Moved by Justice Suter; seconded by Councilman Valentine; RESOLVED: That the Southotd Town Officials who desire to attend the Annual meeting of the Association of Towns of the State of New York to be held on February 9, 9 and 10, 1971 be and hereby are authorized to attend, and it is FURTHER~RESOLVED: That the actual and necessary expense incurred in connect- ion with attendance of such meeting shall be a legal charge against the~Town. RESOLVED: That Supervlsor~Albert Martocchia be designated to represent the Town of Southold at the Annual meeting of the Association of Towns of the State of New York to be held in New York City, N.Y. in February 1971 and to cast the vote of the aforesaid Town pursuant to Section 6 of Article III of the Constitution and by-laws of said Association, and be it further RESOLVED: That JusTice Suter be designated to act as Alternate to cast the vote of said Town at the Annual meeting in the absence of Supervisor Martocchia. Moved by Councilman Rich; seconded by Councilman Valentine; ~ WHEREAS, Southold Town Planning Board has prepared an official repor~ and recommendation and the County Planning Board has been notified and their report returned to the Town Board on the application of Matthew Mullen for a change of zone from "A~' Residential and Agricultural District to "B-2" Business District on certain property situated in Cutchogue/ N.Y. NOW~ THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor's Office, 16 South s~reet, Gree~port, New York, on January 26, 1971 at 7:30 P.M. on the above mentioned petition and that the Town Clerk be and he hereby is authorized and directed to cause notice of said hearing to be published in the L.I. Moved by Councilman Valentine; seconded by Councilman Rich; IN T~E MATTER OF T~E ESTABLISHMENT OF THE WEST GREENPORT WATER SUPPLY DISTRICT· IN THE TOWN OF $OUTHOLD, SUFFOLK COUNTY, NEW YORIf· PURSUANT TO ARTICLE 12A OF T~E TOWN LAW.c The Town Board of the Town of Southold, Suffolk County, New York, baying by order duly adopted on the 5th day of November, 1970, determine~ to hold a public hearing in the matter of the establishment of the West Greenpor~ Water Supply District in the Town of Southold, Suffolk County, New-York to embrace the territory hereinafter described; and a public hearing.~pursuant to due notice thereof, having been held on the 24th day of November, ~970, at the Supervis6r's Office, 16 South Street, Greenport, in the Town of Southold, Suffolk County, New York, at which time and place said Town Board 361 considered said matter and heard all persons interested therein; and said Town Board having by resolution duly adopted on the 24th day of November 1970, following the said hearing and upon the evidence given thereat, duly determined that all of the property and property owners within the proposed District were benefitted thereby; that all the property and property owners benefitted were included within the limits of said proposed district, and that it was ~n the public interest to establish said district and duly resolved to approve the establishment of such Water Supply District to embrace the territory hereinafter described, which said resolution was sub- ject to a permissive referendum as provided in Section 209-e of the Town Law, an~ no petition requesting that the matter of the establishment of said district be submitted to a referendum of the property owners of the proposed district having been filed with the Town Clerk, and the time within which such petition may be so filed having expired; IT IS ORDERED, that the said Water Supply District to be known as the West ~reenport Water Supply District be and it hereby is established to embrace the territory described in and containing the following boundaries, to wit: ALL that certain tract, p£ece or parcel of land, situate west of the Incorporated Village of Greenport, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point formed by the intersection of the northerly line of New York State Route 25 (Main Road) with the center line of Pipes Neck Creek (Moores Drain), running thence in a southerly direction along the center line of Pipes Neck Creek to the mean high water line of Peconic 'Bay~ Continuing thence along the mean high water Line of Peconic ~ay~.~n a generally southerly and then Westerly direction to a point formed by the intersection of the westerly line of land now or formerly of L. Moved by Justice Demarest; seconded by Justice Suter; RESOLVED: That Supervisor Al~bert Martocchia be and he hereby is authorized to sign the following agreement between Town of Shelter Island and the Town of Southold: THIS AGREEMENT made on the 5th day of January, 1971 between the TOWN OF S~E~.~:~ISLANQ, a municipal corporation of t~e State of ~ew York, having its principal office at State' Road (Route 114), Shelter Island, ~SuffOlk County, 'New York', party of the first part, and the TOWN OF SOUTHOLD, a~ municipal Corporation of the State ~ New Y~rk, having its principal office at 16 South Street, Greenport,~Suffolk County, New York, par~¥ of the second part. WHEREAS~the party of the first part ~as H~eretofore established a Central fire alarm system embracing the entire territory of the Town of Shelter Island and desires to provide'for the receiving and dispatching of fire and emergency alarms by the police department of the Town of So~thold, and WHEREAS, the party of the second part maintains a police department~with radio operators on duty twenty-four hours a day and can receive and dis- patch fire and emergency alarms to and from the Southold Town Po'lice De partment to the fire authorities in the Town of Shelter Island ~ithout undue burden to the party of the second part, and WHEREAS, the party of the first part also proposes to install a telephone and other necessary radio and/or electrical equipment for such purpose at the ~olice headquarters of the party of the second part whereby all alarms for fire and other emergencies in the Town of Shelter Islan~may be received through such equipment at the police headquarters~0f the Town of Southold, and dispatched to the fire authorities in the Town of Shelter Island, and WHEREAS~ in view of the foregoing, it is believed that it would be in the public ~~ that the parties h'ereto mutually agree that alarms for fire and other emergencies be received and dispatched on behalf of'the Town of Shelter Island by the Town of Southold at its Police Headquarters at Peconic, New York and that in addition thereto the Town of. Shelter Island at its expense install the necessary c~mmunication equipment at the Southold Town Police Headquarters Building for such purpose. NOW~ T~EREFORE~ IT IS AGREED, as follows; 1. -That t~e Town of Shelter Island, at its own cost and expense will causs the necessary telephone radio and electrical equipment to be installed and maintained at the Southold Town Police Headquarters building at Pecon~c, New York for the pu'rpose of receiving and~ dispatching alarms of fire and other emergencies to and from the central fire alarm system of the Town of Shelter Island and the So~hold Town Police Headquarters. 