HomeMy WebLinkAboutTB-11/06/1980SOUTHOLD TOWN BOARD November 6, 1980 WORK SESSION 9:00 AiM. - The Board audited the bills. 9:30 A.M. - Justices Rich and Tedeschi met with the Town Board to discuss moving the justice offices and court to the Town Hall on January 1st. Justice Rich does not feel it is a good move for the Town; there is not enough room for jury trials, conferences, and space for attorneys To confer with~:their clients. Justice Tedeschi faVor~ the consolidation for the justice court and justice offices at the Town Hall. He has spoken To justices in other towns, inquiring about their operation of their courts and cannot see a problem in Southold Town. Supervisor Pell stated that the Town will not dispose of the present court building until it has been determined that the use of the Town Hall meeting Room as a court room is workable. How- ever, the justice's offices will be moved to the Town Hall as of January 1st. 10:00 A.M. Supervisor Pell discussed the expenditure of the money under the $10,000. youth grant and $40,000. police grant. 10:45 A.M. - 11:15 A.M. - A recess was called by Councilman Murdock for a meeting with Councilmen Drum, Nickles and Sullivan. 11:15 A.M. - The Board began reviewing the agenda. 12:00 Noon - Recess for lunch. (The Board a~tended the ~eteran's Day Luncheon at the Nutrition Center.) 1:40 P.M. - The Board resumed reviewing the agenda. Supervisor Pell stated to the Board that he would like the Town Board to consider going out to competitive bid on insurance policies. He introduced Mr. William Mullen he said he had offered his services to the late Supervisor Martocchia to review the Town's insurance coverage. Mr. Multen is not charging a fee and would be happy To meet with the Town Board and Town Attorney Tasker to further review the insurance coverage. He has already spend over 150 hours on a survey of this nature. Supervisor Pell set 8:00 A.M., Tuesday, November 11, 1980 to meet with Councilman Murdock and Councilman Sullivan of the Taxation and Finance Committee, and 9:00 A.M. to meet with the full Board to further go into the insurance matter. 3:00 P.M. - The Board held a public hearing on the Preliminary 1981 budget, and 3:15 P.M. on the use of federal revenue sharing funds for 1981. 3:50 P.M. - Dick Wilton, Walter Krupski, Peter Kreh, John Case and John Bemryman of the Southold Town Promotion Committee met with the Town Board to request a donation from the Town Board toward updating their brochuref~or 1981. In their proposed budget they ask for a $10,000. contribution from the Town of Southold. No decision was made on this matter. Justice Doyen was present at the Work Session and Budget Hearings from 9:00 A.M. to 4:00 P.M. A regular meeting of the Mouthold Towm~Board was held on Thursday, November 6, 1980 at the Southold Town Hall, Main Road, Southold, New York. On motion of Councilman Murdock, seconded by Councilman Drum, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, November 18, 1980 at the Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes: Councilman Sullivan, Councilman M~rdock, Councilman Drum, Councilman Nickles, Supervisor Pell. This resolution was declared duly adopted. SUPERVISOR PELL: I did not omit the audit of the bills but we have got to transfer some money before we can audit the bills so that will come up later on in the evening. I. REPORTS - SUPERVISOR PELL: 1. ~e asked Councilman Drum to look into and evaluate the school crossing guards throughout out township and I don't believe he is ready to make a report at this time. COUNCILMAN DRUM: No, I have not received complete information yet. SUPERVISOR PELL: That will come probably the next meeting. 21 The minutes of the Mattituck Inlet Advisory Committee. Larry sits on this, Larry, do you want to say anything on that? COUNCILMAN MURDOCK: Well, we seem to be making pretty good progress. The committee is looking into some possible avenues of more immediate action in terms of some zoning recommendations. We are working toward that end as an immediate step and we are going to look to a more long range discussion as to the environmental part of the entire Mattituck Inlet system. 3. The monthly report from the Supervisor's Office, the budget report (month of October 1980). 4. The Highway Department monthly report (month of October, 1980. 5. Fishers Island Feery District monthly report (month of October 1980.) 6. Town Clerk!s monthly report (month of October 1980). 7. Larry, muself and George are working with the Village of Greenport on a contract for what is known as the East-West Fire District. We had some negotiations with them. We made them a semi- formal offer. The money that is to be raised will be placed upon the people who live in the area. We will wait until we hear back from them if they are going to accept it. Then if they accept if we will place it on the agenda for resolution form. 8. The Building Inspector's monthly report (month of October 1980). 9. You do not h~e, but it was delivered today by Justice Doyen from Fishers Island. He was over here at 9:~o o'clock today and stayed until about a quarter of five and he left To go back To Fishers Island. He did take part in the working session of the Board today. (Report of Justice Doyen for the months January-October 1980.) 