EXECUTIVE SESSION 9:15 A.M. - The Board discussed their decision on Patrolman Michael Burke's grievance. WORK SESSION 9:51 A.M. - The Board ~esumed auditing the bills, and reviewed the agenda. Supervisor Pell detailed his meeting with Highway Superintendent Dean and Holzmacher, McLendon and Murrell concerhing the Transportation Bond Act, street sign project and New Suffolk road project. H2M will present a detailed account of the progress of each project. Recess for lunch au 12:15 P.M. Work Session resumed at 1:50 P.M. Councilman Murdock outlined his proposal alternatives To municipal ownership in resource recovery. He said if the Town goes into this project with the five east end Towns it will surely c6st as much as $74,937,000.00 in 1980 dollars and Southold Town's share will be $15,000,000.00. This ddes not include the solution of the sludge problem au a cost_of approximately $3,000,000.00 and covering and capping the present landfill ~.r~. at $3,000,000.00. He suggests meetings width engineers, Energy Development Corp and H2M as well as the DEC and an inspection of the plants at Mt. Holly, New Jersey and Salem, Virginia by Councilman Murd0ck and Highway Superintendent Dean. 2:10 P.M. - The Board met ~th William Price, Sr. of McMann-Price Agency, Donald Gullakson of the McMann-Price Agency, Robert McCarthy fo the Roy Reeve Agency and Andrew Stype of the Val Stype Agency and Mr. William Mullen, consultant to the Tow~ Board concerning the To,~n,ls insuranc~ for 1981. Mr. Stype said he has a company interested in all of the Town's business but did not have enough time To put a package together. He thanked the Board for the opportunity to be of service .... William Price stated he received bids from the following companies: Aetna Casualty at $106,000.00, Hartford au $92,430.00, and Utica Mutual at $82,493.00 and Boston Old Colony at $83,199.00. Mr. Price recommended Utica Mutual not only because they are the lowest, but because the offer is a much more comprehensive package than any of the others. Their package is an all fish blanket policy on all buildings and contents, employee benefits liability, umbrella which will list police professional liability as an underlying coverage and umbrella over and above that. Last year the cost To the Town for insurance was $102,000.00 with not as great coverage. Mr. Price asked if the Board wished to bring their insurance coverage up To date and he was advised this would be looked into after the first of the year. Mr. Mullen asked Mr. Price To find out from Utica how much it would cost To bring the umbrella up to $10,000,000.00 At Mr. Mullen's request, Mr. Price inquired of Utica whether they would accept a downpayment and installments. It was determined they would accept 25% down and the balance in 11 installments without an increase in the amount of the policy.---Supervisor Pell thanked Mr. Mullen for all his help on this project and said the Town owes him their gratitude. 2:40 P.M. - Councilman Nickles questioned the Supervisor relative To the original resolution on Robins Islan~ concerning limited 2 DECEMBER 30 1980 development. Supervisor Pell spoke of a discussion he had with some of the members of the Robins Island Advisory Committee concerning expanding their responsibilities into development. Councilman Nickles stated he was interested in their findings on limited development, not complete development and suggested adding two new members to the Committee to w~rk on the development task - George Sullivan and Jean Tiedke. Supervisor Pell said he would like to talk to the entire Committee to see if they can do it within the time limit with the present Committee or would need two additional people to work in that area. COuncilman Nickles said he feels the Committee shoul'd be directed to work in that area and not asked whether they need additional help. The Board determined that the Town Hall would be closed £rom 12:30 P.M. until 2:00 P.M. to permit employees to attend the funeral services of the last Assessor Melville A. Kelsey, Jr. A regular meeting of the Southold Town Board was held on Tuesday, December 30, 1980 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Pell opened the meeting at 3:00 P.M. with the Pledge of Allegiance to the Flag and a minute of silent prayer in memory of the late Melville A. Kelsey, Jr., Assessors, Town of Southold. Doyen IUd like to announce at this time that the Town Hall will be closed tomorrow from half past 12 until 2:00 P.M. to allow the Town employees who have worked with Mel since 1973, since he has been employed by the Town, a chance to attend his services. The Town Hall will be closed tomorrow from 12:30 until 2:00 o'clock. On motion of Councilman Nickles, seconded by Councilman Drum, it was RESOLVED that the minutes of the December 16, 1980 Southold Town Board meeting be and hereby are approved. On motion of Councilman Murdock, seconded by Councilman Drum, it was RESOLVED that the following ~udited bills be and hereby are ordered paid: General Fund Whole Town bills in t~e amount o£ $19,996.94; General Fund Part Tewn bills in the amount of $11,350.63; Highway Department bills in the amount of $5,212.96; Fishers Island Ferry District bills in the amount of $12,987.08; and Federal Revenue Sharing bills in the amount of $200.00 Vote of the Town Board: Ayes: Councilman Sullivan, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. REPORTS ~ ~UPER¥ISOR PELL: 1. Police Department report for the month Of November (1980). DECEMBER 30, 1980 3 2. Town Justice Rich report for the month of November (1980). 