Box 1179 Southold, New York 11971 Fax (631) 765-6145 Telephone (631) 765-1800 OFFICE OF THE TOWN CLERK TOWN OF SOUTHOLD THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD HELD ON SEPTEMBER 12, 2000: WHEREAS the Town Board of the Town of Southold is considering a change in the zoning designation from B General Business Zoning District Designation to the RO Residential Office Zoning District Designation of a certain parcel of land lying in the Town of Southold identified by SCTM # 1000-055.00-05.00-004.000; and WHEREAS, GEIS which said "no further SEQRA review required" when "Changing the Zoning Category of a parcel from one industrial zone to another industrial zone, or from one conunercial zone to another commercial zone, of from an industrial zone to a commercial zone shall not require further SEQRA review iff a) b) c) d) the proposed new zoning category for the subject parcel is consistent with the zoning of surrounding parcels, or the proposed change of zone does not permit higher intensity use of the subject parcel as compared to the existing zone in terms of lot coverage, building height, parking requirements, traffic, impervious area, drainage, and setbacks, or the proposed change zone does not take place in a designated historical area, a critical environmental area, areas of low depth to groundwater, or contain or are adjacent to freshwater wetlands or tidal wetlands, or the proposed change of zone is consistent with the County Road 48 Corridor Land Use Study and past land use plans of the Town of Southold and this proposed action meets this criteria/threshold"; and WHEREAS, the Town Board nevertheless conducted a LEAF pursuant to SEQRA in addition to the GEIS findings statement; and RESOLVED the Town Board found that for the above action there is no other involved agency, that for the above action the Town Board is Lead Agency; that this action is an Unlisted Action; all pursuant to SEQRA Rules and Regulations 6 NYCRR 617.1 et. Seq. and Chapter 44 of the Southold Town Code; and be it RESOLVED by the Town Board that this proposed project will not have any significant adverse environmental impacts and therefore the Town Board issues a NEGATIVE DECLARATION pursuant to the SEQRA rules and regulations. Our conclusions are the same as contained in the Board's letter to you of October 8, 2000, (attached). Several changes were given careful review as to reasons and fairness for the recommended change. However, recognizing that the underlining premise of this study is to preserve the bypass capability of the CR 48 divided highway and to prevent retail sprawl, the Board has no option but to support the overall recommendations which we feel will accomplish this objective. Collectively we offer the following observations. The underlying premise of this Study is to preserve the bypass capability of the CR 48 divided highway. Doing so will prevent the commercial retail sprawl that characterizes every Long Island town to our west. More specifically, the overall purpose is to avoid repeating the mistakes made elsewhere on western Long Island, where unchecked commercial retail development not only resulted in serious traffic congestion problems, but played a role in the demise of tile economic vitality of downtown districts located on State Route 25. This community's Vision, as stated in many documents and public meetings some going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to preserve the small-town qualities that distinguish Southold. In order to achieve this goal, it is critically important to consolidate future retail business growth around the existing business centers within each hamlet. Furthermore, reducing the potential for retail and other traffic-generating uses to be introduced (or expanded) will have other long-term benefits to the community. First, it will ensure a bypass road for through traffic, thereby relieving some congestion on SR 25. Second, it will boost the economic development potential of the existing and potential business properties bordering SR 25, where most of'the Town's traditional hamlets are centered. Third, it will preserve a scenic corridor that is a source of pleasure to residents and tourists. Therefore, we support the overall study recommendations as proposed. Collectively we offer the following observations. The underlying premise of this Study is to preserve the bypass capability of the CR 48 divided highway. Doing so will prevent the commercial retail sprawl that characterizes every Long Island town to our west. More specifically, the overall purpose is to avoid repeating the mistakes made elsewhere on western Long Island, where unchecked commercial retail development not only resulted in serious traffic congestion problems, but played a role in the demise of the economic vitality of downtown districts located on State Route 25. This community's Vision, as stated in many documents and public meetings some going back to the mid-1980s (prior to the adoption of the 1989 Zoning Map), is to preserve the small-town qualities that distinguish Southold. In order to achieve this goal, it is critically important to