SOUTHOLD TOWN BOARD MINUTES
Meeting of September 11,-1973
The Southold Town Board met at the office of Supervisor Albert M.
Martocchia, 16 South Street, Greenport, New York, at 3:00 P.M.,
Tuesday, SeDtember 11, 1973, with the following present:
Supervisor Albert M. Martocchia
Councilman James H. Rich, Jr.
Councilman James Homart
Justice Martin Suter
Justice Louis M. Demarest
Town Attorney Robert W. Tasker
Highway Superintendent Raymond C. Dean
Town Clerk Albert W. Richmond
Absent: Justice Francis T. Doyen
Moved by Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the minutes of August 28, 1973 be and they hereby
are approved.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the next meetin~ of the Southold Town Board will be
held at 3:00 P.M., Tuesday, September 25, 1973 at the office of
Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York.
Vote of the Town Board: Ayes:' Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Homart, seconded by Councilman Rich, it was
RESOLVED that a recess be called at 3:30 P.M. for the public hearing
on proposed Local Law No. 4-1973.
Vote of the Town'-Board: Ayes: Supervisor Martocchia, Councilman
Rich,-Councilman Homan,-Justice Suter; Justice Demarest.
Meeting reconvened at 3:48 P;M.
Moved by Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that the August t973 reports of the Building Inspector,
Justice Suter, Town Clerk, Police and Supervisor be accepted by
the Town Board and placed on file.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Suter, seconded by Justice Demarest, it was
RESOLVED that Hugo T. Casola-, Greenport, New' York, be and he hereby
is appointed School Traffic Office, Town of Southold, effective
September 1, 1973, at a daily wage of $12.85, payable for each day
worked, and he is to serve at the pleasure of the Town Board.
Vote' of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homart, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Councilman Homart, it was
RESOLVED that Philip Kenter be hired as a Cablevision consultant
for the Town of Southold,-to work on the future franchise. Payment
to Mrl Kenter to be made as-per agreement.

Moved by Councilman Homan, seconded by Justice Suter,
WHEREAS Leander Glov~r, Jr. has, by written application, applied
to this b~ard for a renewal Df his-permit to excavate sand, gravel,-
stone or other materials from premises located on the north side of
Middle Road at Cutchogue, New York, and
WHEREAS a public hearing was held on the original application on
July 13, 1971, the Town Clerk issued a permit as authorized by
resolutions dated October 26, 1971 and August 8, 1972, subject to
the terms and conditions set forth in said resolutions,
NOW, TPIEREFORE, BE IT RESOLVED that the Town Clerk be and he hereby
is authorized and directed to zssue a renewal permit to said Leander
Glover, Jr. for the excavation of sand, gravel, stone, or other
materials from the above described premises for a term of' one year,
subject to the same terms and conditions set forth in said resolutions
of October 26, 1971 and August 8, 1972, and further subject to the
condition that the following fees to be paid before the permit is
issued:
$3~0.00 for the excavation of 15,500 cu. yds. of fill under
permit authorized by the Southold Town Board by resolutions adopted
October 26, 1971 and August 8, 1972, and
$310.00 for the estimated excavation of 15,500 cu. yds. of fill
under renewal permit granted by resolution of the Southold Town Board
on September 11, 1973.

WHEREAS George A. McCarthy applied to the Town Board for a single
trailer renewal permit dated August 27, 1973,
NOW, THEREFORE, BE IT RESOLveD that the application of George A.
McCarthy to locate a single trailer on his property at south side
Main Road, Laurel, New York be and hereby is granted for a period
of six (6) months.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Suter, seconded by Councilman Rich,
WHEREAS Sophie Saunders applied to the Town Board for a single
trailer renewal permit dated September 6, 1973,
NOW, THEP, EFORE, BE IT RESOLVED that the application of Sophie
Saunders to locate a single trailer on her property at Main Road,
Laurel, New York, be and hereby is granted for a period ~ six
(6) months.
Vote of the Town Board: Ayes: Supervismr Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that Chief Ca~l Cataldo is hereby authorized to sign an
agreement on behalf of the Town of Southold with W. T. Grant for
the connection of a leased line alarm system to the alarm panel
of the communications console at Police Headquarters, Main Road,
~econic, New York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman Rich, seconded by Councilman Homan,
ArAtEREAS the Griswold-Terry-Glover Post ~803, American Legion~
applied to the Town Clerk for a Bingo License, and
WHEREAS the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he
hereby zs authorized and directed to execute on behalf of the
Town Board, the findings and determinations required by ~aw, and
it is further
RESOLVED that the Town Clerk be and he hereby is directed to issue
a Bingo License to the Griswold-Terry-Glover Post ~803, American
Legion.

