26O SOUTHOLD TOWN BOARD July 7, 1981 9:30 A,M. - C~uncil, men-?- Nickles, Murdock and Murphy, and Highway Superintendent Dean attended Pre-Draft Environmental Impact Statement scoping meeting with the New York State D~part- ment of Environmental Conservation at Stony' Brook, New York relative to identifying and making preliminary evaluations of the significant environmental impact issues that would be associa- ted with the proposed resource recovery plant in Southold 'Town. WORK SESSION 1:30 P.M. of June. The Board audfted the outstanding bi'lls for the month EXECUTIVE SESSION 2:25 P.M. Lietenant Daniel Winters and the Town Board discussed certain actions of Radio Operator Claude Kumjian. WORK SESSION 3:40 P.M. - Mr. Paul Fink of Pan Tech Management met with the Town Board to discuss the problems he has been having in securing, bidders for the construction of handicap 'facilities at the 'l'ibrar'ies. Mr. Peter Hanlon and Mr. Arthur Til'l~an, members of the Mattituck Library Board were also present. After unsuccessfully advertising for bids Mr. Fink has contacted several contractors directly asking for bids. He received two bids and both-were tremendously higher than the engineering estimate. He feels, after further discussion with one of the bidders, that the construction work, not including should come to about S22,000[00. He asked the Board's permission to break the contract into two phases - one contractor for the construction and one for the paving and was directed by th6 Board to pursue that avenue. The Board suggested names of paving ~ontractors M~. Fink might contact. The major problem in getting-bids locally has been the requirement, when using federal funds, of paying union scale wages, as well as the voluminous paper work involved. Mr. Hanlon questioned fact the grant was.for $50,000 and only $38,000 remains as a balance, with only $33,000 available for the proposed construction. Mr. Fink explained that certain funds were used for the engineering study, preparation of bid documents, administration of the fuffds, and a certain portion for costs to apply for future funding.---Mr. Fink asked for permission, and received same from both the Town Board and Mr. Hanlon and Mr. Tillman to make two changes, as recommended by the engineer, to reduce costs: (1) substitute anodized aluminum railing for the proposed wrought iron railing; and (2) eliminate the front handicapped facility entrance and just have a rear handicapped facility entrance. One entrance is sufficient and does not violate federal regulations for accessibility for the handicapped. If every- thing goes well with the contractors, work should begin in the very near future. Mr. Fink advised the Board that a timetable must be started immediately for correction of the heating system at the Senior/Youth Center. (He will discuss the rehabilitation project at Eighth and Ninth Street, Greenport and the Mattituck Inlet projecz at another time.) Approval of the HUD funds should be received in August, but in order to complete the correction work at the Center before the winter months, the Board should consider hiring an engineering firm for the project. If the project is rushed, it will take about four months from beginning to end. $50,000~:~DO has been allocated for.design and construction. Deputy Supervisor Murphy will request Supervisor Pell to correspond with H2M to determine what their engineering fee would be for the project. 4:10 P.M. On motion of Councilman Nickles, seconded by Councilman Drum, it was RESOLVED that the following audited bills be and hereby are ordered paid: General Fund Whole Town bills in the amount of $56,676.40; General Fund Part Town bills in the amount of $14,258.79; Highway Department bills in the amount of $39,088.58; Fishers Island Ferry District bills in the amount of $38,095.78; Federal Revenue Sharing bills in the amount of $51,417.57; and Delinquency Diversion and Prevention Project bills in the amount of ~$134.44. COUNCILMAN )IURPHY: I'd like to set the date of the next Tbwn Board meeting to July 22nd. This is a day later than normal because of Grievance Day on 7/21. It will be at 3:00 P.M'. in the Town Hall. On motion of Councilman Drum, seconded by Councilman ~urdock, it was RESOLVED that the next re'gular meeting of the Southold Town Board will be held at 3:00 P.M., July 22, 1981 at the Southold Town Hall, Ma~n Road, Southold, New York. COUNCILMAN MURDOCK: This morning the Town Board attending what is called a Scoping Session at the office of the New York De~armment of Environmental Control at Stony Brook. We were there with the people from Energy Development Corporation, the North Fork Environmental Council and a few other people to go over some of the problems pertaining to possible permitting to burn municipal solid waste at the Disposal Area and generate electricity. It was a meeting to get input from groups other than the Town Board and other than the builder, to give information zo NYDEC so that they would know what to put, or the questicns to be asked to be put into an Environmental 262 JULY 7, 1981 Impact Statement which should be prepared and then they will