Councilman Stoutenburgh reviewed the proposed Marine I and Marine 11 regulations;
Clubs a special exception under Marine 1. All approved.
Brecknock Hall, Route 25, Greenport: RO out, must be LB. All agreed.
Heaenic Snack Bar: is RR, owner wants B, is B on current zoning map. Murphy,
Cochran, Penny-B, Stoutenburgh-RR. Marie Ongioni , attorney for Hellenic: her
client will accept LB. Agreed : Murphy, Stoutenburgh, Cochran, Penny, Edwards.
Phil Barth, from the audience, objected to Town Board's procedure of letting people
speak.
Councilman Penny: Proposed Skippers-LB, Schroeder-B, Route 25, East Marion.
Stoutenburgh, Penny: Yes, Murphy, Cochran: No. Remains non-conforming.
Mullen Motors, north side Route 25, Southold, location of body shop, HB to B.
Murphy, Stoutenburgh, Cochran: No. Penny: Yes. Remains HB.
Mandel, east side Rocky Point Road, East Marion, to Industrial. Murphy, Stoutenburgh,
Cochran:. No. Penny: Yes. Remains non-conforming.
Staples, west side MainStreet, Greenport. Recommendation of D. Emilita: leave as
pare-existing non-conforming. Change to B? Murphy, Stoutenburgh, Cochran: No.
Penny: Yes. Remains non-conforming.
Spano gas station, east side Main Street, Greenport. Same recommendation from D.
Emilita. Change to B? Murphy, Stoutenburgh, Cochran: No. Penny: Yes. Remains

Bergen, north side Route 25, west of Factory Avenue, Mattituck, requests 1 /2 the
property where oil tanks are buried, where currently zoned "C" to B-1 : All agreed.
Norris/Carr, Mattituck, from Hd to R-80: Murphy, Stoutenburgh, Cochran: Yes.
Penny: No. Justice Edwards sat in at this time. Ed Siegmann, representing property
owners in the area, requested the Board to put it back to two acreas the way it
"originally appeared on the first map from RPPW'". Jack Hart, attorney for Carr,
stated Carr bought the property with the M zoning, the use he intends to put it -
condominiums. Has spent a great deal of money on this project, engineering studies

alone approaching six figures. Ruth Oliva: supports Siegmann relative to the
original recommendation of R-80. D. Emilita: Town Planning Board and Dr.
Koppelman feel the property should be R-80. Murphy: R-80, Stoutenburgh: R-80,
Cochran: R-80, Edwards: HD, Penny: HD. Stays HD.
Councilman Stoutenburgh asked that Airport be removed from LI permitted use.
Murphy,i Stoutenburgh, Cochran: Out. Edwards, Penny: In. Remains in.
12: 30 P.M. - Mr. Spano appeared before the Board to request their reconsideration
to zone his non-conforming business property B. Board voted earlier.
Letter from Paul Heffernan requesting Larsen property, adjacent to the North Fork
Motel, Route 48, Southold, west of the Town Beach, be zoned B on new plan. Is
current zoned B and run as a Real Estate office. Under new plan would be R-40.
Question of changing the entire block to RR, or RO. Murphy, Cochran, Stoutenburgh:
No. Penny: change to RO. Remains R-40.
At this point the Board members, Murphy, Stoutenburgh, Cochran, Penny, voted
to stop further changes to the proposed plan.