WI~EREAS, a proposed Local Law No. 4 1973 was introduced at a meeting
of this board held on the 28th day of August 1973, and
WHEREAS a public hearing was held thereon by this board on the
llth day of September, 1973 at which time all interested persons
were given an opportunity to be heard thereon,
NOW, THEREFORE, BE IT RESOLVED that Local Law No. 4 - 1973 be
enacted as follows, to wit:
A LOCAL LAW TO PROVIDE FOR THE COMPILATION, RENUMBERING
AND TABULATION OF THE LOCAL LAWS, ORDINANCES AND RESOLUTIONS
OF THE TOWN OF SOUTHOLD
Be it enacted by the Town Board of the Town of Southold:
~ 1-1. Legislative Intent.
The local- laws, ordinances and resolution of the Town of
Southold referred to in ~ 1-2 of this Article shall be known
collectively as the "Code of the-Town of Southold, ' hereafter
termed the "Code, and the various parts and sections of suc~
local laws, ordinances and resolutions shall be distributed and
designated as provided and set forth in ~ 1-2 of this Article.

~ 1-3. Repeal of enactments mot included in Code.
All local laws and ordinances of a general and permanent.
nature of the Town of Southold, in force on the date of the
adoption of this local ~aw ahd not contained i n sucH'Code or
recognized and continued in force by reference therein, are
hereby repealed from and after the effective date of this local
law.
~ 1-4. Enactments saved from repeal; matters not affected.
The repeal of local laws and ordinances provided for in § 1-3 of
this local law shall not affect the following classes of local laws,
ordinances, resolutionS, rights and obligations, which are hereby
expressly saved from repeal:
A. Any right of liability established, accrued or incurred
under any legislative, provision of the Town of Southold
prior to the effective date of this local law or any
a~tion or proceeding brought for the enforcement of Such
right or liability.
B. An offense or act committed or done before the effective
date of this local law in v~olation of any legislative
provision of the Town of Southold or any penalty, punishment
or forfeiture which may result therefrom.
C. Any prosecution, indictment, action, suit or other
proceeding pending, or any judgment reddered prior to the
effective date of this local law brought pursuant to any
legislative provision of the Town of Southold.
D. Any franchise, license, right, easement or pr~ilege
heretofore granted or conferred by the Town of Southold.
E. Any local law, ordinance or resolution of the Town of
Southo~d providing for the laying out, opening,_altering,
widening, relocating, straightening, establishing g~ade,
changing name, improvement, acceptance or vacation of any
right-of-way, easemm~ street, road, highway, park or
other public place within the Town of Southold, or any
portion thereof. ~
F. ~Any ordinance or resolution of the Town of Southo~k~ .__j
appropriating money OS transferring funds, promising or
guaranteeing the payment of money or authorizing the
issuance and delivery of any bond of the Town of Southold,
or other instruments ~or evidence of the town's indebtedness.
G. Local laws, crdinances or resolutions authorizing the ~
purchase, sale, lease or transfer of property, or any
lawful contract or obligation.
H. The levy or imposition of special assessments or char~es.
I. The dedication of property.
J. Any local laws, ordinances or resolutions relating to salaries.
K. Any ordinance or resolution amending the Zoning Map adopted
by the Zoning Ordinance of 11-23-71.
L. The Police Department .Rules and Regulations approved by
resolution of the Town Board 8-10-65.
M. The Highway Specifications approved by resolution of the
Town Board 3-11-70.
Any ordinance or local law adopted after 5-29-73.

