Neck in Orient and ro discuss other ideas they have. They would like to see funds put into next year's budget. These will be on the agenda for the 22nd so they can be with'us. 5. From Southold Town Fire District Officers Association telling us that they feel the Fire Inspectors that we have now that enforce the Fire Code is working out very nicely and they would like to see it ~ontinue that way. We have gone ~ver this for the last six months or a year and they informed us of what it now looks like. 7. Status report from Energy Development Corp. on the progress they have made studying the landfill of Southold Town and incineration perhaps that we might go into. It's a status update of where we stand with them. 8. Letter zo my office informing me that the Huma'n Rights. Commission is going to hold a' seminar on different aspects of training on what's available in human rights needs and I will be attending it. IV. HEARINGS & DECISIONS SUPERVISOR PELL: We had four public hearings last Town Board meeting. We are ready to make decisions on three out of four. Moved by Councilman Murdock, seconded by Councilman Drum, WHEREAS, Fred Melin applied to the Southold Town Board for a permit under the provisions of the We,'land Or,'in'once of the To~m of Southold, application dated June 4, 1981, and WHEREAS, said application was ~eferred to the Southold Town Trustees and Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Board with respect to said application on the 25th day of August, 1981, a~ which time all interested persons were given an opportunity to be heard, NOW, ~HEREFORE, BE IT RESOLVED that Fred ~el'in be and he hereby is granted permission under the provisions of the We'tland 'grdin'anCe of the Town of Southold to install, an aluminum bulkhead, extend existing float and install four Pilings at his proper.ty on Mud Creek at Skunk Lane, ~utchogue, Ne~ York. Sb~ERVISOR PELL: I abstained on that decision because as far as the anloading part of this it is for the unloading of commercial fish boats and ~ am involved in the transportation of the seafood moved off of that propervy. Number 3 the Town Board is not ready'to act upon yet. We still wanv a little more information on that one and it is being referred back ~o get more information and perhaps act upon it at the nex~ Town Board meeting. (Wetland application of Agnes. RESOLUTIONS On motion of Councilman Murphy, seconded by Councilman-Nickles, it was RESOLVED that the Town Board of the Town of Southold approve the application of Martin Sidor for the renewal of his trailer permit for trailer located on the south side of Oregon Road, Mattituck, New York, for a six month period. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. 2. Moved by Councilman Drum, seconded by Councilman Murdock, WHEREAS, Radio OperatOr Gary M. Charters has applied to the Town Clerk for a leave of absence for a six month period commencing October 1, 1981 through March .31, 1982, and ~VHEREAS, the Town Board has determined that the absence of this Radio Operator for such an extended period of time would be an undue hardship on the operation of the Southold Town Police Department, now, therefore, be it ~ RESOLVED that the To~ Board of the Town of Southold hereby denies the request of Radio Operator Gary M. This resolution was declared duly adopted. o On motion of Councilman Murdock, seconded by Councilman Drum, it was RESOLVED that the Town Board of the Town of Southold set 3:30 P.M., Tuesday, September 22, 1981, Southold Town Hall, Main Road, Southold,' New York as time and place for hearing upon application of Agnes Pagnozzi for a permit under the provisions of the Wetland Ordinance of the Town of Southold for permission to attach existing dock to two new wood pilings and add two additional pilings for a hoist for permanent use at her property located off south side of JoCkey Creek Drive~ on Jockey Creek, Southold, New York. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. On motion of COuncilman Nickles, seconded by Councilman Murphy, it was RESOLVED tha~ the Town Board of the Town of Southold oppose the adop%ion of ,Assembly Bill 11058-A entitled "AN ACT to amend the public health law in relation to birth and death records," which proposes to consolidate the keeping of birth and death records in one central location administered by the County Department of Health, and be it further RESOLVED that the Town Clerk be and she hereby is directed to transmit a copy of this resolution to Assemblyman John L. Behan apprising him of the Town Board's opposition to this bill which would be an unnecessary inconvenience and extreme hardship for the residents of SoutholdTown if these records were filed in a remote county facility. SEPTEMBER 8, 1981 ~_ 333 SUPERVISOR PELL: Num$~r 6 was~ofi~t~e~agend'~ · last time It went to a negative vote, did not pass at that time. We had two abstentions. We put it on the agenda today to see if we could gem the four affirmative votes we need to pass anything and we still do not have the votes so it will not be passed at this time. (Create and authorize the SouthoId Town Disposal Area Advisory Committee.) Anybody wish to comment further? (No response.) Number 7. This is a resolution in response to a request from Mayor