2. That the Town of'Southold hereby agrees to maintain sufficient personnel at the Southold Town Police Headquarters building to a~swer all alarms for fire and other emergencies received from the central fire alarm system of the Town of Shelter Island and to dispatch the sa~e to the appropriate fire department and/or other authorities in the Town of Shelter Island and to keep and maintain a proper record of such a~'arms, received and dispatched. 3. That fbr the performance of such services by the Town of Southold for the Town of Shelter Island, the Town of Shelter Island hereby agrees to pay the Town of Southold the annual sum of $900.00 to be paid on or about the 15th day of June of each year during the term of this agreement. 4~' This agreement shall commence on the 1st day of January~ 1971, and shall terminate on the 31st day of December, 1975. Notwithstanding, the foregoing provisions of this paragraph, either party hereto shall have the option to terminate this agreement at the end of any calendar year by giving written notice of termination to the other party at least 30 days prior to the end of such year. 5~ The Town of Southold shall not, in any event, be liable for any damage or loss of property or for the injury to persons, arising from or caused by any break-down, or interruption of service of such commun- ication equipment nor for any such damages or injury caused by the acts of~negligence of the Town of Southold, its officers or employees. The Town of Shelter Island shall indemnify and hold harmless the Town of Southold of and from any and all datLLages, judgments, costs and expenses of every kind, which may arise or result from the acts or comissions of the Town of ~outho&d, its officers and employees performed under and pursuant to the provisions of this agreement. 6. That all equipment to,be installed pursuant to this agreement shall be installed and maintained in such manner as authorized and directed by the Chief of Police of the Southold Town Police Department. Moved~.by Councilman Valentine; seconded by Councilman Rich; RESOLVED: That Supervisor Albert Martocchia be an~ he hereby is auth- orized to sign the following agreement between Town of Shelter Island and the Town of So~hold: THIS AGREEMENT made ~n the 5th day of January, 1971, between the TOWN OF SHELTER ISLAND, a municipal corporation of the State of New York, having its principal office at State Road (Route 114), Shelter Island, Suffolk County, New York, party of the fir~st part, and the TOWN OF SOUTHOLD, a municipal corporation of the sta~e of New York, having its pr~incipal office at 16 mouth Street, Greenport, New York, party of the second part, WHEREAS, the party of the first part owns and operates police vehicles containing radS6 equipment but does not own and maintain a radio transmission base station, and WHEREAS, the p~rty of the second part maintains a police department with a ~adio transmission base station together with radio operators on duty twenty-four hours a day and can receive and transmit radio communications to and from said base station to the~ police vehicles in the Town of Shelter Island without undue burden to the party of the second part, and WHEREAS, the party of the first part also proposes to install a telephone at the police headquarters of the party of the second part whereby all telephone communications directed to the police of the Town of Shelter Island m~y be answered through such a telephone at the police headquarters of the Town of Southold, and WHEREAS, zn view of the foregoing, it is believed that it would be in the public interest that the parties hereto mutually agree that radio transmissions be received and dispatched on behalf of the Town of Shelter Island by the Town of Southold at its radio base station and that in addition thereto the Town of Shelter Island at its expense install a telephone at the Southold Town Police station which will receive teleph- One c~lls directed to the Shelter Island Town police. NOW, THEREFORE, IT IS AGREED, as follows: 1. That the Town of Shelter Island at it3s own cost and expense will cause a telephone and necessary equipment to be installed and maintained at the Southold Town police station at Peconic, New York, wherebyal~ telephone communications directed to the Shelter Island Town police w~ll be transmitted over said telephone and be received at 364 the Southold Town police headquarters. 2. That the Town of Southold hereby agrees that its personnel~ at the Southold Town police station will answer all telephone~communications received on said telephone equipment on behalf of the Town of Shelter Island, will make the proper record of such telephone communications and will where required either by telephone or radio transmission dispatch the necessary information to the Shelter Island Town police relative to such telephone transmissions. 3. That the .Town of Southold hereby agrees that it will ~receive and dispatch radio transmissions to and from the Shelter Island Town police vehicles and that the Town of South~ld will keep a proper record of all such radio transmissions. 4. That for the performance of such services by the Town of Southold for the Town of Shelter Island, the Town of Shelter Island hereby agrees to pay the Town of Southotd the annual sum of $600.00 to be paid on or about the L5th day of June of each year during the term of this agreement. 5. Carl~Moore contributed so much to our public ~ood because of his work and dedication to mur local hospital, and WHEREAS, the So~khold Town Board wishes to record the Sincere apprec- iation of its members on behalf of the Town of Southold and its~ · residents for th'e devotion and interest T.