have public hearings detailing the program to burn municipal solid waste. Of course, we in the Town have a lot of questions about whether we'll be allowed to landfill the ash. As you know, the state has mandated we must close our l~ndfills. So far they have not given us permission to landfill ash but they have recommended that we build a facility in the Town of Southampton and we still can't understand why it's nice to bury ash in Southampton and illegal to bury it in Southold but we're hopeful that we can pursue our objectives which at the firsz blush tha~ we see so fat will save us 90% of the projected costs of participating in the Five Town Program and hopefully in six or seven weeks we'll have a little more information. Thaz was today with the entire Town Board. Thank you, Frank. COUNCILMAN MURPHY: Thank you. Henry? COUNCILMAN DRUM: I have no comment. COUNCILMAN MURPHY: John, do you have anything? COUNCILMAN NICKLES: Nothing really except I'd like to. report.' that the telephones that we had arranged for the three ~e~ches - New Suffolk, To~v~ Beach and McCabes Beach were installed in time for the 4th of July weekend. COUNCILMAN MURPHY: Thank you, John, you did a great job. COUNCILMAN NICKLES: Lieutenant Winters deserves the praise, but I'll accepz it. COUNCILMAN MURPHY: We met--to report on a.c'~am s'eedfng conference or meeting we had with the Town 'of 'E~s~ ~ampton--we met with the Bay Constable, one of the Councilmen and a man by the name of Paul Flagg who's a graduate student at Stony Brook and was runnfng the program for the Town of East Hampton with almost the exact same amount that we're using here to seed our creeks with the oversized clams, uncertified clams for spawning purposes. Paul Stou~-emburgh and Tom Cielatka, Ray Dean and myself went out there and it really was fantastic and the potential here for Southold really looks great. They're growing the seed clams from--probably four of them would be about the size of your small fingernail and in the one sea~on they are growing them zo the size where they're over the size of your thumbnail. A tremendous growth. What they're doing--the survival raze on these clams, ordinary seeding, the spawning of clams, you lose 99 and 99 and 99 hundredths of all the small seed to the natural predators, crabs, fish, anything that's do~wn in the bottom of the creek. This way you get about 99% survival and you get tremendous growth. One of their problems in running the program was thaz the scallop spawns attach themselves to these beds and grow so fast that they can'z even get oum. That every two weeks someone has to come in and clean these beds out. It seems fantastic that you get this amount o£ growth on it. In the fall you take and you~ed the various creeks and in about two years you have a really marketable clam with a tremendous survival rate and according to their figures is over 90%. I think it has a great potential here. ~I--§poke to the Supervisor and he asked me to appoint a committee of interested members of the Town Board and interested people in the community. Tom Cielatka the Bay Constable, Ray Dean will also be very happy and very interested to serve on this. Very low budgeted item but a tremendous potential for really helping revive an industry that really is almost dead here. We also met on Monday with a group of people--two people from the Sea Grant Institute which really works out of Stony Brook and they're doing research on the growing of seaweed. What they were down here for Was just to tell the different towns. They were coming to each town to tell us the progress of their research. It is quite a ways away, but one of the possibilities that they're talking about is establishing these farms out in the-- they're aot even sure where--in the ocean, in the sound, the bays, wherever they feel this would grow the best and harvest this and produce a methane gas. They claim that fairly soon, if everything works out right, it will be down to comparable price with LILCO and they could feed it right in and be a very good clean industry here and it would be another industry that has a potential of growth here using our natural resources what we have here. We're JULY 7, 1981 263 kwo-three years away; two years from now, nok this next summer, but the summer after, they are setting an experimental farm up somewhere probably in Smithtown Bay to do this and then ko set up a pilot plant. So they were coming down just to keep the Town Board informed but this is another potential for our area without hurting anything; not taking any of our natural resources away. Bill asked me to comment on Pan Tech Corporation who was here today and they finally feel they have a contractor for a project that is out for renovating two libraries in the Town. They fipally feel they have a contractor they hope they could work with and get this started. It's a long time coming and hopefully within a couple weeks--the Town Board today agreed to let park of the contract ouk and ko make it easier for this contractor to do the work and I'm sure we can come in within the amount that we have. That's about it. II. PUBLIC NOTICES - COUNCILMAN MURPHY: 1. Department of Transportation, United States Coast Guard concerning the reconstruction of the New Suffolk Avenue bridge over Do~ms Creek in the Town of Southold. This also is posted on the Town Clerk's Bulletin Board. 