tIubbard of the Village of Greenport. The County has authorized some time ago a $1,000,000.00 to rebuild the railroad dock in Greenport. It has not passed the legislature yet. In talking to Mayor Hubbard he asked the Town at Town'Board to recommit itself zo the value of this property to the Village of Greenport and Southold To~m. So, I'm asking the Board at this time to reaffirm the resolution they made on December 2, ~980. On motion of Councilman Murphy, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southold reaffirm and ratify their resolution no. 17 dated December 2, 1980 which reads as follows: "WHEREAS, the County of Suffolk is considering an appropriation of $1,000,000.00 zo finance the reconstruction of the Greenport Railroad Dock for use as a berthing facility for commercial fishing vessels, and WHEREAS, the Village Board of Trustees of the Village of · Greenport fully supporzs said action by the County, and WHEREAS, it has been determined that substantial positive economic impact will result on the Village, Town and County as a result of said action, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town o~ Southold hereby declares its full and enthusiastic support for the proposed Suffolk County Projecz to reconstruct the Greenport Railroad Dock, and be it further RESOLVED that the Town Clerk is hereby directed to forward a certified copy of this resolution to each member of the S~ffolk County Legislature as well as the Suffolk County Executive." Petl, III be and he hereby is authorized and directed to execute a service and,maintenance agreement with Telecome Equipment Corp. for maintenance and repair service with respect ~o telephone equipment in the Southold Town Hall az an annual cost of $1,149.72 for the period commeh~ng .... On motion of Councilman Drum, seconded by Councilman Murdock, it was RESOLVED that the Southo!d Town Police Department be and hereby is $$77.50 for.use by that department. SUPERVISOR PELL: I'd like to commenz on that.10 (a) and (b) if I can for a minute. Last winter the firemen had a group that got together, 20 of them throughout the Town and decided that we needed a rescue team that could dive as well as the one we have ashore. So the firemen--we have 1'2 or 13 firemen that took the course at their own e~pense or whatever it was and we have one police officer that took the course also. What we just did was buy equipmenz for our police department, so with the one police we have, if he has to join the firemen within a rescue dive ~o look for evidence or any- thing we have an officer who is now trained and has the proper equipment to go out and look for evidence or whatever they might need. We feel very strongly about this because we have approximately 200 miles of coastline in Southold Town and we have, as you all know, we lost five or six folks within the last month to the sea around here. This is something that I am personally pleased zo see our police department get involved with and I'm glad the Town Board feels as I do to commit funds to this. I think it is a step in the right direction. Number 11 we are going to wait on. (Reappoint Assistant Inspectors under the Southold Town Fire Code.) We are noz ready to move ye~, even though these dates of these gentlemen will expire on September 9th, they will continue to serve as hold-over appoint- ments until we have cleared with all of them that they wish to be reappointed or else the commissioners who recommend them to the Town Board are satisfied wi~h the job they are doing. SUPERVISOR PELL: The next one is another trans'fer O'f funds. I want to explain a little bit why to a degree we are transferring a lot of funds tonight. In Mattituck on New Suffolk ~v'enne we are repamring that road. It is a 70/30 reimbursemenz. The Town is putting up 30%, the state and federal are putting up 70%. We must put up up front money before we can get reimbursed. We have to pay for it basically first, then we submit a bill and it will be eight weeks to zen weeks before we-get paid from the state for' it. This went to contract in about 1977 I believe even before I got on the Board. Inflation has set in like everything else and the bid prices were received back in '77. The engineering fees have exceeded, the cost of oil is up over it, but we had a commitment to get $89,000.00 to ~traighten the road out from the state funds 335 336 SEPTEMBER 8, 1981 20. 21. 22. so we are going ahead with it, but we do have to cover the expenses. So this is why we are transferring into Highway, New Suffolk Avenue Road you had us mention twice before and you are going to hear it again. We are going to transfer $50,000.00 to put on asphalt on it. That $50,000.00 will be reimbursed vo the Town, but by law before we can go to bid we must have the money earmarked and set · aside so we are making a transfer now of $50,000.00, but that $50,000.00 will come back to the Town, au least 70% of it will come back. One of the gentlemen that rides the bus from Cutchogue won'n lose his job but he will have to move from Cutchogue and move west. So I urge that whatever can be done to convene tha~ meeting no later than next week be done. SUPERVISOR PELL: As soon as we can we will notify all the people that were here that night.