10. Another report I would like to bring up is a meeting we had this morning with our tow justices, Judge Rich and Tedeschi. We discussed in detail the movement of the judge's offices into the Town Hall and the movement of the justice court from Cutchogue into this room right here. We went in detail. We are not recommending ---we are not at this time recommending disposal of the justice court in Cutchogue. We want to ge~ the justice court in here to be sure it ms going to work. We are bringing it down here on a trial basis to make sure there is enough room and sure it can accomodate the court system in this building amd make sure we are making a step in the right direction. il. Another report I made to the Board today, I am working on affirmative action plan All the towns in suffolk met with the county department head of Civil Service and discussed affirmative action plan. Many towns have them. Southold does not. I will distribute to the Board tomorrow a rough,draft of one and they will review it, pick it apart and we will go from there. Later on we will h~ve one for the Board to adopt, but we are just beginning to work on one for Southold Town. That ends the reports,~that I have today. Did I leave anything out? II. PUBLIC NOTICES - COUNCILMAN NICKLES: 1. The first public notice is from the Department of Environmental Conservation, Notice of Complete Application of Zahra Benz to construct a catwalk, ramp and float at Mattituck Inlet. The response time on that is November 19th. 2. Also from the DEC, Notice of Complete App~idation by Ali Agarabi to construct a catwalk, ramp and float at Mattituck Inlet. Also response date to DEC is November 19th. 3. Department of the Army, Corps of Engineers, application by Agarabi to construct a catwalk, ramp and float. Comments to the Corp of Engineers on this by November 20th. 4. Zahra Benz, also the Corps of Engineers, comments by November 20th. 5. bEC, Complete Application by Joseph and Joan Gold to construct a catwalk, ramp and float in Cutchogue. Comments by November 19th 6. DEC, Complete Application and SEQR Negative Declaration on the application of the Town of Southold Solid Waste Facility Operation. comments by November 19th. 7. Department of the Army, Corps of Engineers, application by Norman Boos to construct floating piers and floats at Cutchogue. Comments by December 1st. Copies of all these notices are with the Town Clerk if you wish to look at them they will be available. III.COMMUNICATIONS - SUPERVISOR PELL: 1. From the Mattituck Garden Shop reference zoning enforcement and the lack thereof. We did turn it over to the ~.nilding Department and ask them to check it out. They are working on the violation and they will pursue the complaint and stay on top of it, keep the Boated informed of what they are doing. 2. From Union Carbide reference Temik, charcoal filters, re- charging. Basic bottom line is they suggest we call Design Engineers to find out what can be done and the way of a safe d~isposal of the spent carbon charcoal. Bottom line is they are telling us it is going to be up to the people to dispose of it and they tell u~ who to contact, this engineering firm, but basically they don't tell us much else. We had a letter from the DEC on this and they basically sai~ you cannot put it in the landfill, it's a hazardous waste. We have a problem. Every town on the east end has it. We were assured by public health that they are working on it. DEC is working on it. Everybody is working on it at this time but no answers yet and your Town Board will keep on top of it, trying to push them. 3. Reference the dredging of Corey Creek. We have four letters here on it in regards to it and I belieYe one gentleman in the front row would like to speak on it. JERRY MOYLE: My name is Moyls. I represent not only Laughing--I am a member of Laughing Waters Property Owners Association, but in add:itiOn I represent the other three let~e~s-.a;b~.c& d. Those four letters covertthe circumference--I should say the populated circumference of Corey Creek and basically they all read about the same. It is urgent and they all tell you so and this last storm didn't do it much good. Now, I have been after Supervisor Pell a long time on this situation, ever since Laughing Water was very briefly dropped off the--not only the essential list but the complete list. ~o as a result of my continual talks I received a very encouraging phone call from Counc~l- man Drum and I would like to know from Councilman Drum, are you in a position at this time to confirm it, what you said to me, or if not, how long must we wait.? COUNCILMAN DRUM: The overall dredging of our various inlets, the project the county had scheduled the dredging earlier in the year. At presen~ I do not believe there will be any more derdging this year, calendar year. Now, a person by the name of Mr. Guildi who is the head al all the dredging in the county has promised us that he would have a meeting with us prior to the end of the year, in fact I had hoped it would be in the month of November, and with our NOVEMBER 6, 1980 415' committee, the ~QuthQld Town Committee, of which Mr. Murdeck and~ Mr. Nickles are on the Inland Waterways Committee, and at that particular time he had said we would establish a dredging project list for next year and he also said he hoped that we would start earlier than we did last year. If you may recall, we didn't get started until the later part of May or June., actually and I felt we didn't get our fair share of the dredging this part year. Although they did give us dredging of the creeks that were just about closed. Now, I would have to saythat-prob~bly.