consolidate future retail business growth around the existing business centers within each hamlet. Furthermore, reducing the potential for retail and other traffic-generating uses to be introduced (or expanded) will have other long-term benefits to the community. First, it will ensure a bypass road for through traffic, thereby relieving some congestion on SR 25. Second, it will boost the economic development potential of the existing and potential business properties bordering SR 25, where most of the Town's traditional hamlets are centered. Third, it will preserve a scenic corridor that is a source of pleasure to residents and tourists. Therefore, we support the overall study recommendations as proposed. In recommending their adoption, we recognize there may be reservations about specific October 8, lggg proposed rezonings and that alternate rezoning proposals may be under consideration. The reason for the purchase was two told. While my husband uses this property mainly for storage, Mr. Guarriello actually runs his business from his office there. INTRODUCTION On September g, 19911, the Toxatn Board of the Town of Southold filed a moratorium on the issuance of spprovals and permits for business-zoned propm'ties within the County Rome ~8 corridor. The moratorium was intended to allow for thc study of thc corridor and to make amoadmonts with regard to thc "level and nature of business uses that are appropriate along Route 48, such that these uses compliment ~xisting hamlet economic c~nters and that business uses appropriate outside hamlet centers are provided ample location in which to be situated". The County Route 4g Corridor Land Use Study was subsequently conducted and submitted to the Town Board on April 13, 1999. The study corridor is situated entirely within the Town of Southold and includes portions of Sound Avenue, County Route 48 and State Route 25. The corridor begins on Sound Avenue at the western Southold Town line and continues along Sound Avenue to its junction with County Route 48 in Mattituck haml~ The study corridor then follows County Route 48 until its junction with State Route 25 in thc hamlet of Greenport. The corridor then terminates at the intersection of Manhass~t Avenue and County Route 4g/State Route 25. All parcels located within 1,000 feet of the above portions of these roadways are included in the study, with the exception of those parcels that are within the jurisdiction of the Village of Oreenport. A Positive Declaration, Notice of Public Hearing and Draft Generic Environmental Impact Statement on th~ Land Use Study were adopted by the Town Board of the Town of Southold on April 20, 1999. A Public Hearing on the Draft Cleneric Environmental Impact Statement was held on May 6, 1999 and public comments were accepted until May 20, 1999. A Final Genetic Environmental Impact Statement (FOEIS) was adopted by the Town Board on July 20, 1999. COUNTY ROUTE 48 CORRIDOR LAND USE STUDY The County Route 48 Corridor Land Use Study provides recommendations to the Town Board regarding appropriate land use and zoning within the corridor. These recommendations arc the final step in a four-step planning and study process that was intended to provide a methodical and comprehensive look at land uae and zomng in the comdor. The first step in the Study was to identify the characteristics of the corridor and surrounding areas that thc Town and its citizens believe are important and valuable. These characteristics were garnered from past Town land use plans and studies as well as from the intent of Town actions, partieular{y previous land usc decisions, re-zonings and code changes. Subsequent to the identification of desirable characteristics of the corridor, an analysis of existing conditions along the corridor conducted and included existing zoning, land use, non-conforming lots, soils and habitats, economy, historical areas and traffic conditions. Thc third step in the process outlined the outstanding needs o£tbe corridor baaed on a comparison of the desirable characteristics of the Town to the existing conditions of thc corridor, in other words, the outstanding needs are an enumeration of the work that still needs to be done to make the desired characteristics of thc Town a reality. The final step in the process provided recommendations relative to satisfying the outstanding needs. The recommendations provided in the Study include potential future zoning code changes, changes in permitted land uses within specific zoning di.