3. We have an update on Cablevision putting in new lines in Southold Township. It is a progress report. 4. Councilman Murdock will make a report on the landfill area. COUNCILMAN MURDOCK: Thank you, Bill. This is just a short report. This is the Five Town Solid Waste Management Study that was done and prepared, ~o~ us by ~ol~macher, McLendon in conjunction with the New York State Department of Environmental Conservation. It has to do with what the recommended uses or recommended abuses would be for municipal solid waste. It calls for a capital invest- ment of $74,937,000~00 in 1980 dollars. The:Southold sh~re would be approximately $15,000,000.00. This facility is designed to come on li.ne in 1985 with a life use to the year 2005 and by that time they expect other technologies to be in place. I figured on the basis of amortization over 20 years it would be $800,000.00 per year for Southold Town. The interest on $15,000,000.00 I figured at 12% and I h~ve no way of really knowing how much it will be but 12% is probably conservative, would average $1,800,000.00 per year. What the engineering firm calls the transfer station, the annual cost of operation, which would be where our disposal area is now, would be $193,000.00 per year and the cost of transferring the municipal solid waste from our disposal area in Cutchogue to the recommended site which would be in the Town of Southampton, just behind the Howard Johnson's in the RCA property would be $220,000.00 per year. That makes a total for Southold Town of $3,013;000.00 per year and if you relate that to the Town's total budget for 1980, it's just a little over $5,000,000.00 per year, I feel that this will have quite a disasterous effect on Southold Town. I would like to find other alternatives. At present there are no funds available. The state is saying that there will be funds available, however, they are not in the legislative branch of the governmenz and I take that message of theirs with a little dose of salt. Also, when the funds do become available, since we're talking about 1980 dollars, the cost of the project will probably have gone up by 40% to 50% because of inflation, so I feel that the funds available from--the matching funds available from the state really won't affect the basis premise of how much~it will cost us to operate. Added to that we will have approximately $3,000,000.00 cost to update and change the Greenport facility to handle our sludge problem. And in addition to that we will have a probably cost of $3,000,000,00 for covering and capping and making impervious the present landfill area. That makes a total capital expenditure of some $21,000,000.00 facing the Town of v. outhold in the next three to four years, merely to do with municipal solid waste and the sludge problem. This amou~ of money, of course, is more than the Town has ever spent in any area and I think it is a very serious problem and earlier in the day I recommended to the Town Board that we do become much more involved and much more active in looking for alternatives. We ha~e had meetings with Sacco and Ahlers, an engineering firm here in Southold, I've had mettings with a group called Energy Development Corporation, who have both recommended to us that there are other alternatives instead of this Five Town Management Program. 1 think we should proceed very vigorously with those people. I also recommended that we start a dialogue with Mr. Middleten and the State DEC zo see if there are some other alternatives available that the DECi,.will · allow Southold Town to do and also have recomm.ended that the Town Board send the Highway Superintendent and myself to inspect the facility in Mt, Holly, New Jersey which is operated by the Energy Development Corporation and another facility in Salem, Virginia which is in operation that was recommended to us by Sacco and Ahlers, but I felt that we should have some sort of a report on what Holzmacher-McLendon has recommended to us and I feel :very strongly that the Town should spend a considerable effort in trying to prevent us from having to obligate ourselves for a total of $21,000,000.00 II. PUBLIC NOTICES - COUNCILMAN NICKLES: 1. We have a notice from the Department of E~vironmental C,_onservation from an application by Theodore Laoudis. This is to construct a 60 ft. timber jetty and 'preiill ~it~ 165 cu. yds. on the easterly side with clean fill of similar grain size to indigenous material. Project site in Great Peconic Bay, south side of Watersedge Way, Great Hog Neck, Town of Southold, Suffolk County, New York. If you are interested, the Town Clerk has a 4 DECEMBER 30 1980 copy of this application and you have until January 21st to make comments to the DEC. III. COMMUNICATIONS - SUPERVISOR PELL: 1. For a street ~i~t from Mr. Andrew Goodale. It will be turned over to-the Street Light Committee. 