-al!~Of.the creeks ~ed dredging, or almost all of them need dredging. But it w~s necessary for us to have a priority list and they said we would only get so many project.s and the projects that we included in this past year were those that were almost closed. Now, again, we haven't had our meeting as yet, we h~e:~not conducted our inspection of all of the creeks and inlets and I would hope that Corey Creek would be higher up on the priority or be on the priority list at least. I can't promise anything because we do not know how much funds we are going to get allocated to Southold Town, although I will say I found that they h~ve been very cooperative the latter part of this summer and this fall, they ha~e been very cooperative. We were able to get some of the creeks that were closed opened and the dredging is still under way and ~most completed for this year; MR. MOYLE: The meeting you are speaking of, sometime in November, is that something I can attend or not? COUNCILMAN DRUM: Well, what we will do is we can arrange, I will give you a call, and when we come by and look at your--at Corey Creek--at Corey Creek inlet, at that particular time we can contact and tell you specifically whaz time we will be there. MR. MOYLE: Well, Councilman, I will say to you that my boat will be in the ~ater at least until Thanksgiving Day so you are welcome to the use of my boat. COUNCILMAN DRUM: ~ appreciate that, thank you. SUPERVISOR PELL: 4. From Islip Township reference to a local bottle bill law which they hope the county will enact and they are asking the other nine towns to study it and perhhaps support it. At this time we just received it in the miil. We will study it and perhaps we will put it on the agenda for the next Board meeting to make a comment on or go back to them with our thoughts on it. 5. A letter requesting funds by the Southold Town Promotional Committee. They did come in and talk to the Board today. We did not really reach any agreement with them. In the Town Budget there is $2,100.00 for publicity. They feel it should be a lot more and we discussed the pros and cons today but at this time it remains the same. 6. A Mailgram telling us that the preliminary population coun~ in the Town of Southold is 19,140 people. I have a little problem accepting this because I met with John Behan about two weeks ago or three weeks ago and he had figures that he was informed it was 19,800 people. So far we have three different numbers and nobody can seem to agree on one. It is important because these figures are what your per capita aid, state aid is based on for the next ten years. Each person represents approximately $200 a year in aid and if you lose enough of it over ten years you lost a lot o£ money, and I'm a little thrifty. 7. A letter from Mr. Land, Southampton Township, saying that he does not agree with the census count'~ 8. A letter congratulating us on one of our police officers, Burke, for a fine job he done in regards to an accident where a car overturned and a man and wife was in it but didn't get hurt and what a fine 3. ob he did. It is nic police. I think I'm going to ad Department. I talked ~o the , ago they apprehended ~wo youn: Marion. Which was very nice. apprehended the people who tr in Orient. They apprehended to hear about the good work of the ib a little bit right now. Police ~hief a~ suppertime. Last three days men who broke into two homes in East You read the papers today. They ~d to rob the Orienv Ferry boat terminal oday some people who used a boat, Ou~ board to go on Robins Island, break into the house that is there, take the television out and some other stuff out. The county police had the lead, the ~own police got the lead and .gave it to them. They chased it up ~o Westchester, New York, got the boat, outboard, got 416: OVEMBER the people who came in today and turned themselves in with their attorney; We have a rash of burglaries going on in our township. Every township has them. I think we have made eight or nine arrests within the last ten weeks. We do expect to make some more. But the Chief called me today during the Board term, called me at home and told me of the incident about getting the boat back, the out- board and getting the stuff that was stolen out of the house, and the other one in East Marion and there was one more he told me about. But the police are working hard. The Suffolk Times paid them a very nice tribute today in the editorial part of it, congratulating the police force and they earn it and they are doing a good job. 9. Another letter from Dr. Zaki, County Public Health, on carbon and it says carbon will not be