~riets, potential zoning changes, and the adoption of visual resource best management practices. Once the Land Use Study is adopted, Town would, at its discretion, implement all or part of its recommendations. The Town of Southold finds the following with regard to the County Route 48 Corridor Land Use Study: Previoaa Land Use Plato and Town Actions It was not the intent of the County Route 48 Land Use Study to develop new goals and aU'utegi~ for the Town of Southold to follow, but rather to synopsize what the Town has already determined to be its goals and desires. This determination of goals has been clearly stated in numerous land use pinna and studies, and can be inferred from the intent of past Town re-zonings and code changes. The Land Use Study took these goals and categorized them into four major themes. All four of the themes, derived flora a shared vision of residents and officials, are geared toward providing the Town with a strong economic base and ahigh quality of life. Preanrvatlon of Farmland and Agrlcultmz Farmland is a valuable and dyn~,nie industry in the Town of Southold. The open farmlands are not only highly cherished for their ~conomie value, but for the scenic vistas they provide. The open space and scenery created by farmland additionally contributes to lhe quality of life of the residents, while promoting tourism and recreation. 2. Preservation of Open and ~tional Spare The Town of Somtsold mli~ h~vily upon its ~cenic beauty and open landscapes for ru~rretion, ckan air and wat~, as well as for its atlrsction to tourists and r~or~ation- seekers. Thc Town has attracted many second homeowners because o£its "natural resources, abundance of open space, farms, picturesque villages, and thc cvcr-present waterfront" (Master Plan Update, 1985). Due to this open space, the Town has a tremendous development potential. Bleak pictures have been painted in a few documents, warning of strip-type development, suburban sprawl and water supply issues. The preservation of open and recreational space is not only aesthetic, but also a necessity for the present and future needs of the Town. Preservation of Che Rural, Cultural, Commercial nnd IBstorienl Character of the Hnmlc~ and Surrounding Areas The Town of Southold is renowned for its rural, cultural, commercial and historic character. This unique character is recognized in all of the documents reviewed. Based on tho input ot'Town residents, the Final Report and Recommendations states that the two most prevalent and kW issues rte keepin$ growth in the existing hamlet centers and preserving and enhancing the sun'ounding rural n~a~. Additionally, ~¢ Master Plan update racommands the provision for "a community ot' residential hamlets that are comprised of a ~ariety or'housing opportunities, commercial, service and cultural activities, set in an open or rural atmosphere and supported by a diversified economic base (including agriculture, marine commercial and ~easonaJ recreation aetivities)." Preaervnfion of the Nntnr"l Environment Accommodating'~ow~ and change within the Town without destroying its traditional economic base, the natural environment on which that base rests, and the unique character trod the way of life that defines thc Town" is of utmost importance" (Ground Watershed Protection and Water Supply Management Strategy). The Master Plan Update recommends preservation of the Town's natural environment from wetlands to woodlands and to ,'achieve a land use pat~rn that is sensitive to the limited indigenous water supply and will not degrade thc subsurface water quality. Outstanding Needs The oumnnding nexis enumerated below are thc culmination of careful comparison of the inte~ and goals of the town (ns _~-t,'d in past land use plans and studies) and the exL~ting ~onditions alonl~ the County Route 48 corridor. Therefore, the needs are not new, but reth~ reflect the past and present vision of thc Town nod ~ work that still needs to be done, Due to the proximity of County Route 48 to the hamlet centers and to avoid potentially conflicting developmcnt sU-ategics for the two areas, the outstanding needs ate intended to be valid throughout the Town. Thc outstanding needs for thc Town of Southold are found to be: · Provide for viable land use development at intensities gnsitive to subsurf&¢e water quality and quantity, ~ . q · Maintain and ,:.-engthen hamlet centers as the focus of commercial, residential, and cultu~ activity. , Preserve the open, agricultural and rural character of areas outside of the hamlet c~nters. · Provkle for a vatie~ of housing opportunities for citizens of diffe~nt incomes and age levels. · Enhance the opportunities for pedestrian-fi'iendly shopping. · Continue to support the Town's agricultural economy. · Maximize the Town's natural assets, including its coastal location and agricultural base, by balancing commercial, residential and recreational uses. Strengthen the Town's marine-recreational and marine-eommercial activities. · Encourage the preservation of parkland and public access to the walcrfront. · Support tourism by maint~nin8 and sb-engthening the Town's assets that aUract tourists, namely hamlet center businesses, historic heritage, building architecture, ,a sense of place, rural and open character, agriculture, and marine activities. · Preserve prime farmland in the Town and continue to support the diversification of ~,riculmm. · Preserve thc historic, cultural, architectural and archaeological resources of thc Town. · Ensure the efficient and safe movement of people and goods within thc Town. · Preserve visual quality of hamlet centers. · Encourage appropriatc land uses both inside and out of hamlct centers. · Promote balanced economy and tax base. · Preserve the integrity of thc