2. & 3. For Office o£ New York 5ta~e Mental Retardation and Development to place two homes in Southold Town. One would house eight people and one would hold seven. For our comments on the area we are going to ask the people to come out and talk to the Board on our meeting of January 13th. We had them out a year ago and the idea at that time was to place these homes where these people could be within walking distance to the community shops and recreation area. The two homes they suggest are far from walking distance. So that state has done 180 degree turn on their plans of what they had a year or so ago. So we are going to ask them to come out and explain to us why and give us some of the background information on them. That will reappear on the agenda on the 13th. 4. From Gary Olsen reference to a bond to be returned on a subdivision. It will be returned as long as all the necessary-- as soon as all the necessary paper work is done. 5. The Town Board was asked to make the Town Hall available one day a month for the Veterans,~ Burea~ to come out here and have a representative come out to Southold Tdwn Hall instead of making all our people go up to Riverhead. It will be the second Thursday of each month. Once this is set up we will-publicize it and let it be known. The Town Board did have the request today and did agree to it. 6. A resolution from the Babylon Village on how they wish the~county. sales tax t~o be redistributed so each township would get a littleshare of it. Greg Blass was here the last time the Town Board met and spoke to us about it and I'm sure the Town Board ~ill pass a' similar resolution, probably next month. We want to make sure we are passing the right one and we hope that Greg will be back with us some more facts about it, how much money we can get, how they are going to space it. We will go on record at that time as supporting it. 7. Another letter from,Cablevision. Councilman Nickles wrote a letter right after election night On the outage, why did it go out in Southold Town and we not have it and they replied to it and John you can take it from there. COUNCILMAN NICKLES: I think what the Supervisor is talking about is that at our last Town Board meeting we received a report and it indicated I think only 31 complaints on election day--day after election when we had over a twnetypfour hour outage on the Cable T.V. and we question that, why the number of calls was so few because between all the Town-Board members we had far in excess of 30 phone calls complaining about the Cable ~.V. This letter we have in response says that when they have a situation like that where a whole particular area is out they only count that as one call, even though a thousand people may be calling up because it's not an isolated indicent here or there, it's one outage. They just log it as a service call. 8. A letter from the Cutchogue Firemen regarding the flooding area on'd~~ Mr. Dean has been in contact, and myself, wi~h a gentleman up there. We are looking into acquiring a piece of land up there for the Town to put in a sump so we can eliminate--take care of the flooding area. 9. A resolution passed by the Mattituck Inlet Advisory~ Committee asking the Town Board to see if HUD funds could be available to purchase land up in Mattituck where the tank farms are. This letter was just sent to us and the Town Bo'ard will ~ look into and see if money can be used for that and how much and report back az a later date. 10. A letter from Long Island.Cableivision again reference a toll free number in Southold Town. In the franchise it says they should have a toll free number, 800 number. In order for them to get that they have to go outside the state to make it available in a state-wide area. They explained to us why they didn't have one. 11. Regards ~redging work on Fishers Island~ asking the Town that they have money and will go forward with the dredge but they have to find an upland area where to put the fill and so we will be working ~ith Fishers Island on that one. DECEMBER 30, 1980 12. A request from Mr. Watts for a s~,reet light up on Bay Avenue (Cutchogue). That will be turned over to the Street Light Committee. IV. HEARINGS & DECISIONS SUPERVISOR PELL: Hearings - we held two of them last Town Board meeting. At this time the Town Beard is ready to act on the first one. 1. Moved by Councilman Drum, seconded by Councilman Sullivan, WHEREAS, ,C~ol Galgano applied to the Southold Town Board for a permit under the'provisions of the Wetland Ordinance of the Town of Southold, application dated November 19, 1980, and WHEREAS, said application was referred to the Southold Town Trustees and the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Board with respect to said application onthe 16th day of December, 1980, at which time all interested persons were given an opportunity to be heard, ~OW, THEREFORE, BE IT RESOLVED that Carol Galgano, Oyster Bay, New York be granted permission under the provisions of the Wetland Ordinance of the Town of Southold for the construction of a catwalk, ramp and floating dock on her property located on