MEETING OF DECEMBER 6, 1955.
The Seuthold Town Board met at the of Eice of Supervisor Norman
E. Klipp at Greenpert, on Tmesday, December ~ 19~5. The meet-
ing was called to order at l:30 p;m; with the following present:
Superfisor Klipp; Justices Tuthill, Albertson, Clark andDemarest;
Town Superintendent of Highways Price; Town Attorney Terry and
Town Cle~kBooth.
The Board sat at once as a committee on Audit to examine claims
againSt~.~he Town, Concluding the Audit Work at 2 o'clock P.M.

RESOLVED:-T~at the Annual Audit Meeting of this Board will be

WHERE~S, a ~ecial meeting of the Town Trustees and a group
of Baymen was held at the Sup~visor's Office on December ~,
19%%, the following resolution relating to taking bug escallops
in certain town waters was adopted by the Town Trustees and
was approved and adopted bythe Town Board at their ~egular
meeting~held on De~ember 6th, 195~.
WHEREAS, It is apparent that scallops in the two areas here-
inafter mentioned would probably die during unusually stormy
weather by beingblown ashore or being covered with silt, and
WHEREAS,It is apparent that mahy people could derive a living
from the tsking of these scallops, now, therefore, be it
RESOLVED, Tha$ scallops of ~ny size may be taken from the two
hereinafter mentioned areas in any amount not to exceed five
(%) bushels per person per day by hand, with scalp net or by
sail power from December 5, 195% to March 3l 19~6 both
datesinclusive, snd be it further ' '
RESOLVED~ That persons taking scallops from these areas in
the amount of % bushels per person per day must have in their
possession a Sta~e of New York Conservation Department Digger's
Permit,~and be it further
RESOLVED, That scallops taken from these areas in the manner and
amount as heretofore described may be ~aken for commercial
pzrposeSl only an~ for % days per week only, from Mendy to
Friday, ~beth ~ay~ inclusive, and be it further
RESOLVE~, nothing contained in this resolution shall prevent
any pe is a resident or taxpayer of the Town of Southold

(1) In that area commomly known as Mill Creek at Arshamomaque
New York, from the New York State Route 2% Bridge, north.
(2) In that area commonly known as Gidds Bay, Orient, New York,
northerly,of a straight line drawn between Peter's Neck Point
and Brown s Point.

WHEREAS, the New York State Depirtment of Public.~orks is making
ex~ended improvements and alterations on State HighwayRoute 25
through the Town of Southold, and
WHEREAS, it has become necessary to provide for numero~slcatch
basins to take care of drainage problems on this highway, and
WHEREAS, the installatiom% of such catch basins.~has made. it.
necessary to remove certain trees, particularly in the community
of SouthOld, which trees contributed greatly to'the beauty of
this community, now, therefore, be it
RESOLVED: Thit the Town Board of the Town of Southoldrequest
that our. State Representatives, HonOrable Edmund Lupron, State
Assemblyman, and Honorable S. Wentworth Horton, State Senator,
take wh~tever~steps they deem necessary to-inStitute a program
with the New York State Department of Public Works 2or the re-

WHEREAS,~ it is the considered oponion of the Town Board that the
work at the Southold Town Dump during the winter months is not
sufficient to warrant the employment of two la~ormen, therefore

RESOLVED: That the services of Stephen Coyle, laborer at the
Sou~hold Town Dumpbe and hereby is terminated as of December

The Supervisor read a comm~/%ication form Rudolph Hoerr s~ating
that he was tending his ~esignation as School Traffic Officer
at the Southold School~ effective as of December 22, 19g~.

RESOLVED: That the resigantion of Rudolph Eoerr, Traffic Officer
at the Southold School, be accepted with regret, and be it

RESOL~ZED: That the Supervisor be directed to forward a letter of
commendation to Mr. Ho~rr.

The following resolution offered by Justice Demarest; seconde'd~by
Justice. Albe~tson was duly adopted by ~ mnanimous vote:
WHEREAS~ God~ in his Providence~ has taken from our mids~ the
spirit of Lyie F. Tuthill, and '
WHEEEAS,~Ly~e F. Tuthill served the Town of Southold as its
Trustee faithfully and efficiently for a term of nSne years,
THEREFORE, BE IT RESOLVED: That the Town Board of the Town of
Southold deeply mourns the passing of this associate and friend
and extends its profound sympathy to the members of his family
in %heir bereavement, and that when this Board adjoins this day,
it do so out of respect to the memory of Ly~ F. Tuthill.
BE IT FURTHER RESOLVED: That the Town Clerk be and he herebY is
directed to forw~rd~s copy of this resolution to the members
of his family and a .copy of this resolution be spread upon the
minutes of this meetin~ ~nd become a part of the public record,
of the TOwn of Semibold.