Town's vcgctativc habitats, including freshwater wetlands and woodlands. Recommendations and Opportunities In an effort to satisf7 the outstanding ncccts of the Town of Southold az they apply to the County Route 48 corridor, land usc recommendations were developed. These recommendations arc found to meet ~he outstanding needs to the best extent practicable and are consistent with thc major themes garnered form previous land use documcms and Town actions, while providing the Town flexibility in ~eir actual implementation. However, it should be noted that thc list of recommendations is not exhaustive and that a variety of techniques and mechanisms may be utilized by the Town to achieve desired results. Furt~,uore, it is r~cogni:,~:l that some of the recommendations would need further environmental and planning analysis as well an oppommity for public input prior to impl~on. Each xecommendation below is written in ~o/d lta//e~ and is identified by a bullet. Explanations or further discussions arc provided at~r e~ch recommendation and is written in regular font. The Town of Southold finds that the following recommendations are appropriate for consideration for land use in thc County Route 48 corridor: · Re-tone~ to more apl~eOl~tiete uses. Several oppommities exist to re-zone properties to allow for mor~ appropriate urea: Such re-zonings may include changes from commercial to residential ot A-C zoning categories aa w~[l from residential or A-C to commercial. In ~omc cases, the re-zoning ofpezeela to less intensive uses will help to limit the interllzption of sc~q~ic view8 and VISts. S from the roadway, and will help to m~int~n the agricultural eharactea' ofmue, h of the corridor. 4 Re-zonings are intended m balance thc residential, cowaneroial, environmental and recreational needs of the Town. Existing enclaves of commercial use may be cntumc~d by additional appropriate commercial parcels. Similarly, existing agricultural or residential areas may be enhanced by the re- zoning of nearby variant commercially-zoned patois. By concentrating future conunercial uses in areas of existing commercial activity (pmicularly hamlet centers) results in a more viable and order~ land use pattern and helps to prevent the dilution of consumer activity in the Town. The hamlet centers currently act as the commercial centers of the Town and provide a sense of place. In contrast, areas outside of the hamlet centers generally pottruy a more open and agricultural character, with small areas of commercial activity. The contrasting characteristics of these areas are highly prized by the residents of the Town. Southold is one of the only towns on Long Island wbere hamlet centers still exist for the most part. The re-zoning of certain parcels within the conidor to more appropriate uses will have the effect of enhancing the basic characteristics of the hamlet centers and areas along the corridor. The statement on page 50 of the Land Use Study stating that "a reduction in the potential intensity of land use in this m~a is anticipated m have a beneficial impact in trams of water usage and potential groundwater impact" is rescinded. It is noted that agricultural use may, under cemin scenarios, result in groundwater u~agc and/or contamination above that associated with eommen:ial uses. However, as slated on pasas 4-8 through 4-10 of the Final GEIS, thc l~-nd in agriculture in the Town of Southold is toward crops that require drastically lesser amounts of inigation, fertilizer and pesticide, such as vineyards. · Promote incentive toning as a meansto pre~erve agricultural and other dexlvable l~arc~, and ~ mt!~ati~n for ehaa~e of ~e where appropriate. It is recommended thatapplicants seeking to increase density or change of use allowed by special exception/special permit in an appropriate zoning district would be requil~l to provide development credits firom other more sensitive parcels (clustering). The parcels from which these credits were taken would effectively bccomc stc 'nlizcd, with the cxccption of continued agricultural usage. This progrmn is anticipated to preserve a variety of vegetative habilat ar~as, provide for parkland and open areas, maintain ~-icultoral activity, and limit development within prim~ groundwater recharge areas. As discussed on pages 4-10 through 4-12 of the Final GEIS, the payment of muney to the Town in rerum for incentive ~onlng is not contemplated by the Land Use Study. Further detailed SEQR review will be necessary to identify potential adverse environmental imp~ffprior to thc decision to implmnenl thie recommendation. Require greater setbacks from the roadway for larger agricultural and A formula may b~ developed relating building size to setback distance, with larger buildings be located farther from the roadway. This recommendation is not 5 intended to preuludc the construction of agricultural-related s~xuctures or otherwise limit agricultural activin, but rather to preserve the open agricul~x~-al view~ and vistaz from County Route 48 and Sound Avenue. · Orient buildings to limit the interruption of scenic vistas and views. This recommendation is to be used