The existing deck,which is set back 80 feet from the tidal wetland boundary associated with Jockey Creek,pre-dates 2001 and was thus constructed prior to the adoption of Chapter 275 and the required 100-ft wetlands setback for structures. The proposed addition will extend only laterally toward the west property line,thus maintaining the same 80-ft wetlands setback,with no additional ' encroachment toward Jockey Creek.Due to its location landward of the 10-foot elevation contour,the proposed work is situated outside the tidal wetlands permitting jurisdiction of the New York State Dept.of Environmental Conservation; and with a wetlands setback greater than 75 feet and an area less than 25 percent of the existing dwellling structure,the deck addition meets the definition of a"minor action"that is exempt from LWRP waterfront consistency review.Also eligible for administrative permit review pursuant to Section 275-5(B)(2)(1),the deck addition will have no adverse impacts on the quality or function of the adjacent tidal wetlands or surface waters of Jockey Creek.
