Ma rtocchia, 16 South Street, Greenport, New York, at 3:00 P.M., Tuesday, September 25, 1973, with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James Homan Justice Martin Suter Justzce LOuis M. De~arest Superintendent of Highways Raymond C. Dean Town Clerk Albert W. Richmond Absent: Justice Francis T. Doyen Town Attorney Robert W. Tasker Moved by Justice Suter, seconded by Councilman Homan, it was RESOLVED that the minutes of September 11, 1973 be and they hereby are approved. Vote of the Town Board: Ayes: Supervzsor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Moved by Councilman Rich, seconded by Justice Demarest, it was RESOLVED that the next meetings of the Southold Town Board will be held Friday, October 5, 1973 at 8:00 A.M., and Tuesday, October9, 1973 at 3:00 P.M. at the office of Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Suter, seconded by Councilman Noman, WHEREAS, the following local law being proposed Local Law No. 5 -1973 was heretofore introduced at this meeting by a member of this board, said local law being as follows, to wit: LOCAL LAW No. 5 1973 A LOCAL LAW TO AMEND CHAPTER 100, ARTICLE I, SECTION 100-12 OF THE CODE OF THE TOWN OF SOUTHOLD, IN RELATION TO LOT AREA AND LOT WIDTH OF LOTS ON CERTAIN SUBDIVISION MAPS. Be it enacted by the Town Board of the Town of Southold: Section 1. Chapter 100, Article Ii Section 100-12 of the Code of the Town of Southold (Eoning Ordinance) is amended by adding thereto the following, to wit: Orient-By-The Sea, Section II Cleaves Point, Section III This local la~ shall take effect immediately as provided by law. and WHEREAS, this board desires to hold a public hearing with respect to said local law, NOW, THEREFORE, BE IT RESOLVED that a public hearing be held by the board with respect to the adoption of the aforesaid local law at the Supervisor's Office, 16 South Street, Greenport, New York at 3:00 o'clock P.M. on the 30th day of October 1973, and it is further RESOLVED that the Town Clerk be and he hereby is authorized and directed to cause public notice of said hearing to be given as provided by law. Vote of the Town Board: Ayes: Supervisor Ma rtocc~ia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Supervisor Albert M. Martocchia stated that he had received notice from the Civil Service Commission granting a one year extension, to September 30, 1974, for Alfred R. 8rebe, a member of the Planning Board of the Town of Southold from Fishers Island. Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED that the Southold Town Board approves the action of the Fishers Island Ferry District in the advertisement for bids for the overhaul of one (1) B~ll Detroit Diesel Engine 12-V71 on the M/V Mystic Isle~e. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter~ Justice Demarest. On ~o~ion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Southold Town Board approves the action of the Fishers Island Ferry District in hiring Bertram Fisher as an insurance advisor to the District at an annual compensation of $500.00. Vote of the ~own Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. On motion of ~ouncilman Rich, seconded by Councilman Homan, WHEREAS, the following local law being proposed Local Law No. 6-1973 was heretofore introduced at this meeting by a member of th~s board, said local law b0±ng as follows, to wit: LOCAL LAW No. 6 1973 A LOCAL LAW TO AMEND CHAPTER 92, ARTICLE III, SECTION 92-30 OF THE CODE OF THE TOWN OF SOUTHOLD, IN RELATION TO THE DESIGNATION OF CERTAIN HIGHWAY INTERSECTIONS AS STOP INTERSECTIONS. Be it enacted by the Town Board of the Town of Southold: Section 1. By amending Chapter 92, Article III, Section 92-30 of the:Code of the Town of Southold (Vehicle and Traffic Ordinance) by adding thereto the following, to wit: Direction Stop Sign on of Travel Jernick Lane West Jernick Lane East Ship's Drive (North) West Ship's Drive (South) West At Intersection with Oaklawn Avenue Wells Avenue North Bayview Drive North Bayvlew Rrive Location (ha~iet) Southold Southold Southold Southold ~2. Moved by Justice Suter, seconded by Justice Demarest, WHEREAS the State of New York h~s indicated they plan to remove the State Police from this area, NOW, THEREFORE, BE IT RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized and directed to request the State Of New York not to remove from %his area the barracks and State Police, Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, JuStice Suter, Justice Demarest. Moved by Councilman Rich, seconded by Justice Suter, WHEREAS the .Burton Potter ~Post ~185,'American Legion, Greenport, New York applied to the Town Clerk for a Bingo License Amendment, and WHEREAS the Town Board has examined the application, and after investigation, duly made findings and~determinations as required by law, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby is authorized and directed to execute on behalf of the Town Board, the findings and determinations required by law, and it is further RESOLVED that the Town Clerk be and he hereby is directed to issue an Amended Bingo License to the Burton Potter Post ~185, American Legion, Greepport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Moved by Justice Suter, seconded by Councilman Homan, WHEREAS John C. Tuthill applied to the Town Board for a single trailer renewal permit dated September 4, 1973, NOW, THEREFORE, BE IT RESOLVED that the .application of John C. Tuthill to locate a single trailer on his property at the east side of Eli~ah's Lane, Mattituck, New York be and hereby is granted for a period of slx (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Moved by Justice Suter, seconded by Councilman Homan, WHEREAS Florence S~iner applied to the Town Board for a single trailer renewal permit dated September 1,~ 1973, NOW, THEREFORE, BE IT RESOLVED that the application of Florence Stelner to locate a single trai~r on her property at private road (John's Road), Mattituck, New York be and hereby is granted for a period of six (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman,Homan, Justice Suter, Justice Demarest. Moved by Councilman Homan, seconded by Justice Suter, W~IEREAS Minnie Wilson applied to the Town Board for a single trailer renewal permit dated September 15, 1973, NOW, THEREFORE, BE IT RESOLVED that the application of Min~e Wilson to locate a single trailer on her property off Middle Road, Cutchogue, New York be and hereby is granted for a period of six (6) months, Vote of the Town Board: Ayes: Supervisor M~rtocchia, Councilman Rich, Councilman Homart, Justice Suter, Justice Demarest. Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED that James Bahr, Greenport, New York be and he hereby is appointed Dog Enumerator for the Town of Southold for the year 1973-74. Vot~ of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Moved by Justice Demarest, seconded by Justice Suter, it was RESOLVED that a $1.00 fee be charged for a copy of any ordinance ~ the Southold Town Code which has not been printed in a separate booklet form. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Demarest, seconded by Councilman Homan, it was RESOLVED that.the Southold Town Board approves the action of %he Fishers Island Ferry District in the adjustment of rates for Local Passenger Tariff on one-way and round-trip fares, between Fishers Island and New London, Connecticut, Items No. 10, 20, 30, and extra fare trips; and adjusted rates for Local Freight Tariff, Items No. 50 and 60. (copy on file in the Town Clerk's Office.) Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman'Homan, Justice Suter, Justice Demarest. '~ SEP~b 1~73 A delegation from Wickham Park appeared before the Board to inquire about construction of a residence on Bay Shore Road, close to the wetlands. Meeting adjourned at 4:20 P.M. Albert W.