at the time of site plan review. Consideration should be given to the orientation, size and height of the building with respect to its visual impact from perspectives along County Route 48 and Sound Avenue. This ~commendation is not in~nded to preclude the cons~uction of buildings, but rather to examine viable alternative building locations that meet the needs of the proper~y owner while limiting the interruption of open scenic views. Continue enforcement of the Town Code with respect to the type of products l~ermitted to be sold at.Farm stands. This rccommcndation is intended to help maintain thc agricultural character of the corridor by limiting the products sold at farm stands to only those that arc permitted under the Code. Such limitations have the effect of limiting the dilution of consumer activity in the Town, sL,~ngthen commercial establishments in hamlet areas, maintain the character of the area and maintain the safe and efficiem flow of traffic. It is r~.ognized that thc Town has revisited the section of thc Code dealing with farm stands several times. Due to the continually changing trends in agriculture and the sale of agriculturally r~lated products, the Town Code must be periodically updated to provide for viable enterprises while main~taining the desired character of the Town. · Continue enforcement of the Town Code with respect to the conversion of agricultural buildMgs to atl~er commercial uses. The Town Code contains restrictions on the conversion of agricultural buildings to other commercial uses. It is recommended that the current provisions of the Cod~ continue to be enforced to preserve the character of the agricultural and open areas a.s well as limit the potential for the dilution of consumer activity in the Town. · Cluster residential development away from the roadway. To maintain the open character of most of the corridor, it is recommended that future residential development be clustered away from the roadway. Use of thc clustering techaique allows for retention of natorally vegetated or agricultural lands. Maintaining a distance between the development and the roadway decreases ~ apparem mass of the project and maintains at least a portion of~e open vistas. A recommendation to amend the Town Code with respect to non- contiguous clustering (clustering of development using development fights tnmsfCtTed from non-contiguous parcels) would require deu61ed SEQR review p~ior to implementation. Require vegetated buffers between residential development and the roadway. This recommendation may be utilized in conjunction with the clustering recommendation above. It is suggested that, where possible, agricultural uses be maintained along the roadways for genie vistas and views and then a natural and/or landscape buffer be provided to screen the new home~. Agricultural uses along the roadway would maintain the open views and vistas. A landscape buffer is especially important for screening of distant homes when they are built on farm fields. This recommendation may be implemented on a site by site basis on properties where the size and configuration can support such a layout. · Develop and implement the use ofvlsual resource best managementpractlces. A sugges~d lig of visual resource best manas~,nent practices is provided in Appendix B located at the end of the County Route 48 Land Use Study. These practices were developed subsequent to the identification of four guiding principles of the desirable visual character in the Town of Southold. The best management practices are intended to be utilized at the time of site plan review or a~ otbetwiae deemed appropriate by the Town. Much of the intent of the practices is to m~in!ain or enhance the open character of thc County Ronte 48 corridor. Amend the Town Code with resgect to the Residence OJ~Nce (RO) Distrlca The visual and historical character of the hamlet centers are based, in part, ou the existing residential homes. Historically, many of the homes in thc Town were co--ted along the major roadways. As development and population in the Town has increased, many of these older homes are no longer as desirable for continued residential use due to tra~c and surrounding land uses. Changes of use f~om purely residential to commercial or other uae may likely include the removal of structures that wer~ once a major part ofth~ ehataewx of the hamlet. Strengthening of the RO district through amendment~ to the Coda would help to preserve the a~hit~mral chaxaeter of the hamlets. Recommend~ mdc amendm~ta with respoet to lhe RO di~a'iet include r~quifing the adaptive re-u~e of existing reaidvatcea where appropriate; ~ the number of allowable uses germittad in the RO district, pertieuiarly tl~se that generate little traffic; increase the number of uses permitted in the district by special exception; and amend sit~ plan requirements with re,peet to buffs, garking and building design. Amend tke Town Codt with respect to the Limited Business (LB) D~stric& The Town Code is r~commended to be amended to allow additional ~-of- fight uses in the LB zoning district. The site plan requirements associated with LB