(631) 765-1809 outhold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 18,2025 ZBA FILE: #8003 NAME-OF APPLICANT: Carmela Lazio Revocable Trust PROPERTY LOCATION: 250 Blue Marlin Drive, Greenport,NY SCTM# 1000-56-7-21 / SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTP.'ATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sectiqns A 14-14 to 23;and tl e Suffolk County Department of Planning issued its reply dated February 28, 2025, stating that this application is colisidered a matter for local determination as there appears to be no significant county-wide or inter-community impact. L'VW DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 23, 2025. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of in.,6-astructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. 1. The structure is located within a 0.20N Annual Chance Flood Hazard and a. 1% Annual Chance Flood Hazard Area. 2. Expansion of structure (Increase in Gross Floor Area of 9.17%) within this area should be avoided or minun ized due to repetitive loss from storm damage, including hurricanes. 3. Groundwater elevation is expected to rise over time in this hazard area. By granting the setback variances and denying an increase in square footage based upon the average in the neighborhood permitted under the applicable provisions of the Town Code,as well as making the proposed residence FEMA compliant with all relevant hei fits, the Board may reasonably determine that the proposed project is CONSISTENT with the Local Waterfront Revitalization Program(LWRP), in accordance with all relevant statutory and regulatcry requirements. Page 2,June 18,2025 #8003, Lazio SCTM No. 100-56-7-21 PROPERTY FACTS/DESCRIPTION: The subject property is an existing 19,814 square foot non-coriforming parcel located in an R-40 zoning district. The property has a road frontage along Blue Marlin Drive of 100.00 feet, then turns southeast for 209.30 feet toward Peconic Bay,then turns northwest for 103.47 feet of bulkheaded bay frontage, before returning northwest 196.60 feet back to Blue Marlin Drive. The property is improved with an existing two story residence, and bayfront bulkhead with steps to beach as prepared by Michael Minto Land Surveyor, dated last revised October 5,2024. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; Article XXXVI, Section 280-207; and the Building Inspector's January 24, 2025,Notice of Disapproval based on an application to demolish an existing dwelling and to construct a new single family dwelling; at 1) less than the code required minimum side yard setback of 10 feet; 2) gross floor area exceeding permitted maximum square footage for lot containing up to 20,000 square feet in area; located at: 250 Blue Marlin Drive,(Adj.to Shelter Island Sound)Greenport,NY. SCTM No. 1000-56-7-21. RELIEF REQUESTED: The applicant requests variances to demolish an existing dwelling and construct a new single-family dwelling with the following variance needed: 1. A side yard setback of 8.6 feet where a minimum of 10 feet is required. 2. A gross floor area variance for 3,627.701 square feet where a maximum of 3,326.75 square feet is allowed. AMENDED APPLICATION: During the hearing,the applicant was asked to bring the plan into more conformity with the code. The applicant on June 9, 2025, submitted a plan increasing the side yard setback to the required 10 feet, thereby eliminating the need for variance relief by bringing the plan into conformity with the code. The Gross Floor Area variance remains as applied for. ADDITIONAL INFORMATION: The applicant' architect was asked at the public hearing if a Gross Floor Area (GFA)averaging analysis had been conducted in accordance with the guidelines established by the Zoning Board of Appeals (ZBA). Since none had been undertaken,the hearing was adjourned to permit the applicant's architect time to do so and submit the calculation of the GFA averaging in the applicant's immediate neighborhood. On May 22, 2025,the architect submitted a written statement to the Board stating that the proposed project does not qualify for relief under the GFA averaging provisions as outlined in the Town Code and the ZBA guidelines and therefore, the applicant cannot meet the required standards for the granting of variance relief. Additionally, the applicant revised the proposed site plan to relocate the principal structure so as to meet the required minimum side yard setback of ten(10)feet. As a result of this modification,the application no longer requires a variance for side yard setback relief(see amended relief above). FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 1,2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding area consists primarily of existing one-and two- story single-family residences of varying sizes, situated along the waterfront of Blue Marlin Drive. The proposed Gross Floor Area (GFA) exceeds the maximum average permitted under the Zoning Board of Appeals (ZBA) guidelines for GFA averaging.As such,the proposed expansion would not be consistent with the scale and character of the surrounding development. Any increase in GFA beyond the allowable threshold, as proposed in this Page 3,June 18,2025 48003, Lazio SCTM No. 100-56-7-21 application, is likely to disrupt the visual and spatial harmony of the neighborhood and therefore constitutes an undesirable change in neighborhood character. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method;feasible for the applicant to pursue, other than an area variance. The applicant proposes to demolish the existing residence and construct a new single-family dwelling on the subject property. The lot provides sufficient area and dimensional flexibility to accommodate a new residence that fully complies with applicable zoning regulations,including required setbacks and Gross Floor Area (GFA) limitations. Accordingly, the requested variance relief is not the minimum necessary to afford relief and is therefore unwarranted under the applicable legal standards. 3. Town Law 4267-b(3)(b)(3). The variance proposed herein is mathematically substantial, representing a 9.17% deviation from the maximum Gross Floor Area(GFA)permitted by the applicable zoning code.Notwithstanding the numerical extent of the relief requested,the language and intent of the Town Code explicitly prohibit the granting of GFA variance relief by the Board of Appeals that exceeds the verification of Gross Floor Area in the immediate neighborhood as further clarified by the ZBA Guidelines for GFA Averaging. 4. Town Law 4267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The limitation of house size relative to lot size in the Zoning Code by limiting Gross Floor Area that permits variance relief that meets the GFA average in the immediate neighborhood, does so,in order to prevent adverse impacts on the'character of neighborhoods. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect, and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. The granting of the requested relief does not constitute the minimum necessary action to afford the applicant a reasonable opportunity to construct and enjoy a new single-family residence on the subject property. There exist multiple viable alternatives that would allow for the development of a fully conforming residence, thereby eliminating the need for variance relief. Such alternatives would enable the applicant to achieve their intended use while preserving the established character of the neighborhood and upholding the health, safety, and general welfare of the community, in accordance with the purposes and intent of the zoning regulations. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Planamento, and duly carried,to DENY relief as Amended Vote of the Board: Ayes: Members Weisman(Chairperson), Planamento, Lehnert and Steinbugler.