permitted in the landfill. But it also says it is a problem on getting rid of them and as they progress and find a solutionthey will keep us informed but right now they have no solution. In January it is estimated that some of our area residents will have to have their filters recharged, in January. So we have about sixty more days to find a solution out of this. 10. Another request for Wickhams Creek to be dredged. Again this comes under Councilman Drum's Committee, which he chairs. HaNk, do you want to comment on it? COUNCILMAN DRUM: I just want to say that it will be considered wit'h the others, funds permitting. SUPERVISOR PELL: 11. Reference to the sidewalks in'downtown Southold. Some are~ cracked an- people would like them to be repaired. I did have a conversation with these people (Bertrice Small of the Fat Cat) and told them we would talk to Mr. Dean about it and look az them but t'here is a lot of sidewalks in Southold Town and everybody would like theirs repaired all at once. I do have to say, as the person informed me at the tiem, the ones in £ront of the Southold Town Hall are repaired. We just got them repaired a couple of weeks ago, they were very bad and cracked and took all the years since the Town Hall has been here to get them repaired. We had to wait for our turn like everybody else. But they are repaired in front of here and we will, Mr. Dean will look at the ones down there. 12. A request for street lights on Rocky Point Road (East Marion). We have put money aside for street lights in the federal revenue sharing budget for this year. We have several requests and we will' have in the near future a request made up of the appropriate street, lights and poles and pass it all in one resolution when we buy the lights. We have the money now to do it. 13. From the Southold Senior Citizens Club saying their group is so large, when they meet up at the new center that they are runn~ing out of tables and chairs~ The Town Board will--has money put aside and we will work on this. 14. From the First Universalist Church of Southold in regards to the North Fork Community Theatre building in Mattituck which was put back on the tax rolls. 15. Is a request from the Inter-Agency Council, requesting that the Village of Greenport--the Village of Greenport be included in the $40,000.00 delinquency grant. We are going to sit down with our Ch;ief of police and with the Villge Officials and see if we can work some~ thing out where they could be included in it. The Board feels it is part of Southold Town and they should be. 16. A letter that was sent to the press, we got a copy of it. It's in reference to nuclear power plants. The ones in Connecticut, across Long Island Sound, telling us about their danger. (Letter from North Fork Opponents of Nuclear Exposure). 17. Another one for Councilman Drum, his Inland Waterways Committee. It's the fall of the year and everybody is requesting to be number one on the priority list for next spring. Hank, you are going to have quite a decision to make. How this works out, Mr. Guildi will come out, meet here at Town Hall, physically get in the car with Hank and the Committee and go around and visit every site so they will have a firsthand site of what goes on, then come back and sit down and evaluate the list they will present to the ToWn Board. Hearings weh~ill have in a minutes on the budget and The federal revenue sharing. This resolution was declared duly adopted. V. RESOLUTIONS SUPERVISOR PELL: Number one, resolution number one, a request from the Seniors Club 6f Southold-Peconic for two bus trips. MR. HENRY LYTLE: Mr. Supervisor, May I address you in this matter? Our committee chairman wrote the letter requesting $300.00 for Bethpage and the trip has been oversubscribed many times and we would like to amend that so it will read to use up whatever the balance is in our fund, which I think is about $450.00 ~e' wish to take $300.00 and the other $150.00 so it will wipe out the 1980 budget. I don't h~e the exac~ figures with me but Judy can g~t it from the records, abotu $~50.00, instead of being $300.00 SUPERVISOR PELL: In the budgev resolution which we have prepared we added on to ii, "within your budget". We will approve funds up until- up ~o the amount you have allocated to your group. Other than that, lika the other groups, you have ~o pick up the balance yourself. MR. LYTLE: That's right, that's absolutely right. SUPERVISOR PELL: The resolution will read as prepared--~ithin budget, and then it will be your responsibility to pick up the balance. TOWN CLERK TERRY: Will you be having more than one bus, Mr. Lytle? Fo~ the Milleridge and the Christmas, or just the Milleridge? MY LYTLE: Just the Milleridge. 1.On motion of Councilman Murdock, seconded by Councilman Drum, it was RESOLVED that the Seniors Club df Southold-Peconic, Inc. be and hereby are granted permission to hire one bus at a cost of $350.00 to take their group to New York on December 3, 1980 ~o view the Christmas decoarations and attend the theatre, and two buses to take their group to Old Bethpage and Milleridge Inn for lunch on November 20, 1980, using the balance ~n their .Town account and supplementing the remainder of the cost from their own funds. This resolution was declared duly adopted. 