zoned properties should be amended to pwvida for better buff~4n~ and screening of uses. Additionally, the archit~-~u~ of a proposed structure in this district should be in confonnanco with surrounding area and resemble residential structures as much as possible. The Town Code should be amended with re~pect to non-conforming uses. In certain areas, parcels can be found where the existing use does not con_form with the existing zoning. In cases where the use became non-conforming due to a zone change, provisions can be made to allow for limited expansion of that use or permit a change of use to a less intensive non-conforming use. Applicants requesting expansion or change of use could make site improvements as mitigation for the request. These site improvements are anticipated to improve the visual cham~r of thc area as well as improve traffic flow and other undesirable effects of the non-conforming use. As stated on pages 4-13 and 4-14 of the Final GEIS, this recommendation allows for non-conforming businesses to change, grow and remain viable by permitting expansion and change beyond that which is commonly permitted. The recommendation is not limited to parcels located within the County Route 48 corridor, but instead is intended to be applied to parcels throughout thc Town. · Re-zone appropriateparcels adjacent to Mattituck Creek to MI and/or MII zoning category. The 1985 Master Plan Update (RPPW), as well as other past Town of Southold plans and studies, recommends the athancement of water-related recreational and commercial activities. Opportunities exist in the vicinity of Mattituck Creek to enhance marine recreational and marine business usage. Re- zoning of certain parcels would allow for viable commercial businesses to thrive while taking advantage of the Town's proximity to the water. Matfituck Creek is the only portion of the County Rome 48 corridor that may be appropriate for such Pag~ 2 and 3 of tim Supplemental Final GEIS acknowledged that the southera end of Mattituck Creek conmlns environmental resources that are sensitive to developllle~L It ja im,m~mnt to note that the recommendation for a change of zone does not commit the Town to a cours© of a~tion that will result in adverse environmental impacts. Prior to the re-zoning of parcels consistent with the County Route 48 Corridor Land Use Study and the Master Plan Update, the recommendation to re-zone should undergo SEQR review to determine that smeficient developable land exists on the site for reasonable development with appropri~ mitigation measures. The ultimate development plan for the site should undergo additional SEQR t~,iew and must take into account site-specific characteristics Including, but not limited to, site size, configuration, drainage, surrounding land uae, noise, tt'affic and proximity to wetlands. This recummenanton in effect reduces the number of curb cuts on County Route 48 and Sound Avenue. · l~ere appropriate, comlder the me afJlag lots with common drives for residenthtl developmenL Similar to the recommendalion above, the use of common drives effectively reduces the number of curb cuta on County Route 48 and Sound Avenue. 9 ENVIRONMENTAL SETTING; POTENTIAL ADVERSE ENVIRONMENTAL IMPACTS AND MITIGATION MEASURES Thc Envixonmental Setting for the Land Use Study/GEIS is represented by the existing natural resources and human resources found within the County Route 48 corridor. The Land Use Study reviewed thc existing conditions in the corridor including existing zoning, existing land use, non-conforming lots, soils, habitats, economy, historical areas, and traffic conditions. Past land use plans, studies and Town actions were reviewed in order to identify cormnon goals for proper development in the Town. These goals were compared to the existing conditions in the corridor and a subsequent list of outstanding needs was developed, indicating those areas where the existing conditions were wholly or partially inconsistent with the goals. Thc discrepancies between land use goals and actual land uses are considered to be impacts. The recommendations provided in the Study are intended as mitigation measures to avoid or minimize any future discrepancies (impacts) between future land use and the land use goals. .Accordingly, implementation of the recommendations of the Study or similar land use techniques Is expected to result in significant beneficial environmental and social impacts. As the recommendations of the Study are directed at a more comprehensive, coordinated and sensitive approach to directing land use, the Study is not anticipated to result in any adverse anviromnental impacts. la addition to the analysis described above, a review of the S~udy was conducted in comparison with the Criteria for Determining Significance in Section 617.7 of the SEQRA regulations. These criteria include impacts to air quality; groundwater quality or quantity; smface water quality or quantity; traffic; noise levels; solid waste production; potential for ~rosion, flooding, leaching or drainage problems; impacts to vegetation, wildlife, significant habitzX areas; and threatened or endangered