Re. Proposed Code Amendment
In reviewing a recent application in the Light Industrial (LI) Zone, the Planning Board
i
noted the restriction n the code that limits buildings to no longer than 60 of length along
a street. While the intent, according to Town Board documentation, was to soften the
visual impact of development along the main road, keep vistas open and avoid strip-
mall type development, the effect of this limitation is having unintended consequences
in that it seems to prevent efficient development of some of the Town's industrial lands.
The Town of Southold is fortunate to have businesses interested in locating here in our
industrial properties. The uses in the LI and Light Industrial Office (LIO) are typically
g property erty tax generators, as well as sources of employment. To encourage the

continued development of the LI and LIO zoned properties with appropriate businesses,
it is recommended that the Town Board revisit this building length restriction. Limiting
buildings in these zones to 60' in length along roads is not practical in all situations for
industrial development, and a code amendment to make exceptions to this rule should
be considered.
Below are the relevant sections from the Town Code:
Light Industrial:
280-64 Front yard setbacks. [Added 8-22-199,E by L.L. No. 18-19951
A. Structures shall be set back at least 100 feet from the right-of-way.

B. There shall be an exception to Subsection A if the adjacent parcels are
developed, in which case the minimum front yard setback shall be the
average of the setbacks of the adjacent parcels.
C. A project shall be divided into separate structures so that no single
structure shall have more than 60 linear feet of frontage on one street. The
setbacks of multiple structures on a parcel may vary, provided that the
average setback of the structures meets the setback required above and
all buildings are at least 75 feet from the right-of-way.
Light Industrial Office:
§ 280-60 Front yard setbacks. [Added 8-22-1995 by L.L. No. 18-1995]
A. Structures shall be set back at least 100 feet from the right-of-way.
B. There shall be an exception to Subsection A if the adjacent parcels are
developed, in which case the minimum front yard setback shall be the
average of the setbacks of the adjacent parcels.
C. A project shall be divided into separate structures so that no single
structure shall have more than 60 linear feet of frontage on one street,
except that this requirement shall not apply to a transfer station. The
setbacks of multiple structures on a parcel may vary, provided that the
average setback of the structures meets the setback required above and
all buildings are at least 75 feet from the right-of-way.

The Planning Board has concerns over some areas zoned LI and LIO in locations
where massive buildings may cause impacts to community character and quality of life,
and increase traffic. In these cases the 60' length restriction should not be eliminated.
These locations are generally in and near the hamlet centers. To avoid these impacts,
we suggest the restriction be eliminated only in locations outside the HALO or hamlet
centers, and only in cases where the building can be set back from the road at least 50'
with a vegetated screening buffer. This would not supersede the general setback
requirement in the code, which is 100', with a lesser setback allowed in cases where
adjacent buildings are already closer to the road.
To better understand how this code change would affect the Town, we provide a list of
all the LI and LIO-zoned parcels, including statistics about each (hamlet, tax map #,
size). We excluded those that were protected open space or municipally-owned from
that list. Also provided are maps of each hamlet highlighting the parcels zoned LI and
LIO. The lists and maps identify which parcels are in the HALO and Hamlet Centers and
which are not.
There are 258 acres in 103 parcels zoned LI and LIO in the Town. To put that in
perspective, there are 33,366 acres in over 18,000 parcels in the entire town, so the

amount of land zoned Ll and LIO represents only 0.8% of the land. Parcels zoned Ll or
LIO that are located outside the HALO or Hamlet Centers total 63, with a total of 212
acres in area. With such a small amount of the land being zoned Ll or LIO that is also
located outside the HALO or Hamlet Centers, the potential adverse impact of changing
the code to allow for larger buildings in certain industrially-zoned areas is likely to be
small. There is, however, a potential positive impact to the future property tax base and
local employment that could result from increasing the flexibility for development of our
industrial properties.
Also attached is a copy of the Local Law 18-1995 filing materials and hearing minutes.
This is the local law which added this regulation to the B, LB, Ll and LIO Zoning
Districts. The final page of the local law packet contains the hearing minutes where the
purpose of this code section is explained.

the requirements of Sections A 14-14 to 23 of the Suffolk County
Administration Code., the above referenced application which has been
submitted to the Suffolk County Planning Commission is considered to be a
matter for local determination as there is no apparent significant
county-wide or inter-community impacts. A decision of local determinati,on
should not be construed as either an approval or disapproval. Very truly

which reads as follows: Dear Mrs. Terry, At it's July 10, 1995 meeting, the
Planning Board adopted the following report. The Planning Board has
reviewed the proposed amendment to the Zoning Code pertaining to front yard
setbacks in Limited Business (LB), General Business (B) and Light Industrial
Office (LIO) and Light Industrial (LI). The Board supports this proposed
local law because it will help soften the visual impact of development
alongside the main roads, will prevent the construction of strip-type retail
structures, and will help maintain the rural character of our Town.

SUPERVISOR WICKHAM: Would anyone like to address the Board on this
public hearing? (No response.) I might very briefly preface these comments
by saying that this legislation is pursuant to a policy resolution, that the
Board adopted over a year ago, pledging to keep open the character of Route
48, and the other major roads in town to avoid a strip development
appearance, and to keep the visual distance that are currently available for
people driving through. Also, to keep Route 48 as an express road without a
lot of traffic congestion. Anyone like to address the Board on this proposed
Local Law? (No response.) If not, I declare the hearing closed.

Parcels in the HALO and Hamlet Centers have greater potential for impacts to
community character and quality of life (traffic., visual) and the 60" re striction
should remain.

§ 280-64 Front yard setbacks. [Added 8-22-1995 by L.L. No. 18-1995]
A. Structures shall be set back at least 100 feet from the right-of-way.
B. There shall be an exception to Subsection A if the adjacent parcels are
developed, in which case the minimum front yard setback shall be the average of
the setbacks of the adjacent parcels.
C. A project shall be divided into separate structures so that no single structure shall
have more than 60 linear feet of frontage on one street. The setbacks of multiple
structures on a parcel may vary, provided that the average setback of the
structures meets the setback required above and all buildings are at least 75 feet
from the right-of-way.
