A special meeting of the Southold Town Board was held at the office
of Supervisor Norman E. Klipp at Greenport~ on Wednesday~ June
19~6. The meeting was called to order at 7:1~ P.M. with the following
present: SUpervisor Klipp; Councilman Albertson; Justices Tuthill~
C~ark and Dema~est; Town .Attorney Terry and Town Clark BOoth. Also
present were Howard M. Terry~ Building Inspector~ Frank J. McMann~
Esq. and Nathan Hicks.
The purpose of this meeting was pertaining to the Multiple Resident Law.
Frank McMann~ Esq.' representing Mr. Hicks~ spoke at length in reference
to making the Orient Point Hotel property of Mr. Hicks into a two
story building by closing off the two upper floors. He also spoke of
having the pending charges against Mr. Hicks dismissed by the District
Attorney~ also have e tempory certificate of accupancy for the season
issued to Mr. Hicks pending the-decision of the joint Legislative
Committee. The Board suggested that Town Attorney R~ G. Terry~ Attorney
Frank ~, McMann and Bdilding Inspector Howard M. Terry meet with this
Committee in New Y rk and take the matter up with them and have them
come to some decision if this hotel lk~ with the two upper floors
closed off could ge legally considered as a two story building under
the Multiple R sident Law.
Moved by Councilman Albertson; seconded by Justice Demar~st:
RESOLVED: That the following recommendation of Howard M. Terry~
Building Inspector~ for the Town of Southold ar hereby approved by
the Town Board retroactive to June l, 19~6 and are in full force and
effect as amended or recinded.
(1). To make a permit valid the excavating and complete footing (from
the approved plan) must be completed within first year from date of
issuance.
(2). Permit good for one year from the date of issuance~ project
must be completed in one year form the date the project was started.
(~). Legible plans drawn by builder will be accepted~ except where
engineers plans are required by law.
!4). Notic~ of registration to be published, copy of notice on file
mn Buildin$ Inspector file.
(~). Have forms printed of notice of violations.
(6). The Inspectors must sign ~heir name and date on certificate
of occupancy each time they make an inspection.
(7).'Fees for record searches for transcripts for each inspection is
$1.00 per copy. Complete case history from date the record wes started
will be':$~,'00,
(8). It wes agreed by the Town Board to restrict the activity of the
Building Inspector to Multiple Resident Law only and on ~ other matters
as ordered ~o do so.
Vote of Town Board: Ayes-Supervisor Klipp; Justices Tuthi~l~ Clark
and Demarest~ Councilman Albertson.
Moved by Councilman Albertson; seconded by Justice Demarest:
RESOLVED: That James J. Fitzpatrick be and he hereby is appointed
Police Patrolman (Constable) to serve in such capacity for the Town
of Southotd on a probationary period for six months, and BE IT FURTHER
RESOLVED: That James J. Fitzpatrick be compensated for such service
in the amount of Thirteen Dollars and Eighty-five Cents ($13.8~) per
day, payable in regular bi-weekly payments, and be it further
RESOLVED: That this appointment tkke effect as of June 23~ 19~6~ he to
serve at the pleasure of the Town Board.
Vote of To~ Board: Ayes-Supervisor Klipp; Councilman Albertson; Justica
Tuthill~ Clark and Demarest.
Moved by Justice Tuthill; seconded-by Justice Demarest:
RESOLVED: That the appointment of James J. Fitzpatrick as part time
patrolman be and hereby is terminated as of June 23~ 1956~ and be it
further RESOLVED: that the appointment of James J. Fitzpatrick as Dog
Warden be and here~y is terminated as of June 23, 19~61
Vote of Town Board. Ayes-Supervisor Klipp; Justices Tu~hill, Clark and
Demarest and Councilman Albertson.