spe, cies; impacts to Critical Environmental Area~; historical or archaeological resources; architectural or aesthetic resources; existing community or neighborhood char~er; energy; and agriculture. This review found that adoption ofthe Plan did not exceed any of the thrceholds listed, Accordingly, on this analysis alone, the adoption of the Plan is not anticipated to result in any significant adverse impacts to any of the criteria resources examilled. Also examined was the potential for adverse growth-inducing actions and any potential cumulative impacts from two or more related actions, no one ofwhich would have a significant impact on the environment, but when congidared together result in a substantial adverse impact on the environment. The analysis of these types of impacts found that they would not be generated by tha adoption of the Study. Finally, the Study itself does not, in and of itself, result in any direct physical activity or direct modification of the environment and, therefore, h.~ no potential for significant adverse physical impact, regardless of the aforementioned analyses. In addition, the Study does not I0 commit the Town to any one course of action. Instead the Study presents, in the form of recommendations, mitigation measures or a range of mitigation measures that could be utilized in future land use decisions to minimize or avoid adverse impacts caused by past development patterns. In conclusion, the Town of Southold has not identified any significant adverse environmental impacts for this action. As no~exl above, the proposed action is expected to result in long4erm beneficial impacts on the Town of Southold including those actions which ~re environmentally-sensitive, socially-desirable and economically feasible. 1! ALTERNATIVE The Alternatives section of the DGEIS describes only one alternative, the No action Alternative, which is required by thc SEQRA regulations. No action herein is determined to mcan that land use and development would continue to occur under the present Town Code, zoning and regulations, i.e. thc status quo. (A No Action alternate entailing a No-Build and no physical activity scenario is unrealistic and unfeasible). No other alternative was discussed in this section because no other means of comprehenslvely addressing the identified land usc, transportation, environmental, cultural resource, hamlet and demographic issues has been determined. Under a No Action alternative, a more comprehensive, coordinaml approach to directing land use will not be implemented and the goals of the Town and its citizens will not be addressed in a cohesive wanner. If no action is taken, existing pwblcms and issues identified the existing problems in the corridor that nm contra~ to past land use plans and studies will not be rectified or addressed and will continue to represent significent m'cas of concern for all who livc and work in the Town of Southold. 12 ECONOMIC Analysis and consideration of economic factors and impacts are not mandated by SEQRA as they are not directly involved with the determination of environmental impact. Nevertheless, when issuing a Findings Statement for a decision, Part 617.1 l(d) of the SEQRA regulations requires that the lead agency weigh and balance relevant environmental impacts with economic, social and other considerations. The Land Use Study offers comprehensive planning recommendations whiCh promote land use that is within sound environmental constraints and parameters. There have not been any significant adverse economic impacts identified that would result from the approval of this Land Use Study. The Land Usc Study provides ample oppormui~¢s for existing business to expand and new businesses ~o locate m the Town. Furth~'more, the Plan promotes development ofla~d uses which result in making the Town an auractive place not just in which to work, but in which to live. The Land Use Study accomplishes this by providing ample areas for the growth of commercial, residemlal and a~ricuRural uses while maln~ainin8 ~ open space and rural character of the Town. Measures in~ended to maintain the existing open and rural character of thc Town by promoting balanced and coherent land usc, are anticipa~d to maintain or enhance the draw of tourists and cousumers from outside of the Town, thereby bolstering local businesses. In addison, Land Use S~udy recommendations will help to limit h~fi-astructure costs by promoting commercial uses in existing commercial enclaves, limiting curb cuts, and promoti~ pedestrian-friendly shopping. Addkion~l SEQR~ review will be performed for future specific actions which implement the recommendations of the Land Use Study and which may have ~n economic impact. 