Martocchia, 16 South Street, Greenport, New York, at 3:00 P.M., Tuesday, October 30, 1973, with the following present: Supervisor Albert M. Martocch~ia Councilman James H. Rich, Jr. Councilman ~ames Homart Justice Martin Suter Justice Louis M. Demarest Justice Francis T. Doyen Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Albert W. Richmond Moved by Justice Suter, seconded by Councilma~ Homan, it was RESOLVED that the minutes of October 9, 1973 be and they hereby are approved. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Councilman Homan, seconded by Justice Suter, it was RESOLVED that the next meeting of the Southold Town Board will be held at 3:00 P.M., Thursday, November 8, 1973 at the office of Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Councilman Rich, seconded by Justice Suter, it was RESOLVED that a recess be called at 3:00 P.M. for hearing on Lo~al Law No. 5 - 1973. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Meeting reconvened at 3:15 P.M. A petition was presented by John Ferguson, New Suffolk, New York, signed by approximately 300 residents of the Town of Southold, requesting that the ramp at New Suffolk be cont&~ued as it is. Moved by Justice Surer, seconded by Councilman Homan, it was RESOLVED that Supervisor Albert Martocchia appoint Herbert Boughton, Mattituc~, New York to the Fire Advisory Board of Suffolk County, representing the Town of Southold, for the year 1974, a position he presently holds. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Demarest, seconded by Justice Suter, WHEREAS Section 123 of the Town Law provides that town officials and employees who receive and disburse monies of the Town shall a~count to the Town Board for all monies received and disbursed by them by the 20th day of January, and WHEREAS the Town Board deems it necessary to engage a public accountant to prepare the aforesaid annual, account for all town officers and employees, NOW, THEREFORE, BE IT RESOLVED that the Town Board engage the services of Elaine F. Kaldor, Certifie~ Public Accountant, to make the annual audit of the books and records of officers and~ employees of the Town of Southold for the fiscal year 1973 at a contract fee of $1,200.00. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Councilman Homan, seconded by Councilman Rich, W~EREAS the C.S.E.A. has requested the Town Board to open their contract for negotiations, NOW, THEREFORE, BE IT RESOLVED that the Town Board does not wish to open said contract for negotiations, as it is a two year contract, effective January 1, 1973 and terminating December 31, 1974. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich,~ Councilman Homan, Justice Surer, Justice Demarest, ~ustice Doyen~ Moved by Councilman Homan, seconded by Justice Suter WHEREAS Sam Brown applied to the Town Board for a single trailer renewal permit dated October 1, 1973, NOW, THEREFORE, BE IT RESOLVED that the application of Sam Brown to locate a single trailer on his property at Middle Road, Cutchogue, be and hereby is granted for a period of six (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Su~er, seconded by Councilman Homan, WHEREAS Steve Hamilton applied to the Town Board for a single trailer renewal permit dated October 24, 1973, NOW, THEREFORE, BE IT RESOLVED that the application of Steve Hamilton to locate a single trailer on the property of Elmer Ruland, Route 25 and Mill Lane, Mattituck, New York, be and hereby is granted until April 20, 1974. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Demarest, seconded by Justice Doyen, it was RESOLVED that $5,363.00 be transferred from Full Town Surplus to: ~ Buildings - A1620 - $2,000.00 Drainage - A8540 $63.~00 Beaches - A7180 - Si,G00.00 Youth Recreation - A7310.4 - $2,300 Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan~ Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that $12,158.00 be transferred from Part Town Surplus tg: Police - B3120 - $4,000.00 Social Security - B9030.8 - $1,158.00 and $7,000.00 from Part Town Contingent to Bay Constable - B3130.2. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Surer, seconded by Councilman Homan, it was RESOLVED that Supervisor Martocchia be and he hereby is ~uthorized to pay voucher of A. J. Gada, Fishers Island, in the amount of $2,217.00. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, C~nncilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Councilman Homan, seconded by Councilman Rich, it was RESOLVE~ that Supervisor Albert Martocchia be and he hereby is authorized to advertise for ~ids for a 4-wheel drive vehicle for the Bay Constable. Bids to be opened at 3:00 P.M., November 13, 1973. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Suter, seconded by Councilman Rich, it was RESOLVED that Supervisor Albert Martocchia be and he hereby is authorized to advertise for bids for two engines fQr the Poli~e Boat, said bids to be opened Novembe~ 13, 1973. Vote of the Town Board: Ayes: Supervisor MartoccSia, Councilman Rich, Councilman ~oman, Justice'Suter, Justice Demarest, Justice Doyen. Moved by Justice Cuter, seconded by Justice Demarest, it was RESOLVED that the Town ~erk be and he hereby is instructed to request the Long Island Lighting ComPany to: Change 100W light to 175MV light on Wickham Avenue and Mill Lane, Pole ~52; and install 175MV light on the corner of Wickham Avenue and Grand Avenue, Pole ~LILCO 23A, both in Mattituck, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. A meeess was called at 3:45 P.M., to reconvene at ~:00 P.M. Hearings were held oQ wetland applications at 4:15 P.M.-Richard E. Reunis (Application ~11) an~ 4:30 P.M.-Eli Frumkin (Application ~12.) Me~ing reconvened at 5:00 P.M. Moved by Councilman Homan, seconded by Justice Demarest, WHEREAS, proposed Local Law No. 5 1973 was introduced at a meeting of this board held on the 25th day of September 1973, and WHEREAS, a public hearing was held thereon by this board on the 30th day of October, 1973 at which time all interested persons were given an opportunity to be heard thereon, NOW, THEREFORE, BE IT RESOLVED that Local Law No. 5 - 1973 be enacted as follows, to wit: LOCAL LAW No. 5 1973 A LOCAL LAW TO AMEND CHAPTER 100, ARTICLE I, SECTION 100-12 OF THE CODE OF THE TOWN OF ~OUTHOLD, IN RELATION TO LOT AREA AND LOT WIDTH OF LOTS ON CERTAIN SUBDIVISION MAPS. Be it enacted by the Town Board of the Town of Southold: Section 1. Zhapter 100, Article I, Section 100-12 of the Code of the Town of Southold (Zoning Ordinance) is amended by adding thereto the following, to wit: Orient-By-The-See, Section II Cleaves Point, Section III This local law shall take effect immediately as provided by law. Vote of the Town Board: Ayes: Supervisor Martocc~ia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Moved by Councilman Rich, seconded by Councilman Homan, WHERRAS, proposed Local Law No. 6 - 1973 was introduced at a meeting of this board held on the 25th day of September 1973, and ~I~EREAS a publichearing was held thereon b~ this board on the 30th day of October, 1973 at which time all interested persons were given an opportunity to be heard thereon, NOW, THEREFORE, BE IT RESOLVED that Local Law No. 6 - 1973 be enacted as follows, to wit: LOCAL LAW No. 6 1973 A LOCAL LAW TO AMEND CHAPTER 92, ARTICLE III, SECTION 92-30 OF THE CODE OF THE TOWN OF SOUTHOLD, IN RELATION TO THE DESIGNATION OF CERTAIN HIGHWAY INTERSECTIONS AS STOP INTERSECTIONS. Be it enacted by the Town Board of the Town of Southold: Section 1.
