Moved by Councilman Valentine; seconded by Councilman Rich; WHE~S,~by resolution duly adopted on the 23rd day of ~eb. 1971, Joseph Lite, Esq. was duly retained as Special Attorney, for the purpose of conducting all proceedings~necessary for the acquisition of the necess- ary lands for the construction of the Grand Avenue Bridge at Mattituck in the Town of Southold, and WHEREAS~ pursuant to Section 4 of the Suffolk County Improvement Act, it is necessary and required that a taking map of the proposed acquisition to be condemned is a condition precedent, NOW, THEREFORE, BE IT RESOLVED that Joseph Lite, Esq. be authorized to utilize the taking maps prepared by the Suffolk County Dep~rtment of Public ~o~ks,o~n~ it is further RESOLVED: That such maps be filed in the office of the County Clerk as re- quired b~ the Suffolk County Improvement Act. Vote of own Board: Ayes; Supervisor Martocchia; Councilmen Valentine and Rich; Justices Demarest and Suter. 386 MOved by Councilman Valentine; seconded by Justice Suter; WHEREAS, this Board did heretofore enact Local Law No. 1-1971 entitled "a local law to provide tha~ ~he offices of assessors in the Town of Southotd shall continue to be elective'~ and Local Law No. 2-1971 entitled ,A Lgcal LaW to provide that the number of assessors in the Town of Southold be ret duced from six to three" both of which local laws are subject toga m~n~a~ory referendum, and WHEREAS, this Board now desires to provide for a special town electioD~at which time the aforesaid local l~ws shall be submitted for the app~oval~of the electors of the Town, now, therefore be it RESOLVED, AS FOLLOWS: ~ Section 1. A Special Election shall be h~ld in the Town of Sou~hold, in the County of Suffolk, New York, in said Town on April-20, 1971, at 11:00 o'clock A.M'. (E.S.T.) and the polls shall remain op~nl~unti1 8:00oo"clock P.M? (E.S.T.') or as much longer as may be necessary to enable the voters then present to cast their votes. Voting will be at ~hepol!ing places set forth in the form of notice of said Special Town Election-herein- after prescribed. Section 2. The Town Clerk of the said Town shall cause such Notice of said Special Town Election to be published at least once in ~ME Suffolk Weekly Times, a newspaper published in the Town of Southo!d;~New. York, and designated the official newspaper of the Town and the-Long~ Island Traveler-Mattituck Watchman an additional newspaper designated ~or the publication of notices, resolutions and ordinances in the Town of~Southold, and to be posted on the sign board of the Town maintained pursuant to sub- division 6 of Section 30 of the Town Law, Said publication and post~n~ to be at least ten (10) days before such Special Town Election. Section 3. Said Town Clerk is hereby authorized and directed to include in the Notice of the Special Town Election as hereinafter s.et forth notice that the Town Board will submit at the said Special Town E~!ection, for the approval or disapproval of the voters of the Town, the Propositions therein set forth. Real property owned by one or more persons, each of whom ~s~Sixty-five years of age or over, or real property owned by husband and ~i~e, one of whom~is sixty-five ~ears Of age or over,~ shall be exempt from taxes to the extent of ~fifty per centum of the assessed valuation ~hereof. ..... Section 2. No exemption shall be granted - -~a) If.the.income of the owner or the combined income of the owner~ of the property for the income tax year immediately preceding the date of making application for exemption exceeds the-sum of five thousand "388 dollars, Income tax year shall mean the twelve month period for which the owner or owners filed a federal personal income tax return, or if no such return is filed, the calendar, year. Where title is vested in either the husband or ~the wife, their combined income, may not exceed such sum. Such income shall include social security and retirement benefits, interest, dividends net re~al income, salary or earnings, and net income f~mm self- employment, but shall not include ~i~ts or inheritances; (b) Unless the title of the property shall have been vested in the owner or all of the owners o'f the property for at least sixty consec- utive months prior to the date'of making application for exemption, pro- vided, however, that in the event of the death of either a husband or wife ~-~, in whose name title of the property shall have been vested at the time of death and then becomes vested solely in the survivor by virtue of devise .... by or descent from the deceased husband or wife, the time of ownership of the property by the deceased husband or wife shall be ddemed also a time of ownership by the survivor and such ownership shall be deemed continuous for the purposes of computing such period of sixty consecutive months and provided further-that where property of the owner or owners has been acquired to replace property formerly owned by such owner or owners and taken by eminent domain or other involuntary proceeding, except,a tax sale, the period of ownership of the former property shall be combined with the period of ownership of~theproperty for which application is made for ex- emption and such periods of ownership shall be deemed to be consecutive for purposes of this ordinance; (c) Unless the property is used exclusively for residential purposes; (d) Unless the real.property is the leal residence of and is occupied in whol~ or in part by the owner or by all of the owners of the property. Section 3.' Application for such exemption must be made b~the owner or all of the owners of the property, on forms prescribed by the state board to be furnished by the appropriate assessing authority and shall furnish the information and be executed ~in ~he manner required or prescrib-~ ed in shch forms, and shall ~be filed in such .assessor's office on or beforei ~ the appropriate taxable status date. Section 4. At least sixty days prior to the appropriate taxable status date, the assessing authority shall mail to each person who was granted exemption pursuant to this ordinance, o~ the latest completed assess- ment roll an application form and a notice that such application must be filed on or before taxable status date and be approved in order for th~ exemption to be granted.'. Failure.to mail any such application~form and notice or the failure of such person.to receive the 'same.shall not prevent the levy collection and enforcement or the payment of the taxes on property owned by such person. Section 5. Any conviction of having made-any willful.fa~s~.~ statement in the application for such exemption, shall be punishable by a fine'-of.not more than one hundred dollars and shall; disqualify ~he_~ applicant or applicants from further exemption f. ora period 6f fivfe_Years. Mr. Gallagher, Mattituck, N.Y. appeared before the Town Board requesting more information on taking over ~ road known as Donna Drive and Theresa Drive owned by Frank Zaleski. Town Attorney explained at great length that Mr. Zaleski had not met with the highway specifications and had not ded- icated~the roads to the Town. The League of Women Voters presented a letter requesting the immediatee enactment of a vital wetlands ordinance. Edward Latham spoke against one acre zoning. Mrs..~ytle spoke on preservation of wetlands. Also on the damage ~eing done by erosion..0n the Sound Shore from Peconic Inlet to ~orto~ Point, So~thold.
