Moved by Justice Clark; seconded by Councilman Ai~ertson: RESOLVED: That the minutes of the two previous meeting s~ March 6 and March 7, be and hereby are duly approved as corrected. CERTIFICATE OF SUPERINTENDENT OF HiGHWA~S DETERMINING THAT AN EMERGENCY EXISTS PRICE, Superintendent of Highways of the Town of ~ffolk County~ New York, do hereby Certify that as a result e two unprecedented and excessively severe snow storms occurring on Friday~ March 16, 1956~ and Sunday, March 18, 19~6, coupled with the accidental destruction and failure of certain Town highway equipment, there existed a grave emergency, attested to by the declaratioo of a sta~e of emergency by the Sheriff of Suffolk, County~ and I made the determinmtion that the emergency was so great as to warrant the immediate purchase of a Walters snow fighter at a price of $18~910.00 in order to immediately snd adequately cope with the emergency. Southold, N.~. 3!0 Moved by Justice Tuthill; seconded by Justice Demarest: SERIAL BOND RESOLUTION ~ated March 27~ 1956, authorizing the issu- ance of SERIAL BONDS of the TOWN OF SOUTHOLD, Suffolk Count~, New York~ in the amount of $17,000.00. for the purchase of ene (1) Ealters Snowfighter. WHW~REAS, the Town Board of the Town of Southotd~5~.Y.~ by a reso- lution duly adopted on the 27th day of Nmrch, 19 I authorizing the Town Superintendnet of Highways to purchase certain machinery for highway maintenance and snow removal at a total cost of $18~910.~ subject to the approval of the County Superintendent of Highways, and provided that $17,000. of such cost was to be paid from ~he'~ proceeds of obligat~ions to be issued pUrsUant to the Local F~nanCe Law. NOW, THEREFORE~ BE IT RESOLVED: 1. The specific object or purpose for which obligations are to be issued pursuant to this resolution is to finance the cost of one (1) Walters Snow Fighter. 2. The maximum cost of such machinery is $18~910.~ and the p~an of financing such cost is as follows: By current funds in the amount offS1,910, to be paid from the machinery fund. The balance of ~he cost is to be provided by the issuance of serial bonds in the amount of $I7~000. pursuant to this resolution. 3. The following determinations are hereby made: (a) The period of probable usefulness of such machinery is five years. (b) The subdivision of paragraph a of Section ll. O0 of the Local Finance Law which is applicable in the circumstances is subdivision "28". (~) The proposed maturity of the obligations authorized by this resolution will not be in excess of five years. ~. The power to fix and determine the exact d~te of s~ch bonds is here~y delegated to the Supervisor. ~. The bonds shall be issued in bearer form without coupons~ and shall not contain a power to convert to registered form. The bonds shall bear interest at a rate not exceeding two and one-half (25,%) per centum payable semi-annually. The Supervisor is here~y delegated the power to prepare such bonds and to sell such bonds ~t private sale at not.less than par and accrued interest~ and at such sale to fix the interest ~ate to be borne by such bonds within the limitations set forth in this resolution. The Supervisor~ Shall deliver such bonds to the purchaser thereof only against cash or a certified check. The proceeds of sale of the bonds shall be deposited in a special bank account as required by Section 165.00 of the Local Finance Law. The powers delegated to the Supervisor by this reSOlution shall be exercised in conformity with the provisions of the Local Finance Law. 7. This resolution shall take effect immediately. The Supervisor informed the Town Board of the Following situation in regard to the Welfare Account being practically depleted. Moved by Councilman Albertson; seconded by Justice Demarest: WHEREAS, The State of New York has. delayed in reimbursing the. Town of Southold for the months of December 195% and January and February 1956 for moneys advanced by the Town for Welfare purposes, and ~HEREAS~ the delay by the State has caused the Welfare Account to become practically depleted~ now~ therefore~ be it RESOLVED: That the Supervisor be and he hereby is directed ~o take the necessary steps to borrow Five Thousand Dollars ($5,000) on a budget note to cover the emergency. Moved by ~o~man Albertson; seconded by Justice Demarest; BUDGET NOTE RESOLUT~0N DATEE MARCH 27th~ 1956~ AUTHORIZING THE ISSUANCE OF A BUDGET NOTE OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, IN THE AMOUNT OF $5,000.00 FOR HOME RELIEF. BE IT RESOLVED this 27th day of March~ 1956~ by the Town of Southold~ Suffolk County, New York, as follows: Section 1. That, pursuant to the provisions of Subdivision 2 of paragraph a and paragraph e of Section 29~ and Section 108 of the Local Finance Law, Section 93 of the Social Welfare Law and S~ction ll$ of the Town Law,.for the purpose of paying the cost of home relief expenditures for which insufficient provision was made in the annual budget for the year 1956~ there is hereby appropriated as.~a supplemental appropriation for home relief the sum of $~,000oOO and there is hereby authorized to be issued a budget note of the Town of Southold ~n the principal amount of $5,000.00 whic~ is the maximum cost of such object or purpose~ which note shall mature on March 27th~ 1957. Section 2. That, except as herein specifically prescribed~ said note shall be of the date, terms~ form~ contents and place of payment~ and'~ at a rate of interest not exceeding three per centum per annum, as may be determined by the Town Supervisor, consistent, however~ with~he provisions of said Local Finance Law of the State of New York~ and shall be executed in the name of the Town of Southold by its SuperVisor ~nd .the seal of said T~wn shall be attached thereto. Section ~o That said note shall be sold at private sale by the Town Supervisor at a price of not less thanD~rbvalue and accrued interest~ if any, and upon due execution and sale of said note the same shall be delivered to the purchaser upon payment by him to the Town Supervisor of the purchase price in cash; and the receipt of such Supervisor shall be a full acquittance to such purchaser who shall not be obliged to see to the application of the purchase money.