2. New York State Deparkment of Environmental Conservation, Notice of Complete Application, Suffolk County DPW to remove and reconstruct two bridges on New Suffolk Avenue over Mud and Downs Creeks. III. COMMUNICATIONS - COUNCILMAN ML~PHY: t. Request for Laurel Lake (Scuba Diving Training Courses by 7 Z's Hampton Divers, Inc.). 2. From John Behan on Coastal zone managemenk. 3. From Pan Tech Management--this is the HUD funds that we are going to contact a consulting firm to start to draw up plans for this so that the firsk project we are going to work on is the renovation of the heat ak the Senior Citizen'S'and Y~nth Center. which cosk the Town a fortune last year in the electric heat. Hopefully we can save quite a bit of money. 4. From the Kenney's Beach Civic Association. A committee will be sek up to meet with these people. 5. Letter from the Southold Town Promotional Committee thank- you note (for financial support from the Town). 6. Suffolk County resolution. This is_only still in the talking stage. Fifty cents per capita allotment. This is what they're talking of the Town's share of the sales tax. 7. A request from Carol A. Bolger concerning the use of the Rec Center for a group of women interested in exercise classes. I believe Carol is here. Would you like to say anything on it? The Town Board did gr~nt Mr. Petl the permission to allow you to use this,working the dates with what we have scheduled already. MRS. CAROL A. BOLGER: That's very nice and we thank you. It's not mine, it's the group that I have requested. I wrote the letter, but we thank you very much. How will I find out what day or how will we find out what evening? COUNCILMAN MURPHY: Bill Pell will be in contact with you when he checks with Ray Dean who keeps the schedule of the building to see whak days are available and what days would be most preferable. 8. Letter from the Chamber of Commerce in Mattituck concerning the sidewalks. This has been turned over to Ray Dean. 9. Letker from West Creek Estates Property Owners Association concerning dredging of West and Goose Creeks in Southold. This will be turned over ko the Trustees to investigate and make their recommenda- tions. ~ 10. A letter from Greg Bla~s concerning detergents. It's mostly concerned with the Riverhead Sewer Districk area. 11. Suffolk County Traffic Safety Board, a letter concerning the changing of the hours bars would stay open. The Town Board did go on record in favoring this once we check with the Police Chief or Lieutenant ~inters to find out if he would recommend it. If he does we would be in complete agreement with it and fully support it and Bill Pell will send a letter. 12. There was a letter from our County Executive Peter Cohalan who was very pleased to learn the Southold Town Board's unanimous action to help save Robins Island. He is very proud of us and pleased. 264 JULY 7, 1981 13. The Town's participation in Long Island Tourism and Con- vention Commission. The three chambers of commerce in Mattituck, Southold and Cutchogue will be conzacZed to find out their interesz. 14. A letter concerning a proposed gift of some land in Southo!d (Wortis & Potz) which the Supervisor will look into and discuss with the people. I-V. HEARINGS AND DECISIONS COUNCILMAN MURPHY: This is a decision On the wetlands application of Marino Faraguna, a public hearing that was held on June 23rd in Southold Town Hall. Moved by Councilman Murphy, seconded by Councilman Ni~kles, WHEREAS, Marino Faraguna applied to the Southold Town Board for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 19, 1981, and ~%THEREAS, said application was referred to the Souzhold Town Truszees and the Southold Town Conservation Advisory Council for their find- ings and recommendations, and ;~EREAS, a public hearing was held by the Town Board with respect to said application on the 23rd day of June, 1981, at which time all interested persons were given an opportunity to be heard now, therefore, be it ' ~ RESOLI~D that Marino Faraguna be granted permission under the provisions of the Wetland Ordinance of the Town of Southold for the construction of a2 aluminum alloy bulkhead at his property on the wesz side of Skunk Lane, on Mud Creek,~Cutchogue, New York. COUNCILMAN MURPHY: Number vwo is pending decision on property owned by Kim Brownie. Public'Hearing was held on June 23rd. Moved by Councilman Nickles, seconded by Councilman Drum, WHEREAS, the Building Inspector has heretofor made a formal inspection of the premises owned by Klm BroWnie located on the wesz side of Wells Road at Peconic, pursuant to Chapter 90 of the Southold Town Code, and WHEREAS, the Building Inspector determined that the structure located on the aforesaid premises is dangerous 'or UnSafe tG t'he public and thereafter serve~ notice upon the owner of said premises, and WHEREAS, this Board held a hearing pursuant to Chapter 90 of the Code on the 23rd day of June, 1981 at which hearing the Building Inspeczor appeared and presented oral and documentamy evidence ~s to the unsafe and dangerous condition of the structure located on the aforesaid premises, and no one having appeared at such hearing on behalf of the owner, NOW, THEREFORE, IT IS DETERMINED AS FOLLOWS: 1. That the struczure located on the west side of Wells Road a~ Peconic, sho~m on the Suffolk County Tax Map as District 1000, Section 86, Block 1, Lot 10.002, consisting of an open building foundation, unenclosed, is unsafe and dangerous to the pubic. 