a right-of-way off of the north side of Westphalia Road, on Mattituck Creek, Mattituck, New York. Vote of the Town Board: Ayes: Councilman Sullivan, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: The next hearing we held two weeks ago was on the applicati.on of Norman C. Boos. The Town Board did discuss this today. They ~eel they are'not ready to act on this one. They are going to seek additional information. The application was not claer in certain respects on how far the filling behind the bulkhead will go and-they have a couple of other things that they would like to find out before they rule on that. I will be in touch with Mr. Boos tomorrow and~ask him to clarify these points for the Town Board so the next time The Town Board meets on January 13th they can rule on it at that time. We have a hearing to be held in a few minutes at 3:30, 15 minutes away. We will move on to Resolutions. V. RESOLUTIONS 1. On. motion of Councilman Murdock, seconded by Councilman Sullivan, it was RESOLVED that Supervisor William R. Pell, III be and hereby is authorized and directed to execute an agreement between the Town of Southold and the North Fork B~n~ & Trust Compan~ for the lease of one Burroughs F 5706 accounting machine, serial no. F-182934 for a twelve month period commencing on January 1, 1981 and terminating on December 31, 1981 at a rental price of $620.00 Vote of the Town Board: Ayes: Councilman Sullivan, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pell. This resolution was declared duly adopted.- 2. On motion of Councilman Drum, seconded by Councilman Murdock, it was RESOLVED that the application of Zdzislaw Mikolajczyk dated November 7, 1980 for the renewal ~f a house' trailer' '~ermit at the south side private road off east side Main Road, Mattituck, New York, be and hereby is granted for a six month period. On motion of Councilman Sullivan, seconded by Councilman Drum, it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6~YCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Board, as lead agency for the action described below, has determined that the project will not have a significant effect on the environment. DECEMBER 30, 1980 DESCRIPTION OF ACTION Proposal by the Town of Southold for Feconstruction of bulkhead at Mill Road~ Mattituck, New York. DESCRIPTION OF ACTION Proposed B-1 Zoning of two parcels on the ~ain Road (Route 25) attltuck~ New York by '~he Town Board of the Town of Southotd. parcels on the south are presently located in the B-1 District on the Building Zone Map of the Town of Southold, and the parcels were formerly a part of the roadbed of the Main State Road (Route 25) and as a result of the relignment of said road, were abandoned as either a State of Town highway. The project was been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment are likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation, it is assumed that there is no objection nor comments by that agency. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment are likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. COUNCILMAN SULLIVAN: Question. I realize--I address this to the Town Clerk--it is a procedural matter but when we say it might not have any--doesn't have any adverse effect to the environment, I don't think we--based on--- TOWN CLERK TERRY: I think you det~rmoned in your discussion on Boos it was only a matter of outlining the area where the spoil was going to go and not a matter that he was going to encroach upon the wetlands. COUNCILMAN SULLIVAN: Since we haven't written, maybe we don't know that yet. TOWN CLERK TERRY: I have to ask for a legal opinion on that. I was told we follow this procedure that follows lead agency and DECEMBER 30, 1980 7 we take this action within 20 days and haven't heard anything from any other agency except, you are right, the Building Depart- ment. Bob? TOWN ATTORNEY TASKER: I don'.t get the nature of the question. COUNCILMAN SULLIVAN: On this it says an environmental assessment has been submitted and says there are no significant adverse effects To the environemvn are likely to occur should the project be implemented as planned. Based on maybe the further description of this there may be some adverse effecT. TOWN ATTORNEY TASKER: Then you would vote no on the resolution. COUNCILMAN SULLIVAN: But I don't know--could we hold this off until there is a more detailed description? COUNCILMAN MURDOCK: My interpretation of the difference of the two, this refers to permission requested to construction of a ramp, catwalk and floating dock at the right-of=way. The resolution or the problem that we had was with dredging and backfilling.-- Sorry, I have the wrong resolution. COUNCILMAN DRUM: I think it is applicable. TOWN CLERK TERRY: As I understand, the only question raised was the location of the spoil. SUPERVISOR PELL: I might suggest that we table this one until we have the other information and put it back on the 13th. Any objections to that? COUNCILMAN MURDOCK: I withdraw my motion. RECREATIONAL AREAS - Include all parks, playgrounds, athletic fields, boat launch- ing ramps, all areas between the ends of highways and tidal waiers areas, including approaches, driveways, parking areas, and buildings and structures located th.