Terry, Planner David Emilita.
Absent: Councilman James A. Schondebare, Justice Raymond W. Edwards.
Abigail Wickham, Attorney, for clients Katherine & Marjorie Tuthill, property on
Cutchogue Harbor, New Suffolk, designated MB, changed to Marine I on 3/19, wish
designated R-40. All agreed.
Abigail Wickham, Attorney, for Herbert Mandel, property east side Rocky Point Road,
East Marion, wishes designated Industrial. Is auto body use. Board will consider.
Patricia Moore, Attorney, for Robert Schroeder, property south side Route 25, East
Marion, wishes designated Business. Mr. Schroeder is under contract for purchase
of piece of industrial property where he will move his heavy equipment. Board will
consider.
Marie Ongioni, Attorney, on behalf of owners of Hellenic Snack Bar, north side Route
25, East Marion, request be zoned Hamlet Business instead of Resort Residential. After
a conference with her clients, they withdrew the request. Later she advised the Board
her clients had changed their minds and wishes consideration of HB. D. Emilita advised
that HB in that location is contrary to the HB district classification. No: Murphy,
Stoutenburgh. Will discuss again with full Board.
Ed Siegmann requested Board to consider the Norris/Carr property, Mattituck, from
HD to R-80.
C. Penny: Between Augie's Deli & Pacific Street, Mattituck, designated RO (no retail
sales) . Dave Strong, whose property is in that location, advised they are now B on
current zoning map and should be designated B on proposed. Discussion later: B for
Deli & Strong only. All agreed.
Mullen Motors, north side Route 25, Southold, where body shop is located, designated
HB, wants B. Board could not agree.
Dale Bergen, MainRoad, Mattituck, gas station is Industrial, oil tank property is
Residential. Discussion relative to designating Industrial to railroad tracks or only
1 /2 way. Board will look at the property.

Southold Flooring, south side Route 48, Southold. Designated A-C. LB on either
side. Change to LB. All agreed.
Skippers Restaurant, north side Route 25, East Marion. Now non-conforming. Board
will consider what to do.
Norris /Carer property, Mattituck, discussed again. HD to R-80. Yes : Murphy,
Stoutenburgh. Cochran: Would like all Board members present for this discussion,
stating Board had previously changed it to HD on advice of Counsel. Feels the entire
Board should be present for this discussion. (Ed Siegmann took exception. Said
Board present had been making decisions for two days without full Board. ) Council-
woman Cochran: I rescind every decision I've made for the past two days. Will not
continue without full Board present and a member of the Planning Board to advise
their thinking in making a designation on parcels now under consideration.
Narrow River Road, Orient - 7 foot line, revise per map lines submitted by G. Penny.
All agreed.
Discussion of Marina I & Marina II. Councilman Stoutenburgh advised the marina
owners are not in agreement with "municipal sewer & water" feel on-site community
water and sewer would be satisfactory. Will discuss with full Board.
Richard Lark, Attorney, representing owner of Brecknock Hall property. According
to covenants & restrictions on the property the designation should be LB. Will review
with D. Emilita.

Board reviewed proposal of Councilmen Stoutenburgh & Penny to revise Marine
Business (MB) District and divide into M-I & M-II districts, as worked out with
marina owners during the morning of :3/1"9/87. (Proposal attached hereto.) There
was discussion with respect to public water and sewer for marinas with motels and
restaurant. There was discussion relative to a possible requirement that existing
marines must install pump-out facilities when they serve over-night patrons.
Marine I marinas would be those in creeks: Narrow River Road Marina, Village
Marine, Mattituck, Boatmans Harbor, Cutchogue, Strong's Marina, Mattituck, Boos
Marina, Cutchogue, Jim' Murray's Marina, Laurel, Ulrich Marina, Southold, School
House Creek Marina (Tuthill) , New Suffolk.
Marine 11 marinas would be: Sterling Harbor Marina, Greenport, Brewers Yacht
Yard Marina, Greenport, Orient-By-The-Sea Marina, Orient, Young"s Boatyard &
Marina, Greenport, Goldsmith's at Mill' Creek, Southold, Port of Egypt Marina,
Southold, Albertson's Marina, Southold, Matt-A-Mar Marina, Mattituck, New Suffolk
Shipyard, New Suffolk, North Fork Shipyard, New Suffolk, Goldsmith's at Founders
Landing, Southold, Mill Creek Marina, Southold, Mattituck Inlet Marina, Mattituck,
Mattituck Dry Land Marina (Peterson) , Mattituck, Mattituck Fishing Station, Mattituck.
(possibly the two marins on Fishers Island - to be discussed with Justice Edwards.
Individual Parcels:
Lizewski property, northeast corner Main' Road and Depot Lane, Cutchogue. R-40
on the proposed map. Change home and club lots to RO. All agreed.
Jim Murray's Marina, southwest corner Brushes Creek at Peconic Bay Boulevard,
Laurel. R-40 on proposed map. Change to Marine 1 . All agreed.
Fort Corchoge (Downs farm). A-C on proposed map. This is the only protection
the Town can give the property. Review of historical nature of the property under
a SEQR action if property were to be developed.
Halsey Staples (monument business) , Main Road and Wilmarth Avenue, Greenport.
Spano gas station, Main Road diagonally across from Staples. Both non-conforming.
Possibly a light business. To be investigated by D. Emilita.