2.On motion of Councilman Sullivan, seconded by Councilman Nickles, it was RESOLVED that the Town Board of the Town of Southol~ grants permission to the Southodl P.T.A. to use Hobart Road and Boisseau Avenue as assembly areas for their "Happy Holiday" Parade on November ~2, 1980 at 10:~30 A.M., provided they secure the necessary insurance to hold the Town of Southold harmless. Vote of the Town Board: Ayes: Councilman Sullivan, Councilman Murdock, Councilman Nickles, Councilman Drum, Supervisor Pall. This resolution was declared duly adopted. 3.On motion of Councilman Nickles, seconded by Councilman Murdock, it was RESOLVED that the Town Board of the Town of SoUthold authoirzes pay- roll deductions for employees of the Town of Southold who wish to join the Suffolk Federal Credit Union. SUPERINTENDENT ~' Shall mean the head of the Department of Public Works of the Town of Southold, who shall be in charge, of all Recreational Areas. VEHIC] may 'be mounted on wheels and is or may be pro- pelled either by. its own power or by another power driven vehicle to which i~ may be type or description. ~ - '. §6~r2 'Recreational Area Property. No person in a Recreationa,1 area shall: ~ A. l~Iark, de£aee, injure or damage any building,' structure, property or equipment in or on any recreational area. B. Dig and/or remove sand or gra-vel or other material from a recreational area; nor cut, carve, remove or otherwise~darr~age - any tree or plant in such areas. C: Hunt, molest,- disturb, injnre or. kilt any animal or mammal' in or on any recreational area. . D. Bring~n or_ump,~ deposi~ or lea~e' any bottles, broken glass, ashes, paper boxes, cans, dirt; rubbish, waste, garbage or . _ refuse or other trash. No such re~use or trash shall be placed - in any waters or left anywhere on the recreational area grounds, but shall be placed in the prop}r receptacles where these are provided; where receptacles- are not so provided, all such rubbish or waste shall be carried away from the recreational area by -- .i: lhe person responsible' for its presence and properly d~sposed of ' ' elsewhere. NO person in a recreational area'shall: A. Fail ~o comply with all applicable provisions of the state motor vehicle traffic laws, laws of the Town of Southold in regard to equipment and operation Of vehicles. Bathing and swimming. No person shall: A. SwimJ' bathe or w.~de 'in any waters or water,rays in or adjacent to any recreational area except in such waters and at such places as are provided therefor, and in' compliance with such regulations as are herein set forth or may be hereafter adopted. Nor shall any person frequent any waters or places customarily designated for the purpose of swimming or bathing, or congregate thereat, when such activity is prohibited by the Superintendent upon a finding that such use of the water would be dangerous or otherwise inadvisable. Such designated bathing areas shall be kept free from any form of water equipment or other floating objects or any other form of device that in the Superintendent's judgment may cause inconvenience, injury or discomfort to bathers, except if such equipment is intended for the protection of life. Ce Frequent any waters or places designated for the purpose of swimming or bathing, or congregate thereat, except between such hours of lhe day as shall be designated by the Superintendent for such purposes for each individual area. COUNCILMAN MURDOCK: We have begun an ongoing 201 study with the Village of Greenport and Town o£ Shelter Island and Town of Southold to try to solve the peoblem of wh~t to do with our honey wagons and the sludge therefrom and we had hire H2M Corporation to make the study and make the report vo the Town and the Village and meanwhile the Federal EPA passed a new set of laws saying that we had to have a further study and further hearings to allow more public participation. We have had three--~wo or three meetings with the EPA and H2M negotiating the amount of-steps that they wanted in their public participation program. We have crystalized it down from their original request of $24,000. worth of studies to $9~,~000. some odd hundred worth of studies and we think we are down as low with ~hem as we can go. 20. I think that he should be complimented for the effort he put in on ~his and getting this program for public hearing cut down fromo $24,000.00 to $9,800.00 of which the Town's share is going to be one third of $1,228.00 and the balance is paid for by state and federal funding. As you know, ~the Town has a franchise agreement with the Long Island Cablevision Corporation and Tuesday night they kind of let us down again and we on the Town Board, Mr. Pell and the Councilmen get a lot of phone calls when Cablevision doesn't work out properly. Needless to say Tuesday night was election returns for the Presidential race and many other races and people were looking forward to it and of course they were disappointed when Cable- vision went off sometime after 5 o'clock and didn't come back until the next morning. After getting a lot of complaints yesterday ~ wrote the