&reon owned, leased or operated by the Town of Southold. ~ SUPERINTENDENT - Shall mean the head of the D~partment of Public Works of the Town of Southold, who shall be in charge offal-1 lq~ecreaiio~-A~e~s. The terra shall include any trailer of any size, type or descripifon. §62-2 Recreational Area Property ~. No person in a Recreational area shall: A. A4~ark, deface, 'injure or damage any building, structure, property' or equipment in or on any recreation~ DECEMBER 30, 1980 Dig and/or remove S~rld 6r ~i~'~el or'other material from a recreational area; norcut, carve, remove or otherwise damage any tree or plant in such areas. C. Hunt, molest, disturb, injure or kill any animal or mammal in or on any recreational_Ia_rea. .... D. Bring in or dump, deposit or leave any bottles, broken glass, ashes, paper boxes, cans, dirt, rubbish, waste, garbage or refuse or other trash. No such refuse or trash shall be placed in any waters or left anywhere' on the recreational area grounds, but shall be placed in the proper receptacles where these are provided; where receptacles are not so provided, all such rubbish or waste shall be carried away from the recreational area by the person responsible for its presence and properly disposed of elsewhere. $62-3 Vehicles and traffic.. No person in a recreational area shall: A. Fail to comply with all applicable provisions of the state motor vehicle traffic laws, laws of the Town of Southold in regard to equipment and operation of vehicles. B. Fail to obey all traffic officers and recreational area employees, such persons being hereby authorized and instructed to direct traffic whenever and wherever needed in the recreational area and on the highways, streets or roads immediately adjacent thereto in ac~ordan'ce with the provisions of these regulations and such supplem&ntary regulations as may be issued subsequently by the Superintendent Fail to observe carefully all traffic signs indicating speed, direction, caution, st~pping or parking and all others posted for proper control and to safeguard life and property. D. Ride or drive a vehicle at a rate of speed exceeding ien (10) miles per hour, except upon such roads as the Superintendent may designate by posted signs for speedier travel. Drive any vehicle on any area excepl' the paved roads or parking areas or such other areas as may on occasion be specifically designated as 'temporary parking areas by the Superintendent. Fe .Park a vehicle in other than an established or designated parking area, and such use shall be in accordance with the posted instructions thereat and with the instructions of any ailendant who may.be present. G. Fail to immediately notify an attendant' of' an emergency in the nature of a breakdown requiring the assistance of a tow truck, mechanic or other person. H. Fail 'to use a'muffler adequate to deaden the sound of the engine in a motor vehicle. I. Repair, wash, wax or perform other maintenance on his or another- v-ehicl~._ J. The provisions of this ~Chapter shall not apply to the following motor vehicles: (i) Motor vehicles of the United States of America, the State of New York, the County of SuffoLk, the Town of Southold, and any agency, instrumentality or department thereof, when used on official business, or motor vehicles operated by officers or employees of such governmental agencies when used on official business. tO. . DECEMBER 30,.1980 §62-4 (2) Motor vehicles commandeered for use by police officers in the performance of their duiies. (3) Ambulances or motor vehicles used as ambulances. (4) Motor vehicles operated by a fire department or fire district in the performance of its duty. (5:) Motor vehicles used for launching and hauling boats, at public .boat launching sites. Bathing and s%vimming. NO person shall: A. Swim, bathe or wade :in any waters or waterways in or adjacent to any recrealional area except in such waters and at such places as are provided therefor and in compliance with suc.h, regulations as. are herein set forth or may be hereafter adopted. Nor shall any person frequent any waters or places customarily designated for the purpose of swimming or bathing, or congregate thereat, when such activity is prohibited by the Superintendent upon a finding thai such use 'of the water would be dangerous or otherwise inadvisable. Such designated bathing areas shall be kept free from any form of water equipment or other floating objects or any other form :of device that in the Superintendeut's judgment may . ~ cause inconvenienoe; injury or discomfort to'bathers, except if such equipment is intended for the protection of life. B. Frequent any waters or place~, designated for the purpose of swimming or bathing, or congregate, thereat, except between such hours of the day as shall be designated by the Superintendent for Such purposes for each-individual area. C, Erect, maintain, use or occupy on or in any beach or bathing area any tent, shelter or structure of any kind unless there shall be an unobstructed view into said tent, shelter or structure from at lease two (2) sides; nor shall any guy