Marine I , with exception of Bork - New Suffolk Shipyard to Marine II.

17. Article X11 (Board of Appeals) is renumbered Article XXVII and a new Article
XII is added in its place, to provide as follows:
ARTICLE XII
Mar'
Section 100-120. Purpose.
To provide a waterfront location for a range of water dependent and water
related uses which are those uses which require or benefit from direct access
to, or location in marine or tidal waters.
Section 100-121 . Use regulations.
In an MB District, no building or premises shall be used and no building or
part of a building s all be erected or altered which is arranged, intended or
designed to be used in whole or in part for any uses except the following:

1 (1) One-family detached dwelling.
Z L (2) Marinas for the docking mooring and accommodation of recreational
orYAQN-commercial boats, includin the sale of fuel and oil primarily
or the use of boats accommodated in such marina.
3 (3) Boat docks slips piers or wharves for charter boats carrying
passengers on excursions pleasure or fishing trips orfs
Y (4) Beach club yacht club or boat club including use accessory to them
such as swimming pools, tennis courts, racquetball facilities.
(5) Boat yard for building ' storing repairing, renting, selling or servicing
boats which may inc ude t-he ollowing as an accessory use: office
for the sale of marine equipment or products dockside facilities for

No buildin shall be used and no building or art thereof shall be erected or
altered in the MB District unless the same conforms with the Bulk Schedule and
Parking and Loading Schedules incorporated into this chapter, by reference,
with the same force and effect as if such regulations were set forth herein in
full.

Present: Supervisor Francis J. Murphy, Justice Raymond W. Edwards, Councilman
Paul Stoutenburgh, Councilman James A. Schondebare, Councilwoman Jean W. Cochran,
Councilman George L. Penny IV, Town Clerk Judith T. Terry, Town Attorney Robert
W. Tasker, Town Planner David Emilita.
The Board met to discuss action to be taken on proposed "Local Law to Amend the
Southold Town Zoning Code and the Zoning Map Incorporated therein, to implement,
in whole or in part, the recommendations of the Master Plan Update prepared by
the Planning Board. "
Councilman Schondebare - keep the present zoning code. Throw out the proposed
update, it is 'a disaster. 16 zones is crazy - a bureacratic nightmare.
Justice Edwards - throw it out.
Councilwoman Cochran-- adopt now and pledge to make changes immediately.
Councilman Penny - would have to know the process. There are numerous parcels
that should be addressed now. A generic environmental impact statement should
be done. Horrendous misconceptions on Marine Zones.
Councilman Stoutenburgh - some things were overlooked. Should make corrections,
do generic EIS, then rehear. Marine Zones should be revised.
Supervisor Murphy - also feels some changes should be made & do a generic EIS.
Agrees Marine Zones must be readdressed.
David Emilita - as a result of the comments at the public hearing he feels the safest
course would be to do a generic EIS. Could hold a joint hearing on the Local Law
and SEQR by June.
Town Attorney Tasker - legally Board would be safer to review and make necessary
changes and conduct a generic SEQR review.