In compiling and preparing the local laws, ordinances and
resolutions of the town for publication as the "Code of the Town of
Southold" as distributed and designated in the table in ~ 1-2, no
changes in the meaning or intent of such local laws, ordinances and
resokutions have been made.
~ ~-6. Severability.
If any clause, sentence, paragraph, section, Article or part
of this Article or of any local law or ordinance cited in the table
in ~ ~-2 hereof shall be adjudged by any court of competent jurisdiction
to be invalid, ~uch judgment Shall not affect, impair or inva~idate
the remainder thereof, but shall be confined in its operation to the
clause, sentence, paragraph, section, ~rticle or part thereof directly
involved in the controversy 'in which such judgment shall b~ve been
~ 1-7. Cgpy of Code on file.
A copy of the Code in loose-leaf form, has been filed in the
office of the Town Clerk of the Town. of Southold and shall remain
there for the use and examination of the public until final action
is taken on this local law; and, if this local law shall be adopted,
such copy shall be certified to the Town Clerk of the Town of Southold
by impressing thereon the seal of the Town of Southold, and such
certified copy shall remain on file in the office of said Town Clerk
to be made available to persons desiring to examine the same during
all times while the said Code is in effect~
~ 1.-8~ Amendments to Code.
Any and all additions, deletions, amendments or supplements to
any of the local laws, ordinances and resolutions known collectively
as the "Code of the Town of Southold," or any new local law, ordinances
or resolutions, when enacted or adopted in such form as to indidate
the intention of the Town Board to be a part thereof, shall be deemed
to be incorporated into such Code so that reference to the Code shall
be understood and intended to include such additions, deletions,
amendments or spp~lements. Whenever such additions, deletions,
amendments or supplements to the Code shall be enacted or adopted,
they shall thereafter be printed and, as provided hereunder, inserted
in the l~ose-leaf book containing the said Code, as amendments and
s~P~emen~s thereto. Nothing contained in this local law shall affect
the status of any local law, ordinance or resolution contained herein
and may be amended, deleted or changed from time to time as the Town
Board deems desirable. Legislation originally adopted by resolution
may be amended by local law, resolution or ordinance. Legislation
originally adopted by ordinance may be amended by local law or
ordinance. Legislation originally adopted by local law may be
amended only by another local law.
§ 1-9. Code book to be kept up-to-date.
It shall be the duty of the Town~ Clerk to keep up-to-date the
certified copy of the book containing the "Code of the Town of
Southotd" rqquired to be filed in the office of the Town Clerk for
the use of the public. Ail changes in said Code and all local laws,
ordinances and resolutions adopted by tke Town'Board subsequent to
the enactment of this Article in such form as to indicate the intention
of said Town Board=to be a part of said Code shall, when finally
enacted or adopted, be included therein by temporary attachment of
copies of such changes or loaal laws, ordinances or resolutions until
such change or local laws, ordinances or resolutions are printed as
supplements to said Code book, at which time such supplements shall
be inserted therein.
§' 1-10. Sale of Code book; supplementation.
Copies of the Code may be purchased from the Town Clerk of t~e
Town of Southold upon payment of a fee to be set by resolution of
the Town Board, which may also arrange by resolution for procedures
for the periodic supplementation thereof.
~ 1-11. Penalties for Offenses.
Any person who, without authorization from the Town Clerk, changes
or amends, by additions or deletions, any part or portion of the "Code
of the Town of Southo~d," or who alters or tampers with such Dode in
any manner whatsoever which will cause the legislation of the Town
of Southold to be misrepresented thereby, or who violates any ot~er
provision of this local law shall be guilty Of a~ offense and shall,
upon conviction thereof, be subject to a fine of not m~re than two
hundred fifty dollars ($250.) or imprisonment for a term of not more
than fifteen (15) days, or both.
~ 1-12. Incorporation of provisions into Code.
The provisions of this local law. are hereby made Chapter 1 of
the "Code of the Town of Southold," to be entitled "General Provisions,
Article I, Adoption of Code," and the sections of this local law sh~ll
be numbered ~ 1-1 to 1-13 inclusive.
~ 1-13. When effective.
This local law shall take effect immediately upon filing with the
Secretary of State of the State of New Yor~/