wire, rope or extension or exterior brace or support be connected or fastened from any such structure to any other structure, stake, rock or other object thereof, ' Dress or undress on any beach or in any vehicle, toilet room or bther place, except in such bathing houses or structures as may be provided for thai purpose. §62-5 Beach activities. No person shall: A. Bring into or operate any boat, raft or other watercraft, whether motor-powered or not, upon any waters at places designated for ~ bathing. B. Fish offshore from t_own~ope~ated_beaches except from such portions_ thereof a~ ~iT~a~' be staked off and posted therefor, nor shall any person at any time fish in any area while bathing is permitted, ~62-6 Hunting and firearms. No person shall hunt, trap or pursue wildlife at any time. Bio person s~all use, e~,~,~-er-~p~ firearms of any description or air rifles, spring guns, bow and arrows, slings or any other forrr~ of weapons DECEMBER 30, 1980 potentially harmful to wildlife and dangerous to human safety, or any instrument that can be loaded with and fire blank cartridges, or any kind of trapping device. Shooting into recreational areas from be~.ond their boundaries is forbidden. ~62-7 Use of picnic areas. No person shall: Picnic in a place other than those places designated for that purpose by the Superintendent. Recreation area representatives shall have the authority to regulate the activities in such areas when necessary ~o prevent congestion and to secure the maximum use for the comfort and convenience of all. Visitors shall comply with any directions given to achieve this end. All organized picnics and outings shall first obtain a special permit from the Superintendent. Violate the regulation that use of the individual fireplaces, together with tables and benches, follows · generally the rule of "first eom'e, first served, "except if it is au organized picnic and exhibits a permit duly issued by the Superintendent. C. Use any portion of the picnic areas or of any of the buildings or structures therein for the purpose of holding picnics to the exclusion of other persons, nor shall any person use such area and facilities-fOr an unreasonable time if the facilities are crowded. D. Ignite or maintain a fire on any beach or in any recreational area except in a proper, designated area and fireplaces. E. Leave a picnic area before a fire is completely extinguished and before all trash' in the nature of boxes, papers, cans, bottles, garbage and other, refuse is placed in the disposal receptacles where provided. If no such trash receptacles are available, then refuse and trash shall be carried away from the recreational area by ihe picnicker, to be properly disposed of elsewhere. 1t §62~S Games. No person shall take part in or abet the playing of any games involving thrown or otherwise propelled objects, such as balls, stones, arrows, javelins or model airplanes, except in areas set apart for such forms of recreation. The playing of active sports or games such as football, baseball and golf is prohibited except on theffields and courts or areas provided therefor. §62-9 Behavior and conduct. No perSon shall: - B. Be' present in any recreational area while under the influence of intoxicating liquor. ,Bririg i c~og or other-domestic animsL into recreational areas other than automobile parking con~i'ses and walks immediately adjacent thereto, Nothing herein shall be construed as .permitting the running of dogs at large. All dogs in those areas where such animals are permitted shall be restrained at all times on adequate leashes not greater ihan four (4) feet in length. C. Build or attempt to build a fire except in such areas and under such regulations as may be designated by the Superintendent. 12 · DECEMBER 30, 1980 Fail .to produce and exhibit any permit from the Superintendent which he claims to have, upon request of any authorized person who shall desire to inspect the same for the purpose of enforcing compliance with any law or rule. §62-10 Hours of use. E. Disturb or interfere unreasonably'with any person or party occupying any area or participating in an activiiy under the authority of a permit. F. Erect any structure, stand or platform, or hold any meetings, perform~ any ceremony, make a speech or address, exhibit any performance or form any parade or procession in any recreational area without first obtaining authorization. Recreational areas shall be open to the public at~uch periods and during such hours as shall be fixed byresotution of the town board. It shall be the duty of the Superintendent to post notices of the opening and closing hours in each recreational area. ..