13 REVIEW AND IMPLEMENTATION OF FUTURE SPECIFIC AND SITE-SPECIFIC ACTIONS RELATED TO THE LAND USE STUDY S EQRA regulations 617.10(b) and (c)state that: "GEISs and their findings should set forth specific conditions or criteria under which future actions will be undertaken or approved, including requirements for any subsequent SEQR compliance. This may Include thresholdx and criteria for supplemental EISs to reflect specific significant impacts, such as site specific impacts, that were not adequately nrlrlressed or analyzed in the generic EIS. Impacts of individual actions proposed to be carried out in conformance with [the land Use Study] and the thresholds or conditions identified in the generic EIS [and findings statementJ may require no or limited SEQR review". In conformance with this portion of thc SEQR regulations, criteria and thresholds have been established to indicate when additional SEQR review is required for actions carried out in conformance with the recommendations of thc Land Use Study. These criteria and thresholds do not preclude the Town from reviewing proposed actions, but rather states when SEQR review is required. These criteria and thresholds arc as follows: Changing the zoning category of a parcel from any onc of the industrial or commercial zones in the Town of Southold to a single-family residential or Agricultural Conservation zone shall not requiro further SEQR review. Changing thc zoning category of a parcel from a higher density residential zone to a lower density residential zone or Agricultural Conservation zone shall not r~iuiro further SEQR review. Changing the zonlnE category of a parcel from one industrial zone to another industrial zone, or f~rom one commercial zone to another comlllercial zone, or from an industrial zone to commercial zone shall not requite further SEQR review if: a) the propo~t new zonin$ category for the subject parcel is consistent with the zoning of surrounding paroels, or b) the proposed change of zone does not permit higher intensity use of the subject parcel as compared to the existing zone in terms of lot coverage, building height, parking requirements, Ixaffic, impervious area, drainage, and aethacks, or c) the proposed change of zone does not tek¢ place in a designated historical area, a critical environmental area, areas of low depth to groundwater, or contain or ar~ adjacent to freshwater or tidal wetlands, or d) the proposed change of zone is incon~iatent with the County Route 48 Corridor Land Ua~ Study and past land use plans of the Town of Southold. 14 o o Changing the zoning category of a parcel to MI or MI1 will require detailed SEQR review duc, in part, to its inherent proximity to surface waters. SEQR review for such a change of zone shall consider impact~ to surface and ground waters, w~t[and~ arid telT~Sffial vegetation, visual character of the area, tra~c, surrotmdin~o la~d use, precedent-setting effect, as well as other areas deemed appropriate for review by th~ Town of Southold. Changes to the Code of the Town of Southold relaw~d to non-contiguous clustering shall require detailed SEQR review. This review must consider potential impacta to groundwater resources, sanitary flow, nearby public and private wells, trafftc, visual character, commuaity services, taxing jurisdictions particularly school diatricts, az wall az other aw~a d~med appropriate for review by the Town of Southold. Changes to the Code of the Town of Southold related to incentive zol~in~ shall require detailed SEQR review. Thia review must consider potential impacts to groundwater r¢-nourcea, sanitary flow, nearby public and private wells, noise, visual char'ac~, traffic, community services, taxing jurisdictions particularly ~hool districtz, as well as other areas deemed appropriate for review by the Town of $outhold. Changes to the Code of the Town of Southold related to expanding the D-tuber and types of uses I~=~itted in zonin~o categories aa-of-right shall required d~tailcd SEQR review. CERTIFICATION OF FINDINGS TO APPROVE: In accordance with Part 617.11 (d) of the New York State Environmental Quality Review Act regulations, thc Town Board of thc Town of Southold has considered thc Draft Generic and Final Gencric Environmental Impact Statements for the action known as the County Route 48 Comdor Land Use Study and has met the requirements of this Part. These Findings contain the facts and conclusions relied upon to support the Town Board's decision and indicate thc social, economic and other factors and standards which formcd the basis of its decision. Furthermore, the Town Board finds that consistent with social, economic and other essential considerations in the No Action Alternative, the Land Use Study avoids or minimizes adverse environmental impacts to the maximum extent practicable. The Study provides an assessment of existing conditions along the corridor and identifies lhose areas where the existing conditions are inconsistent with the goals of past land use plans. The Study then offers various recommendations as mitigation measures to bring the conditions of the County Route 48 corridor into conformance with the goals of the Town. Therefore, adverse environmental impacts will be avoided or minimized by the implementation of all or part of the recommendations (mitigation measures) of the Land Use Study, or the implementation of other land use policies that have the same effect as the Study recommendations. It is therefore recommended that the County Route 48 Comdor Land Use Study and its recommendations be adopted.