2. That the owner has neglected and refused to either secure or remove said structure within the time specified by the Building Inspector. 3. This resolution was declared duly adopted. JULY 7, 1981 265 COUNCILMAN MURPHY: Number three ~'~' ~hdf~g decision on property owned by H. Sacks and Sons, Produce Inc. This was another hearing that was held au the same Time and we are going to hold off the decision on this. Mr. Sacks has offered th'~s property to 'the Mattituck Park District as a future park or parking area for the Town. The park district accepted this and we do have a deed that was drawn up and it was sent over to the Sacks~ business office in Quogue for them to sign it and we should have it signed and it's a very good way. This was where ~he old potato house burned down in Mattituck. It is a very nice gift of his and the. park district and I'm sure all of Southotd Town appreciates it. Number four is a public hearing on July 7th. Moved by Councilman Nickles, seconded by Councilman Drum, WHEREAS, a proposed Local Law No. 4 - 1981 was introduced at a meeting of this Board held on the 23rd day of June, 1981, and ~ WHEREAS, a public hearing was held thereon by the Board on the 7th day of July, 1981, at which time all interested persons were given an opportunity to be heard thereon, NOW, THEREFORE, BE IT RESOLVED that Local Law No. 4 - 1981 be enacted as follows: LOCAL LAW NO. 4 ~ 1'981 A Local Law to amend Chapter 92 of the Codes of the Town of Southold in relation to traffic regulations. BE IT ENACTED by the Town Board of the Town of Southold as follows: Article IV of Chapter 92 of the Code of the Town of Southcld is hereby amended as follows: I. By amending Section 92-41 thereof by adding thereto the following: Name of Street Side Terry Lane South Lo'~at'ion At Southold from extension south- .erly of the east curb line of Hobart Road, easterly for a distance of 127 feet. Terry Lane North Hobart Road East At Southold from the easterly curb line of Hobart Road, east- erly for a distance of 142 feet~ At Southold from the northerly curb line of Terry Lane, northerly for a distance of 98 feet. II. By amending Section 92-42 thereof by adding thereto the following: Between the Name of Street Side Hours of Location Terry Lane North 10:00 p.m. & In Southold from the west 7:00 a.m. curb line of Hobart Road westerly to ~own Creek. III. By adding a new Section therezo, to be Section 92-43A, to read as follows: ~92-43A - Public Parking Lots. The parking of vehicles in the Public Parking Lot located in Southold on the south side of Route 25 approximately 170 feet easz of Wells Avenue is hereby prohibited for a longer period than two (2) hours. IV. This Local Law shall take effect immediately. COUNCILMAN MURDOCK: I think,John, that no where in the resolution does it mention that Terry Lane location and Hobarz Road location .... COUNCILMAN NICKLES: I'll explain that, Larry. By Section 92-41 it is a parking ordinance section and on Terry Lane, on the south side of---from the extension southerly of the;east curb line of ~ Hobart Road, easterly for a distance of 127 feet, that will be a No Parking From Here To Corner. Terry Lane on the north side at the easterly curb line of Hobart Road for a distance of 142 feet, that will be No Parking From Here to Corner. At Hobart Road on the east side which is 98 feet from the curb line of Terry Lane, that will be No Parking From Here To Corner. The other one on Terry Lane which is from the wes~ curb line of Hobart Road westerly to Town Creek is Parking Prohibited from 10:00 p.m. to 7:00 a.m. It doesn't specifically say this in here but it relates to the Code when you read the Code. 266 JULY 7, 1981 COUNCILMAN MURDOCK: I just wanted the public to understand it was for No Parking Zone. COD~CiLMAN MURPHY: This-is to help control the traffic down at the Southold Town Park and hopefully we can solve some of their problems with this and make the access in there, make it a lot safer and hopefully a lot quieter for the people down there. Vote of the Town Board: Ayes: Councilman Murphy, Murdock, Councilman Nickles, Councilman.Drum. This resolution was declared duly adopted. Councilman V. RESOLUTIONS COUNCILMAN MURPHY: We will move on To resolutions. Number one we are going to hold, we would like to discuss this with the Super- in~endents Of the two contracting districts. This is an Attendance Officer Law under the old common school districts, New Suffolk and Laurel and we would like to see i~ could take the money by having the contracting district, their Attendance Officer, take over this duty rather than have the Town, which there has never been a ca!l, buz under this law we have to have it. So if we could use the Attendance Officer on a per diem basis fine. We are going to hold this. The Supervisor is going to contact the two superintendents of Southold and Mattituck. 