- § 62-1.t Rule s and regulations The Superintendent shall be authorized to otherwise set down rules Md regula- tions that he may deem proper to maintain the safety and welfare of those persons using town recreational areas as defined herein. ~62-12' Er~orcement; penalties for offenses. A. The Superintendent and recreational area personnel shall, in connection with their duties imposed by law, diligently enforce the provisions of this Chapter. B. The Superintendent, .any recreational area personnel or members of the Southold Town Police Department have the authority to enforce and/or eject from the recreational area any person violating the provisions of thais Chapter or any other provisions of law. C. In addition ~o any other penalty as p~ovided for by law, any person / or persons, association or corporation committing an offense against this Chapter or any section or provision ther eof is guilty ora violation punishable by a fine not exceeding two hundred fifty dollars ($250.) or impri~sonment for a period not exceeding fifteen (15) days for each such offense, or by both Such fine and imprisonment. D. The Superintendent and any recreational area personnel shall have the authority to seize and confiscate any property, thing or device in the recreational area or used in violation of this Chapter. SUPERVISOR PELL: I'd like to ad lib on that if I could a little bit. January of last year I had a gentleman come in my room by the name of Mr. Bill Mullen, retired senior citizen from Cutchogue. He said, "I'm in the insurance business all my life and I would like to review the town's policies." I said, "Be my guest. The public has a right to review." He reviewed it and took him from January until the end o£ March and he ga~e me a nice report at the end o£ March with certain recommendations on. I turned it voer to Councilman George Sullivan and his committee to review and work out with the present insurance firm. By them working with Mr. Mullen, with the insurance men, the committee representing the Town Board, last year for the same coverage we paid $102,000.00. We have saved $20,000.00 through a community effort. It started with a senior citizen, retired, went to the Town Board, went to the insurance firm and the benefit are the residents of Southold ToWn. To all concerned, Mr. M~llen, George, Larry was on the committee and the Town Board I think we have a lot to be thankful for for the type of individuals who are willing to dedicate their time and effort without being reimbursed for the benefit of the people of the Town. I personally would like to thank all concerned and all who were involved in it. COUNCILMAN MURDOCK: I would just like to add one other comment. That policy that we now have is a better policy than last year. It encompasses more coverage for the Town in the realm of public liability, than we had before. SUPERVISOR PELL: It is a better policy than we had and it took the work of many people to get it. Again, I say, thank you. 26. As Some of you.have come to~ -meetings you know we've had some hot times in this room especially that we withstood the fire pretty well and in recognition of George's contribution to the community and his help to his fellow Board members, I'd like to offer the following resolution: Moved by Councilman Nickles, seconded , expires December 31; 1980, and WHEREAs,.'Ge0rge R. Sullivan'haS given generously of his time and .ce to the Town of Southold residents as a- ~ since January'2, 1980, and WHEREAS, hisrecord ot diligence to the Town of So~ deserves the sincere of those with whom and for whom ~e worked, and be it RESOLVED that the Town of Southold hereby expresses their most sincere appreciation to George R. Sullivan for his unselfish and DECEMBER 30, 1980 17 RESOLVED that a copy of this resolution be presented to Mr. Sullivan and entered in the permanent records of this Town Board meeting. COUNCILMAN DRUM: I most heartily second it, George, and I want to personally thank you for your contribution to the Town government. We are .a more efficient body thanks to your fine fine ability. COUNCILMAN MURDOCK: I ~would like to thank you George 'it'.was ,a pleasure for the last year and yQur counsel and guidance has been very valuable to me alSo. COUNCILMAN NICKLES: I don't want to neglect one other person who is sitting out' in the audience, George's'wife Margaret and his 'two children Megan and Bobby. They also contribute because-they missed their daddy and their husband, in the course of the many hours he was down here~ So, again, Margaret, children, we appreciate what you have had to go through' this year. In addition, we want to present to you Councilman Sullivan, to make sure you a.re reminded--we've had his Councilm~n nameplate framed. COUNCILMAN SULLIVAN: Thank you, John and Bill, Larry, Hank, Bob, Judy. It's been certainly an interesting year and I've enjoyed my year on the Town Board. Certainly I was disappointed in the election results, I had hoped to had sat at least one more year. It was a tremendous learning experience to see how Town government works. I think we'Ve had a good Board this year. We worke~ together pretty well and I think we have become most representative of the people of the Town l I feel we've accomplished a lot and the Board has accomplished a lot. My successor is in the ~udience, Frank Murphy, I wish him luck inthe future. There's a lot' of work to do, there are a lot of challanges ahead for local government as well as national government. So I hope to attend Town Board meetings and offer my suggestions_and input where I feel it\is proper~ ~-So, again, thank you for.the presentation and it will hang in my house and it will be quite an honor to do it.