following letter to Richard Tuthill, General Manager, Long Island Cablevision TV Corporation, Route 28 and Osprey Avenue, Riverhead, New York. "Dear Mr. Tuthill: I am stunned by the Long Island CATV's cavalier treatment of the CATV subscribers of Southold Town. A Presidential Election is a historic event. Your CATV service failed shortly after 5 P.M. and was not restored until today. Last night's loss of CATV service compounded by your inability to restore the service within a reasonable length of time was the "final straw". It now has become clear that we have become a captive audience without any alternative. I am certain that if you did not have a monopoly in Southold Town - Long Island CATV would have noticed a distinct drop in the number of subscribers. I don't know what can be done to terminate the franchise agreement or whether we ha~e a choice of renewing theis agreement when it expires - but I do know I am going to find a way. I will suggest to the public that they call the TOLL FREE number 800-342-3350 of the New York State Commission on Catv for consumer complaints where their complaints will have more impact than calling your oSfice." I think all of us are tired of having subscribers call their oSSice when they have a problem and get treated in an offhand manner or in a rude fashion and I am going to ask as we spoke about earlier today that the Supervisor invite the Manager down here for the next Town Board m-eting. Earlier this year we instituted a monthly report for them where they send us in a kind of score card on the kind of complaints they had and how they~were handled. That still hasn't, I think, resolved, the porbtem, but we are trying and we'll give them hell when they come down. SUPERVISOR PELL: Yesterday I tried myself aster I had got in Town Hall yesterday mroning and the phone started ringing and we put in I don't know how many calls and tried to get through. We never could get through ~o them. Ray Dean was here today and said his wife tried for over Two hours just sitting there pushing the buttons on the telephone. After Two hours and something she finally got through on complaining about service. The letter is already Typed and will go out the first thing in the morning inviting him down toe.our meeting on the 18th. Any other Board members have anything? COUNCILMAN DRUM: Good letter, John. SUPERVISOR PELL: As I said before, the Town Board is planning to move the Judges in here and the Councilmen's office will be set up and we have to get furniture, desks, chairs, telephone in and what not and I'm going to.~ask and appoint Councilman Murodck to work with me to · get the equipment set up and se everybody will feel at home when they come in. The floor is yours, does anybody wish to address the Board? MR. LYTLE: Mr. ~,upervisor, on Item II of resolutions, aren't Wiedersum Associates the original architects of this building? SUPERVISOR PELL: They are the original architects of the west half. When they d~signed this building and put it up they have correspondence on the sprinkler system that was put in with the Town people at that tiem and the sprinkler system does not meet the fire insurance under- writers specs to give us a lower rate. MY LYTLE: I understand the reason but I am just wondering whether they weren't partly responsible for the conditions? SUPERVISOR PELL: They brought this up to the attention oS the Town Board at the time. MR. LYTLE: The east end was not up to standards? SUPERVISOR PELL: This side is not half bad. This side is going to be fairly inexpensive. We have enough sprinkler heads around here. MY LYTLE: This is going to help your insurance premiums? SUPERVISOR PELL: $5,000.00 a year. NOVEMBER 6, 1980 MR. LYTLE: I am just wondering if they are the proper ones to go back to. Are they doing it on a reasonable basis? SUPERVISOR PELL: They are doing it on a precentage fee. Their percent charge as any other architect percent charge would be of about ten percent. COUNCILMAN NICKLES: I wasn't here then but my understanding is that the Town got what they paid for, not that Wiede~sum Associates planned the sprinkler system improperly. ',Those,people who were here before me can agree or disagree with thav but I thought during our discussions relative to updating the sprinkler system it was not an error or ommission or any o£ that type of thing. If any of you~have ever built a house you know somewhere along the line you have to de6~de whether you wanv the B cabinets or the A cabinets and you have X amount of dollars to do the job and I presume this is why fire protection was provided but it wasn't the type that would give us the most benefit insurance -wise and at that time I guess the Board had to evaluate what kind of building you were going to have and what kind of money you were going to have to build it with. SUPERVISOR PELL: Exactly, John is absolutely right. I was ~rying to say it a little bit nicer. Anybody else wish to address the Board? If not, gentlemen, the motion is in order. On motion of Councilman Drum, seconded by Councilman NIckles, it was RESOLVED that there being no further business to come before this Town Board meeting adjounrment be called at 8:55 P.M.