2. On motion af Councilman Murdock, seconded by Councilman Drum, it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Reivew and 6NYCRR Part 617, Section 617.10 and ChapTer 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Board, as lead agency for the action described below, has determined that the project, ~i~h is unlisted, will not have a significant effect on the ehvir~'~. Description of Action: Application of Fred Meiin for perm~s~i'~ to install an aluminum bulkhead, extend existing float and i~a!t~'~f~ur pilings az his property on Mud Creek at Skunk Lane, Cutch~e, The project has been determined not to have a signif~ca~n.t ~.ffect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department 'of Environmental Conservation, it is assumed that t~ere is no objection nor comments by that agency. On motion of Councilman Drum, seconded by Councilman Murphy, it was RESOLVED that'.the Town Board of the Town of Southold accepts the resignation of Robert E. Wall as Commissioner of the Fishers Island Garbage and Refuse District. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum. This resolution was declared duly adopted. 4. On motion of Councilman Murdock, seconded by Councilman Drum, it was RESOLVED that the Town Board of the Town of Southold approves the appointment of Albert D. Dawson as Commissioner-Treasurer of the Fishers Island Garbage and Refuse District effective immediately. On motion of Councilman Drum, seconded by Councilman Murdock, it was RESOLVED that the application of Zdzislaw ~ikolajczyk dated May 4, 1981, for permission to maintain a single family trailer on the south side of Private Road (John's Road) off the east si'de of Main Road, Mattituck, New York, be and hereby is renewed for a six (6) month period. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nicktes, Councilman Drum. This resolution was declared duly adopted. JULY 7, 1981 ~ 267 10. On motion of Councilman Nicktes, seconded by Councilman Murdock, it was RESOLVED that the Town Board of the Town of Southold reauest the Suffolk County Department of Transportation to erect "NO PARKING" signs at the n,orvhwest corner of County Route 48 and Horton's Lane, Southold, New York where a new business has opened and customers are parking at the curving corner curb, thus obstructing vision at the intersection. COUNCILMAN NICKLES: County Route 48, by the way, is formerly County Route 27. Vote of the Town Board: Ayes: Councilman Murphy, Councilman Murdock, Councilman Nickles, Councilman Drum. BE IT ENACTED by the Town Board of the Town of Southol~,, Suffolk County, New York,as follows: Section 1. The term of office of the town clerk shall be four years. Section 2. This local law shall supersede section twenty-four of the town law, insofar as it is inconsistent with such section. Section 3. A proposition for the approval of this local law shall be submitted to the electors of the to~m of Southold at the general election to be held in November, nineteen hundred eighty- one, and this local law shall become operative only if approved by the affirmative voze of a majority of the qualified e~eetors voting upon such proposition. Section 4. If this local law is approved by the affirmative vote of a majority of the qualified electors of the town voting thereon at said general election, this local law shall become and be effective immediately. COUNCILMAN MURPHY: I'm going to vote yes. I would like to make a comment on it just for the record. Very quick in hearing about this and the only reason I really woul~ say yes, I do feel that the Town Clerk's term should be four years~ but I do think that you should have had a little more time to study and maybe add one or two other people. Maybe you'd wan~ to add the Superintendent of Highways or even the Supervisor into this to the same purpose. I do realize we are going to have a public hearing, we are going to have more information and the people can come in and give us their input and also then we are all going to have our final say on election day. The reason I am voting yes now is because time is very critical and should be done and we really don't have the time to study this and have the public hearing by going to our next Board meeting. The only thing else is we had a letter in communications from Assemblyman Behan on the coastal zone management and Deputy Supervisor indicated to us today that they are trying to get.: together a meeting with Marry Lang tomorrow concerning the coastal zone management legislation in Albany which is revised and is now called Waterfront Revitalization and Coastal Resources which is another ac~, Article 34, relative to coastal erosion hazard areas. I guess the five east end towns are concerned about this matter, but I spoke to Senator LaValle yesterday and he said both pieces of legislation, if I understood him correctly, have been passed by both houses.
